list-item="no"><Text>Whereas the Public Service Commission has decided that it is neither practicable nor in the best interests of the public service to apply the provisions of the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal><FootnoteRef idref="footnotea_e">a</FootnoteRef> respecting official language proficiency to certain persons described in the annexed Order;</Text><Footnote id="footnotea_e" placement="page" status="official"><Label>a</Label><Text>S.C. 2003, c. 22, s. 12 and 13</Text></Footnote></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="611611" lims:id="611611" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Therefore, the Public Service Commission, pursuant to section 20 of the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal><FootnoteRef>a</FootnoteRef>, hereby makes the annexed <XRefExternal reference-type="regulation" link="SI-2005-118">Public Service Official Languages Exclusion Approval Order</XRefExternal>.</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="611612" lims:id="611612" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 20 of the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal><FootnoteRef>a</FootnoteRef>, hereby approves the annexed <XRefExternal reference-type="regulation" link="SI-2005-118">Public Service Official Languages Exclusion Approval Order</XRefExternal> made by the Public Service Commission.</Text></Provision></Order><Body lims:inforce-start-date="2006-03-22" lims:fid="611614" lims:id="611614"><Heading lims:inforce-start-date="2006-03-22" lims:fid="611615" lims:id="611615" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="611616" lims:id="611616"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="611617" lims:id="611617">Definitions</MarginalNote><Label>1</Label><Text>The following definitions apply in this Order.</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="611618" lims:id="611618" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="611619" lims:id="611619" generate-in-text="no"><Text><DefinedTermEn>agreement to become bilingual</DefinedTermEn> means an agreement in writing by which a person</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="611620" lims:id="611620"><Label>(a)</Label><Text>undertakes to attain the level of official language proficiency required for a bilingual position, through language training at public expense, within a period of two years beginning on the later of the date of the written agreement of appointment to the bilingual position and the effective date of the appointment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="611621" lims:id="611621"><Label>(b)</Label><Text>agrees that if, at the end of the two-year period, the person has not attained the level of language proficiency required for the bilingual position, the person will be appointed or deployed on an indeterminate basis to a position for which the person meets the essential qualifications referred to in paragraph 30(2)(a) of the Act and that is of a similar level and salary as the bilingual position. (<DefinedTermFr>engagement de devenir position</DefinedTermEn> means a position identified by the deputy head as one for which the work to be performed requires proficiency in both official languages. (<DefinedTermFr>poste bilingue</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="611623" lims:id="611623" generate-in-text="no"><Text><DefinedTermEn>non-imperative</DefinedTermEn>, in relation to an appointment to a bilingual position, means that the appointment is for an indeterminate period and the bilingual position has been identified by the deputy head as not requiring, at the time of the appointment, occupation by a person who meets the required level of proficiency in both official languages. (<DefinedTermFr>nomination non impérative</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="611624" lims:id="611624" generate-in-text="no"><Text><DefinedTermEn>unilingual person</DefinedTermEn> means, in relation to a bilingual position, a person who meets the required level of proficiency in only one of the official languages. (<DefinedTermFr>personne unilingue</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="611625" lims:id="611625" level="1"><TitleText>Non-Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="611626" lims:id="611626"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="611627" lims:id="611627">Non-application</MarginalNote><Label>2</Label><Text>No person is excluded by this Order from any requirement to meet any qualifications with respect to shorthand, typing, translation, editing, proofreading, revising, writing or interpretation or to meet any specialized or expert proficiency requirements in one or both official languages.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="611628" lims:id="611628" level="1"><TitleText>Agreement to Become Bilingual</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="611629" lims:id="611629"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="611630" lims:id="611630">Exclusion from paragraph 30(2)(a) of the Act with respect to official language proficiency</MarginalNote><Label>3</Label><Text>A unilingual person who enters into an agreement to become bilingual in order to be appointed on a non-imperative basis to a bilingual position is excluded from the operation of paragraph 30(2)(a) of the Act with respect to the official language proficiency required for the appointment.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="611631" lims:id="611631" level="1"><TitleText>Medical Grounds</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="611632" lims:id="611632"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="611633" lims:id="611633">Exclusion from paragraph 30(2)(a) of the Act with respect to official language proficiency</MarginalNote><Label>4</Label><Text>If a unilingual person has a long-term or recurring physical, mental or learning impairment that makes the person unable to attain, through language training, the official language proficiency required for a bilingual position, the person is excluded from the operation of paragraph 30(2)(a) of the Act with respect to that requirement for a non-imperative appointment to that position.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="611634" lims:id="611634" level="1"><TitleText>Eligibility for an Immediate Annuity</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="611635" lims:id="611635"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="611636" lims:id="611636">Exclusion from paragraph 30(2)(a) of the Act with respect to official language proficiency</MarginalNote><Label>5</Label><Text>If a unilingual person is eligible for an immediate annuity under the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal> within two years after a non-imperative appointment to a bilingual position and the person submits an irrevocable resignation to take effect no later than the end of that two-year period, the person is excluded from the operation of paragraph 30(2)(a) of the Act with respect to the official language proficiency required for that
