C-10</Text></Footnote></Provision><Provision lims:inforce-start-date="2010-10-21" lims:fid="765345" lims:id="765345" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to subsection 19(1)<FootnoteRef idref="fn_612543-E_hq_8547">b</FootnoteRef> of the <XRefExternal reference-type="act" link="C-10">Canada Post Corporation Act</XRefExternal>, hereby approves the annexed <XRefExternal reference-type="regulation" link="SOR-2010-220">Postage Meter Regulations, 2010</XRefExternal>, made by the Canada Post Corporation on August 4<Sup>th</Sup>, 2010.</Text><Footnote id="fn_612543-E_hq_8547" placement="page" status="official"><Label>b</Label><Text>S.C. 1992, c. 1, s. 34</Text></Footnote></Provision></Order><Body lims:inforce-start-date="2010-10-21" lims:fid="765346" lims:id="765346"><Heading lims:inforce-start-date="2010-10-21" lims:fid="765347" lims:id="765347" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765348" lims:id="765348"><Label>1</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2010-10-21" lims:fid="765349" lims:id="765349" generate-in-text="no"><Text><DefinedTermEn>ascending register</DefinedTermEn> means the device in a postage meter that records the total accumulated value of postage that has been printed by the meter. (<DefinedTermFr>totalisateur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-10-21" lims:fid="765350" lims:id="765350" generate-in-text="no"><Text><DefinedTermEn>descending register</DefinedTermEn> means the device in a postage meter that records the value of the remaining postage. (<DefinedTermFr>soustracteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-10-21" lims:fid="765351" lims:id="765351" generate-in-text="no"><Text><DefinedTermEn>item</DefinedTermEn> means an item of mailable matter. (<DefinedTermFr>version anglaise seulement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-10-21" lims:fid="765352" lims:id="765352" generate-in-text="no"><Text><DefinedTermEn>lessee</DefinedTermEn> means a person who is party to a lease with a supplier authorizing the use of a postage meter. (<DefinedTermFr>locataire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-10-21" lims:fid="765353" lims:id="765353" generate-in-text="no"><Text><DefinedTermEn>postage meter</DefinedTermEn> means a machine that contains an ascending and a descending register, has the capacity to connect remotely to a supplier’s system for setting the descending register and exchanging information, is used to print a postage meter impression and may be used to print other words and symbols as well. (<DefinedTermFr>machine à affranchir</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-10-21" lims:fid="765354" lims:id="765354" generate-in-text="no"><Text><DefinedTermEn>postage meter impression</DefinedTermEn> means an impression that is printed by a postage meter and shows a barcode or data matrix code, an amount of postage, the serial number of the meter and the supplier’s identifying mark. (<DefinedTermFr>empreinte de machine à affranchir</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2010-10-21" lims:fid="765355" lims:id="765355" generate-in-text="no"><Text><DefinedTermEn>supplier</DefinedTermEn> means a person who is party to an agreement with the Corporation for the installation of postage meters in Canada. (<DefinedTermFr>fournisseur</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765356" lims:id="765356" level="1"><TitleText>Installation of Postage Meters</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765357" lims:id="765357"><Label>2</Label><Text>No person shall install a model of postage meter for use in Canada unless they</Text><Paragraph lims:inforce-start-date="2010-10-21" lims:fid="765358" lims:id="765358"><Label>(a)</Label><Text>are a supplier;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-10-21" lims:fid="765359" lims:id="765359"><Label>(b)</Label><Text>have obtained written approval from the Corporation to install that particular model of meter; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-10-21" lims:fid="765360" lims:id="765360"><Label>(c)</Label><Text>have entered into a lease for the use of the meter with the person in control of the premises where it is to be installed.</Text></Paragraph></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765361" lims:id="765361" level="1"><TitleText change="off">Setting w Descending Register</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765362" lims:id="765362"><Label>3</Label><Text>No person, other than a supplier, shall set a descending register.</Text></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765363" lims:id="765363" level="1"><TitleText>Using a Postage Meter</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765364" lims:id="765364"><Label>4</Label><Text>No person shall use a postage meter unless they are a supplier or lessee of the meter or use it under the authority of a supplier or lessee.</Text></Section><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765365" lims:id="765365"><Label>5</Label><Text>A person who uses a postage meter to print a postage meter impression on an item shall print the impression in fluorescent red ink</Text><Paragraph lims:inforce-start-date="2010-10-21" lims:fid="765366" lims:id="765366"><Label>(a)</Label><Text>directly on the mailing cover of the item;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-10-21" lims:fid="765367" lims:id="765367"><Label>(b)</Label><Text>on a postage meter tape affixed to the item; or</Text></Paragraph><Paragraph lims:inforce-start-date="2010-10-21" lims:fid="765368" lims:id="765368"><Label>(c)</Label><Text>on a label approved by the Corporation that is affixed or attached to the item.</Text></Paragraph></Section><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765369" lims:id="765369"><Label>6</Label><Text>A person may print a postage meter impression that bears the words “RETURN POSTAGE — PREPAID/PORT DE RETOUR PAYÉ” on an item provided that it is a pre-addressed reply card, label or envelope that is to be mailed by someone else.</Text></Section><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765370" lims:id="765370"><Label>7</Label><Text>A person may use a postage meter to print words or symbols on an item, including advertisements, slogans or a return address, provided that the words and symbols do not infringe on the area reserved for the postage meter impression.</Text></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765371" lims:id="765371" level="1"><TitleText>Posting Items Printed with a Postage Meter Impression</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765372" lims:id="765372"><Label>8</Label><Subsection lims:inforce-start-date="2010-10-21" lims:fid="765373" lims:id="765373"><Label>(1)</Label><Text>No person shall post an item on a date other than the date shown in the postage meter impression.</Text></Subsection><Subsection lims:inforce-start-date="2010-10-21" lims:fid="765374" lims:id="765374"><Label>(2)</Label><Text>However, if an item cannot be posted on the date shown in the postage meter impression, a person may print a second impression bearing another date and a zero dollar postage value and may post the item on that other date. The second impression must not be placed so as to infringe on the original.</Text></Subsection></Section><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765375" lims:id="765375"><Label>9</Label><Text>When an item bears a postage meter impression with a postal code, no person shall post the item from a location outside the municipality to which the postal code is assigned unless the location has been agreed to in writing by the Corporation.</Text></Section><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765376" lims:id="765376"><Label>10</Label><Text>If the amount of postage shown in the postage meter impression on an item appears to have been altered, the item shall be dealt with as undeliverable mail in accordance with the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1298">Undeliverable and Redirected Mail Regulations</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765377" lims:id="765377" level="1"><TitleText>Lessee’s Duties</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765378" lims:id="765378"><Label>11</Label><Text>A lessee who intends to move the postage meter to a new address shall inform the supplier of the new address and the date on which the meter will be moved.</Text></Section><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765379" lims:id="765379"><Label>12</Label><Text>If a lessee becomes aware of a malfunction in the meter or suspects that the meter has been tampered with, they shall immediately inform the supplier, cease to use the meter and make it available to the supplier for inspection.</Text></Section><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765380" lims:id="765380"><Label>13</Label><Text>A lessee shall immediately inform the supplier if the meter is lost or stolen.</Text></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765381" lims:id="765381" level="1"><TitleText>Inspection of Postage Meters</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765382" lims:id="765382"><Label>14</Label><Text>After receiving reasonable notice from the Corporation, a supplier or lessee shall make any postage meter in its possession available for inspection by the Corporation or a person designated by the Corporation.</Text></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765383" lims:id="765383" level="1"><TitleText>Return of Postage Meters</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765384" lims:id="765384"><Label>15</Label><Text>When the lease of a postage meter expires or is terminated, the lessee shall immediately return the meter to the supplier.</Text></Section><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765385" lims:id="765385"><Label>16</Label><Text>The Corporation, or a person designated by the Corporation, may require the supplier of a postage meter to immediately repossess the meter if the Corporation has reasonable grounds to believe that the meter has a malfunction or has been tampered with.</Text></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765386" lims:id="765386" level="1"><TitleText>Repeal</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765387" lims:id="765387"><Label>17</Label><Text>[Repeal]</Text></Section><Heading lims:inforce-start-date="2010-10-21" lims:fid="765388" lims:id="765388" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2010-10-21" lims:lastAmendedDate="2010-10-21" lims:fid="765389" lims:id="765389" type="transitional"><Label>18</Label><Text>These Regulations come into force on the day on which they are registered.</Text></Section></Body></Regulation>
