lims:id="859273">Definitions</MarginalNote><Label>1</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2018-11-02" lims:fid="859274" lims:id="859274" generate-in-text="no"><Text><DefinedTermEn>accessible part</DefinedTermEn> means any part of a product that may be touched, licked, mouthed or swallowed during the reasonably foreseeable use of the product. (<DefinedTermFr>partie accessible</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-02" lims:fid="859275" lims:id="859275" generate-in-text="no"><Text><DefinedTermEn>consumer product containing lead</DefinedTermEn> means any of the following products that contains lead: </Text><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="859276" lims:id="859276"><Label>(a)</Label><Text>a product that is brought into contact with the user’s mouth during normal use, except for</Text><Subparagraph lims:inforce-start-date="2018-11-02" lims:fid="859277" lims:id="859277"><Label>(i)</Label><Text>a kitchen utensil, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-02" lims:fid="859278" lims:id="859278"><Label>(ii)</Label><Text>a product that is subject to the <XRefExternal reference-type="regulation" link="SOR-2016-175">Glazed Ceramics and Glassware Regulations</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="859279" lims:id="859279"><Label>(b)</Label><Text>any clothing or clothing accessory that is intended for use by a child under 14 years of age;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="859280" lims:id="859280"><Label>(c)</Label><Text>a product that is intended for use in learning or play by a child under 14 years of age;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="859281" lims:id="859281"><Label>(d)</Label><Text>a book or similar printed product that is intended for a child under 14 years of age, except if it is</Text><Subparagraph lims:inforce-start-date="2018-11-02" lims:fid="859282" lims:id="859282"><Label>(i)</Label><Text>printed on paper or cardboard, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-02" lims:fid="859283" lims:id="859283"><Label>(ii)</Label><Text>printed and bound in a conventional manner using conventional materials;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="859284" lims:id="859284"><Label>(e)</Label><Text>a product whose primary purpose is to facilitate the relaxation, sleep, hygiene, carrying or transportation of a child under four years of age. (<DefinedTermFr>produit de consommation contenant du plomb</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-11-02" lims:fid="859285" lims:id="859285" generate-in-text="no"><Text><DefinedTermEn>good laboratory practices</DefinedTermEn> means practices that are in accordance with the principles set out in the Organisation for Economic Co-operation and Development document entitled <XRefExternal reference-type="other">OECD Principles of Good Laboratory Practice</XRefExternal>, Number 1 of the <XRefExternal reference-type="other">OECD Series on Principles of Good Laboratory Practice and Compliance Monitoring</XRefExternal>, ENV/MC/CHEM(98)17, the English version of which is dated January 21, 1998 and the French version of which is dated March 6, 1998. (<DefinedTermFr>bonnes pratiques de laboratoire</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2018-04-23" lims:fid="859286" lims:id="859286" level="1"><TitleText>Requirements</TitleText></Heading><Section lims:inforce-start-date="2018-11-02" lims:lastAmendedDate="2018-11-02" lims:fid="859287" lims:id="859287"><MarginalNote lims:inforce-start-date="2018-11-02" lims:fid="859288" lims:id="859288">Lead content — accessible part</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2018-11-02" lims:fid="859289" lims:id="859289"><Label>(1)</Label><Text>Subject to subsection (2), each accessible part of a consumer product containing lead must not contain more than 90 mg/kg of lead when tested in accordance with good laboratory practices.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-02" lims:fid="859290" lims:id="859290"><MarginalNote lims:inforce-start-date="2018-11-02" lims:fid="859291" lims:id="859291">Exception</MarginalNote><Label>(2)</Label><Text>Each accessible part may contain more than 90 mg/kg of lead if</Text><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="859292" lims:id="859292"><Label>(a)</Label><Text>lead is necessary to produce an essential characteristic of the part;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="859293" lims:id="859293"><Label>(b)</Label><Text>no alternative part containing less lead is available; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="859294" lims:id="859294"><Label>(c)</Label><Text>the part, when tested in accordance with good laboratory practices, does not release more than 90 mg/kg of lead.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2018-04-23" lims:fid="859295" lims:id="859295" level="1"><TitleText>Repeal</TitleText></Heading><Section lims:inforce-start-date="2018-11-02" lims:lastAmendedDate="2018-11-02" lims:fid="859296" lims:id="859296" type="amending"><Label>3</Label><Text>The <XRefExternal reference-type="regulation" link="SOR-2010-273">Consumer Products Containing Lead (Contact with Mouth) Regulations</XRefExternal><FootnoteRef idref="fn_1">1</FootnoteRef> are repealed.</Text><Footnote id="fn_1" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2018-04-23" lims:lastAmendedDate="2018-04-23" lims:fid="859298" lims:id="859298" type="transitional"><MarginalNote lims:inforce-start-date="2018-04-23" lims:fid="859299" lims:id="859299">Six months after publication</MarginalNote><Label><FootnoteRef idref="fn_IndAFA8_hq_21883">*</FootnoteRef>4</Label><Text>These Regulations come into force on the day that, in the sixth month after the month in which they are published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal>, Part II, has the same calendar number as the day on which they are published or, if that sixth month has no day with that number,
