lims:enacted-date="2023-06-19" lims:fid="1407080" lims:id="1407080" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas the purpose of the annexed Regulations is to ensure that the laws set out in Schedule 2 to the annexed Regulations apply as federal law to the project lands, within the limits of federal constitutional authority;</Text></Provision><Provision lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407081" lims:id="1407081" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas, in accordance with paragraph 3(2)(b) of that Act, the annexed Regulations confer on the Minister of Indigenous Services the legislative power that the Governor in Council considers necessary to effectively regulate the commercial or industrial undertakings that are located on the reserve lands described in the annexed Regulations;</Text></Provision><Provision lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407082" lims:id="1407082" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas the annexed Regulations specify provincial officials by whom, and provincial bodies by which, powers may be exercised or duties are to be performed;</Text></Provision><Provision lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407083" lims:id="1407083" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And whereas, in accordance with paragraph 5(1)(b) of that Act, an agreement has been concluded between the Minister of Indigenous Services, the Province of British Columbia and the council of the Squamish Nation for the administration and enforcement of the annexed Regulations by those lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407096" lims:id="1407096">Expanded meaning of undertaking</MarginalNote><Label>(2)</Label><Text>For the purposes of the <XRefExternal reference-type="act" link="F-11.64">First Nations Commercial and Industrial Development Act</XRefExternal>, the meaning of the expression “commercial or industrial undertaking” is enlarged to include a manufactured home park and a residential tenancy development.</Text></Subsection></Section><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" certainty, the adaptations in sections <XRefInternal>11</XRefInternal> to <XRefInternal>31</XRefInternal> are to be interpreted to be part of the incorporated laws to which they apply.</Text></Section><Heading lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407101" lims:id="1407101" level="1"><TitleText>Purpose</TitleText></Heading><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:lastAmendedDate="2023-06-19" lims:fid="1407102" lims:id="1407102"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407103" lims:id="1407103">Purpose</MarginalNote><Label>4</Label><Text>The purpose of these Regulations is to implement with respect to the project lands a legal regime that is harmonized with the legal regime of British Columbia that governs the landlord and tenant relationship in relation to manufactured home parks and residential tenancy developments.</Text></Section><Heading lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407104" lims:id="1407104" level="1"><TitleText>Application of Incorporated Laws</TitleText></Heading><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:lastAmendedDate="2023-06-19" lims:fid="1407105" lims:id="1407105"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407106" lims:id="1407106">Power to fix date of application</MarginalNote><Label>5</Label><Text>Subject to sections <XRefInternal>6</XRefInternal> and <XRefInternal>9</XRefInternal>, the Minister must, by order, fix and set out in column 3 of Schedule 1, the date on which the incorporated laws begin to apply to project lands listed in column 2 of that Schedule.</Text></Section><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:lastAmendedDate="2023-06-19" lims:fid="1407107" incorporated law applies only if the provision of the law of British Columbia that it incorporates is in force.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407110" lims:id="1407110"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407111" lims:id="1407111">Restriction — limits of authority</MarginalNote><Label>(2)</Label><Text>For greater certainty, an incorporated law applies only to the extent that it is within the limits of federal constitutional authority.</Text></Subsection></Section><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:lastAmendedDate="2023-06-19" lims:fid="1407112" contravention of a law of British Columbia that is incorporated in these Regulations is an offence under the laws of British Columbia, contravention of the incorporated law is also an offence and is subject to the same penalties as under the laws of British Columbia.</Text></Section><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:lastAmendedDate="2023-06-19" lims:fid="1407114" lims:id="1407114"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407115" lims:id="1407115">Incorporation of procedural matters</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407116" lims:id="1407116"><Label>(1)</Label><Text>Unless otherwise provided and subject to any adaptations set out in sections <XRefInternal>11</XRefInternal> to <XRefInternal>31</XRefInternal>, the following are to conform to the laws of British Columbia, whether or not those laws have been set out in Schedule 2:</Text><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407117" lims:id="1407117"><Label>(a)</Label><Text>the enforcement of incorporated laws;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407118" lims:id="1407118"><Label>(b)</Label><Text>the prosecution of an offence, or any other proceedings, in relation to the contravention of an incorporated law;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407119" lims:id="1407119"><Label>(c)</Label><Text>the review or appeal of an action or decision taken, or of a failure to take an action that could have been taken, under an incorporated law; and</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407120" lims:id="1407120"><Label>(d)</Label><Text>any requirements for notice or other procedures in relation to an action to be taken under an incorporated law.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407121" lims:id="1407121"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407122" lims:id="1407122">Related powers</MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), a person, provincial official or provincial body that has a power, duty or function under a law of British Columbia is a person, provincial official or provincial body specified to have the same power, duty or function in respect of any actions taken under that subsection.</Text></Subsection></Section><Heading lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407123" lims:id="1407123" level="1"><TitleText>Notice</TitleText></Heading><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:lastAmendedDate="2023-06-19" lims:fid="1407124" lims:id="1407124"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407125" lims:id="1407125">Notice to leaseholders and Indians in lawful possession</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407126" lims:id="1407126"><Label>(1)</Label><Text>Before the Minister makes an order under section <XRefInternal>5</XRefInternal> with respect to any project lands, the council of the First Nation must</Text><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407127" lims:id="1407127"><Label>(a)</Label><Text>send notice by mail to the following persons registered as leaseholders or Indians in lawful possession, as applicable, in a register in which the project lands are registered, at the addresses that are indicated in relation to the registrations or that may be otherwise known by the First Nation, advising those leaseholders and Indians of the intention to apply the incorporated laws to the project lands:</Text><Subparagraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407128" lims:id="1407128"><Label>(i)</Label><Text>any leaseholder in any of the project lands, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407129" lims:id="1407129"><Label>(ii)</Label><Text>any Indian considered to be lawfully in possession of any of the lands under section 20 of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407130" lims:id="1407130"><Label>(b)</Label><Text>publish a notice one day per week for two consecutive weeks, in the local newspaper with the largest circulation, advising of the intention to apply the incorporated laws to the project lands; and</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407131" lims:id="1407131"><Label>(c)</Label><Text>provide the Minister with written notice of compliance with paragraphs (a) and (b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407132" lims:id="1407132"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407133" lims:id="1407133">No invalidity or cause of action</MarginalNote><Label>(2)</Label><Text>An order made by the Minister under section <XRefInternal>5</XRefInternal> is not invalid by reason only of the failure of a leaseholder or Indian referred to in paragraph (1)(a) to receive notice under subsection (1) and no cause of action exists against His Majesty in right of Canada, the Minister, His Majesty in right of British Columbia, any provincial official, any provincial body, the First Nation or the council of the First Nation from such a failure.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407134" lims:id="1407134"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407135" lims:id="1407135">Definition of <DefinitionRef>Indian</DefinitionRef></MarginalNote><Label>(3)</Label><Text>In this section, <DefinitionRef>Indian</DefinitionRef> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:lastAmendedDate="2023-06-19" lims:fid="1407136" register</MarginalNote><Label>10</Label><Text>Once the incorporated laws apply to the project lands, the officer in the Department of Indigenous Services responsible for the management of the register in which those project lands are registered must place a notation on the register indicating that the incorporated laws apply to those project lands.</Text></Section><Heading lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407138" lims:id="1407138" level="1"><TitleText>General Adaptations to Incorporated Laws</TitleText></Heading><Section lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:lastAmendedDate="2023-06-19" lims:fid="1407139" lims:id="1407139"><MarginalNote lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407140" lims:id="1407140">Statutes and regulations of British Columbia</MarginalNote><Label>11</Label><Text>Unless otherwise indicated, the statutes and regulations referred to in sections <XRefInternal>16</XRefInternal> to <XRefInternal>31</XRefInternal> are statutes and regulations of British Columbia.</Text></Section><Section following:</Text><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407146" lims:id="1407146"><Label>(a)</Label><Text>spent provisions, commencement provisions and consequential amendments;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-19" lims:enacted-date="2023-06-19" lims:fid="1407147" lims:id="1407147"><Label>(b)</Label><Text>provisions certainty, a person, provincial official or provincial body that has a power, duty or function under an incorporated law or a law of British Columbia referred to in subsection <XRefInternal>8</XRefInternal>(1) that is not set out in Schedule 2, is a person specified to have the same power, duty or function under these Regulations, subject to the adaptations set out in
