(<DefinedTermFr>faune exotique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="870996" lims:id="870996" generate-in-text="no"><Text><DefinedTermEn>firearm</DefinedTermEn> means any weapon from which any shot, bullet or other missile can be discharged and that is capable of causing injury or death to wildlife and includes anything that can be adapted for use as a firearm and anything that is designed for or capable of being used for the purpose of causing injury or death to wildlife; (<DefinedTermFr>arme à feu</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="870997" lims:id="870997" generate-in-text="no"><Text><DefinedTermEn>guide</DefinedTermEn> means a person who holds a valid licence issued pursuant to the <XRefExternal reference-type="regulation">National Parks Businesses Regulations</XRefExternal><FootnoteRef idref="fn1_e">*</FootnoteRef> to carry on the business of a guide; (<DefinedTermFr>guide</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="870998" lims:id="870998" generate-in-text="no"><Text><DefinedTermEn>hunt</DefinedTermEn> means to trap, chase, pursue, worry, follow after or on the trail of, search for, shoot at, stalk, lie in wait for, or to attempt, in any manner, to capture, kill or injure any wildlife whether or not the wildlife is captured, killed or injured; (<DefinedTermFr>chasser</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="870999" lims:id="870999" generate-in-text="no"><Text><DefinedTermEn>hunting permit</DefinedTermEn><Repealed>[Repealed, SOR/91-421, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="871000" lims:id="871000" generate-in-text="no"><Text><DefinedTermEn>loaded</DefinedTermEn> with respect to a firearm, means that a live shell or cartridge is present in the breach, chamber or attached magazine of the firearm or that a projectile is present in the barrel of the firearm; (<DefinedTermFr>chargée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="871001" lims:id="871001" generate-in-text="no"><Text><DefinedTermEn>park</DefinedTermEn><Repealed>[Repealed, SOR/91-421, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="871002" lims:id="871002" generate-in-text="no"><Text><DefinedTermEn>possession</DefinedTermEn> means possession within the meaning of subsection 4(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>; (<DefinedTermFr>piège</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="871017" lims:id="871017" generate-in-text="no"><Text><DefinedTermEn>vehicle</DefinedTermEn> means every device in, on or by which any person or property is or may be transported or drawn on land; (<DefinedTermFr>véhicule</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="871018" lims:id="871018" generate-in-text="no"><Text><DefinedTermEn>vessel</DefinedTermEn> includes any boat, canoe, raft, amphibious vehicle or any other structure, other than a sea plane, used or capable of being used for transportation on water; (<DefinedTermFr>bateau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2009-12-03" lims:fid="871019" lims:id="871019" generate-in-text="no"><Text><DefinedTermEn>wildlife</DefinedTermEn> means all wild mammals, amphibians, reptiles, birds, fish, insects and other invertebrates and any part thereof, and includes their eggs and young; (<DefinedTermFr>faune ou animaux sauvages</DefinedTermFr>) </Text></Definition><Footnote id="fn1_e" placement="section" status="editorial"><Label>*</Label><Text>[<Emphasis style="bold">Note:</Emphasis> The <XRefExternal reference-level="federal" reference-type="regulation">National Parks Businesses Regulations</XRefExternal>, referred to in the definition of “guide”, have been replaced by the <XRefExternal reference-level="federal" reference-type="regulation">National Parks Businesses Regulations, 1998</XRefExternal> (SOR/98-455). SOR/88-40, s. 1; SOR/91-421, s. 1; SOR/92-441, s. 1, 4(E); SOR/97-102, s. 1; SOR/2009-322, s. 16</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="871022" lims:id="871022" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="871023" lims:id="871023"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871024" lims:id="871024"><Label>(1)</Label><Text>Subject to sections 40 and 41 of the <XRefExternal reference-type="act" link="N-14.01">Canada National Parks Act</XRefExternal>, these Regulations apply to all parks other than Wood Buffalo National Park of Canada and to all park reserves as if they were parks.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871025" lims:id="871025"><Label>(1.1)</Label><Text>In the event of an inconsistency between these Regulations and the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1120">National Parks of Canada Fishing Regulations</XRefExternal> or the <XRefExternal reference-type="regulation" link="SOR-2004-301">Mingan Archipelago National Park Reserve of Canada Snowshoe Hare Regulations</XRefExternal>, the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1120">National Parks of Canada Fishing Regulations</XRefExternal> and the <XRefExternal reference-type="regulation" link="SOR-2004-301">Mingan Archipelago National Park Reserve of Canada Snowshoe Hare Regulations</XRefExternal> prevail, respectively, to the extent of the inconsistency.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871026" lims:id="871026"><Label>(2)</Label><Text>These Regulations do not apply to a superintendent, park warden, peace officer or any other person authorized by the superintendent to carry out functions related to the management of a park while any of those persons is engaged in carrying out such functions.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871027" lims:id="871027"><Label>(3)</Label><Text><Repealed>[Repealed, SOR/2004-301, s. 21]</Repealed></Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="871029" lims:id="871029">SOR/88-40, s. 2; SOR/92-441, s. 4(E); SOR/97-102, s. 2; SOR/2004-301, s. 21</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="871030" lims:id="871030" level="1"><TitleText>General Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2009-12-03" lims:lastAmendedDate="2009-12-03" lims:fid="871031" lims:id="871031"><Label>4</Label><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871032" lims:id="871032"><Label>(1)</Label><Text>Except as otherwise provided in these Regulations, no person shall</Text><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871033" lims:id="871033"><Label>(a)</Label><Text>hunt, disturb, hold in captivity or destroy any wildlife within, or remove any wildlife from, a park;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871034" lims:id="871034"><Label>(b)</Label><Text>in La Mauricie National Park, Georgian Bay Islands National Park, St. Lawrence Islands National Park or the Mingan Archipelago National Park Reserve, have in the person’s possession any wildlife;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871035" lims:id="871035"><Label>(c)</Label><Text>in any park other than a park referred to in paragraph (b), or outside a park, be in possession of any wildlife killed or procured within a park, unless the wildlife is in that person’s possession in accordance with subsection (4);</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871036" lims:id="871036"><Label>(d)</Label><Text><Repealed>[Repealed, SOR/2009-322, s. 17]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871037" lims:id="871037"><Label>(e)</Label><Text>disturb or destroy a nest, lair, den or beaver house or dam in a park;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871038" lims:id="871038"><Label>(f)</Label><Text>touch or feed wildlife in a park or entice wildlife that is in a park to approach by holding out or setting out decoys or any such devices, foodstuffs or bait of any kind; or</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871039" lims:id="871039"><Label>(g)</Label><Text>release any exotic wildlife within a park.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871040" lims:id="871040"><Label>(2)</Label><Text>No person shall shine a movable light having a voltage greater than 4.5 volts in any area frequented by wildlife between sunset and sunrise.</Text></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871041" lims:id="871041"><Label>(3)</Label><Text>A person may, in the Mingan Archipelago National Park Reserve, have in the person’s possession wild ducks, if</Text><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871042" lims:id="871042"><Label>(a)</Label><Text>the ducks have been hunted in accordance with these Regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871043" lims:id="871043"><Label>(b)</Label><Text>at the request of a park warden or other park officer, the person in possession of the ducks produces a hunting permit issued pursuant to section 13.1.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871044" lims:id="871044"><Label>(4)</Label><Text>A person may, in any park other than a park referred to in paragraph (1)(b), have in the person’s possession any wildlife if</Text><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871045" lims:id="871045"><Label>(a)</Label><Text>subject to subsection (5), the person in possession of the wildlife produces, on the request of a park warden or other park officer,</Text><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="871046" lims:id="871046"><Label>(i)</Label><Text>an export permit as issued pursuant to the <XRefExternal reference-type="act">Game Export Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="871047" lims:id="871047"><Label>(ii)</Label><Text>a hunting licence or permit or a trapping licence or permit issued by the province in which the wildlife was procured,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="871048" lims:id="871048"><Label>(iii)</Label><Text>a hunting tag issued by the province in which the wildlife was procured and the tag is properly placed on the wildlife as required by the laws of that province, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="871049" lims:id="871049"><Label>(iv)</Label><Text>where the wildlife has been obtained as a gift, a valid licence or permit issued by the province in which the wildlife was procured permitting a person to give such wildlife to another person or a statement signed by the donor of the gift that includes the date of the gift, the type and number of wildlife, the name of the person receiving the gift and the licence or permit number under which the wildlife was procured; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871050" lims:id="871050"><Label>(b)</Label><Text>subject to subsection (5), the person is in possession of the wildlife in the park for the purpose of</Text><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="871051" lims:id="871051"><Label>(i)</Label><Text>storing it at a permanent residence in the park,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="871052" lims:id="871052"><Label>(ii)</Label><Text>transporting it directly on a through highway to a permanent residence within the park,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="871053" lims:id="871053"><Label>(iii)</Label><Text>transporting it directly through the park to private property outside the park on a road that is the sole means of access to that property, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="871054" lims:id="871054"><Label>(iv)</Label><Text>in the case of the Prince Edward Island National Park and where entrance onto the Gulf Shore Parkway was made solely for the purpose of travelling the most direct route to a private or public road outside the Park, transporting it on the Gulf Shore Parkway.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871055" lims:id="871055"><Label>(5)</Label><Text>Subsection (4) does not apply to a person who is in possession of wildlife that the person is authorized under paragraph 15(1)(a) to remove, relocate or destroy.</Text></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871056" lims:id="871056"><Label>(6)</Label><Text>Notwithstanding subsection (1), reasonable protection from biting or stinging insects is permitted.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-12-03" lims:fid="871058" lims:id="871058">SOR/88-40, s. 3; SOR/91-421, s. 2; SOR/92-441, s. 2; SOR/97-102, s. 3; SOR/2009-322, s. 17</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="871059" lims:id="871059" level="1"><TitleText>Point Pelee National Park</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="871060" lims:id="871060"><Label>5. to 13</Label><Text><Repealed>[Repealed, SOR/91-421, s. 3]</Repealed></Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="871061" lims:id="871061" level="1"><TitleText>Mingan Archipelago National Park Reserve</TitleText></Heading><Section lims:inforce-start-date="2009-12-03" lims:lastAmendedDate="2022-07-30" lims:fid="871062" lims:id="871062"><Label>13.1</Label><Subsection lims:inforce-start-date="2022-07-30" lims:enacted-date="2022-05-20" lims:fid="871063" lims:id="1373131"><Label>(1)</Label><Text>Subject to subsections (2) to (5), the superintendent of the Mingan Archipelago National Park Reserve may, upon receiving an application, issue a hunting permit, to the person named in the application permitting that person to hunt Eider and Long-tailed duck within the boundaries of that Reserve during the open season set out for those species in that area in the <XRefExternal reference-type="regulation" link="SOR-2022-105">Migratory Birds Regulations, 2022</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871064" lims:id="871064"><Label>(2)</Label><Text>No person is eligible for a hunting permit unless that person</Text><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871065" lims:id="871065"><Label>(a)</Label><Text>is a permanent resident of the communities of Longue Pointe de Mingan, Mingan, Havre St-Pierre or Baie John Beetz in the Province of Quebec; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-07-30" lims:enacted-date="2022-05-20" lims:fid="871066" lims:id="1373132"><Label>(b)</Label><Text>holds a valid migratory game bird hunting permit issued under the <XRefExternal reference-type="regulation" link="SOR-2022-105">Migratory Birds Regulations, 2022</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871067" lims:id="871067"><Label>(3)</Label><Text>No person shall hunt for duck unless the person is the holder and is in possession of a hunting permit issued under subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871068" lims:id="871068"><Label>(4)</Label><Text>The superintendent may specify, in the hunting permit</Text><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871069" lims:id="871069"><Label>(a)</Label><Text>the period of time for which the permit is valid;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871070" lims:id="871070"><Label>(b)</Label><Text>the locations in the Mingan Archipelago National Park Reserve where the hunting of duck may take place; and</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871071" lims:id="871071"><Label>(c)</Label><Text>such other conditions as are necessary to ensure public safety and the protection of resources in the Mingan Archipelago National Park Reserve.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871072" lims:id="871072"><Label>(4.1)</Label><Text><Repealed>[Repealed, SOR/2009-322, s. 18]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="871073" lims:id="871073"><Label>(5)</Label><Text lims:inforce-start-date="2022-07-30" lims:enacted-date="2022-05-20" lims:fid="1348682" lims:id="1373133">The holder of a hunting permit may hunt Eider and Long-tailed duck</Text><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="871074" lims:id="871074"><Label>(a)</Label><Text>between one-half hour before sunrise and one-half hour after sunset during the period referred to in subsection (1); and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871096" lims:id="871096"><Label>(c)</Label><Text>all entrances to the park.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871097" lims:id="871097"><Label>(3)</Label><Text>A notice posted in accordance with subsection (2) shall contain</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871098" lims:id="871098"><Label>(a)</Label><Text>a description of the areas in the park to which the prohibition applies; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871113" lims:id="871113"><Label>(b)</Label><Text>a bonded armoured car service guard who is carrying out assigned duties in the park.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871114" lims:id="871114"><Label>(3)</Label><Text>No person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871115" lims:id="871115"><Label>(a)</Label><Text>have a loaded firearm in or on a vehicle, vessel or aircraft; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871116" lims:id="871116"><Label>(b)</Label><Text>discharge a firearm from a vehicle, vessel or aircraft.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871117" lims:id="871117"><Label>(4)</Label><Text>The superintendent may issue a permit authorizing a person to carry a firearm or trap where the firearm or trap is to be carried through the park for use outside the park.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871118" lims:id="871118"><Label>(5)</Label><Text>No person shall carry a firearm or trap outside a vehicle, vessel or aircraft unless</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871119" lims:id="871119"><Label>(a)</Label><Text>that person</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="871120" lims:id="871120"><Label>(i)</Label><Text>has a permit from the superintendent authorizing the carrying of a firearm or trap, whichever is applicable, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="871121" lims:id="871121"><Label>(ii)</Label><Text>complies with these Regulations; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="871122" lims:id="871122"><Label>(b)</Label><Text>the firearm or trap is being carried directly</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="871123" lims:id="871123"><Label>(i)</Label><Text>from a vehicle, vessel or aircraft to that person’s premises, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="871124" lims:id="871124"><Label>(ii)</Label><Text>to a vehicle, vessel or aircraft from that person’s premises.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871125" lims:id="871125"><Label>(6)</Label><Text>No person, other than a bonded armoured car service guard in the performance of that person’s duties in a park, shall discharge a firearm, except on a rifle range or when shooting wild ducks in the Mingan Archipelago National Park Reserve in accordance with these Regulations.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="871126" lims:id="871126"><Label>(7)</Label><Text>No person shall possess a firearm or other device for capturing or destroying wildlife in Kejimkujik, La Mauricie or Point Pelee National Parks, or in Forillon National Park except when traversing the park along Highway 132, unless the person has been authorized under paragraph 15(1)(a) to remove, relocate or destroy wildlife.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="871128" lims:id="871128">SOR/82-463, s. 1(F);
