idref="footnote1_e">*</FootnoteRef>, the Minister of the Environment published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> Part I on March 16, 1991, a copy of the proposed <XRefExternal reference-type="regulation">Regulations respecting the import and export of contaminated fuel</XRefExternal> and amending the List of Toxic Substances in Schedule I to the <XRefExternal reference-type="act">Canadian Environmental Protection Act</XRefExternal>, substantially in the form annexed hereto;</Text><Footnote id="footnote1_e" placement="page" status="official"><Label>*</Label><Text>R.S., c. 16 (4th Supp.)</Text></Footnote></Provision><Provision lims:inforce-start-date="2018-02-02" lims:fid="937038" lims:id="937038" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas more than 60 days have elapsed from the date of publication and no notices of objection to the proposed Regulations were filed with the Minister of the Environment pursuant to subsection 48(2) of the <XRefExternal reference-type="act">Canadian Environmental Protection Act</XRefExternal><FootnoteRef>*</FootnoteRef>;</Text></Provision><Provision lims:inforce-start-date="2018-02-02" lims:fid="937039" lims:id="937039" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And Whereas, in the opinion of the Governor in Council, pursuant to subsection 34(3) of the <XRefExternal reference-type="act">Canadian Environmental Protection Act</XRefExternal>, the regulations do not regulate any aspect of any substance that is regulated by or under any other Act of Parliament;</Text></Provision><Provision lims:inforce-start-date="2018-02-02" lims:fid="937040" lims:id="937040" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Therefore, His Excellency the Governor General in Council, pursuant to section 34<FootnoteRef idref="footnote2_e">**</FootnoteRef> of the <XRefExternal reference-type="act">Canadian Environmental Protection Act</XRefExternal><FootnoteRef>*</FootnoteRef>, on the recommendation of the Minister of the Environment and the Minister of National Health and Welfare and after the federal-provincial advisory committee has been given an opportunity to provide its advice under section 6 of that Act, is pleased hereby to make the annexed <XRefExternal reference-type="regulation">Regulations respecting the import and export of contaminated fuel</XRefExternal> and amending the List of Toxic Substances in Schedule I to the <XRefExternal lims:id="937044"><Label>2</Label><Text>In these Regulations, <DefinedTermEn>contaminated fuel</DefinedTermEn> means any fuel described in item 13 of the List of Toxic Substances in Schedule 1 to the <XRefExternal reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal>.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" level="1"><TitleText>Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2019-04-08" lims:enacted-date="2019-04-08" lims:lastAmendedDate="2019-04-08" lims:fid="937048" lims:id="1122464"><Label>3</Label><Subsection lims:inforce-start-date="2019-04-08" lims:enacted-date="2019-04-08" lims:fid="1122465" lims:id="1122465"><Label>(1)</Label><Text>Subject to subsections 4(1) and (2.1) and section 5, it is prohibited for any person to import contaminated fuel.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-08" lims:enacted-date="2019-04-08" lims:fid="1122466" lims:id="1122466"><Label>(2)</Label><Text>Subject to subsections 4(2) and (2.1), it is prohibited for any person to export contaminated lims:inforce-start-date="2018-02-02" lims:lastAmendedDate="2019-04-08" lims:fid="937052" lims:id="937052"><Label>4</Label><Subsection lims:inforce-start-date="2018-02-02" lims:fid="937053" lims:id="937053"><Label>(1)</Label><Text>A person may import into Canada contaminated fuel for destruction, disposal or recycling in accordance with applicable federal or provincial law regarding the destruction, disposal or recycling of hazardous wastes.</Text></Subsection><Subsection lims:inforce-start-date="2018-02-02" lims:fid="937054" lims:id="937054"><Label>(2)</Label><Text>A person may export contaminated fuel to a country if the appropriate authority in that country authorizes or permits the importation.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-08" lims:enacted-date="2019-04-08" lims:fid="1122470" lims:id="1122470"><Label>(2.1)</Label><Text>A person does not contravene section 3 if the contaminated fuel is in transit through Canada, from a place outside Canada to another place outside Canada, and there is written evidence establishing that the fuel is in transit.</Text></Subsection><Subsection lims:inforce-start-date="2018-02-02" lims:fid="937055" lims:id="937055"><Label>(3)</Label><Text>For the purposes of subsection (2), <DefinedTermEn>appropriate authority</DefinedTermEn> means the authority, body or person, of a country that is competent under the laws of that country to authorize the import of contaminated fuel into that country.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="937058" level="1"><TitleText>Maintenance of Records</TitleText></Heading><Section lims:inforce-start-date="2018-02-02" lims:lastAmendedDate="2018-02-02" lims:fid="937059" lims:id="937059"><Label>5</Label><Subsection lims:inforce-start-date="2018-02-02" lims:fid="937060" lims:id="937060"><Label>(1)</Label><Text>A person who imports contaminated fuel into Canada shall maintain, for each shipment of contaminated fuel imported, records that contain the following information:</Text><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937061" lims:id="937061"><Label>(a)</Label><Text>the type of contaminated fuel imported;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937062" lims:id="937062"><Label>(b)</Label><Text>the quantity of each type of contaminated fuel imported;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937063" lims:id="937063"><Label>(c)</Label><Text>the date on which the contaminated fuel was imported;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937064" lims:id="937064"><Label>(d)</Label><Text>the port of entry through which the contaminated fuel passed;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937065" lims:id="937065"><Label>(e)</Label><Text>the commodity code for each type of contaminated fuel imported;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937066" lims:id="937066"><Label>(f)</Label><Text>the importer number for the shipment of contaminated fuel;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937067" lims:id="937067"><Label>(g)</Label><Text>the name of the manufacturer of the contaminated fuel, if known;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937068" lims:id="937068"><Label>(h)</Label><Text>the name of the supplier of the contaminated fuel, if different from that of the manufacturer;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937069" lims:id="937069"><Label>(i)</Label><Text>locations to which the contaminated fuel is to be delivered;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937070" lims:id="937070"><Label>(j)</Label><Text>the name and address of all purchasers of the contaminated fuel;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937071" lims:id="937071"><Label>(k)</Label><Text>the class and name of each dangerous good that contaminates the fuel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="937072" lims:id="937072"><Label>(l)</Label><Text>the purpose for which the contaminated fuel was imported.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-02-02" lims:fid="937073" lims:id="937073"><Label>(2)</Label><Text>A person who exports contaminated fuel out of Canada shall maintain, for each shipment of contaminated fuel exported, a document that provides proof that the importation into the country of destination is authorized or permitted by that country in accordance with subsection 4(2).</Text></Subsection><Subsection lims:inforce-start-date="2018-02-02" lims:fid="937074" lims:id="937074"><Label>(3)</Label><Text>Any record referred to in subsection (1) and any document referred to in subsection (2) shall be kept by the importer or exporter, as the case may be, for a period of five years after the day on which the record or document, as the case may be, is Documents</TitleText></Heading><Section lims:inforce-start-date="2018-02-02" lims:lastAmendedDate="2018-02-02" lims:fid="937078" lims:id="937078"><Label>6</Label><Text>An importer or exporter of
