Marginal note:Participation in mediation

• 94 (1) The parties shall participate in the mediation provided by the Board, unless, no later than 15 days after the party that did not refer the grievance to adjudication received a copy of the notice of the reference to adjudication, a party notifies the Executive Director in writing that it does not intend to participate.

• Marginal note:Request to mediate

  (2) Despite subsection (1), a party may, after notifying the Executive Director of its intention not to participate in mediation, and with the agreement of the other party, request mediation of the grievance.
