the same meaning as in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="448503" lims:id="448503" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448504" lims:id="448504"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448505" lims:id="448505">Definitions</MarginalNote><Label>3</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="448506" lims:id="448506"><Text><DefinedTermEn>collective agreement</DefinedTermEn> means the collective agreement entered into between an employer and the union that expired on January 31, 1991; (<DefinedTermFr>convention collective</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="448507" lims:id="448507"><Text><DefinedTermEn>employee</DefinedTermEn> means a person who is employed by an employer and is bound by the collective agreement; (<DefinedTermFr>employé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="448508" lims:id="448508"><Text><DefinedTermEn>employer</DefinedTermEn> means any employer named in the schedule; (<DefinedTermFr>employeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="448509" lims:id="448509"><Text><DefinedTermEn>mediator-arbitrator</DefinedTermEn> means the mediator-arbitrator appointed pursuant to subsection 8(1); (<DefinedTermFr>médiateur-arbitre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="448510" lims:id="448510"><Text><DefinedTermEn>union</DefinedTermEn> means the <Emphasis style="italic">Transportation — Communications International Union</Emphasis> and its Lodge 650. (<DefinedTermFr>syndicat</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="448511" lims:id="448511" level="1"><TitleText>Grain Handling Operations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448512" lims:id="448512"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448513" lims:id="448513">Resumption of grain handling operations</MarginalNote><Label><FootnoteRef idref="T-10.6_en_1">*</FootnoteRef>4</Label><Text>On the coming into force of this Act,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448514" lims:id="448514"><Label>(a)</Label><Text>each employer shall forthwith resume grain handling operations at Thunder Bay, Ontario; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448515" lims:id="448515"><Label>(b)</Label><Text>each employee shall, when so required, forthwith resume the lims:inforce-start-date="2002-12-31" lims:fid="448517" lims:id="448517">Obligations of employers</MarginalNote><Label><FootnoteRef idref="T-10.6_en_2">*</FootnoteRef>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448518" lims:id="448518"><Label>(1)</Label><Text>No employer or officer or representative of an employer shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448519" lims:id="448519"><Label>(a)</Label><Text>in any manner impede any employee from complying with paragraph 4(b); or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448520" lims:id="448520"><Label>(b)</Label><Text>discharge or in any other manner discipline, or authorize or direct the discharge or discipline of, any employee by reason of that employee’s having been on strike before the coming into force of this Act.</Text><Footnote id="T-10.6_en_2" placement="section" status="editorial" lims:fid="448521" lims:id="448521"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448522" lims:id="448522">Obligations of union</MarginalNote><Label><FootnoteRef idref="T-10.6_en_3">*</FootnoteRef>(2)</Label><Text>The union and each officer and representative of the union shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448523" lims:id="448523"><Label>(a)</Label><Text>forthwith on the coming into force of this Act, give notice to the employees that, by reason of that coming into force, grain handling operations are forthwith to be resumed at Thunder Bay, Ontario and the employees, when so required, are forthwith to resume the duties of their employment;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448524" lims:id="448524"><Label>(b)</Label><Text>take all reasonable steps to ensure that employees comply with paragraph 4(b); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448525" lims:id="448525"><Label>(c)</Label><Text>refrain from any conduct that may encourage employees not to comply with paragraph 4(b).</Text><Footnote section 14.]</Text></Footnote></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448526" lims:id="448526"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448527" lims:id="448527">Extension of collective agreement</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448528" lims:id="448528"><Label>(1)</Label><Text>The term of the collective agreement is extended to include the period beginning on February 1, 1991 and ending on a date to be fixed by the mediator-arbitrator, which date shall not be earlier than January 31, 1993 or later than January 31, 1994.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448529" lims:id="448529"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448530" lims:id="448530">Collective agreement binding for extended term</MarginalNote><Label>(2)</Label><Text>The collective agreement, as amended by or pursuant to this Act, is effective and binding on the parties thereto for the period for which the agreement is extended by subsection (1) notwithstanding anything in Part I of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> or in the agreement, and Part I of that Act applies in respect of the agreement, as so amended, as if that period were the term of the agreement.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448531" lims:id="448531"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448532" lims:id="448532">Strikes and lockouts prohibited</MarginalNote><Label>7</Label><Text>During the term of the collective agreement, as extended by subsection 6(1),</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448533" lims:id="448533"><Label>(a)</Label><Text>no employer shall declare or cause a lockout against the union;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448534" lims:id="448534"><Label>(b)</Label><Text>no officer or representative of the union shall declare or authorize a strike against an employer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448535" lims:id="448535"><Label>(c)</Label><Text>no employee shall participate in a strike against an employer.</Text></Paragraph></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="448536" lims:id="448536" level="1"><TitleText>Mediator-Arbitrator</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448537" lims:id="448537"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448538" lims:id="448538">Appointment of mediator-arbitrator</MarginalNote><Label><FootnoteRef idref="T-10.6_en_4">*</FootnoteRef>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448539" lims:id="448539"><Label>(1)</Label><Text>The Minister shall, after the coming into force of this Act, appoint a mediator-arbitrator and refer to the mediator-arbitrator all matters relating to the amendment or revision of the collective agreement that, at the time of the appointment, remain in dispute between the union and the employer.</Text><Footnote id="T-10.6_en_4" placement="section" status="editorial" xml:space="default"><Label>*</Label><Text>[Note: Act in force on the day immediately after the day on which this Act is assented to (assent date being October 11, 1991), but not before the twelfth hour after the time at which this Act is assented to, <Emphasis style="italic">see</Emphasis> section 14.]</Text></Footnote></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448540" lims:id="448540"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448541" lims:id="448541">Duties</MarginalNote><Label>(2)</Label><Text>The mediator-arbitrator shall, within ninety days after the mediator-arbitrator’s appointment or such longer period as the Minister may allow,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448542" lims:id="448542"><Label>(a)</Label><Text>endeavour to mediate all the matters referred to in subsection (1) and to bring about agreement between the union and the employer on those matters;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448543" lims:id="448543"><Label>(b)</Label><Text>if the mediator-arbitrator is unable to bring about agreement in respect of any such matter, hear the union and the employer on the matter, arbitrate the matter and render a decision in respect thereof; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448544" lims:id="448544"><Label>(c)</Label><Text>report to the Minister on the resolution of all such matters.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448545" lims:id="448545"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448546" lims:id="448546">Powers</MarginalNote><Label>(3)</Label><Text>The mediator-arbitrator has, with such modifications as the circumstances require,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448547" lims:id="448547"><Label>(a)</Label><Text>for the purposes of the mediation referred to in paragraph (2)(a), all the powers of a conciliation commissioner under section 84 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448548" lims:id="448548"><Label>(b)</Label><Text>for the purposes of the arbitration referred to in paragraph (2)(b), all the powers and duties of an arbitrator under sections 60 and 61 of that Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448549" lims:id="448549"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448550" lims:id="448550">Form of decision</MarginalNote><Label>(4)</Label><Text>The decision of the mediator-arbitrator in respect of any matter arbitrated by the mediator-arbitrator shall be set out in such form as will enable the decision to be incorporated into the collective agreement in accordance with section 9.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448551" lims:id="448551"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448552" lims:id="448552">Incorporation in collective agreement</MarginalNote><Label>9</Label><Text>When the mediator-arbitrator reports to the Minister pursuant to subsection 8(2), the collective agreement shall be deemed to be amended by the incorporation therein of any amendments agreed to by the union and the employer pursuant to the mediation and any decision of the mediator-arbitrator in respect of a matter arbitrated by the mediator-arbitrator, and the agreement, as so amended, constitutes a new collective agreement that shall be deemed to have effect on and after February 1, 1991.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="448553" lims:id="448553" level="1"><TitleText>Amendment of Collective Agreement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448554" lims:id="448554"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448555" lims:id="448555">Parties may amend collective agreement</MarginalNote><Label>10</Label><Text>Nothing in this Act shall be construed so as to limit or restrict the rights of the parties to the collective agreement to agree to amend any provision of the agreement as amended by or pursuant to this Act, other than a provision relating to the term of the agreement, and to give effect thereto.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="448556" lims:id="448556" level="1"><TitleText>Enforcement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448557" lims:id="448557"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448558" lims:id="448558">Offence by individuals</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448559" lims:id="448559"><Label>(1)</Label><Text>An individual who contravenes any provision of this Act is guilty of an offence punishable on summary conviction and is liable, for each day or part of a day during which the offence continues, to a fine</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448560" lims:id="448560"><Label>(a)</Label><Text>of not more than $50,000, where the individual was acting in the capacity of an officer or representative of an employer or the union when the offence was committed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="448561" lims:id="448561"><Label>(b)</Label><Text>of not more than $1,000, in any other case.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="448562" lims:id="448562"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448563" lims:id="448563">Offence by employer or union</MarginalNote><Label>(2)</Label><Text>Where an employer or the union contravenes any provision of this Act, it is guilty of an offence punishable on summary conviction and is liable, for each day or part of a day during which the offence continues, to a fine of not more than $100,000.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448564" lims:id="448564"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448565" lims:id="448565">Presumption</MarginalNote><Label>12</Label><Text>For the purposes of enforcement proceedings under this Act, the employer and the union are deemed to be persons.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448566" lims:id="448566"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448567" lims:id="448567">Construction</MarginalNote><Label>13</Label><Text>For greater certainty, nothing in this Act shall be construed so as to restrict a person from raising a defence of due diligence in a prosecution for an offence under this Act.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="448568" lims:id="448568" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="448569" lims:id="448569"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="448570" lims:id="448570">Coming into force</MarginalNote><Label><FootnoteRef idref="T-10.6_en_5">*</FootnoteRef>14</Label><Text>This Act shall come into force on the day immediately after the day on which this Act is assented to, but not before the twelfth hour after the time
