lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2022-06-29" lims:fid="767814" lims:id="767814"><Label>1</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2016-06-14" lims:fid="767815" lims:id="767815" generate-in-text="no"><Text><DefinedTermEn>borrower</DefinedTermEn> means a person who obtains a residential mortgage. (<DefinedTermFr>emprunteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="767816" lims:id="767816" generate-in-text="no"><Text><DefinedTermEn>institution</DefinedTermEn> means any of the following:</Text><Paragraph lims:inforce-start-date="2022-06-29" lims:enacted-date="2021-08-04" lims:fid="767817" lims:id="1370573"><Label>(a)</Label><Text><Repealed>[Repealed, SOR/2021-181, s. 109]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-29" lims:enacted-date="2021-08-04" lims:fid="767818" lims:id="1370574"><Label>(b)</Label><Text><Repealed>[Repealed, SOR/2021-181, s. 109]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="767819" lims:id="767819"><Label>(c)</Label><Text>a retail association, as defined in section 2 of the <XRefExternal reference-type="act" link="C-41.01">Cooperative Credit Associations Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="767820" lims:id="767820"><Label>(d)</Label><Text>a company, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-11.8">Insurance Companies Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="767821" lims:id="767821"><Label>(e)</Label><Text>a society, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-11.8">Insurance Companies Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="767822" lims:id="767822"><Label>(f)</Label><Text>a company, as defined in section 2 of the <XRefExternal reference-type="act" link="T-19.8">Trust and Loan Companies Act</XRefExternal>. (<DefinedTermFr>institution</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="767823" lims:id="767823" generate-in-text="no"><Text><DefinedTermEn>insurer</DefinedTermEn> includes a government agency that provides mortgage insurance to an institution. (<DefinedTermFr>assureur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="767824" lims:id="767824" generate-in-text="no"><Text><DefinedTermEn>mortgage insurance</DefinedTermEn> means an insurance policy or a guarantee against default on a residential mortgage. (<DefinedTermFr>assurance hypothécaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="767825" lims:id="767825" generate-in-text="no"><Text><DefinedTermEn>point of service</DefinedTermEn> means a physical location at which an institution issues or initiates the issuance of a residential mortgage through a natural person. (<DefinedTermFr>point de service</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="767826" lims:id="767826" generate-in-text="no"><Text><DefinedTermEn>residential mortgage</DefinedTermEn> means a loan made in Canada on the security of residential property that has four or less residential units. (<DefinedTermFr>hypothèque résidentielle</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-14" lims:fid="767828" lims:id="767828">SOR/2016-142, s. 6(F)</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2022-06-29" lims:enacted-date="2021-08-04" lims:fid="1370575" lims:id="1370575" lims:enactId="1314030">SOR/2021-181, s. 109</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2011-01-01" lims:fid="767829" lims:id="767829" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767830" lims:id="767830"><Label>2</Label><Text>These Regulations do not apply in respect of an institution that has obtained mortgage insurance from an insurer if neither the institution nor any of its affiliates charges borrowers an amount for that insurance.</Text></Section><Heading lims:inforce-start-date="2011-01-01" lims:fid="767831" lims:id="767831" level="1"><TitleText>Manner and Timing of Disclosure</TitleText></Heading><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767832" lims:id="767832"><Label>3</Label><Text>Any information that is required to be disclosed by an institution under these Regulations must be disclosed in language, and presented in a manner, that is clear, simple and not misleading.</Text></Section><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767833" lims:id="767833"><Label>4</Label><Text>Every institution that provides residential mortgages to borrowers and charges them an amount for mortgage insurance must</Text><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767834" lims:id="767834"><Label>(a)</Label><Text>maintain and make available at each of its branches or offices and at each of its points of service where residential mortgages are offered in Canada and on each of its websites through which residential mortgages are offered in Canada, the information in respect of mortgage insurance referred to in sections 5 and 6, paragraphs 7(a), 8(a) and 9(a) and subparagraphs 10(a)(i) and (b)(i) for each insurer with which it has entered into an arrangement to receive payments or benefits;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767835" lims:id="767835"><Label>(b)</Label><Text>provide to customers and to the public, on request, the information referred to in sections 5 and 6 and paragraphs 7(a), 8(a) and 9(a) and subparagraphs 10(a)(i) and (b)(i) for each insurer with which it has entered into an arrangement to receive payments or benefits; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767836" lims:id="767836"><Label>(c)</Label><Text>provide to each borrower that the institution charges for mortgage insurance, in a separate document, at or before the time that they enter into the mortgage agreement,</Text><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767837" lims:id="767837"><Label>(i)</Label><Text>the information referred to in sections 5 to 10 as it applies to that particular borrower,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767838" lims:id="767838"><Label>(ii)</Label><Text>the total of the amounts referred to in paragraphs 7(a), 8(c) and 9(c) and subparagraphs 10(a)(iii) and (b)(iii) as they apply to that particular borrower, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767839" lims:id="767839"><Label>(iii)</Label><Text>the total of the percentages referred to in paragraphs 7(b), 8(b) and 9(b) and subparagraphs 10(a)(ii) and (b)(ii) as they apply to that particular borrower.</Text></Subparagraph></Paragraph></Section><Heading lims:inforce-start-date="2011-01-01" lims:fid="767840" lims:id="767840" level="1"><TitleText>General Information on Mortgage Insurance</TitleText></Heading><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767841" lims:id="767841"><Label>5</Label><Text>Every institution that charges borrowers an amount for mortgage insurance must disclose</Text><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767842" lims:id="767842"><Label>(a)</Label><Text>the coverage provided by the mortgage insurance, including which party is protected by the mortgage insurance and which party pays for it;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767843" lims:id="767843"><Label>(b)</Label><Text>the manner in which the amount that the institution is being charged by the insurer for the mortgage insurance is calculated; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767844" lims:id="767844"><Label>(c)</Label><Text>any other information in respect of the mortgage insurance that could reasonably be expected to have an impact on the borrower.</Text></Paragraph></Section><Heading lims:inforce-start-date="2011-01-01" lims:fid="767845" lims:id="767845" level="1"><TitleText>Disclosure of Information Relating to Arrangements Between Institutions and Insurers</TitleText></Heading><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767846" lims:id="767846"><Label>6</Label><Subsection lims:inforce-start-date="2011-01-01" lims:fid="767847" lims:id="767847"><Label>(1)</Label><Text>Subject to subsection (2), every institution that enters into an arrangement with an insurer to receive payments or benefits from the insurer, shall, if the insurer also provides the institution with mortgage insurance, disclose in a single document information relating to all of their business arrangements with the insurer in respect of that mortgage insurance, including</Text><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767848" lims:id="767848"><Label>(a)</Label><Text>the nature of the arrangements;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767849" lims:id="767849"><Label>(b)</Label><Text>any payments or benefits referred to in section 7 or 8 that are received directly or indirectly by the institution from the insurer or any of its affiliates; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767850" lims:id="767850"><Label>(c)</Label><Text>any payments or benefits referred to in section 9 or 10 that are expected to be received directly or indirectly by the institution from the insurer or any of its affiliates.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-01-01" lims:fid="767851" lims:id="767851"><Label>(2)</Label><Text>Subsection (1) does not apply in respect of a business arrangement entered into by an institution to provide the insurer with products and services that are offered by the institution to its customers and to the public in the normal course of business.</Text></Subsection></Section><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767852" lims:id="767852"><Label>7</Label><Text>If an institution receives payments or benefits in respect of mortgage insurance from an insurer under an arrangement referred to in subsection 6(1) on a per residential mortgage basis, the institution must disclose</Text><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767853" lims:id="767853"><Label>(a)</Label><Text>in respect of each type of activity that is the subject of such payments or benefits, the amount of each of those payments or benefits expressed in dollars; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767854" lims:id="767854"><Label>(b)</Label><Text>in respect of a particular borrower that obtains a residential mortgage from the institution, the amount of each of those payments or benefits expressed as a percentage of the amount that the institution charges the borrower for mortgage insurance.</Text></Paragraph></Section><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767855" lims:id="767855"><Label>8</Label><Text>If, on the first day of a fiscal quarter, an institution has, in any of the first four fiscal quarters of the preceding five fiscal quarters, received payments or benefits in respect of mortgage insurance from an insurer under an arrangement referred to in subsection 6(1) on a basis other than that referred to in section 7 and each of those five preceding fiscal quarters begins on or after July 1, 2010, the institution must disclose</Text><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767856" lims:id="767856"><Label>(a)</Label><Text>in respect of each type of activity that is the subject of such payments or benefits, the total amount, expressed in dollars, of such payments or benefits received from that insurer in those first four fiscal quarters;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767857" lims:id="767857"><Label>(b)</Label><Text>each of the total amounts referred to in paragraph (a) expressed, respectively, as a percentage of the total amount paid to the insurer by the institution in respect of policies and guarantees in those first four fiscal quarters; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767858" lims:id="767858"><Label>(c)</Label><Text>in respect of a particular borrower that obtains a residential mortgage from that institution, the amounts, expressed in dollars, that are determined by multiplying the amount that the institution charges the borrower for mortgage insurance by each of the percentages referred to in paragraph (b).</Text></Paragraph></Section><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767859" lims:id="767859"><Label>9</Label><Text>If, on the first day of a fiscal quarter, an institution has not, in any of the first four fiscal quarters of the preceding five fiscal quarters, received payments or benefits in respect of mortgage insurance from an insurer under an arrangement referred to in subsection 6(1), but expects to receive such payments or benefits from an insurer in that fiscal quarter, or in any of the three following fiscal quarters, on a basis other than that referred to in section 7, the institution must disclose</Text><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767860" lims:id="767860"><Label>(a)</Label><Text>in respect of each type of activity that is the subject of such payments or benefits, the total amount, expressed in dollars, of such payments or benefits that the institution expects to receive from that insurer in that fiscal quarter and the three following fiscal quarters;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767861" lims:id="767861"><Label>(b)</Label><Text>each of the total amounts referred to in paragraph (a) expressed, respectively, as a percentage of the total amount expected to be paid to the insurer by the institution in respect of policies and guarantees in that fiscal quarter and the three following fiscal quarters; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767862" lims:id="767862"><Label>(c)</Label><Text>in respect of a particular borrower that obtains a residential mortgage from that institution, the amounts, expressed in dollars, that are determined by multiplying the amount that the institution charges the borrower for mortgage insurance by each of the percentages referred to in paragraph (b).</Text></Paragraph></Section><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767863" lims:id="767863"><Label>10</Label><Text>If, on the first day of a fiscal quarter that begins on or after January 1, 2011 or includes but does not begin on that day, an institution has, in any of the first four fiscal quarters of the preceding five fiscal quarters, received payments or benefits under an arrangement in respect of mortgage insurance from an insurer on a basis other than that referred to in section 7 and one or more of those five preceding fiscal quarters begins before July 1, 2010, the institution must</Text><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767864" lims:id="767864"><Label>(a)</Label><Text>if the fiscal quarter begins on or after January 1, 2011, disclose</Text><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767865" lims:id="767865"><Label>(i)</Label><Text>in respect of each type of activity for which the institution expects to receive payments or benefits in respect of mortgage insurance from that insurer under an arrangement referred to in subsection 6(1) in that fiscal quarter and the three following fiscal quarters, the total amount, expressed in dollars, of such payments or benefits,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767866" lims:id="767866"><Label>(ii)</Label><Text>each of the total amounts referred to in subparagraph (i) expressed, respectively, as a percentage of the total amount expected to be paid to the insurer by the institution in respect of policies and guarantees in that fiscal quarter and the three following fiscal quarters, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767867" lims:id="767867"><Label>(iii)</Label><Text>in respect of a particular borrower that obtains a residential mortgage from that institution, the amounts, expressed in dollars, that are determined by multiplying the amount that the institution charges the borrower for mortgage insurance by each of the percentages referred to in subparagraph (ii); and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2011-01-01" lims:fid="767868" lims:id="767868"><Label>(b)</Label><Text>if the fiscal quarter includes January 1, 2011 but does not begin on that day, disclose</Text><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767869" lims:id="767869"><Label>(i)</Label><Text>in respect of each type of activity for which the institution receives or expects to receive payments or benefits in respect of mortgage insurance from that insurer under an arrangement referred to in subsection 6(1) in that fiscal quarter and the three following fiscal quarters, the total amount, expressed in dollars, of such payments or benefits,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767870" lims:id="767870"><Label>(ii)</Label><Text>each of the total amounts referred to in subparagraph (i) expressed, respectively, as a percentage of the total amount paid or expected to be paid to the insurer by the institution in respect of policies and guarantees in that fiscal quarter and the three following fiscal quarters, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-01-01" lims:fid="767871" lims:id="767871"><Label>(iii)</Label><Text>in respect of a particular borrower that obtains a residential mortgage from that institution, the amounts, expressed in dollars, that are determined by multiplying the amount that the institution charges the borrower for mortgage insurance by each of the percentages referred to in subparagraph (ii).</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2011-01-01" lims:lastAmendedDate="2011-01-01" lims:fid="767872" lims:id="767872"><Label>11</Label><Text>For greater certainty, the payments referred to in sections 7 to 10 do not include any payment received by
