17</Text></Footnote></Provision><Provision lims:inforce-start-date="2025-02-26" lims:enacted-date="2025-02-26" lims:fid="1514170" lims:id="1514170" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And whereas, under section 11.1 of that Act, the Minister of Employment and Social Development has provided persons with disabilities from a range of backgrounds with meaningful and barrier-free opportunities to collaborate in the development and design of the annexed Regulations;</Text></Provision><Provision lims:inforce-start-date="2025-02-26" lims:enacted-date="2025-02-26" reference-type="act" link="C-3.45">Canada Disability Benefit Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514179" lims:id="1514179" generate-in-text="no"><Text><DefinedTermEn>applicant</DefinedTermEn> means a person who has applied for a benefit or on whose behalf an application for a benefit has been made. (<DefinedTermFr>demandeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514180" lims:id="1514180" generate-in-text="no"><Text><DefinedTermEn>beneficiary</DefinedTermEn> means a person to whom payment of a benefit has been approved or on whose behalf a benefit has become payable. (<DefinedTermFr>prestataire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514181" lims:id="1514181" generate-in-text="no"><Text><DefinedTermEn>benefit</DefinedTermEn> means a Canada disability benefit payable under the Act. (<DefinedTermFr>prestation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514182" lims:id="1514182" generate-in-text="no"><Text><DefinedTermEn>cohabiting spouse or common-law partner</DefinedTermEn> has the same meaning as in section 122.6 of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>. (<DefinedTermFr>époux ou conjoint de fait visé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514183" lims:id="1514183" generate-in-text="no"><Text><DefinedTermEn>payment period</DefinedTermEn> means the period beginning on July 1 of a calendar year and ending on June 30 of the following calendar year. (<DefinedTermFr>période de paiement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514184" lims:id="1514184" generate-in-text="no"><Text><DefinedTermEn>release</DefinedTermEn>, in relation to a person who has been incarcerated, means release from custody on earned remission, at the expiry of a sentence, or on parole or statutory release that has not been terminated or revoked. (<DefinedTermFr>libération</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2025-02-26" lims:enacted-date="2025-02-26" lims:fid="1514185" lims:id="1514185" level="1"><TitleText>Eligibility</TitleText></Heading><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:lastAmendedDate="2025-05-15" lims:fid="1514186" lims:id="1514186"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514187" lims:id="1514187">Eligibility criteria</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514188" lims:id="1514188"><Label>(1)</Label><Text>A person is eligible to receive a benefit for any month after May 2025 in which they meet the following criteria:</Text><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514189" lims:id="1514189"><Label>(a)</Label><Text>they are at least 18 years of age but not more than 65 years of age;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514190" lims:id="1514190"><Label>(b)</Label><Text>they are a <DefinitionRef>DTC-eligible individual</DefinitionRef>, as defined in subsection 146.4(1) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514191" lims:id="1514191"><Label>(c)</Label><Text>they are resident in Canada for the purposes of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> and are</Text><Subparagraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514192" lims:id="1514192"><Label>(i)</Label><Text>a Canadian citizen,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514193" lims:id="1514193"><Label>(ii)</Label><Text>a <DefinitionRef>permanent resident</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514194" lims:id="1514194"><Label>(iii)</Label><Text>a temporary resident within the meaning of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal> who was resident in Canada for the 18 months preceding that month,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514195" lims:id="1514195"><Label>(iv)</Label><Text>a protected person within the meaning of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514196" lims:id="1514196"><Label>(v)</Label><Text>an <DefinitionRef>Indian</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514197" lims:id="1514197"><Label>(d)</Label><Text>they are not incarcerated as a result of a sentence of imprisonment of two years or more that is to be served in a penitentiary by virtue of any Act of Parliament; and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514198" lims:id="1514198"><Label>(e)</Label><Text>they have filed a return of income under the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> for the last taxation year that ended before the beginning of the payment period in which that month falls.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514199" lims:id="1514199"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514200" lims:id="1514200">Exception — 65 years of age</MarginalNote><Label>(2)</Label><Text>Despite paragraph (1)(a), a person is eligible for a benefit for the month in which they turn 65 years of age.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514201" lims:id="1514201"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514202" lims:id="1514202">Exception — incarceration</MarginalNote><Label>(3)</Label><Text>Despite paragraph (1)(d), a person is eligible for a benefit for the first month in which they are incarcerated and for the month in which they are released.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514203" lims:id="1514203"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514204" lims:id="1514204">Condition — cohabiting spouse or common-law partner</MarginalNote><Label>(4)</Label><Text>Despite subsections (1) to (3), a person is eligible for a benefit for any month in a payment period only if their cohabiting spouse or common-law partner has filed a return of income under the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> for the last taxation year that ended before the beginning of that payment period.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514205" lims:id="1514205"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514206" lims:id="1514206">Waiver</MarginalNote><Label>(5)</Label><Text>The Minister may waive the condition set out in subsection (4) if the Minister is satisfied that the condition is unreasonable or impracticable in the circumstances, including if</Text><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514207" lims:id="1514207"><Label>(a)</Label><Text>the cohabiting spouse or common-law partner is not resident in Canada for the purposes of the <XRefExternal reference-level="federal" reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514208" lims:id="1514208"><Label>(b)</Label><Text>for reasons not attributable to the person or their cohabiting spouse or common-law partner, the person is not living with their cohabiting spouse or common-law partner; or</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514209" lims:id="1514209"><Label>(c)</Label><Text>the cohabiting spouse or common-law partner has engaged in <DefinitionRef>family violence</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-level="federal" reference-type="act" link="D-3.4">Divorce Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514210" lims:id="1514210"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514211" lims:id="1514211">Exception — suspension of payments</MarginalNote><Label>(6)</Label><Text>Despite subsections (1) to (3), a person is not eligible for a benefit for any month during which payment of a benefit has been suspended under section <XRefInternal>11</XRefInternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:lastAmendedDate="2025-05-15" lims:fid="1514212" lims:id="1514212"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514213" lims:id="1514213">Evidence of age and identity</MarginalNote><Label>3</Label><Text>The Minister may determine the age and identity of an applicant on the basis of any information made available to the Minister by the Canada Employment Insurance Commission under subsection 28.2(5) of the <XRefExternal reference-type="act" link="H-5.7">Department of Employment and Social Development Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2025-02-26" lims:enacted-date="2025-02-26" lims:fid="1514214" lims:id="1514214" level="1"><TitleText>Application for Benefits</TitleText></Heading><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:lastAmendedDate="2025-05-15" lims:fid="1514215" lims:id="1514215"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514216" lims:id="1514216">Form of application</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514217" lims:id="1514217"><Label>(1)</Label><Text>An application for benefits must be made in the form and manner specified by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514218" lims:id="1514218"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" ceases as of that month and they must make a new application to resume benefits.</Text></Subsection></Section><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" date</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514226" lims:id="1514226"><Label>(1)</Label><Text>Subject to subsection (2), an application is deemed to be approved by the Minister on the earliest day on which an applicant becomes eligible for a benefit in accordance with the Act and these Regulations and for which a benefit has not already been paid.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514227" lims:id="1514227"><MarginalNote be deemed to have been approved is the day that is 24 months before the day on which the application is made.</Text></Subsection></Section><Heading lims:inforce-start-date="2025-02-26" lims:enacted-date="2025-02-26" lims:fid="1514229" lims:id="1514229" level="1"><TitleText>Amount of Benefit</TitleText></Heading><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:lastAmendedDate="2025-05-15" lims:fid="1514230" lims:id="1514230"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:id="1514232"><Label>(1)</Label><Text>The benefit that is payable to a beneficiary for any month for which they are eligible to receive a benefit in a payment period is the amount — rounded to the nearest cent or, if the amount is equidistant from two cents, to the higher of them — determined by the formula</Text><FormulaGroup lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:enacted-date="2025-02-26" lims:fid="1514243" lims:id="1514243"><Label>(a)</Label><Text>the beneficiary’s working income for the last taxation year that ended before the beginning of the payment period, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514244" lims:id="1514244"><Label>(b)</Label><Text>the product of $10,000 and the indexing factor for the payment period, calculated in accordance with subsection (5); and</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition does not meet the eligibility criteria set out in section <XRefInternal>2</XRefInternal> or that an inquiry with respect to their eligibility is necessary, the Minister may suspend payment of the benefit to the beneficiary until the Minister is satisfied that they are eligible.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514297" writing that the Minister resume payment of their benefit within 24 months after the date of suspension. lims:id="1514326"><Label>(1)</Label><Text>If a beneficiary has disappeared under circumstances that the Minister concludes raise, beyond a reasonable doubt, a presumption that the beneficiary is dead, the Minister may determine the date on which, for the purposes of the Act and these Regulations, that beneficiary’s death is presumed to have occurred, and the beneficiary will be deemed for all purposes of the Act and these Regulations to have died on that date.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514327" lims:id="1514327"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514328" lims:id="1514328">Change of date</MarginalNote><Label>(2)</Label><Text>If, after having determined the date of the beneficiary’s death, the Minister is satisfied on the basis of new information or evidence that the date of death is different, the Minister may determine a different date for the purposes of the Act and these Regulations and the Minister must, within a reasonable time, pay any benefit that would have been payable if the initial determination had not been this section, the Minister is satisfied on the basis of new information or evidence that the beneficiary is alive, the Minister must, within a reasonable time, pay any benefit that would have been affairs, the Minister may direct that the benefit be paid on their behalf to their representative, if the representative is authorized by or under a law of Canada or of a province to manage the the Act or these Regulations that no benefit be paid to them, or respecting the amount of a benefit that the person has received or will receive, may, within 180 days after the day on which the person is notified in writing of the decision, make a request to the Minister for a reconsideration of that decision.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" under section <XRefInternal>35</XRefInternal> and who is dissatisfied with that decision or with the amount of the penalty may, within 180 days after the day on which the person is notified in writing confirm, amend or rescind it, and may approve payment of a benefit, determine the amount of a benefit or determine that no benefit is payable. Only a decision of the Minister made under subsection <XRefInternal>18</XRefInternal>(4) of these Regulations in respect of these decisions may be appealed to the Social Security to provide information or documents</MarginalNote><Label>(2)</Label><Text>Despite any other provision of the Act or these Regulations, the Minister may, subject to subsection (3), by notice served personally or by confirmed delivery service, require that any person provide any information or document for any purpose relating to the administration or enforcement of the Act or these Regulations within the reasonable time specified in the notice.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514428" lims:id="1514428"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514429" lims:id="1514429">Other persons</MarginalNote><Label>(3)</Label><Text>The Minister must obtain the authorization of a judge under subsection (4) before requiring that a person — other than an applicant, a beneficiary or the representative of an applicant or beneficiary who is incapable of managing their own affairs — provide information or documents under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514430" lims:id="1514430"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514431" lims:id="1514431">Judicial authorization</MarginalNote><Label>(4)</Label><Text>On an <Emphasis style="italic"><Language xml:lang="la">ex parte</Language></Emphasis> application by the Minister, a judge may, subject to the conditions that the judge considers appropriate, authorize the Minister to require information or documents under subsection (2) from a person referred to in subsection (3) if the judge is satisfied by information on oath that the information or documents are required to verify compliance by the person with a duty or obligation under the Act or these Regulations.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514432" lims:id="1514432"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514433" lims:id="1514433">Service of authorization</MarginalNote><Label>(5)</Label><Text>An authorization granted under subsection (4) must be served together with the notice referred to in subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514434" lims:id="1514434"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514435" lims:id="1514435">Review of authorization</MarginalNote><Label>(6)</Label><Text>A person on whom an authorization and a notice are served under subsection (5) may, not later than 15 days after the day on which the authorization and notice are served, apply to the judge who granted the authorization under subsection (4) or, if that judge is unable to act, to another judge of the same court for a review of the authorization.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" review</MarginalNote><Label>(7)</Label><Text>On hearing an application under subsection (6), a judge may cancel the authorization previously granted if the judge is not then satisfied that the conditions referred to in subsection (4) have been met, and the judge may confirm or vary the authorization if the judge is satisfied that those conditions have been <DefinedTermEn>judge</DefinedTermEn> means a judge of a superior court having jurisdiction in the province where the matter arises or a judge of the Federal under the Act or these Regulations, the person by whom it is examined or to whom it is provided may make or cause to be made one or more certified copies of it and any such copy is evidence of the nature and content of the original document and has the same probative force as the original document would have if it were proven in the ordinary way.</Text></Section><Section preventing non-compliance with the Act or these Regulations, require an applicant, a beneficiary or the representative of an applicant or beneficiary who is incapable of managing their own affairs to be at a suitable place — or to be available by audioconference or videoconference or in any other suitable manner — at a suitable time in order to provide any information or document related to their application that the Minister may require.</Text></Section><Heading lims:inforce-start-date="2025-02-26" lims:enacted-date="2025-02-26" lims:fid="1514444" lims:id="1514444" level="1"><TitleText>Administrative Monetary Penalties</TitleText></Heading><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:lastAmendedDate="2025-05-15" lims:fid="1514445" lims:id="1514445"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514446" lims:id="1514446">Violations</MarginalNote><Label>35</Label><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514447" lims:id="1514447"><Label>(1)</Label><Text>A person commits a violation if they</Text><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514448" lims:id="1514448"><Label>(a)</Label><Text>knowingly make, in relation to an application for a benefit under the Act, a representation that is false or misleading; or</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514449" lims:id="1514449"><Label>(b)</Label><Text>make an application for, and receive, a benefit under the Act knowing that they are not eligible to receive it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514450" lims:id="1514450"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514451" lims:id="1514451">Penalty</MarginalNote><Label>(2)</Label><Text>Subject to subsection (7), the Minister may impose a penalty on a person if the Minister is of the opinion, based on documents or information collected or obtained by the Minister, that the person has committed a violation.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514452" lims:id="1514452"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514453" lims:id="1514453">Amount of penalty</MarginalNote><Label>(3)</Label><Text>The penalty that the Minister may issue is</Text><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514454" lims:id="1514454"><Label>(a)</Label><Text>for a first violation, 15 per cent of the amount calculated by multiplying by 12 the monthly amount of the benefit payable to a beneficiary during the payment period in which the violation was committed, calculated in accordance with section <XRefInternal>6</XRefInternal> without any reduction based on income; and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514455" lims:id="1514455"><Label>(b)</Label><Text>for each subsequent violation, 50 per cent of the amount calculated by multiplying by 12 the monthly amount of the benefit payable to a beneficiary during the payment period in which the violation was committed, calculated in accordance with section <XRefInternal>6</XRefInternal> without any reduction based on income.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514456" lims:id="1514456"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514457" lims:id="1514457">Presumption — first violation</MarginalNote><Label>(4)</Label><Text>For the purposes of subsection (3), if no penalty was imposed on a person under this section in the 10 years preceding the day on which a violation occurred, the violation is deemed to be a first violation.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514458" lims:id="1514458"><MarginalNote lims:inforce-start-date="2025-05-15" mistakenly believe that a representation is true or that they, or the person on whose behalf they made an application for a benefit, were eligible to receive the benefit, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514460" lims:id="1514460"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514461" lims:id="1514461">Limitation</MarginalNote><Label>(6)</Label><Text>A penalty must not be imposed on a person in respect of an act referred to in subsection (1) if</Text><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514462" lims:id="1514462"><Label>(a)</Label><Text>a prosecution for the act has been another person’s information for the purpose of obtaining a benefit for themselves;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514473" lims:id="1514473"><Label>(b)</Label><Text>counsel a person to apply for a benefit with the intent to steal all or a substantial part of it; or</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514474" lims:id="1514474"><Label>(c)</Label><Text>knowingly make false or misleading representations in relation to an application for a benefit.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514475" lims:id="1514475"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514476" lims:id="1514476">Saving</MarginalNote><Label>(2)</Label><Text>No proceeding may be commenced under this section or the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> for an act if a penalty for that act has been imposed under section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514480" lims:id="1514480"><Label>(1)</Label><Text>A person or agency that has received a benefit payment to which the person or agency is not entitled, or that has received a benefit payment in excess of the amount of the benefit to which the person or agency is entitled, must return the amount of the erroneous payment or the overpayment, as the case may be, as soon as feasible.</Text></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514481" Majesty</MarginalNote><Label>(2)</Label><Text>The amount of the erroneous payment or overpayment constitutes a debt due to His Majesty in right of Canada, as of the day on which it was paid, that may under this section may be paid as a single payment or, if the Minister agrees, in instalments in any amount that does not cause undue hardship to the person.</Text></Subsection><Subsection that results from an erroneous payment or overpayment unless the payment was made as a result of a violation for which a penalty was imposed under section <XRefInternal>35</XRefInternal> or as a result of an offence under subsection <XRefInternal>36</XRefInternal>(1) for which a fine or a term of imprisonment was imposed under the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:lastAmendedDate="2025-05-15" lims:fid="1514487" penalty imposed under section <XRefInternal>35</XRefInternal> constitutes a debt due to His Majesty in right of Canada, as of the day on which it was imposed, that may be recovered by the Minister.</Text></Section><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:lastAmendedDate="2025-05-15" lims:fid="1514489" lims:id="1514489"><MarginalNote taken to recover money owing under the Act or these Regulations after the end of the six-year limitation period or prescription that begins on the day on which the money becomes due and is suspended during any period in which</Text><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514494" lims:id="1514494"><Label>(a)</Label><Text>it is prohibited to commence or continue an action or other proceedings against the debtor to recover money owing under the Act or these Regulations; or</Text></Paragraph><Paragraph lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514495" lims:id="1514495"><Label>(b)</Label><Text>a review of a decision establishing liability in respect of money owing under the Act or these Regulations is pending.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514496" lims:id="1514496"><MarginalNote lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:fid="1514497" lims:id="1514497">Enforcement proceedings</MarginalNote><Label>(3)</Label><Text>This section does not apply in respect of an action or proceedings relating to the execution, renewal or enforcement of a judgment.</Text></Subsection></Section><Section lims:inforce-start-date="2025-05-15" lims:enacted-date="2025-02-26" lims:lastAmendedDate="2025-05-15" lims:fid="1514498" lims:id="1514498"><MarginalNote
