Regulations Respecting Zoning at Muskoka Airport

Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 6 of the Aeronautics Act, is pleased hereby to approve the annexed Regulations respecting zoning at Muskoka Airport made by the Minister of Transport.

Short Title

 These Regulations may be cited as the Muskoka Airport Zoning Regulations.

Interpretation

  •  (1) In these Regulations,

    airport

    airport means the Muskoka Airport at Gravenhurst in the District of Muskoka, in the Province of Ontario; (aéroport)

    airport reference point

    airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

    approach surface

    approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)

    Minister

    Minister means the Minister of Transport; (ministre)

    outer surface

    outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)

    strip

    strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)

    transitional surface

    transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)

  • (2) For the purposes of these Regulations, the assigned elevation of the airport reference point is deemed to be 278 m above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule.

General

 No person shall erect or construct on any land to which these Regulations apply any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point

  • (a) any approach surface;

  • (b) the outer surface; or

  • (c) any transitional surface.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.

Disposal of Waste

 No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste edible by or attractive to birds.

SCHEDULE

PART I(Section 2)Description of Airport Reference Point

The airport reference point is a point marked by a tablet described as DHO Precise BM 278-67 and set horizontally in the north face of the concrete foundation, 1.37 m west of the northeast (front) corner and 24 cm below the siding, of a one storey (metal clad) equipment garage on the property of Muskoka Airways, east side of Highway 11, 6.0 km south of the junction of Highway 11 and the entrance street to the Town of Bracebridge, 2.9 km north of the junction of Highway 11 and Reays Road, 175.3 m south of Muskoka Airways Office and 11.9 m west of the gravel entrance drive.

PART II(Section 2)Description of the Approach Surfaces

The approach surfaces, shown on Muskoka Airport Zoning Plan No. 44-022-82-48, Sheets 2, 5, 6, 7, 8 and 9, dated August 24, 1983, are surfaces abutting each end of the strips associated with runways designated 09-27 and 18-36 and are described as follows:

  • (a) a surface abutting the end of the strip associated with runway approach 09 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 310 m from the projected centre line; the said imaginary horizontal line being 62.50 m measured vertically above the elevation at the end of the strip;

  • (b) a surface abutting the end of the strip associated with runway approach 18 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 375 m from the projected centre line; the said imaginary horizontal line being 60 m measured vertically above the elevation at the end of the strip;

  • (c) a surface abutting the end of the strip associated with runway approach 27 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 310 m from the projected centre line; the said imaginary horizontal line being 62.50 m measured vertically above the elevation at the end of the strip; and

  • (d) a surface abutting the end of the strip associated with runway approach 36 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 375 m from the projected centre line; the said imaginary horizontal line being 60 m measured vertically above the elevation at the end of the strip.

PART III(Section 2)Description of the Outer Surface

The outer surface, shown on Muskoka Airport Zoning Plan No. 44-002-82-48, Sheets 1 to 11 inclusive, dated August 24, 1983, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point, except where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground.

PART IV(Section 2)Description of the Strips

The strips, shown on Muskoka Airport Zoning Plan No. 44-002-82-48, Sheets 5 and 8, dated August 24, 1983, are described as follows:

  • (a) the strip associated with runway 09-27 being 120 m in width, 60 m being on each side of the centre line of the runway, and 655 m in length; and

  • (b) the strip associated with runway 18-36, being 150 m in width, 75 m being on each side of the centre line of the runway, and 1643 m in length.

PART V(Section 2)Description of Each Transitional Surface

Each transitional surface, shown on Muskoka Airport Zoning Plan No. 44-002-82-48, Sheets 2, 5, 6, 7, 8 and 9, dated August 24, 1983, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of each strip extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.

PART VI(Section 3)Description of the Lands to Which These Regulations Apply

The boundary of the lands to which these Regulations apply, shown on Muskoka Airport Zoning Plan No. 44-002-82-48, Sheets 1 to 11, dated August 24, 1983, are described as follows:

Commencing at the southeastern corner of Lot 1 in Concession 4 of the geographic Township of Muskoka, now in the Town of Gravenhurst;

THENCE westerly along the southern boundary of Lots 1, 2, 3, 4 and 5 in Concession 4 to the southwestern corner of the said Lot 5;

THENCE westerly across the allowance for road between Lots 5 and 6 in Concession 4 to the southeastern corner of the said Lot 6;

THENCE westerly along the southern boundary of Lots 6, 7 and 8 in Concession 4 to the southwestern corner of the said Lot 8;

THENCE northerly along the western boundary of Lot 8 in Concession 4 to the northwestern corner of the Lot;

THENCE northerly across the allowance for road between Concessions 4 and 5 to the southeastern corner of Lot 9 in Concession 5;

THENCE westerly along the southern boundary of Lots 9 and 10 in Concession 5 to the southwestern corner of the said Lot 10;

THENCE westerly across the allowance for road between Lots 10 and 11 in Concession 5 to the southeastern corner of the said Lot 11;

THENCE westerly along the southern boundary of Lot 11 in Concession 5 to the southwestern corner of the Lot;

THENCE northerly along the western boundary of Lot 11 in Concession 5 to the northwestern corner of the Lot;

THENCE westerly along the southern limit of Lots 11 and 12 in Concession 6 to the southwestern corner of the said Lot 12;

THENCE northerly along the western limit of Lot 12 in Concession 6 to the northwestern corner of the Lot;

THENCE northerly across the allowance for road between Concessions 6 and 7 to the southeastern corner of Lot 13 in Concession 7;

THENCE westerly along the southern limit of Lot 13 in Concession 7 to the southwestern corner of the Lot;

THENCE northerly along the western boundary of Lot 13 in Concessions 7 and 8 to the northwestern corner of Lot 13 in Concession 8;

THENCE northerly across the allowance for road between Concessions 8 and 9 to the southwestern corner of Lot 13 in Concession 9;

THENCE northerly along the western boundary of Lot 13 in Concession 9 to the northwestern corner of the Lot;

THENCE easterly along the northern boundary of Lot 13 in Concession 9 in the geographic Township of Muskoka (being also the boundary between the Town of Gravenhurst and the Town of Bracebridge) to the southwestern corner of Lot 12 in Concession 10;

THENCE northerly along the western boundary of Lot 12 in Concession 10 in the Town of Bracebridge to the northwestern corner of the said Lot 12;

THENCE westerly across the allowance for road between the former Townships of Draper and Muskoka on the production westerly of the southern boundary of Lot A in Concession 4 in the former Township of Draper to the eastern boundary of Lot 1 in Concession 3 in the former Township of Muskoka;

THENCE northerly along the eastern boundary of Lot 1 in Concession 3 in the former Township of Muskoka to the POINT OF COMMENCEMENT.
