(<DefinedTermFr>cendres</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880710" lims:id="880710" generate-in-text="no"><Text><DefinedTermEn>available</DefinedTermEn>, in respect of a grave, means that a certificate has not been issued with respect to that grave; (<DefinedTermFr>certificat</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880716" lims:id="880716" generate-in-text="no"><Text><DefinedTermEn>Field Cemetery</DefinedTermEn> means that part of Yoho National Park so designated and shown on a plan of survey of record in the Canada Lands Surveys Records of the Department of Energy, Mines and Resources, Ottawa, as number 20590; (<DefinedTermFr>cimetière de Field</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880717" lims:id="880717" generate-in-text="no"><Text><DefinedTermEn>grave</DefinedTermEn> means an excavation in a cemetery plot for the burial of human remains or ashes; (<DefinedTermFr>tombe</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880718" lims:id="880718" generate-in-text="no"><Text><DefinedTermEn>holder of a certificate</DefinedTermEn> means a person to whom a certificate is issued and, where that person is deceased, means the estate of that person; (<DefinedTermFr>titulaire d’un certificat</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880719" lims:id="880719" generate-in-text="no"><Text><DefinedTermEn>immediate next of kin</DefinedTermEn><Repealed>[Revoked, SOR/90-32, s. 1(E)]</Repealed></Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880720" lims:id="880720" generate-in-text="no"><Text><DefinedTermEn>indigent</DefinedTermEn> means a person who</Text><Paragraph lims:inforce-start-date="2010-02-02" lims:fid="880721" lims:id="880721"><Label>(a)</Label><Text>before his death was a permanent resident of one or more parks for a period of at least 25 years in the aggregate and at some time lived in the park where the burial is to take place, or</Text></Paragraph><Paragraph lims:inforce-start-date="2010-02-02" lims:fid="880722" lims:id="880722"><Label>(b)</Label><Text>at the time of his death was a permanent resident of the park where the burial is to take place and whose financial means are not sufficient to cover the fees for burial; (<DefinedTermFr>personne indigente</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880723" lims:id="880723" generate-in-text="no"><Text><DefinedTermEn>Jasper Park Cemetery</DefinedTermEn><Repealed>[Repealed, SOR/2010-23, s. 7]</Repealed></Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880724" lims:id="880724" generate-in-text="no"><Text><DefinedTermEn>marker</DefinedTermEn> means a memorial of metal, stone or other similar material placed at the level of the surrounding ground at the foot of a grave; (<DefinedTermFr>dalle tombale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880725" lims:id="880725" generate-in-text="no"><Text><DefinedTermEn>monument</DefinedTermEn> means a memorial of stone, marble or other similar material placed above the level of the surrounding ground at the head of a grave or plot; (<DefinedTermFr>monument</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880726" lims:id="880726" generate-in-text="no"><Text><DefinedTermEn>Mountain View Cemetery</DefinedTermEn><Repealed>[Revoked, SOR/90-235]</Repealed></Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880727" lims:id="880727" generate-in-text="no"><Text><DefinedTermEn>next of kin</DefinedTermEn> means the spouse and children of a deceased person; (<DefinedTermFr>plus proche parent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880728" lims:id="880728" generate-in-text="no"><Text><DefinedTermEn>park</DefinedTermEn><Repealed>[Repealed, SOR/96-477, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880729" lims:id="880729" generate-in-text="no"><Text><DefinedTermEn>perpetual care</DefinedTermEn> means the preservation, improvement, embellishment and maintenance in perpetuity of a grave in a cemetery; (<DefinedTermFr>entretien permanent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880730" lims:id="880730" generate-in-text="no"><Text><DefinedTermEn>plot</DefinedTermEn> means a numbered lot shown on the plan of survey of a cemetery, containing one or more graves; (<DefinedTermFr>terrain</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880731" lims:id="880731" generate-in-text="no"><Text><DefinedTermEn>Superintendent</DefinedTermEn><Repealed>[Revoked, SOR/90-32, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880732" lims:id="880732" generate-in-text="no"><Text><DefinedTermEn>tablet</DefinedTermEn> means a memorial of metal, stone or other similar material placed at the level of the surrounding ground at the head of a grave; (<DefinedTermFr>plaque</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880733" lims:id="880733" generate-in-text="no"><Text><DefinedTermEn>Waterton Cemetery</DefinedTermEn> means that part of Waterton Lakes National Park so designated and shown on a plan of survey of record in the Canada Lands Surveys Records of the Department of Energy, Mines and Resources, Ottawa, as number 42297. (<DefinedTermFr>cimetière de Waterton</DefinedTermFr>) </Text></Definition><Definition lims:inforce-start-date="2010-02-02" lims:fid="880734" lims:id="880734" generate-in-text="no"><Text><DefinedTermEn>Waterton Park Cemetery</DefinedTermEn><Repealed>[Revoked, SOR/90-32, s. 1]</Repealed></Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-02-02" lims:fid="880736" lims:id="880736">SOR/90-32, s. 1; SOR/90-235; SOR/96-477, s. 1; SOR/2010-23, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="880737" lims:id="880737" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2010-02-02" lims:lastAmendedDate="2010-02-02" lims:fid="880738" lims:id="880738"><Label>3</Label><Text>These Regulations apply to Field Cemetery and Waterton Cemetery.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-02-02" lims:fid="880740" lims:id="880740">SOR/90-32, s. 2; SOR/90-235; SOR/2010-23, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="880741" lims:id="880741" level="1"><TitleText>Reserved Areas</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880742" lims:id="880742"><Label>4</Label><Text>The superintendent may divide a cemetery into areas and may reserve</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880743" lims:id="880743"><Label>(a)</Label><Text>an area for the burial of the remains of persons not more than one year of age;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880744" lims:id="880744"><Label>(b)</Label><Text>an area for the burial of ashes; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880745" lims:id="880745"><Label>(c)</Label><Text>an area for the burial of the remains of persons who at anytime served with or were attached to the naval, army or air forces of Her Majesty or a power allied or associated with Her Majesty.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:id="880748" level="1"><TitleText>Cemetery Records</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880749" lims:id="880749"><Label>5</Label><Text>The superintendent shall maintain a register for a cemetery in which shall be entered,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880750" lims:id="880750"><Label>(a)</Label><Text>in respect of each grave in the cemetery for which a certificate has been issued, the name and address of the person to whom the certificate was issued, the date of issue of the certificate and the amount paid therefor, the number of the certificate and such other particulars as the superintendent considers necessary; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880751" lims:id="880751"><Label>(b)</Label><Text>in respect of each person whose remains or ashes are buried in a grave in the cemetery,</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880752" lims:id="880752"><Label>(i)</Label><Text>his name, address prior to death, nationality, religion, age and sex,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880753" lims:id="880753"><Label>(ii)</Label><Text>the name and address of the next of kin of the person or the nearest relative of the person,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880754" lims:id="880754"><Label>(iii)</Label><Text>the date and cause of death,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880755" lims:id="880755"><Label>(iv)</Label><Text>the name of the attending physician,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880756" lims:id="880756"><Label>(v)</Label><Text>the date of burial, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880757" lims:id="880757"><Label>(vi)</Label><Text>such other particulars as the superintendent considers 2(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="880760" lims:id="880760" level="1"><TitleText>Use of Plot</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880761" lims:id="880761"><Label>6</Label><Text>No person shall use a plot or grave for any purpose other than for the burial of human remains or ashes.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="880762" lims:id="880762" level="1"><TitleText>Certificates</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880763" lims:id="880763"><Label>7</Label><Text>An application for a certificate shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880764" lims:id="880764"><Label>(a)</Label><Text>in Form A set out in Schedule II; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880765" lims:id="880765"><Label>(b)</Label><Text>accompanied by the applicable fee.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="880767" lims:id="880767">SOR/96-477, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880768" lims:id="880768"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880769" lims:id="880769"><Label>(1)</Label><Text>Where the superintendent receives an application that complies with the requirements of section 7 for a certificate for a grave and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880770" lims:id="880770"><Label>(a)</Label><Text>the applicant is applying for the certificate in respect of the burial of the remains or ashes of a person who</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880771" lims:id="880771"><Label>(i)</Label><Text>before his death was a permanent resident of one or more parks for a period of at least 25 years in the aggregate and at sometime lived in the park where the burial is to take place, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880772" lims:id="880772"><Label>(ii)</Label><Text>at the time of his death was a permanent resident of the park where the burial is to take place,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880773" lims:id="880773"><Label>(b)</Label><Text>the applicant is applying for a certificate in respect of the burial of the remains or ashes of a person who is a next of kin of a person for whose remains or ashes a certificate has been issued under paragraph (a), and the person in respect of whose burial the application is made</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880774" lims:id="880774"><Label>(i)</Label><Text>lived in one or more parks for a period of at least 25 years in the aggregate, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="880775" lims:id="880775"><Label>(ii)</Label><Text>was, at the time of the death of the person described in paragraph (a), a permanent resident of the park where the burial is to take place,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880776" lims:id="880776"><Label>(c)</Label><Text><Repealed>[Revoked, SOR/90-32, s. 4]</Repealed></Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="880777" lims:id="880777"><Text>the superintendent shall, if there are any available graves in the cemetery, select such a grave and issue a certificate to the applicant in respect of that grave in Form B set out in Schedule II.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880778" lims:id="880778"><Label>(2)</Label><Text>A certificate issued pursuant to subsection (1) is valid for 10 years and may be renewed once by the certificate holder at no additional charge for an additional period of 10 years.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="880780" lims:fid="880781" lims:id="880781"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880782" lims:id="880782"><Label>(1)</Label><Text>Where a certificate is issued on or after the date of the coming into force of these Regulations and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880783" lims:id="880783"><Label>(a)</Label><Text>in the case of a certificate that has not been renewed, no burial takes place in the grave before the expiration of a period of 10 years from the date of issue of the certificate, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880784" lims:id="880784"><Label>(b)</Label><Text>in the case of a certificate that has been renewed in accordance with subsection 8(2), no burial takes place in the grave and a new application is not received before the expiration of the renewal period,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="880785" lims:id="880785"><Text>the certificate becomes void on the day following the expiration of the initial period of 10 years or the renewal period, as the case may be, and the interest in that grave of any person named in the certificate is thereby terminated without compensation.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880786" lims:id="880786"><Label>(2)</Label><Text>Where a certificate was issued before the date of the coming into force of these Regulations and no burial takes place in the grave before the expiration of a period of 49 years from the date of issue of the certificate, the certificate becomes void on the day following the expiration of that period and the interest of any person in that grave is thereby terminated without compensation.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880787" lims:id="880787"><Label>(3)</Label><Text>The holder of a certificate issued pursuant to subsection 8(1) that has expired and may no longer be renewed may reacquire an interest in the grave for which the certificate was issued by submitting a new application therefor in accordance with section 7.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="880788" lims:id="880788" level="1"><TitleText>Disposition of Plots and Graves</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880789" lims:id="880789"><Label>10</Label><Text>No person, other than the superintendent, shall exchange, assign or subdivide any plot or grave.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="880791" lims:id="880791">SOR/90-32, s. 5; SOR/92-675, s. 2(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="880792" lims:id="880792" level="1"><TitleText>Burials</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880793" lims:id="880793"><Label>11</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880794" lims:id="880794"><Label>(1)</Label><Text>No person shall bury or cause to be buried any human remains or ashes in a grave unless</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880795" lims:id="880795"><Label>(a)</Label><Text>he complies with the laws of the province in which the cemetery is located respecting cremation and the burial of human remains or ashes;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880796" lims:id="880796"><Label>(b)</Label><Text>he applies to the superintendent for authorization to bury the human remains or ashes; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880797" lims:id="880797"><Label>(c)</Label><Text>the superintendent has authorized in writing the burial of the human remains or ashes and the opening of a grave therefor.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:id="880820"><Label>16</Label><Text>No person shall bury in one grave more than one person’s remains or ashes, except where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880821" lims:id="880821"><Label>(a)</Label><Text>the remains of a mother and her child one week old or less are buried at the same time;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880822" lims:id="880822"><Label>(b)</Label><Text>the ashes of not more than three persons are buried; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880823" hedges, flowers, grass or other vegetation or construct, erect or place any foundation, fence, railing, curbing, monument, vault, mausoleum, tablet or other structure or do any other construction or any alteration work</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880835" lims:id="880835"><Label>(a)</Label><Text>without written authorization from the superintendent to do so;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880836" lims:id="880836"><Label>(b)</Label><Text>on a Sunday or other holiday;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880837" lims:id="880837"><Label>(c)</Label><Text>between the hours of eight o’clock in the evening and eight o’clock in the morning; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880838" lims:id="880838"><Label>(d)</Label><Text>within 30 m of any grave in which a burial is taking place.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880839" lims:id="880839"><Label>(2)</Label><Text>Paragraph (1)(a) does not apply to any person who, with the permission of the superintendent, does work in a cemetery that is necessary for the routine operation, maintenance, administration or use of the lims:inforce-start-date="2010-02-02" lims:lastAmendedDate="2010-02-02" lims:fid="880843" lims:id="880843"><Label>20</Label><Subsection lims:inforce-start-date="2010-02-02" lims:fid="880844" lims:id="880844"><Label>(1)</Label><Text>Where the superintendent receives an application from the holder of a certificate for authorization to construct, erect or place a foundation, monument or tablet on the grave to which the certificate relates and the superintendent is satisfied that, based on the plans and specifications submitted to him with the application, the proposed foundation, monument or tablet complies with the requirements of section 22, he shall give written authorization to the holder of the certificate to do so.</Text></Subsection><Subsection lims:inforce-start-date="2010-02-02" lims:fid="880845" lims:id="880845"><Label>(2)</Label><Text>Where the planting of vegetation or the construction, erection or placing of a structure or any other construction or any alteration work is necessary for the operation, maintenance, administration or use of a cemetery, the superintendent may give written authorization to any person to do application referred to in subsection 20(1) shall be accompanied by</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880850" lims:id="880850"><Label>(a)</Label><Text>detailed plans and specifications; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880851" lims:id="880851"><Label>(b)</Label><Text>a plan of the grave showing the location of the proposed foundation, monument or tablet.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="880852" lims:id="880852" level="1"><TitleText>Foundations, Monuments and Tablets</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880853" lims:id="880853"><Label>22</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880854" lims:id="880854"><Label>(1)</Label><Text>A monument or tablet authorized to be constructed, erected or placed pursuant to subsection 20(1) shall be confined within the limits of the grave in respect of which it is constructed, erected or placed and shall, where possible, be aligned with other monuments or tablets on adjoining graves.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880855" lims:id="880855"><Label>(2)</Label><Text>A monument or tablet shall be placed on a concrete foundation not less than 10 cm thick and not less than 10 cm wider or 10 cm longer than the base of the monument or tablet it supports.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880856" lims:id="880856"><Label>(3)</Label><Text>The foundation of a tablet shall be so placed that the top of the tablet is level with the surrounding ground.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880857" lims:id="880857"><Label>(4)</Label><Text>The area of a tablet shall not exceed</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880858" lims:id="880858"><Label>(a)</Label><Text>in respect of a grave in which human remains are buried, .20 m<Sup>2</Sup>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="880859" lims:id="880859"><Label>(b)</Label><Text>in respect of a grave in which ashes are buried, .10 m<Sup>2</Sup>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880860" lims:id="880860"><Label>(5)</Label><Text>A monument shall not exceed 1 m in height above the level of the surrounding ground and shall be of such other dimensions and design as not to be, in the opinion of the superintendent, offensive to the majority of people visiting the cemetery.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880861" lims:id="880861"><Label>(6)</Label><Text>No person shall place an inscription on any marker, monument or tablet without the written approval of the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880862" lims:id="880862"><Label>(7)</Label><Text>The superintendent shall not give his written approval for an inscription referred to in subsection (6) if, in his opinion, the inscription would be offensive to the majority of the people visiting the 2(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="880865" lims:id="880865"><Label>23</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880866" lims:id="880866"><Label>(1)</Label><Text>Where any person constructs, erects or places any monument or tablet in a cemetery in a manner that fails to comply with section 19, 20 or 22, the superintendent may order the person, by notice in writing mailed to him at his last known address, to remove the monument or tablet.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880867" lims:id="880867"><Label>(2)</Label><Text>Where the monument or tablet referred to in subsection (1) has not been removed within 30 days from the date of receipt of the notice referred to in that subsection, the superintendent may remove it.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880868" lims:id="880868"><Label>(3)</Label><Text>Where the whereabouts of the person referred to in subsection (1) is unknown, the superintendent may, after taking reasonable steps to notify the person, remove the monument or tablet referred to in that subsection.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:lastAmendedDate="2006-03-22" lims:fid="880872" lims:id="880872"><Label>24</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880873" lims:id="880873"><Label>(1)</Label><Text>No person shall exhume human remains or ashes from a cemetery without the written authorization of the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880874" lims:id="880874"><Label>(2)</Label><Text>An application for the exhumation of human remains or ashes from a cemetery shall be made in writing to the superintendent and shall be accompanied by the applicable fee and any authorization for exhumation that is required by the laws of the province in which the cemetery is located.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880875" lims:id="880875"><Label>(3)</Label><Text>Where the superintendent receives an application that complies with the requirements of subsection (2) for the exhumation of human remains or ashes from a grave, he shall give written authorization to the applicant for that exhumation.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem is in a state of disrepair or is no longer suitable for the purpose for which it is intended to be used.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="880884" lims:id="880884"><Label>(2)</Label><Text>The superintendent may remove from a cemetery any article referred to in subsection (1) and, if he does so, shall notify the holder of the certificate of the grave in respect of which the article was placed in the cemetery.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem
