Killer Whale (<Language xml:lang="la">Orcinus orca</Language>) Northeast Pacific southern resident population (SRKW):</Text><Provision lims:inforce-start-date="2018-11-01" lims:fid="631845" lims:id="631845" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>the <XRefExternal reference-type="other">Recovery Strategy for the Northern and Southern Resident Killer Whales (<Language xml:lang="la">Orcinus orca</Language>) in Canada</XRefExternal>, published in 2008 and amended in 2011;</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631846" lims:id="631846" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>the <XRefExternal reference-type="other">Action Plan for the Northern and Southern Resident Killer Whale (<Language xml:lang="la">Orcinus orca</Language>) in Canada</XRefExternal> and the <XRefExternal reference-type="other">Multi-species Action Plan for Pacific Rim National Park Reserve of Canada</XRefExternal>, published in 2017;</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631847" lims:id="631847" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>the <XRefExternal reference-type="other">Multi-species Action Plan for Gulf Islands National Park Reserve of Canada</XRefExternal>, published in 2018; and</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631848" lims:id="631848" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>the <XRefExternal reference-type="other">Recovery Strategy for the Northern and Southern Resident Killer Whales (<Language xml:lang="la">Orcinus orca</Language>) in Canada (proposed)</XRefExternal>, identifying additional areas of critical habitat and published on September 4, 2018;</Text></Provision></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631849" lims:id="631849" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas, on May 24, 2018, the Minister of Fisheries and Oceans and the Minister of the Environment announced that they had formed the opinion that the SRKW faces imminent threats to its survival and recovery and identified three key threats to the population, namely prey availability, acoustic and physical disturbance and environmental contaminants;</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631850" lims:id="631850" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas, having formed that opinion, the Ministers recommended under subsection 80(2) of the <XRefExternal reference-type="act" link="S-15.3">Species at Risk Act</XRefExternal> that the Governor in Council make an emergency order;</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631851" lims:id="631851" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas measures under the <XRefExternal reference-type="act" link="S-15.3">Species at Risk Act</XRefExternal> are in place to protect and address the threats to the SRKW, including the prohibition in section 32 against the killing, harming, harassing, capturing or taking of an individual of an endangered species and the <XRefExternal reference-type="regulation" link="SOR-2009-68">Critical Habitats of the Northeast Pacific Northern and Southern Resident Populations of the Killer Whale (<Language xml:lang="la">Orcinus orca</Language>) Order</XRefExternal>, made in 2009, which triggered the prohibition in subsection 58(1) of the <XRefExternal reference-type="act" link="S-15.3">Species at Risk Act</XRefExternal> against the destruction of any part of the critical habitat of these two populations;</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631852" lims:id="631852" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas other measures have been taken, continue to be taken and will be taken by the Government of Canada and other organizations to address the three imminent threats to the survival and recovery of the SRKW, including</Text><Provision lims:inforce-start-date="2018-11-01" lims:fid="631853" lims:id="631853" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>with respect to prey availability,</Text><Provision lims:inforce-start-date="2018-11-01" lims:fid="631854" lims:id="631854" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>fisheries closures for recreational finfish and commercial salmon fisheries in key foraging areas from June 1 to September 30, 2018, partial, varying closures in the mouth of the Fraser River from June 1 to September 30, 2018 and potential further closures at times and places to be established before the 2019 fishing season based on information available at that time,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631855" lims:id="631855" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>a reduction in total fishery removals for Chinook salmon of 25-35% in 2018 and potential further reductions to be established before the 2019 fishing season based on information available at that time,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631856" lims:id="631856" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>habitat restoration to increase Chinook productivity,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631857" lims:id="631857" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iv)</Label><Text>aerial coverage of the SRKW and their critical habitat and increased enforcement capacity,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631858" lims:id="631858" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(v)</Label><Text>development of the Southern BC Chinook Strategic Planning Initiative (CSPI) to support the recovery and rebuilding of the Chinook salmon population,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631859" lims:id="631859" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vi)</Label><Text>finalization of a renegotiated Chinook chapter of the <XRefExternal reference-type="other">Pacific Salmon Treaty</XRefExternal>, and</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631860" lims:id="631860" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vii)</Label><Text>increased hatchery production;</Text></Provision></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631861" lims:id="631861" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>with respect to acoustic and physical disturbance,</Text><Provision lims:inforce-start-date="2018-11-01" lims:fid="631862" lims:id="631862" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>fishery closures in key foraging areas and reductions in fishery removals, which contribute to reducing the impacts associated with disturbance from vessel noise,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631863" lims:id="631863" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>amendments to the <XRefExternal reference-type="regulation" link="SOR-93-56">Marine Mammal Regulations</XRefExternal> to establish 200 metres as the minimum approach distance for killer whales in all Canadian fisheries waters in the Pacific Ocean and British Columbia, which came into force on June 22, 2018,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631864" lims:id="631864" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>enhancement of enforcement capacity for the <XRefExternal reference-type="regulation" link="SOR-93-56">Marine Mammal Regulations</XRefExternal> and the <XRefExternal reference-type="act" link="S-15.3">Species at Risk Act</XRefExternal>,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631865" lims:id="631865" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iv)</Label><Text>voluntary slow-downs of commercial vessels in Haro Strait and other zones,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631866" lims:id="631866" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(v)</Label><Text>voluntary trial lateral displacement of commercial vessels within the shipping lanes in the Strait of Juan de Fuca away from foraging areas,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631867" lims:id="631867" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vi)</Label><Text>seeking of new expanded legislative authorities under the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal> to regulate the impacts of vessels on the marine environment,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631868" lims:id="631868" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vii)</Label><Text>conservation agreements or memoranda of understanding with key stakeholder groups on vessel noise mitigation measures to formalize and expand on voluntary measures,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631869" lims:id="631869" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(viii)</Label><Text>proposal to extend existing requirements for automatic identification systems to smaller commercial vessels to improve safety and collision avoidance while also strengthening the ability of government to better target dynamic management measures based on traffic density,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631870" lims:id="631870" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ix)</Label><Text>improvements to whale detection tools and alerting procedures,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631871" lims:id="631871" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(x)</Label><Text>development of noise management plans with industry for quieting the marine environment,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631872" lims:id="631872" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xi)</Label><Text>deployment of hydrophones to acquire baseline data to help develop noise reduction targets, and</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631873" lims:id="631873" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xii)</Label><Text>research on technical solutions for quieting ships;</Text></Provision></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631874" lims:id="631874" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>with respect to environmental contaminants,</Text><Provision lims:inforce-start-date="2018-11-01" lims:fid="631875" lims:id="631875" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>regulatory measures governing the release of deleterious or toxic substances under the <XRefExternal reference-type="regulation" link="SOR-2002-222">Metal and Diamond Mining Effluent Regulations</XRefExternal>, the <XRefExternal reference-type="regulation" link="SOR-92-269">Pulp and Paper Effluent Regulations</XRefExternal>, the <XRefExternal reference-type="regulation" link="SOR-2012-139">Wastewater Systems Effluent Regulations</XRefExternal> and the <XRefExternal reference-type="regulation" link="SOR-2012-285">Prohibition of Certain Toxic Substances Regulations, 2012</XRefExternal>,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631876" lims:id="631876" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>strengthening of regulatory controls for five persistent organic pollutants, including two flame retardants (polybrominated diphenyl ethers (PBDEs) and hexabromocyclododecane (HBCD)) and three oil and water repellents (perfluorooctane sulfonate and its salts and precursors (PFOS), perfluorooctanoic acids and its salts and precursors (PFOA) and long chain perfluorocarboxylic acids and their salts and precursors (LC-PFCAs)), as outlined in a notice of intent published in October 2018, with publication of the proposed regulatory amendments in Part I of the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> anticipated for winter 2020, subject to consultations,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631877" lims:id="631877" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>upgrades to wastewater treatment with the construction in Victoria and Vancouver of two new wastewater treatment plants expected to be operational by January 1, 2021 and a third in Vancouver expected to be operational by January 1, 2031, and</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631878" lims:id="631878" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iv)</Label><Text>research for the purpose of monitoring and measuring contaminants in the SRKW, their habitat and their main prey; and</Text></Provision></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631879" lims:id="631879" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>with respect to all of those threats, expansion of research to inform future decision-making, including research</Text><Provision lims:inforce-start-date="2018-11-01" lims:fid="631880" lims:id="631880" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>on SRKW health and condition,</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631881" lims:id="631881" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>on the effectiveness of threat mitigations, and</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631882" lims:id="631882" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>on the foraging success of the SRKW in known key foraging areas and on prey availability over time;</Text></Provision></Provision></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631883" lims:id="631883" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas the above measures, considered together, will contribute to abating the imminent threats to the survival and recovery of the SRKW;</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631884" lims:id="631884" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And whereas social, economic, policy and other factors, and the broader public interest, have also been considered;</Text></Provision><Provision lims:inforce-start-date="2018-11-01" lims:fid="631885" lims:id="631885" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Therefore, Her Excellency the Governor General in Council declines to make an emergency order pursuant to section 80 of the <XRefExternal reference-type="act" link="S-15.3">Species at Risk
