lims:id="809813" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="809814" lims:id="809814" generate-in-text="no"><Text><DefinedTermEn>lounge</DefinedTermEn> means a facility located in a building occupied by the Force where alcohol may be served to any person under the Commissioner’s jurisdiction, individuals undergoing police training and their guests. (<DefinedTermFr>bar</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="809815" lims:id="809815" generate-in-text="no"><Text><DefinedTermEn>mess</DefinedTermEn> means a place that is operated and administered to provide services to members of a mess association. (<DefinedTermFr>mess</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-28" lims:fid="809816" lims:id="809816" generate-in-text="no"><Text><DefinedTermEn>Regulations</DefinedTermEn> means the <XRefExternal reference-type="regulation" link="SOR-2014-281">Royal Canadian Mounted Police Regulations, 2014</XRefExternal>. (<DefinedTermFr>Règlement</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="809817" lims:id="809817" level="1"><TitleText>Duties and Functions of Members Who Are Peace Officers</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809818" lims:id="809818"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809819" lims:id="809819">Additional duties and functions</MarginalNote><Label>2</Label><Text>In addition to the duties prescribed by the Act and the Regulations, members who are peace officers are required to perform duties and functions of an operational, administrative, scientific or technical nature, including duties in support of those duties and functions.</Text></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="809820" lims:id="809820" level="1"><TitleText>Messes and Lounges</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809821" lims:id="809821"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809822" lims:id="809822">Mess establishment and dissolution</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809823" lims:id="809823"><Label>(1)</Label><Text>Subject to the approval of the Commissioner, members may establish, determine the membership structure and dissolve a Force mess.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809824" lims:id="809824"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809825" lims:id="809825">Approval of Commissioner</MarginalNote><Label>(2)</Label><Text>The Commissioner may approve the establishment, dissolution and membership structure of Force messes.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809826" lims:id="809826"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809827" lims:id="809827">Mess association</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809828" lims:id="809828"><Label>(1)</Label><Text>Members of a mess must establish a mess association, consisting of members of the Force organized on the basis of geographical area and rank.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809829" lims:id="809829"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809830" lims:id="809830">Mess constitution</MarginalNote><Label>(2)</Label><Text>Each mess association must establish a mess constitution that provides for the operation of the mess and includes a provision for the election of a mess committee that is responsible for the operation and administration of the mess.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809831" lims:id="809831"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809832" lims:id="809832">Mess membership</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809833" lims:id="809833"><Label>(1)</Label><Text>Every regular member, other than a special constable, is a member of the mess established for the member’s rank in the geographical area where the member is physically posted.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809834" lims:id="809834"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809835" lims:id="809835">Obligations</MarginalNote><Label>(2)</Label><Text>Every mess member must observe the mess constitution, and pay any fees that it requires, for the mess of which they are a member.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809836" lims:id="809836"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809837" lims:id="809837">Other members of mess</MarginalNote><Label>(3)</Label><Text>Special constable members, civilian members and civilian employees may become members of a mess under the terms and conditions established by the mess constitution.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809838" lims:id="809838"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809839" lims:id="809839">Lounge</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809840" lims:id="809840"><Label>(1)</Label><Text>The Commissioner may establish lounges.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809841" lims:id="809841"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809842" lims:id="809842">Lounge committee</MarginalNote><Label>(2)</Label><Text>The Commanding Officer for the division in which a lounge is located must establish a lounge committee and appoint its members.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809843" lims:id="809843"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809844" lims:id="809844">Committee responsibility</MarginalNote><Label>(3)</Label><Text>The lounge committee is responsible for directing the operation of the lounge.</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809845" lims:id="809845"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809846" lims:id="809846">Insurance</MarginalNote><Label>7</Label><Text>Liability insurance must be maintained for messes and lounges.</Text></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="809847" lims:id="809847" level="1"><TitleText>Representation</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809848" lims:id="809848"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809849" lims:id="809849">Providing representation or assistance</MarginalNote><Label>8</Label><Text>With the exception of a Member Representative or a Conduct Authority Representative as defined in section 29 of the <XRefExternal reference-type="regulation" link="SOR-2014-291">Commissioner’s Standing Orders (Conduct)</XRefExternal>, or a staff relations representative, as referred to in subsection 56(2) of the Regulations, and subject to subsection <XRefInternal>9</XRefInternal>(1), a person under the Commissioner’s jurisdiction may provide representation or assistance to a member under subsection 47.1(1) of the Act only if the person has been authorized to do so by the person who holds the first position of officer or its equivalent in the person’s chain of command.</Text></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="809850" lims:id="809850"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809851" lims:id="809851">Exceptions</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809852" lims:id="809852"><Label>(1)</Label><Text>For the purposes of paragraph 47.1(3)(b) of the Act, a person must not represent or assist a member under subsection 47.1(1) of the Act in any of the following circumstances:</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809853" lims:id="809853"><Label>(a)</Label><Text>the person is involved as a party, witness, participant or interested person in the grievance, in the proceeding before a board or in the alleged misconduct that led to the decision giving rise to the appeal;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809854" lims:id="809854"><Label>(b)</Label><Text>any representation or assistance could result in a conflict of interest;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="809855" lims:id="809855"><Label>(c)</Label><Text>any representation or assistance could impair the efficiency, administration or good government of the Force.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="809856" lims:id="809856"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="809857" lims:id="809857">Request to provide representation or assistance</MarginalNote><Label>(2)</Label><Text>A person who wants to represent or assist a member must make a request in writing to the first position of officer or its equivalent in the person’s chain of command and a decision in response to that request must be rendered in writing as soon as feasible.
