Ltd. pursuant to the said Act; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635402" lims:id="635402" format-ref="indent-2-2" language-align="no" list-item="no" topmarginspacing="2"><Text>IN THE MATTER OF subsection 20(4) of the said Act; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635403" lims:id="635403" format-ref="indent-2-2" language-align="no" list-item="no" topmarginspacing="2"><Text>IN THE MATTER OF Condition 7 of SCHEDULE III to and subsection 21(2) of the said Act;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635404" lims:id="635404" format-ref="indent-2-2" language-align="no" list-item="no" topmarginspacing="2"><Text>Agency File No. 5014.</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635405" lims:id="635405" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas a Certificate of Public Convenience and Necessity dated the 13th day of April, 1978, is declared to have been issued pursuant to the <XRefExternal reference-type="act" link="N-26">Northern Pipeline Act</XRefExternal> to Foothills Pipe Lines (South B.C.) Ltd. [hereinafter called “Foothills (South B.C.)”] in respect of the pipeline defined in the said Act for that portion of the route in the south-eastern area of the Province of British Columbia as more particularly set forth in ANNEX I of SCHEDULE I to the said Act;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635406" lims:id="635406" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And Whereas Foothills Pipe Lines (Yukon) Ltd., The Alberta Gas Trunk Line (Canada) Limited, Westcoast Transmission Company Limited, Alberta Natural Gas Company Ltd. and The Alberta Gas Trunk Line Company Limited, at a public hearing, before the National Energy Board, commencing on the 12th day of April, 1976, in the City of Ottawa, in the Province of Ontario, continued in the Town of Inuvik, in the Northwest Territories, in the City of Whitehorse, in the Yukon Territory, and in the City of Yellowknife, in the Northwest Territories, respectively, and adjourned on the 12th day of May, 1977, in the City of Ottawa, in the Province of Ontario, adduced <Language xml:lang="la">inter alia</Language> certain evidence, gave certain undertakings and made certain commitments in respect of the “Alaska Highway Pipeline Project”;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635407" lims:id="635407" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And Whereas subsection 21(2) of the said Act provides that every such undertaking is deemed to be</Text><QuotedText><Provision format-ref="indent-1-1" language-align="no" list-item="no"><Label>“(a)</Label><Text>an undertaking of every company insofar as the undertaking relates to the company and to the portion of the route indicated in the Agreement in respect of such company; and</Text></Provision><Provision format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>a term or condition set out in Schedule III.”;</Text></Provision></QuotedText></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635408" lims:id="635408" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And Whereas pursuant to the provisions of subsection 20(4) of the said Act the Designated Officer may, with the approval of the Governor in Council, rescind, amend or add to the terms and conditions set out in Schedule III to the said Act.</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635409" lims:id="635409" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Now Therefore, the Designated Officer, Northern Pipeline Agency, pursuant to the provisions of subsection 20(4) of the <XRefExternal reference-type="act" link="N-26">Northern Pipeline Act</XRefExternal>, hereby</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="635410" lims:id="635410" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>rescinds Condition 7 of Schedule III to the Act, insofar as it applies to Foothills (South B.C.);</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635411" lims:id="635411" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>rescinds those undertakings in respect of social and economic matters and environmental, fisheries and agricultural concerns deemed, pursuant to the provisions of subsection 21(2) of the Act, to be terms or conditions set out in Schedule III to the Act, insofar as they apply to Foothills (South B.C.), except that undertaking referred to in item 7, under the heading “Compensation”, contained in “APPENDIX 5-2”, on page 9 of 41, Volume 3 of the <XRefExternal reference-type="other">REASONS FOR DECISION, NORTHERN PIPELINES</XRefExternal>, dated June 1977, of the National Energy Board; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635412" lims:id="635412" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>adds to the terms and conditions set out in Schedule III to the Act the terms and conditions annexed hereto and titled <XRefExternal reference-type="other">Northern Pipeline Socio-Economic and Environmental Terms and Conditions for Southern British Columbia</XRefExternal> to be applicable to Foothills (South B.C.).</Text></Provision></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635413" lims:id="635413" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Dated at the City of Calgary, in the Province of Alberta, this 12th day of June, 1980.</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="635414" lims:id="635414" format-ref="right-align" language-align="yes" list-item="no"><SignatureBlock justification="right" width="15pc"><SignatureTitle justification="right" topmarginspacing="10">NORTHERN PIPELINE AGENCY</SignatureTitle><SignatureName justification="right">W. lims:lastAmendedDate="2006-03-22" lims:fid="635419" lims:id="635419"><Label>2</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635420" lims:id="635420"><Label>(1)</Label><Text>In these terms and conditions,</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="635421" lims:id="635421" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="N-26">Northern Pipeline Act</XRefExternal>; (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635422" lims:id="635422" generate-in-text="no"><Text><DefinedTermEn>agricultural land</DefinedTermEn> means any land that is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635423" lims:id="635423"><Label>(a)</Label><Text>cleared and used for pasture,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635424" lims:id="635424"><Label>(b)</Label><Text>under cultivation, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635425" lims:id="635425"><Label>(c)</Label><Text>part of an agricultural land reserve; (<DefinedTermFr>terre agricole</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635426" lims:id="635426" generate-in-text="no"><Text><DefinedTermEn>agricultural land reserve</DefinedTermEn> means a reserve of land established under section 8 of the <XRefExternal reference-type="act">Agricultural Land Commission Act</XRefExternal> (British Columbia); (<DefinedTermFr>réserve de terres agricoles</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635427" lims:id="635427" generate-in-text="no"><Text><DefinedTermEn>big game animals</DefinedTermEn> means <DefinedTermEn>big game</DefinedTermEn> as defined in the <XRefExternal reference-type="act">Wildlife Act</XRefExternal> (British Columbia); (<DefinedTermFr>gros gibier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635428" lims:id="635428" generate-in-text="no"><Text><DefinedTermEn>borrow pit</DefinedTermEn> means a site used for the extraction of granular material and fill and the excavation resulting from such extraction; (<DefinedTermFr>ballastière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635429" lims:id="635429" generate-in-text="no"><Text><DefinedTermEn>construction</DefinedTermEn> means, in respect of the building of the pipeline or any portion thereof, those field activities carried out by Foothills from the commencement of the clearing for the pipeline or any portion thereof until leave to open the pipeline or portion thereof, as the case may be, is granted by the Board but does not include clearing for survey lines by Foothills; (<DefinedTermFr>construction</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635430" lims:id="635430" generate-in-text="no"><Text><DefinedTermEn>environmental impact</DefinedTermEn> means any change in the existing physical or biological conditions of the environment resulting from the construction or operation of the pipeline; (<DefinedTermFr>répercussions écologiques</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635431" lims:id="635431" generate-in-text="no"><Text><DefinedTermEn>facility</DefinedTermEn> means any fixed installation of a temporary or permanent nature installed by Foothills as a part of the pipeline or that is used by Foothills in the construction or operation of the pipeline; (<DefinedTermFr>installations</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635432" lims:id="635432" generate-in-text="no"><Text><DefinedTermEn>fish</DefinedTermEn> means <DefinedTermEn>fish</DefinedTermEn> as defined in the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal>; (<DefinedTermFr>poisson</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635433" lims:id="635433" generate-in-text="no"><Text><DefinedTermEn>Foothills</DefinedTermEn> means Foothills Pipe Lines (South B.C.) Ltd.; (<DefinedTermFr>Foothills</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635434" lims:id="635434" generate-in-text="no"><Text><DefinedTermEn>fuel</DefinedTermEn> means all liquid and gaseous hydrocarbons and petroleum products used in the construction and operation of the pipeline; (<DefinedTermFr>carburants</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635435" lims:id="635435" generate-in-text="no"><Text><DefinedTermEn>fur-bearing animals</DefinedTermEn> means <DefinedTermEn>fur-bearing animals</DefinedTermEn> as defined in the <XRefExternal reference-type="act">Wildlife Act</XRefExternal> (British Columbia); (<DefinedTermFr>animaux à fourrure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635436" lims:id="635436" generate-in-text="no"><Text><DefinedTermEn>grazing reserve</DefinedTermEn> means a grazing reserve established under the <XRefExternal reference-type="act">Land Act</XRefExternal> (British Columbia) for the purpose of grazing livestock; (<DefinedTermFr>pâturage</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635437" lims:id="635437" generate-in-text="no"><Text><DefinedTermEn>hazardous material</DefinedTermEn> means any chemical, explosive, toxic material or other substance that, if spilled, misused or allowed to escape, may cause damage to the environment; (<DefinedTermFr>produits dangereux</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635438" lims:id="635438" generate-in-text="no"><Text><DefinedTermEn>Indian</DefinedTermEn> means a person who, pursuant to the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, is registered as an Indian or is entitled to be registered as an Indian; (<DefinedTermFr>Indien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635439" lims:id="635439" generate-in-text="no"><Text><DefinedTermEn>inspection</DefinedTermEn> means observation and measurement by Foothills to verify that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635440" lims:id="635440"><Label>(a)</Label><Text>the construction and operation of the pipeline accord with the designs and specifications of the pipeline, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635441" lims:id="635441"><Label>(b)</Label><Text>these terms and conditions are complied with; (<DefinedTermFr>inspection</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635442" lims:id="635442" generate-in-text="no"><Text><DefinedTermEn>monitoring</DefinedTermEn> means data gathering, data analysis and interpretation and data presentation to determine magnitudes and characteristics of environmental change; (<DefinedTermFr>contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635443" lims:id="635443" generate-in-text="no"><Text><DefinedTermEn>operation</DefinedTermEn> means any field activity by Foothills relating to the pipeline or any portion of the pipeline for which leave to open has been granted; (<DefinedTermFr>exploitation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635444" lims:id="635444" generate-in-text="no"><Text><DefinedTermEn>Province</DefinedTermEn> means the Province of British Columbia; (<DefinedTermFr>province</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635445" lims:id="635445" generate-in-text="no"><Text><DefinedTermEn>rare and endangered species</DefinedTermEn> means those animal or plant species that occupy areas or exist in numbers so small that, in the opinion of the designated officer, their existence would likely be threatened by the construction or operation of the pipeline; (<DefinedTermFr>espèces rares et menacées</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635446" lims:id="635446" generate-in-text="no"><Text><DefinedTermEn>waste</DefinedTermEn> means discarded or abandoned liquid or solid matter including human waste, garbage, oil drums, petroleum products, ashes and equipment; (<DefinedTermFr>déchets</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635447" lims:id="635447" generate-in-text="no"><Text><DefinedTermEn>waterbodies</DefinedTermEn> means lakes and ponds and permanent and intermittent rivers and streams and their beds; (<DefinedTermFr>masses d’eau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="635448" lims:id="635448" generate-in-text="no"><Text><DefinedTermEn>wildlife</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635449" lims:id="635449"><Label>(a)</Label><Text>all big game animals and fur-bearing animals that are native to the Province,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635450" lims:id="635450"><Label>(b)</Label><Text>migratory game birds as defined in the <XRefExternal reference-type="act">Migratory Birds Convention Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635451" lims:id="635451"><Label>(c)</Label><Text>all <Language xml:lang="la">Galliformes</Language> native to the Province,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635452" lims:id="635452"><Label>(d)</Label><Text>all species of the orders <Language xml:lang="la">Falconiformes</Language> and <Language xml:lang="la">Strigiformes</Language>, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635453" lims:id="635453"><Label>(e)</Label><Text>rare and endangered species of birds, mammals, reptiles and amphibians. (<DefinedTermFr>faune</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635454" lims:id="635454"><Label>(2)</Label><Text>All other words and expressions have the same meaning as in the Act.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635455" lims:id="635455" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635456" lims:id="635456"><Label>3</Label><Text>These terms and conditions are added to the terms and conditions set out in Schedule III to the Act and shall apply to Foothills but, unless the context otherwise requires, shall only apply to the construction and operation of that portion of the pipeline that extends from a point on the Alberta-British Columbia boundary near Coleman in a south-westerly direction across British Columbia generally parallel to the existing pipeline facilities of Alberta Natural Gas Company Ltd. to a point on the International Boundary Line between Canada and the United States of America at or near Kingsgate in the Province.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635457" lims:id="635457" level="1"><TitleText>General</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="635458" lims:id="635458" level="2"><TitleText>Compliance With the Law</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635459" lims:id="635459"><Label>4</Label><Text>Foothills shall, in the construction and operation of the pipeline, comply with the laws of Canada and the laws of the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635460" lims:id="635460"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635461" lims:id="635461"><Label>(1)</Label><Text>Subject to subsection (2), Foothills shall, when entering into any contract with a contractor for the construction or operation of the pipeline, require as a condition of such a contract that the contractor or any subcontractor of that contractor observe and comply with these terms and conditions.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635462" lims:id="635462"><Label>(2)</Label><Text>Where an application is made by Foothills to the designated officer to exempt Foothills from the requirement referred to in subsection (1) in respect of the observing of or compliance with any provision of Part I, the designated officer may exempt Foothills from that requirement in respect of that provision.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635463" lims:id="635463"><Label>(3)</Label><Text>Foothills shall be responsible for any breach of these terms and conditions by a contractor referred to in subsection (1) or any subcontractor of that contractor as if the breach had been committed by Foothills.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635464" lims:id="635464" level="2"><TitleText>Assistance to Designated Officer</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635465" lims:id="635465"><Label>6</Label><Text>When requested by the designated officer, Foothills shall give him any reasonable assistance that he may require to carry out his duties in respect of the pipeline and shall furnish him with such information in respect of the construction or operation of the pipeline as he may request.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635466" lims:id="635466" level="2"><TitleText>Access to Right-of-Way of Pipeline</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635467" lims:id="635467"><Label>7</Label><Text>Employees or agents of the government of the Province shall, for the purpose of carrying out their duties in respect of the pipeline, be allowed reasonable access to any part of the right-of-way of the pipeline or any other area where the pipeline is being or is to be constructed.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635468" lims:id="635468" level="2"><TitleText>Indemnification</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635469" lims:id="635469"><Label>8</Label><Text>Foothills shall, at all times, save harmless and indemnify and keep Her Majesty indemnified against and be responsible for all claims, demands, actions, suits, costs or other legal proceedings made or brought against Her Majesty by reason of or arising out of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635470" lims:id="635470"><Label>(a)</Label><Text>the construction or operation of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635471" lims:id="635471"><Label>(b)</Label><Text>the escape, ignition or explosion, for any cause, of gas or related hydrocarbons from or in the pipeline on the lands of Her Majesty;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635472" lims:id="635472"><Label>(c)</Label><Text>any act or omission on the part of Foothills, its contractors and their subcontractors and its or their officers, servants, agents or employees in respect of or in relation to the pipeline on the lands of Her Majesty, including the construction or operation of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635473" lims:id="635473"><Label>(d)</Label><Text>any act or omission on the part of any officer, servant, agent or employee of Her Majesty in respect of or in relation to the pipeline on the lands of Her Majesty, not including such acts or omissions as would in law constitute gross negligence.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635474" lims:id="635474"><Label>9</Label><Text>Foothills shall, at all times, pay to Her Majesty the amount of any loss or damage that has been suffered or sustained by Her Majesty by reason of or arising out of the matters set out in section 8.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635475" lims:id="635475" level="2"><TitleText>Emergency Measures</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635476" lims:id="635476"><Label>10</Label><Text>Foothills shall establish emergency procedures satisfactory to the designated officer to deal with any emergency arising from the construction or operation of the pipeline that may adversely affect the environment or persons who reside in the vicinity of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635477" lims:id="635477"><Label>11</Label><Text>Foothills shall, to the satisfaction of the designated officer, designate and train persons working on the pipeline to carry out the emergency procedures referred to in section 10.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635478" lims:id="635478"><Label>12</Label><Text>Where any emergency arises in the course of the construction or operation of the pipeline, Foothills shall forthwith advise the designated officer and the agency or ministry of the government of the Province specified by the designated officer of the emergency and the measures it has taken or intends to take to deal with it.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635479" lims:id="635479"><Label>13</Label><Text>Where the emergency referred to in section 10 is a forest fire, Foothills shall make available to the Province personnel to assist in fighting the fire and any equipment or aircraft suitable for fire suppression owned or controlled by Foothills that is in the vicinity of the pipeline.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635480" lims:id="635480" level="1"><Label>PART I</Label><TitleText>Socio-Economic Terms and Conditions</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="635481" lims:id="635481" level="2"><TitleText>Undertakings</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635482" lims:id="635482"><Label>14</Label><Text>Where Foothills gives an undertaking to any government, organization or community referred to in subsection 21(1) during consultations required by that section and the undertaking is accepted by that government, organization or community, Foothills shall, unless otherwise directed by the designated officer within 30 days of the giving of the undertaking, comply with that undertaking.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635483" lims:id="635483" level="2"><TitleText>Plans</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635484" lims:id="635484"><Label>15</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635485" lims:id="635485"><Label>(1)</Label><Text>Subject to subsection (2), where, pursuant to this Part, Foothills is required to submit a plan in respect of any matter to the designated officer for his approval, that plan, when approved, constitutes Foothills’ plan for that matter and Foothills shall comply therewith.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635486" lims:id="635486"><Label>(2)</Label><Text>The designated officer may, on giving Foothills reasonable notice in writing, modify or vary any provision set out in a plan referred to in subsection (1) and Foothills shall comply with the plan as so modified or varied.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635487" lims:id="635487" level="2"><TitleText>Plan Schedule</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635488" lims:id="635488"><Label>16</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635489" lims:id="635489"><Label>(1)</Label><Text>Foothills shall, within 30 days of the coming into force of this Part or at such later date as may be fixed by the designated officer, submit to the designated officer for his approval a plan schedule that sets out the date on which each plan referred to in subsection 15(1) is to be submitted to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635490" lims:id="635490"><Label>(2)</Label><Text>The plan schedule referred to in subsection (1), when approved by the designated officer, constitutes Foothills’ plan schedule and Foothills shall comply therewith.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635491" lims:id="635491"><Label>(3)</Label><Text>The designated officer may, at the request of Foothills, modify or vary the plan schedule referred to in subsection (2).</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635492" lims:id="635492" level="2"><TitleText>Information and Consultation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635493" lims:id="635493"><Label>17</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635494" lims:id="635494"><Label>(1)</Label><Text>Foothills shall provide information in respect of the planning and construction of the pipeline to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635495" lims:id="635495"><Label>(a)</Label><Text>the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635496" lims:id="635496"><Label>(b)</Label><Text>the government of the Province;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635497" lims:id="635497"><Label>(c)</Label><Text>communities situated in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635498" lims:id="635498"><Label>(d)</Label><Text>Indian, Metis and non-status Indian organizations in the Province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635499" lims:id="635499"><Label>(e)</Label><Text>any special interest group requesting such information except a special interest group that does not have, in the opinion of Foothills or the designated officer, a <Language xml:lang="la">bona fide</Language> need for the information.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635500" lims:id="635500"><Label>(2)</Label><Text>The information referred to in subsection (1) shall be provided in a form and manner satisfactory to the designated officer and shall include information in respect of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635501" lims:id="635501"><Label>(a)</Label><Text>the route alignment and construction schedules of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635502" lims:id="635502"><Label>(b)</Label><Text>the anticipated impact of the pipeline on the communities situated in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635503" lims:id="635503"><Label>(c)</Label><Text>the potential opportunities resulting from the construction of the pipeline for the residents in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635504" lims:id="635504"><Label>(d)</Label><Text>the proposed use of any land or waterbody;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635505" lims:id="635505"><Label>(e)</Label><Text>any significant adverse environmental impact resulting from the construction of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635506" lims:id="635506"><Label>(f)</Label><Text>the opportunities referred to in sections 29 and 30;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635507" lims:id="635507"><Label>(g)</Label><Text>the opportunity for businesses in the Province to participate in the supply of goods and services for the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635508" lims:id="635508"><Label>(h)</Label><Text>any other matter specified by the designated officer.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635509" lims:id="635509"><Label>18</Label><Text>Foothills shall facilitate public access to the information referred to in section 17 and shall ensure that those communities situated in the vicinity of the pipeline have access to the information.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635510" lims:id="635510"><Label>19</Label><Text>Foothills shall consult with the government of the Province, communities situated in the vicinity of the pipeline, Indian, Metis and non-status Indian organizations in the Province and any special interest group in the Province, on the request of that group, to ascertain their requirement for information.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635511" lims:id="635511"><Label>20</Label><Text>Where a public meeting, workshop or seminar is convened in a community situated in the vicinity of the pipeline for the purpose of disseminating information in respect of the pipeline, Foothills shall, when directed by the designated officer, make available informed persons to assist in the dissemination of such information.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635512" lims:id="635512"><Label>21</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635513" lims:id="635513"><Label>(1)</Label><Text>Where Foothills receives a direction from the designated officer to consult with the government of the Province, an Indian, Metis or non-status Indian organization in the Province or with any community situated in the vicinity of the pipeline in respect of any matter in connection with the construction or operation of the pipeline, Foothills shall, within 30 days of receiving such direction, consult with that government, organization or community.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635514" lims:id="635514"><Label>(2)</Label><Text>Foothills shall report to the designated officer the significant results of any consultation pursuant to subsection (1).</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635515" lims:id="635515"><Label>22</Label><Text>Where Foothills, at any time, consults with any contractor or labour organization in respect of any matter critical to construction progress, Foothills shall report the significant results of such consultation to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635516" lims:id="635516"><Label>23</Label><Text>Foothills shall identify and make available a person to assist Foothills in</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635517" lims:id="635517"><Label>(a)</Label><Text>disseminating the information referred to in section 17;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635518" lims:id="635518"><Label>(b)</Label><Text>arranging consultations with communities situated in the vicinity of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635519" lims:id="635519"><Label>(c)</Label><Text>performing any liaison function with such communities.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635520" lims:id="635520"><Label>24</Label><Text>Foothills shall submit to the designated officer for his approval a plan, to be known as the information plan, that sets out the manner in which Foothills intends to carry out the provisions of sections 17 to 19 and sections 22 and 23.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635521" lims:id="635521" level="2"><TitleText>Pipeline Labour</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635522" lims:id="635522"><Label>25</Label><Text>Foothills shall, in the preparation and implementation of the detailed manpower plan referred to in paragraph 9(a) of Schedule III to the Act, consult with the government of the Province and labour organizations in the Province in respect of the plan and the recruitment and training of employees to be used in the construction and operation of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635523" lims:id="635523"><Label>26</Label><Text>Foothills shall, in consultation with the Government of Canada and the government of the Province, take such measures as are satisfactory to the designated officer to discourage the migration of persons seeking work on the pipeline into any area in the vicinity of the pipeline.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635524" lims:id="635524" level="2"><TitleText>Orientation of Employees</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635525" lims:id="635525"><Label>27</Label><Text>Foothills shall, in respect of those persons who commence work on the construction of the pipeline, carry out an orientation program that includes environmental information, to assist such persons to become familiar with their working conditions and to become aware of the potential to damage the environment.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635526" lims:id="635526"><Label>28</Label><Text>Foothills shall, following consultation with the government of the Province, submit to the designated officer for his approval a plan, to be known as the orientation plan, that sets out the manner in which Foothills intends to carry out the orientation program referred to in section 27.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635527" lims:id="635527" level="2"><TitleText>Opportunity Measures</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635528" lims:id="635528"><Label>29</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635529" lims:id="635529"><Label>(a)</Label><Text>ensure that Indian, Metis and non-status Indian people of the Province have access to training and employment opportunities in respect of the construction or operation of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635530" lims:id="635530"><Label>(b)</Label><Text>ensure that women of the Province have access to employment opportunities in respect of the construction or operation of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635531" lims:id="635531"><Label>(c)</Label><Text>provide appropriate support measures in relation to training, recruitment and employment practices to meet any special needs of women and of the Indian, Metis and non-status Indian people of the Province to enable them to take maximum advantage of the opportunities referred to in paragraphs (a) and (b).</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635532" lims:id="635532"><Label>30</Label><Text>Foothills shall ensure that Indian, Metis and non-status Indian people of the Province have a fair and competitive opportunity to participate in the supply of goods and services for the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635533" lims:id="635533"><Label>31</Label><Text>Foothills shall, following consultation with Indian, Metis and non-status Indian organizations in the Province, and, when directed by the designated officer, any women’s organizations in the Province, submit to the designated officer for his approval a plan, to be known as the opportunity measures plan that sets out the manner in which Foothills intends to carry out the provisions of sections 29 and 30.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635534" lims:id="635534" level="2"><TitleText>Business Opportunities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635535" lims:id="635535"><Label>32</Label><Text>Foothills shall provide businesses in the Province with a fair and competitive opportunity to supply goods and services for the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635536" lims:id="635536"><Label>33</Label><Text>Foothills shall cooperate with the government of the Province in that government’s program in assisting businesses in the Province that are seeking to supply goods and services for the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635537" lims:id="635537"><Label>34</Label><Text>Foothills shall, following consultation with the government of the Province, submit to the designated officer for his approval a plan, to be known as the business opportunities plan, that sets out the manner in which Foothills intends to carry out the provisions of sections 32 and 33.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635538" lims:id="635538" level="2"><TitleText>Health</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635539" lims:id="635539"><Label>35</Label><Text>Foothills shall, in consultation with the government of the Province, ensure that proper facilities are provided and arrangements are made for adequate care and treatment of any ill or injured person employed in the construction or operation of the pipeline.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635540" lims:id="635540" level="2"><TitleText>Security</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635541" lims:id="635541"><Label>36</Label><Text>Foothills, in consultation with the Government of Canada, the government of the Province and the Royal Canadian Mounted Police, shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635542" lims:id="635542"><Label>(a)</Label><Text>maintain security on the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635543" lims:id="635543"><Label>(b)</Label><Text>cooperate with and give assistance to the Royal Canadian Mounted Police and the Sheriffs’ Services of the Province to enable them to carry out their duties.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635544" lims:id="635544"><Label>37</Label><Text>For the purpose of promoting effective law enforcement in the vicinity of the pipeline, Foothills, in consultation with the Royal Canadian Mounted Police and the government of the Province, shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635545" lims:id="635545"><Label>(a)</Label><Text>provide the Royal Canadian Mounted Police and the Sheriffs’ Services of the Province with immediate access to the pipeline and to persons employed in the construction or operation of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635546" lims:id="635546"><Label>(b)</Label><Text>provide sufficient information to enable the Royal Canadian Mounted Police to establish</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635547" lims:id="635547"><Label>(i)</Label><Text>the nature and extent of the policing required on the pipeline,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635548" lims:id="635548"><Label>(ii)</Label><Text>a working arrangement between Foothills’ security personnel and the Royal Canadian Mounted Police, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635549" lims:id="635549"><Label>(iii)</Label><Text>a system of reporting on policing matters.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635550" lims:id="635550"><Label>38</Label><Text>Foothills shall not permit the possession by any person employed in the construction of the pipeline of a firearm or game hunting device</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635551" lims:id="635551"><Label>(a)</Label><Text>on any portion of the pipeline right-of-way where construction activity has commenced, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635552" lims:id="635552"><Label>(b)</Label><Text>at any time in a campsite established by Foothills or on any property, vehicle or aircraft of Foothills</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635553" lims:id="635553"><Text>unless authorized, in writing, by the designated officer.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635554" lims:id="635554" level="2"><TitleText>Surveillance, Inspection and Monitoring</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635555" lims:id="635555"><Label>39</Label><Text>Foothills shall ensure the maintenance and availability, for examination at any time by the Agency, of such of its records pertaining to its activities in the Province as may be required by the Agency to determine compliance with this Part.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635556" lims:id="635556"><Label>40</Label><Text>Foothills shall report to the Agency, at such times as may be required by the designated officer, on the measures that have been taken by Foothills in complying with this Part.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635557" lims:id="635557"><Label>41</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635558" lims:id="635558"><Label>(1)</Label><Text>Foothills, when directed by the designated officer, shall undertake special studies of the socio-economic impact of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635559" lims:id="635559"><Label>(2)</Label><Text>Every special study referred to in subsection (1) shall be forwarded to the Agency on its completion.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635560" lims:id="635560"><Label>42</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635561" lims:id="635561"><Label>(a)</Label><Text>establish procedures and allocate resources for the purpose of assessing the effectiveness of its compliance with this Part; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635562" lims:id="635562"><Label>(b)</Label><Text>on the request of the designated officer, assess the effectiveness of its compliance with this Part and report the assessment to the Agency.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635563" lims:id="635563" level="2"><TitleText>Compensation for Damage to Property</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635564" lims:id="635564"><Label>43</Label><Text>Foothills shall be liable for any damage to property directly or indirectly caused by Foothills, a contractor of Foothills or a subcontractor of that contractor in connection with or resulting from their activities in the construction or operation of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635565" lims:id="635565"><Label>44</Label><Text>Where, in the course of construction or operation of the pipeline, any damage is either directly or indirectly caused by Foothills, a contractor of Foothills or a subcontractor of that contractor to any property, other than the property of Foothills, a contractor of Foothills or a subcontractor of that contractor, Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635566" lims:id="635566"><Label>(a)</Label><Text>immediately take action to prevent further damage;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635567" lims:id="635567"><Label>(b)</Label><Text>immediately inform the owner of the property of the nature of the damage; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635568" lims:id="635568"><Label>(c)</Label><Text>arrange, as soon as possible, for</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635569" lims:id="635569"><Label>(i)</Label><Text>compensation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635570" lims:id="635570"><Label>(ii)</Label><Text>the repair of the damage, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635571" lims:id="635571"><Label>(iii)</Label><Text>the replacement of the damaged property.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635572" lims:id="635572"><Label>45</Label><Text>Foothills shall submit to the designated officer, in a manner determined by him, information in respect of any unresolved matter referred to in paragraph 44(c).</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635573" lims:id="635573"><Label>46</Label><Text>Where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635574" lims:id="635574"><Label>(a)</Label><Text>Foothills and a claimant against Foothills fail to agree as to liability or compensation for damage for which the claimant alleges Foothills is responsible, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635575" lims:id="635575"><Label>(b)</Label><Text>the claimant referred to in paragraph (a) agrees with Foothills</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635576" lims:id="635576"><Label>(i)</Label><Text>to enter into an arbitration submission governed by the provisions of the <XRefExternal reference-type="act">Arbitration Act</XRefExternal> (British Columbia), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635577" lims:id="635577"><Label>(ii)</Label><Text>that a decision of the arbitrator is binding and conclusive,</Text></Subparagraph></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635578" lims:id="635578"><Text>Foothills shall enter into such arbitration submission and shall pay all costs of and incidental to any arbitration proceedings pursuant thereto except where the arbitrator determines that the claim is frivolous.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635579" lims:id="635579" level="2"><TitleText>Protection of Native Traditional Harvesting and Cultural Areas</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635580" lims:id="635580"><Label>47</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635581" lims:id="635581"><Label>(1)</Label><Text>Foothills shall, following consultation with the government of the Province and Indian, Metis and non-status Indian organizations in the Province, submit to the designated officer, in a manner and form satisfactory to him, an inventory that sets out the hunting, trapping and fishing areas used by Indian, Metis or non-status Indian people in the vicinity of the pipeline and any area of cultural importance to Indian, Metis or non-status Indian people in the vicinity of the pipeline and a resource use analysis of such hunting, trapping and fishing areas.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635582" lims:id="635582"><Label>(2)</Label><Text>The resource use analysis referred to in subsection (1) shall consist of information on the seasonal use of hunting, trapping and fishing areas.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635583" lims:id="635583"><Label>48</Label><Text>In locating the pipeline or any portion thereof, Foothills shall, following consultation with the government of the Province and Indian, Metis and non-status Indian organizations in the Province, locate the pipeline in a manner that minimizes, to the satisfaction of the designated officer, interference with the hunting, trapping and fishing areas and areas of cultural importance set out in the inventory referred to in section 47.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635584" lims:id="635584"><Label>49</Label><Text>In proposing the construction schedule in respect of the pipeline or any portion thereof, Foothills shall, following consultation with the government of the Province and Indian, Metis and non-status Indian organizations in the Province, propose a schedule that minimizes, to the satisfaction of the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635585" lims:id="635585"><Label>(a)</Label><Text>any conflict with the seasonal use of hunting, trapping and fishing areas, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635586" lims:id="635586"><Label>(b)</Label><Text>the disturbance of areas of cultural importance</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635587" lims:id="635587"><Text>set out in the inventory referred to in section 47.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635588" lims:id="635588"><Label>50</Label><Text>Foothills shall, if directed by the designated officer, submit to him for his approval a plan, to be known as the traditional resource protection plan, that sets out the manner in which Foothills intends to carry out the provisions of sections 48 and 49.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635589" lims:id="635589" level="1"><Label>PART II</Label><TitleText>Environmental Terms and Conditions</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="635590" lims:id="635590" level="2"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635591" lims:id="635591"><Label>51</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635592" lims:id="635592"><Label>(a)</Label><Text>plan and construct the pipeline efficiently and expeditiously; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635593" lims:id="635593"><Label>(b)</Label><Text>minimize to the extent possible any adverse environmental impact.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635594" lims:id="635594"><Label>52</Label><Text>Where, in this Part, Foothills is required to make plans, take measures and implement procedures in respect of the environment, Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635595" lims:id="635595"><Label>(a)</Label><Text>incorporate in such plans, measures and procedures those environmental practices ordinarily followed in constructing and operating pipelines in the Province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635596" lims:id="635596"><Label>(b)</Label><Text>comply with those standards established under the laws of the Province that are applicable to any pipeline constructed and operated under the laws of the Province except where such standards are inconsistent with the Act, any terms and conditions made thereunder or any other law of Canada.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635597" lims:id="635597" level="2"><TitleText>Terrain, Landscape and Waterbodies</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635598" lims:id="635598"><Label>53</Label><Text>Foothills shall, in the planning and construction of the pipeline, minimize to the satisfaction of the designated officer any adverse environmental impact on land through which the pipeline passes and on waterbodies or groundwater in the vicinity of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635599" lims:id="635599"><Label>54</Label><Text>Where Foothills proposes a location of the pipeline or a portion thereof to the designated officer for approval, it shall, in a manner satisfactory to the designated officer, take into account the effect, if any, of the construction or operation of the pipeline on the existing or potential uses of any land or waterbody through which the pipeline is proposed to pass.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635600" lims:id="635600" level="2"><TitleText>Drainage, Erosion Control, Rehabilitation and Revegetation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635601" lims:id="635601"><Label>55</Label><Text>Foothills shall, in the planning and construction of the pipeline, take such measures as are satisfactory to the designated officer to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635602" lims:id="635602"><Label>(a)</Label><Text>minimize disturbance on erosion-sensitive terrain; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635603" lims:id="635603"><Label>(b)</Label><Text>minimize construction on erosion-sensitive terrain during periods in which erosion is most likely to be initiated.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635604" lims:id="635604"><Label>56</Label><Text>Foothills shall design and implement erosion control measures satisfactory to the designated officer to protect the pipeline, minimize interference with any other use of land or water and to protect the environment of any area through which the pipeline passes.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635605" lims:id="635605"><Label>57</Label><Text>Foothills shall, in the construction and operation of the pipeline, minimize to the satisfaction of the designated officer the development of subsurface channels along the pipeline and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635606" lims:id="635606"><Label>(a)</Label><Text>any change in the natural drainage patterns, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635607" lims:id="635607"><Label>(b)</Label><Text>any increase in the sediment loading in waterbodies</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635608" lims:id="635608"><Text>of those areas through which the pipeline passes.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635609" lims:id="635609"><Label>58</Label><Text>Foothills shall implement such measures as are satisfactory to the designated officer to rehabilitate land, other than agricultural land, disturbed by the construction or operation of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635610" lims:id="635610"><Label>59</Label><Text>Foothills shall take measures to revegetate land, other than agricultural land, to the satisfaction of the designated officer, disturbed by the construction or operation of the pipeline in a manner that complements any other measure Foothills takes to control drainage and erosion.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635611" lims:id="635611"><Label>60</Label><Text>Where land is to be rehabilitated pursuant to section 58 or revegetated pursuant to section 59, Foothills shall rehabilitate or revegetate, as the case may be, the land in a manner consistent with present land use practices employed in that portion of the Province through which the pipeline passes and shall give priority to the following objectives:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635612" lims:id="635612"><Label>(a)</Label><Text>the control of erosion and its impact,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635613" lims:id="635613"><Label>(b)</Label><Text>the protection of important wildlife habitat, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635614" lims:id="635614"><Label>(c)</Label><Text>the restoration of the aesthetic value of the land</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635615" lims:id="635615"><Text>and such priority shall be given in the order set out in paragraphs (a) to (c).</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635616" lims:id="635616"><Label>61</Label><Text>Where Foothills has backfilled any part of the pipeline under construction, Foothills shall, unless otherwise authorized by the designated officer, commence as soon as practicable but, in any event, within one year of the backfilling, the erosion control measures referred to in section 56, the rehabilitation measures referred to in section 58 and the revegetation measures referred to in section 59.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635617" lims:id="635617"><Label>62</Label><Text>Foothills shall,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635618" lims:id="635618"><Label>(a)</Label><Text>where a revegetation measure referred to in section 59 is taken that involves the seeding of land, use only seed mixes acceptable to the government of the Province;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635619" lims:id="635619"><Label>(b)</Label><Text>take such measures as are satisfactory to the designated officer to ensure that noxious weeds are not brought into the area through which the pipeline passes on construction equipment used by Foothills; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635620" lims:id="635620"><Label>(c)</Label><Text>take measures satisfactory to the designated officer to eradicate infestations of noxious weeds caused by the construction of the pipeline.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635621" lims:id="635621"><Label>63</Label><Text>Foothills shall, from time to time, inspect in a manner satisfactory to the designated officer the implementation of the erosion control measures referred to in section 56, the rehabilitation measures referred to in section 58, the revegetation measures referred to in section 59 and the measures relating to noxious weeds referred to in paragraphs 62(b) and (c).</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635622" lims:id="635622"><Label>64</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635623" lims:id="635623"><Label>(1)</Label><Text>Foothills shall, in carrying out the inspection pursuant to section 63, evaluate the effectiveness of the measures referred to in that section and, when requested by the designated officer, report to the designated officer in a manner satisfactory to him the results and evaluation of such inspection.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635624" lims:id="635624"><Label>(2)</Label><Text>Where, in the opinion of the designated officer, the measures referred to in section 63 are ineffective, Foothills shall implement such remedial measures as are satisfactory to the designated officer.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635625" lims:id="635625" level="2"><TitleText>Water Quality</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635626" lims:id="635626"><Label>65</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to ensure that significant quantities of deleterious substances, as defined in the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal>, sediment, silt or wood chips resulting from the construction of the pipeline are not left in an area where they are likely to enter into any waterbody.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635627" lims:id="635627"><Label>66</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635628" lims:id="635628"><Label>(1)</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to minimize the entry into any waterbody of any aqueous run-off or discharge resulting from the construction of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635629" lims:id="635629"><Label>(2)</Label><Text>Where there is any aqueous run-off or discharge referred to in subsection (1) and that run-off or discharge enters a waterbody, Foothills shall take such measures as are satisfactory to the designated officer to protect the quality of the water in the waterbody.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635630" lims:id="635630"><Label>67</Label><Text>Where the construction or operation of the pipeline takes place within a waterbody, Foothills shall take such measures as are satisfactory to the designated officer to protect the quality of the water in that waterbody.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635631" lims:id="635631" level="2"><TitleText>Air Quality</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635632" lims:id="635632"><Label>68</Label><Text>Where Foothills submits to the designated officer for his approval proposals for the design and location of a compressor station for the pipeline, Foothills shall include in the submission a description of the measures Foothills intends to implement</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635633" lims:id="635633"><Label>(a)</Label><Text>to control air pollution and to disperse and, where possible, reduce any ice fog resulting from the operation of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635634" lims:id="635634"><Label>(b)</Label><Text>to preserve the aesthetic value of the landscape in the vicinity of the pipeline.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635635" lims:id="635635"><Label>69</Label><Text>Foothills shall, in the operation of a compressor station, take such measures as are satisfactory to the designated officer to minimize any adverse effects of air pollution and ice fog resulting from the operation of the pipeline on</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635636" lims:id="635636"><Label>(a)</Label><Text>the health or recreation of any person;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635637" lims:id="635637"><Label>(b)</Label><Text>transportation; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635638" lims:id="635638"><Label>(c)</Label><Text>wildlife and wildlife habitat.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635639" lims:id="635639"><Label>70</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635640" lims:id="635640"><Label>(1)</Label><Text>Foothills shall, at each compressor station selected by the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635641" lims:id="635641"><Label>(a)</Label><Text>sample and analyze air quality in the vicinity of that compressor station,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635642" lims:id="635642"><Label>(b)</Label><Text>sample and analyze gaseous emissions from the compressor station,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635643" lims:id="635643"><Label>(c)</Label><Text>measure precipitation, wind speed and direction and air mass stability in the vicinity of the compressor station, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635644" lims:id="635644"><Label>(d)</Label><Text>record the quantity and type of fuel consumed by that compressor station</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635645" lims:id="635645"><Text>by a method and at such times as are approved by the designated officer.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635646" lims:id="635646"><Label>(2)</Label><Text>Foothills shall report to the designated officer, when requested by him, the results of the sampling and analysis and measurements referred to in paragraphs (1)(a) to (c) and the record of the quantity and type of fuel consumed referred to in paragraph (1)(d).</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635647" lims:id="635647" level="2"><TitleText>Noise</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635648" lims:id="635648"><Label>71</Label><Text>Foothills shall incorporate noise abatement devices in the design of any compressor station it installs for the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635649" lims:id="635649"><Label>72</Label><Text>Foothills shall, in the construction and operation of the pipeline, take such noise abatement measures as are satisfactory to the designated officer to minimize the disturbance by noise of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635650" lims:id="635650"><Label>(a)</Label><Text>persons residing in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635651" lims:id="635651"><Label>(b)</Label><Text>wildlife referred to in paragraph 74(a) in the areas of land and waterbodies during the periods of time described in the information referred to in section 74 in respect of such wildlife; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635652" lims:id="635652"><Label>(c)</Label><Text>livestock in the vicinity of the pipeline.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635653" lims:id="635653"><Label>73</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635654" lims:id="635654"><Label>(1)</Label><Text>Foothills shall, when requested by the designated officer and in a manner satisfactory to him, record noise levels caused by the operation of pipeline facilities and equipment and shall report, within a reasonable period of time, the noise levels so recorded to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635655" lims:id="635655"><Label>(2)</Label><Text>Where, in the opinion of the designated officer, any noise level reported to him pursuant to subsection (1) disturbs or is likely to disturb persons, wildlife or livestock referred to in section 72, Foothills shall take such remedial measures to lower that noise level as are satisfactory to the designated officer.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635656" lims:id="635656" level="2"><TitleText>Wildlife</TitleText></Heading><Section consultation with the government of the Province, submit to him for his approval information in respect of those areas of land and waterbodies in which, and the periods of time in respect of those areas and waterbodies during which, the construction or operation of the pipeline may</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635658" lims:id="635658"><Label>(a)</Label><Text>threaten the continued existence of significant wildlife populations; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635659" lims:id="635659"><Label>(b)</Label><Text>result in significant adverse effects on significant wildlife populations.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635660" lims:id="635660"><Label>75</Label><Text>Foothills shall, in a manner satisfactory to the designated officer, prepare construction schedules for the pipeline and propose the location of the pipeline in such a manner that when the construction of the pipeline is being carried out the adverse impact on wildlife in any areas and during any periods of time in respect of those areas described in the information referred to in section 74 is minimized.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635661" lims:id="635661"><Label>76</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635662" lims:id="635662"><Label>(a)</Label><Text>to prevent big game animals from being obstructed or entrapped by the construction of the pipeline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635663" lims:id="635663"><Label>(b)</Label><Text>to ensure that the construction or operation of the pipeline does not unreasonably interfere with guiding and trapping in the vicinity of the pipeline.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635664" lims:id="635664"><Label>77</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635665" lims:id="635665"><Label>(1)</Label><Text>Foothills shall, from time to time during the construction of the pipeline, inspect those areas described in the information referred to in section 74 in which the continued existence of significant wildlife populations may be threatened.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635666" lims:id="635666"><Label>(2)</Label><Text>Foothills shall, in carrying out an inspection referred to in subsection (1), evaluate the effectiveness of its measures to mitigate any adverse impact on wildlife and shall, when requested by the designated officer, report to him the results of the evaluation.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635667" lims:id="635667"><Label>78</Label><Text>Where, in the opinion of the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635668" lims:id="635668"><Label>(a)</Label><Text>the proposed location of the pipeline or the construction schedule of the pipeline referred to in section 75 is such that it does not minimize the adverse environmental impact on wildlife, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635669" lims:id="635669"><Label>(b)</Label><Text>the measures taken pursuant to paragraph 76(a) are ineffective,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635670" lims:id="635670"><Text>Foothills shall take such remedial measures as are satisfactory to the designated officer.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635671" lims:id="635671" level="2"><TitleText>Fisheries</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635672" lims:id="635672"><Label>79</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635673" lims:id="635673"><Label>(1)</Label><Text>Foothills shall, when requested by the designated officer and following consultation with the government of the Province, submit to him for his approval information in respect of those areas of fish habitat in which, and the periods of time in respect of those areas during which, the construction or operation of the pipeline may threaten the continued existence of significant fish populations.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635674" lims:id="635674"><Label>(2)</Label><Text>The areas referred to in subsection (1) shall include fish spawning grounds, significant overwintering areas and migration routes in waterbodies through which the pipeline passes.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635675" lims:id="635675"><Label>(3)</Label><Text>The periods of time referred to in subsection (1) shall include those periods for the spawning, incubation, emergence, rearing and migration of fish.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635676" lims:id="635676"><Label>80</Label><Text>Foothills shall, in a manner satisfactory to the designated officer, prepare construction schedules for the pipeline to ensure that when the construction of the pipeline is being carried out any adverse impact on the fish in any fish habitat and during any periods of time in respect of that habitat described in the information referred to in subsection 79(1) is minimized.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635677" lims:id="635677"><Label>81</Label><Text>Where the pipeline or any facility is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635678" lims:id="635678"><Label>(a)</Label><Text>scheduled to be constructed at a time, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635679" lims:id="635679"><Label>(b)</Label><Text>located at a place</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635680" lims:id="635680"><Text>that may be disruptive to fish and fish habitat, Foothills shall take such measures as are satisfactory to the designated officer to avoid or minimize, to the satisfaction of the designated officer, any adverse environmental effects on fish and fish habitat.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635681" lims:id="635681"><Label>82</Label><Text>Foothills shall implement construction and operation practices to protect, to the satisfaction of the designated officer, fish and fish habitat against any adverse effect of any siltation, excavation of grandular materials, changes in water temperature and chemistry or reduction in dissolved oxygen in the water in any waterbody through which the pipeline passes.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635682" lims:id="635682"><Label>83</Label><Text>Foothills shall not, during the construction of the pipeline, unless permitted by the designated officer, obstruct fish migration by any blockage, diversion or prolonged acceleration of water flow.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635683" lims:id="635683"><Label>84</Label><Text>Foothills shall take measures satisfactory to the designated officer to ensure that any culvert placed in a waterbody frequented by fish does not prevent the passage, during any period set out in the information referred to in subsection 79(1), of fish frequenting such waterbody.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635684" lims:id="635684"><Label>85</Label><Text>Foothills shall take measures satisfactory to the designated officer to ensure that the construction and operation of the pipeline does not unreasonably interfere with any domestic, commercial or sport fishing or adversely affect any fishing area in any area through which the pipeline passes.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635685" lims:id="635685"><Label>86</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635686" lims:id="635686"><Label>(1)</Label><Text>Foothills shall, in a manner satisfactory to the designated officer, inspect fish movements and fish habitat utilization during construction of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635687" lims:id="635687"><Label>(2)</Label><Text>Foothills shall, in carrying out the inspection referred to in subsection (1), evaluate the effectiveness of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635688" lims:id="635688"><Label>(a)</Label><Text>the construction schedule referred to in section 80,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635689" lims:id="635689"><Label>(b)</Label><Text>the measures referred to in sections 81, 84 and 85, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635690" lims:id="635690"><Label>(c)</Label><Text>the practices referred to in section 82,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635691" lims:id="635691"><Text>and shall, when requested by the designated officer, report to the designated officer in a manner satisfactory to him the results of the evaluation and of the inspection referred to in subsection (1).</Text></ContinuedSectionSubsection></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635692" lims:id="635692"><Label>87</Label><Text>Where, in the opinion of the designated officer, the measures referred to in section 81 or 84 are ineffective, Foothills shall take such remedial measures as are satisfactory to the designated officer.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635693" lims:id="635693" level="2"><TitleText>Special Interest Areas</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635694" lims:id="635694"><Label>88</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635695" lims:id="635695"><Label>(1)</Label><Text>Foothills shall, in consultation with the government of the Province, identify each area of natural or cultural significance in the vicinity of the proposed route of the pipeline and shall propose a location of the pipeline that, insofar as possible, does not pass through that area.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635696" lims:id="635696"><Label>(2)</Label><Text>Where the location referred to in subsection (1) of the pipeline is in an area identified under that subsection and the location of the pipeline has been approved by the designated officer, Foothills shall take such measures as are satisfactory to the designated officer to protect the natural and cultural values of that area.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635697" lims:id="635697"><Label>89</Label><Text>Foothills shall obtain the approval of the designated officer before commencing construction of the pipeline within 30 m of a monument, archaeological site or burial ground.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635698" lims:id="635698"><Label>90</Label><Text>Foothills shall establish and conduct an archaeological program satisfactory to the designated officer to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635699" lims:id="635699"><Label>(a)</Label><Text>identify and protect or excavate, salvage and investigate historical and archaeological sites, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635700" lims:id="635700"><Label>(b)</Label><Text>analyze historical, archaeological and associated palaeoecological materials</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635701" lims:id="635701"><Text>on land used for or disturbed by the construction of the pipeline.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635702" lims:id="635702"><Label>91</Label><Text>Foothills shall provide, when requested by the designated officer, evidence satisfactory to the designated officer that any archaeological and related materials, field notes, plans and maps, photographs, analyses and other relevant documents collected during the archaeological program referred to in section 90 are retained at a place and under such arrangements as are approved by the government of the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635703" lims:id="635703"><Label>92</Label><Text>Foothills shall report immediately to the designated officer any discovery of a historical or archaeological site and shall not disturb the site without his prior approval.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635704" lims:id="635704"><Label>93</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635705" lims:id="635705"><Label>(1)</Label><Text>In constructing the pipeline, Foothills shall avoid, where practicable, disturbance of geodetic or legal survey monuments.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635706" lims:id="635706"><Label>(2)</Label><Text>Where a geodetic monument is disturbed in the course of construction of the pipeline, Foothills shall report such disturbance forthwith to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635707" lims:id="635707"><Label>(3)</Label><Text>Where a geodetic monument is disturbed, Foothills shall, at its expense and in accordance with the instructions of the Dominion Geodesist, cause the monument to be restored or re-established.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635708" lims:id="635708" level="2"><TitleText>Agricultural Land</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635709" lims:id="635709"><Label>94</Label><Text>Foothills shall, when constructing the pipeline on land comprising part of an agricultural land reserve or grazing reserve, take into account the provisions set out in the document entitled “Terms and Conditions for Linear Development in Agricultural Land Reserves and Grazing Reserves” issued by the Ministry of Agriculture of the government of the Province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635710" lims:id="635710"><Label>95</Label><Text>Where topsoil on agricultural land is disturbed or removed during construction of the pipeline, Foothills shall take such measures as are satisfactory to the landowner or tenant, as soon as possible after the disturbance or removal, to stabilize the surface or replace such topsoil of such agricultural land and, to the extent possible, to return it to its previous level of fertility.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635711" lims:id="635711"><Label>96</Label><Text>Where, as a consequence of the construction of the pipeline a fence or gate is damaged or destroyed by Foothills, Foothills shall, in consultation with the owner of the land on which the fence or gate is situated or the tenant thereof, repair or replace that fence or gate.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635712" lims:id="635712"><Label>97</Label><Text>Where Foothills requires access to the pipeline for the purpose of maintenance through land that is fenced, Foothills shall, in consultation with the landowner or tenant, construct and maintain a gate in the fence for such access.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635713" lims:id="635713"><Label>98</Label><Text>Where Foothills has stabilized the surface of agricultural land and to the extent possible returned it to its previous level of fertility pursuant to section 95, Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635714" lims:id="635714"><Label>(a)</Label><Text>inspect to the satisfaction of the landowner or tenant agricultural land that may have been or may be affected by the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635715" lims:id="635715"><Label>(b)</Label><Text>report forthwith to the designated officer any evidence of any adverse environmental impact on agricultural land; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635716" lims:id="635716"><Label>(c)</Label><Text>take such remedial measures as directed by the designated officer in respect of any agricultural land discovered by the inspection to be adversely affected by the pipeline.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635717" lims:id="635717" level="2"><TitleText>Clearing</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635718" lims:id="635718"><Label>99</Label><Text>Foothills shall minimize to the satisfaction of the designated officer any adverse environmental impact of vegetation clearing operations by Foothills, including such impact on erosion-sensitive terrain.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635719" lims:id="635719"><Label>100</Label><Text>Foothills shall, in respect of the construction of the pipeline,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635720" lims:id="635720"><Label>(a)</Label><Text>clear vegetation from only those areas essential for the construction;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635721" lims:id="635721"><Label>(b)</Label><Text>cut, stack and dispose of any merchantable timber cleared by Foothills in such manner as is satisfactory to the designated officer;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635722" lims:id="635722"><Label>(c)</Label><Text>leave a buffer strip of undisturbed vegetation satisfactory to the designated officer</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635723" lims:id="635723"><Label>(i)</Label><Text>between any area cleared by Foothills of vegetation and an adjacent waterbody, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="635724" lims:id="635724"><Label>(ii)</Label><Text>between any area cleared of vegetation and an adjacent road;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635725" lims:id="635725"><Label>(d)</Label><Text>promptly remove any debris entering or likely to enter any waterbody as a result of the clearing of vegetation by Foothills; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635726" lims:id="635726"><Label>(e)</Label><Text>take such measures as are satisfactory to the designated officer to minimize windthrow in buffer strips.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635727" lims:id="635727"><Label>101</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635728" lims:id="635728"><Label>(1)</Label><Text>Foothills shall, when clearing any area for construction, take measures to minimize to the satisfaction of the designated officer the operation of any machinery along or across any permanent or intermittent river or stream channel.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635729" lims:id="635729"><Label>(2)</Label><Text>Foothills shall not skid any logs along or across any unfrozen permanent river or stream channel or along any unfrozen intermittent stream channel.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635730" lims:id="635730"><Label>102</Label><Text>Foothills shall dispose of any debris resulting from the clearing of vegetation by Foothills in such manner as is satisfactory to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635731" lims:id="635731"><Label>103</Label><Text>Foothills shall not pile any debris resulting from the construction of the pipeline in a manner that creates a continuous barrier to big game animal movements.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635732" lims:id="635732" level="2"><TitleText>Fuel and Other Hazardous Material</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635733" lims:id="635733"><Label>104</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635734" lims:id="635734"><Label>(a)</Label><Text>establish procedures satisfactory to the designated officer to minimize the possibility of an accident occurring during the storage, handling and use of fuel or any other hazardous material;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635735" lims:id="635735"><Label>(b)</Label><Text>locate, in a manner satisfactory to the designated officer, storage and handling sites for fuel and hazardous material to minimize any contamination of any waterbody described in the information referred to in section 74, any fish habitat described in the information referred to in subsection 79(1) or any important fish harvesting area; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635736" lims:id="635736"><Label>(c)</Label><Text>establish procedures satisfactory to the designated officer to contain and clean up any fuel or other hazardous material spilled, misused or allowed to escape.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635737" lims:id="635737"><Label>105</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635738" lims:id="635738"><Label>(1)</Label><Text>Where Foothills uses a fuel storage area containing any above-ground tank exceeding 4 600 l in capacity, Foothills shall surround that area by a dyke of reinforced concrete or a dyke of earth lined with plastic or other impervious material.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635739" lims:id="635739"><Label>(2)</Label><Text>Foothills shall, in constructing a dyke referred to in subsection (1), comply with any requirements established by the designated officer for the design and location of the dyke and of the area that it surrounds.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635740" lims:id="635740"><Label>106</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635741" lims:id="635741"><Label>(1)</Label><Text>Foothills shall establish such procedures as are satisfactory to the designated officer to detect any loss of fuel or other hazardous material at any storage and handling facility.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635742" lims:id="635742"><Label>(2)</Label><Text>Where any loss of fuel or other hazardous material referred to in subsection (1) occurs, Foothills shall investigate the cause of such loss and take such measures as are satisfactory to the designated officer to prevent further loss.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635743" lims:id="635743"><Label>107</Label><Text>Foothills shall not</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635744" lims:id="635744"><Label>(a)</Label><Text>use, transport or dispose of any radioactive materials, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635745" lims:id="635745"><Label>(b)</Label><Text>use herbicides or pesticides except for domestic use,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635746" lims:id="635746"><Text>unless such use, transportation or disposition, as the case may be, is approved by the designated officer.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635747" lims:id="635747" level="2"><TitleText>Waste Management</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635748" lims:id="635748"><Label>108</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635749" lims:id="635749"><Label>(1)</Label><Text>Foothills shall ensure that liquid or solid wastes produced as a consequence of the construction, operation or abandonment of the pipeline are collected and, where required by the designated officer, treated in a manner satisfactory to the designated officer.</Text></Subsection><Subsection satisfactory to the designated officer.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635751" lims:id="635751"><Label>109</Label><Text>Foothills shall not use borrow pits as liquid or solid waste disposal sites unless such use is approved by the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635752" lims:id="635752"><Label>110</Label><Text>Foothills shall establish procedures satisfactory to the designated officer for the handling and disposal of any wastes containing a hazardous material.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635753" lims:id="635753"><Label>111</Label><Text>Foothills shall establish procedures satisfactory to the designated officer to prevent access by carnivorous mammals and bears to waste disposal sites, incinerator sites or other waste storage or treatment sites and to minimize the attractiveness of such sites to such mammals and bears.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635754" lims:id="635754"><Label>112</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635755" lims:id="635755"><Label>(1)</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635756" lims:id="635756"><Label>(a)</Label><Text>monitor the operation of its liquid waste treatment facilities and the quantity and composition of effluent discharges therefrom, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635757" lims:id="635757"><Label>(b)</Label><Text>evaluate the effectiveness of its solid waste management procedures</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635758" lims:id="635758"><Text>at such times as directed by the designated officer.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635759" lims:id="635759"><Label>(2)</Label><Text>Foothills shall, within a reasonable time, report the results of the monitoring referred to in subsection (1) to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635760" lims:id="635760"><Label>(3)</Label><Text>Foothills shall take any remedial measures with respect to solid waste management and liquid waste treatment as directed by the designated officer.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635761" lims:id="635761" level="2"><TitleText>Granular Materials, Borrow Pits and Quarries</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635762" lims:id="635762"><Label>113</Label><Text>Where Foothills uses a borrow pit or quarry, Foothills shall minimize to the satisfaction of the designated officer</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635763" lims:id="635763"><Label>(a)</Label><Text>the disturbance of the environment in the vicinity of the borrow pit or quarry;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635764" lims:id="635764"><Label>(b)</Label><Text>the amount of land used for the borrow pit or quarry; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635765" lims:id="635765"><Label>(c)</Label><Text>the amount of materials extracted from the borrow pit or quarry.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635766" lims:id="635766"><Label>114</Label><Text>Foothills shall, where possible, use existing roads, trails or cutlines for access to borrow pits or quarries.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635767" lims:id="635767"><Label>115</Label><Text>Foothills shall not extract granular materials from the bed of a waterbody unless that part of the bed of the waterbody from which such materials are to be extracted is dry.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635768" lims:id="635768"><Label>116</Label><Text>Foothills shall leave buffer strips of undisturbed vegetation between any borrow pit or quarry that it opens and any adjacent road.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635769" lims:id="635769"><Label>117</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635770" lims:id="635770"><Label>(1)</Label><Text>Foothills shall not, without the approval of the designated officer, use a borrow pit or quarry within or adjacent to a waterbody, swamp, marsh, bog or fen.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635771" lims:id="635771"><Label>(2)</Label><Text>Where the use of a borrow pit or quarry referred to in subsection (1) has been approved by the designated officer, Foothills shall take such measures as are satisfactory to the designated officer to protect fish and fish habitat in that waterbody, swamp, marsh, bog or fen, as the case may be.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635772" lims:id="635772"><Label>118</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635773" lims:id="635773"><Label>(1)</Label><Text>When directed by the designated officer, Foothills shall close and rehabilitate, in a manner satisfactory to the designated officer, any borrow pit or quarry that it uses.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635774" lims:id="635774"><Label>(2)</Label><Text>Where Foothills is required to rehabilitate a borrow pit or quarry pursuant to subsection (1), it shall, to the satisfaction of the designated officer,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635775" lims:id="635775"><Label>(a)</Label><Text>stabilize the ground surface; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635776" lims:id="635776"><Label>(b)</Label><Text>re-establish vegetation similar to that in existence before the excavation of the borrow pit.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635777" lims:id="635777"><Label>119</Label><Text>Where Foothills uses any granular materials, such granular materials shall be used in a manner satisfactory to the designated officer and compatible with any other use of such materials in that portion of the Province through which the pipeline passes.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635778" lims:id="635778" level="2"><TitleText>Blasting</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635779" lims:id="635779"><Label>120</Label><Text>Foothills shall establish blasting procedures satisfactory to the designated officer to minimize</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635780" lims:id="635780"><Label>(a)</Label><Text>any adverse effects on bird, fish or mammal populations, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635781" lims:id="635781"><Label>(b)</Label><Text>any interference with fishing, hunting or trapping</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635782" lims:id="635782"><Text>in the area through which the pipeline passes.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635783" lims:id="635783"><Label>121</Label><Text>Foothills shall minimize blasting in or adjacent to any waterbody, swamp or marsh.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635784" lims:id="635784"><Label>122</Label><Text>Where Foothills intends to blast, it shall advise persons living in the vicinity of its intention and of the time of the intended blasting.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635785" lims:id="635785" level="2"><TitleText>Water Crossings</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635786" lims:id="635786"><Label>123</Label><Text>Foothills shall, when submitting construction procedures and schedules to the designated officer for his approval and when constructing the pipeline, take into account any particular environmental characteristic of any water crossing by the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635787" lims:id="635787"><Label>124</Label><Text>Where Foothills submits a site-specific design for a water crossing to the designated officer for approval, Foothills shall include in the submission the information in respect of the hydrological and geotechnical conditions at that crossing that was used by Foothills in preparing the design.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635788" lims:id="635788"><Label>125</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635789" lims:id="635789"><Label>(1)</Label><Text>Foothills shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635790" lims:id="635790"><Label>(a)</Label><Text>inspect every pipeline water crossing for evidence of deterioration in bank stability and stream bed condition, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635791" lims:id="635791"><Label>(b)</Label><Text>when directed by the designated officer, monitor the consequences of any pipeline water crossing</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="635792" lims:id="635792"><Text>in a manner satisfactory to the designated officer.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635793" lims:id="635793"><Label>(2)</Label><Text>Foothills shall report, within a reasonable period of time, to the designated officer the results of the inspection referred to in paragraph (1)(a) and, when required by the designated officer, the results of the monitoring referred to in paragraph (1)(b).</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635794" lims:id="635794"><Label>126</Label><Text>Where the designated officer is of the opinion that remedial measures are necessary at a pipeline water crossing, Foothills shall take such remedial measures as are satisfactory to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635795" lims:id="635795"><Label>127</Label><Text>Where an impervious seam is cut in the bed of a waterbody during a trench excavation at a water crossing, Foothills shall take such measures as are satisfactory to the designated officer to restore water movements above the seam to their original pattern.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635796" lims:id="635796"><Label>128</Label><Text>When constructing the pipeline across a stream, Foothills shall trench, lay pipe and backfill as expeditiously as possible.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635797" lims:id="635797"><Label>129</Label><Text>Foothills shall, unless otherwise directed by the designated officer, on completion of any pipeline construction across a stream, restore the bed of the stream to its original shape by using the original materials of the stream bed or other material of equivalent stability.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635798" lims:id="635798" level="2"><TitleText>Water Withdrawal, Water Discharge and Hydrostatic Testing</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635799" lims:id="635799"><Label>130</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to ensure to the satisfaction of the designated officer that water withdrawals and discharges will not have an unreasonable adverse effect on</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635800" lims:id="635800"><Label>(a)</Label><Text>the level or rate of flow of water in the waterbody or well from which the water withdrawal is made or into which the discharge is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635801" lims:id="635801"><Label>(b)</Label><Text>the existing use of the waterbody from which a water withdrawal is made or into which the discharge is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635802" lims:id="635802"><Label>(c)</Label><Text>the transportation on or access to the waterbody from which a water withdrawal is made or into which the discharge is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635803" lims:id="635803"><Label>(d)</Label><Text>the trapping or fishing by persons residing in the vicinity of the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635804" lims:id="635804"><Label>(e)</Label><Text>the fish populations in or dependent on the waterbody from which the water withdrawal is made or into which the discharge is made; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635805" lims:id="635805"><Label>(f)</Label><Text>any waterfowl or mammal populations using any waterbody or its margins from which a water withdrawal is made or into which a discharge is made.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635806" lims:id="635806"><Label>131</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635807" lims:id="635807"><Label>(1)</Label><Text>Subject to subsection (2), Foothills shall ensure that, during any withdrawal of water from a waterbody for hydrostatic testing, the rate of flow or depth of water in that waterbody does not fall below such minimum as is specified by the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635808" lims:id="635808"><Label>(2)</Label><Text>Foothills may withdraw water referred to in subsection (1) where the rate of flow and depth of water in the waterbody is below the minimum specified pursuant to that subsection if such withdrawal is approved by the designated officer.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635809" lims:id="635809"><Label>132</Label><Text>Foothills shall, when carrying out hydrostatic testing of the pipeline, carry out such tests in a manner that will minimize the use of water.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635810" lims:id="635810"><Label>133</Label><Text>Foothills shall appoint a qualified person to supervise the withdrawal and discharge of water for the construction or testing of the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635811" lims:id="635811"><Label>134</Label><Text>Where Foothills withdraws water for the construction or testing of the pipeline, it shall install screens satisfactory to the designated officer on all water intakes.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635812" lims:id="635812"><Label>135</Label><Text>Foothills shall, in a manner satisfactory to the designated officer, furnish him with the details in respect of each water withdrawal or discharge used for constructing or testing the pipeline.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635813" lims:id="635813"><Label>136</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635814" lims:id="635814"><Label>(a)</Label><Text>to avoid spilling any test fluid other than a spill caused by the failure of a pipe when being tested; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635815" lims:id="635815"><Label>(b)</Label><Text>to contain and remedy the effect of any test fluid that has been spilled.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635816" lims:id="635816"><Label>137</Label><Text>Foothills shall conduct all hydrostatic tests of the pipeline in the presence of the designated officer or his authorized representative.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635817" lims:id="635817"><Label>138</Label><Text>Foothills shall, prior to discharging any hydrostatic test fluid, ensure that the fluid meets such standards of composition as are satisfactory to the designated officer.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635818" lims:id="635818" level="2"><TitleText>Roads and Other Facilities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635819" lims:id="635819"><Label>139</Label><Text>Where Foothills is required to submit to the designated officer for approval the design and location of any access road or pipeline facility other than a road or facility on the pipeline right-of-way and the procedures to be used in the construction, operation or abandonment of that road or facility, Foothills shall take into account the local and regional environment including the following:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635820" lims:id="635820"><Label>(a)</Label><Text>hydrological characteristics;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635821" lims:id="635821"><Label>(b)</Label><Text>terrain conditions;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635822" lims:id="635822"><Label>(c)</Label><Text>ground thermal regime;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635823" lims:id="635823"><Label>(d)</Label><Text>wildlife and fish populations;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635824" lims:id="635824"><Label>(e)</Label><Text>land and water use for purposes other than for the pipeline;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635825" lims:id="635825"><Label>(f)</Label><Text>archaeological sites; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635826" lims:id="635826"><Label>(g)</Label><Text>aesthetic value of the landscape and waterbodies.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635827" lims:id="635827"><Label>140</Label><Text>Foothills shall maintain any right-of-way travelling surface so that cross drainage is both efficient and effective without causing accelerated erosion or ponding.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635828" lims:id="635828"><Label>141</Label><Text>Where Foothills submits to the designated officer for approval a proposed crossing of a waterbody by an access road, Foothills shall propose the installation of bridges or culverts where, in the opinion of the designated officer, they are required to protect fish and fish habitat.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635829" lims:id="635829"><Label>142</Label><Text>Foothills shall, where required by the designated officer, render any access road built or rehabilitated by it, other than a road to be used by Foothills in the maintenance of the pipeline, impassable and take such measures as are satisfactory to the designated officer to control erosion of such road.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635830" lims:id="635830"><Label>143</Label><Text>Foothills shall not construct or use a bridge that consists of logs on top of which earth has been placed.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635831" lims:id="635831" level="2"><TitleText>Machinery, Transportation and Construction Equipment</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635832" lims:id="635832"><Label>144</Label><Text>Foothills shall take such measures as are satisfactory to the designated officer to minimize the use by Foothills of vehicles and transportation and construction equipment in any area other than on public and access roads and the pipeline right-of-way.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635833" lims:id="635833"><Label>145</Label><Text>Where Foothills operates machinery, transportation or construction equipment within any waterbody, such operation shall take place in respect of that waterbody during such time and in such manner as is satisfactory to the designated officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635834" lims:id="635834"><Label>146</Label><Text>Foothills shall equip and maintain all machinery and transportation and construction equipment with factory standard emission and noise control devices.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635835" lims:id="635835" level="2"><TitleText>Inspection and Monitoring</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635836" lims:id="635836"><Label>147</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635837" lims:id="635837"><Label>(1)</Label><Text>Foothills shall, in a manner satisfactory to the designated officer, inspect the pipeline and the land and water disturbed by the pipeline, evaluate the results of the inspection and, when directed by the designated officer, monitor the environmental impact of the pipeline.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635838" lims:id="635838"><Label>(2)</Label><Text>When requested by the designated officer, Foothills shall, within a reasonable period of time, report the results of the inspection, evaluation and monitoring referred to in subsection (1) to the designated officer.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635839" lims:id="635839"><Label>148</Label><Text>Where the designated officer is of the opinion that the construction or operation of the pipeline has caused or is likely to cause a significant adverse environmental impact, Foothills shall take such measures as are satisfactory to the designated officer to mitigate or remedy the environmental impact and to prevent its recurrence.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635840" lims:id="635840" level="2"><TitleText>Environmental Plans and Procedures Manual</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635841" lims:id="635841"><Label>149</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635842" lims:id="635842"><Label>(1)</Label><Text>Foothills shall prepare and submit to the designated officer an Environmental Plans and Procedures Manual, constituted in Parts, that sets out the procedures and measures Foothills intends to take to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635843" lims:id="635843"><Label>(a)</Label><Text>comply with this Part;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635844" lims:id="635844"><Label>(b)</Label><Text>carry out any environmental requirements imposed by law; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635845" lims:id="635845"><Label>(c)</Label><Text>prevent, mitigate or remedy any adverse environmental impact that may result from the construction or operation of the pipeline.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635846" lims:id="635846"><Label>(2)</Label><Text>Each Part of the Environmental Plans and Procedures Manual referred to in subsection (1) shall be submitted to the designated officer for his approval in accordance with the schedule referred to in subsection (3).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635847" lims:id="635847"><Label>(3)</Label><Text>Foothills shall, by such date as may be fixed by the designated officer, submit to the designated officer a Parts schedule for his approval that sets out the procedures and measures to be dealt with in each Part referred to in subsection (1) and the date that each Part is to be submitted to the designated officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635848" lims:id="635848"><Label>(4)</Label><Text>The Parts schedule referred to in subsection (3), when approved by the designated officer, constitutes Foothills’ Parts schedule and Foothills shall comply therewith.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635849" lims:id="635849"><Label>(5)</Label><Text>Where the designated officer approves a procedure or measure set out in a Part submitted by Foothills pursuant to subsection (2), Foothills shall thereupon carry out such procedure or measure.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="635850" lims:id="635850" level="2"><TitleText>Submissions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635851" lims:id="635851"><Label>150</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635852" lims:id="635852"><Label>(1)</Label><Text>Foothills shall submit to the designated officer, in accordance with a schedule approved by him,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635853" lims:id="635853"><Label>(a)</Label><Text>the environmental information used by it in preparing the Parts referred to in subsection 149(1); and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="635854" lims:id="635854"><Label>(b)</Label><Text>construction scheduling and engineering design information necessary for a review and evaluation of the Parts referred to in subsection 149(1).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635855" lims:id="635855"><Label>(2)</Label><Text>Foothills shall, when requested by the designated officer, submit to him any studies, reports, analyses or other material on which the information submitted pursuant to section 74 or subsection 79(1) was based.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="635856" lims:id="635856"><Label>(3)</Label><Text>Where Foothills conducts studies or gathers data or information when considering the effect, if any, of the construction or operation of the pipeline on the existing or potential use of any land or waterbody through which the pipeline passes for the purpose of taking into account such effect pursuant to section 54, such studies, data or information shall be submitted by Foothills to the designated officer when requested by him.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635857" lims:id="635857"><Label>151</Label><Text>When requested by the designated officer and in a manner satisfactory to him, Foothills shall submit to him any procedures or measures proposed by Foothills as alternatives to the procedures or measures referred to in subsection 149(1).</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="635858" lims:id="635858"><Label>152</Label><Text>Where, subsequent to the approval by the designated officer of any procedure or measure referred to in subsection 149(1), Foothills obtains additional information of environmental significance relating to that procedure or measure, Foothills shall forthwith report such information to the designated officer.</Text></Section></Body></Regulation>
