Whereas, pursuant to section 38 of the Canada Consumer Product Safety Acta, the Minister of Health caused the proposed Exemption Regulations (Consumer Products), substantially in the annexed form, to be laid before the House of Commons on March 31, 2014 and the Senate on April 1, 2014 and no appropriate committee of either House of Parliament made a report with respect to the proposed Regulations;And whereas, pursuant to paragraph 38(4)(b) of the Act, 90 calendar days have passed since the proposed Regulations were laid before each House of Parliament;Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to subsection 37(1) of the Canada Consumer Product Safety Acta, makes the annexed Exemption Regulations (Consumer Products).aS.C. 2010, c. 21Definition

1In these Regulations, donation means a transfer of a consumer product made without consideration.

Exemption

2(1)A retailer is exempt from the application of subparagraph 13(1)(a)(i) of the Canada Consumer Product Safety Act in respect of a consumer product that they obtained by donation.(2)Subsection (1) does not apply if the consumer product was donated by a person who, in the course of business, is or was engaged in manufacturing, importing or selling such consumer products.

Coming into Force

3These Regulations come into force on the day on which they are registered.
