format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the Government of Canada also wishes to foster cooperation in that field with foreign governments and international language-align="no" list-item="no"><Text>AND WHEREAS the Government of Canada considers that the creation of a public health agency for Canada and the appointment of a Chief Public Health Officer will contribute to federal efforts to identify and reduce public health risk factors and to support national readiness for public health threats;</Text></Provision></Preamble><Enacts list-item="no"><Text>NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:fid="401110" lims:id="401110">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="P-29.5">Public Health Agency of Canada Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2015-02-05" lims:fid="401111" lims:id="401111" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:id="401114"><Text><DefinedTermEn>Agency</DefinedTermEn> means the Public Health Agency of Canada established by section 3. (<DefinedTermFr>Agence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-05" lims:fid="401115" lims:id="401115"><Text><DefinedTermEn>Chief Public Health Officer</DefinedTermEn> means the Chief Public Health Officer appointed under lims:fid="401122" lims:id="401122">Establishment</MarginalNote><Label>3</Label><Text>The Public Health Agency of Canada is established for the purpose of assisting the Minister in exercising or performing the Minister’s powers, duties and functions in relation to public health.</Text></Section><Section lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="401123" lims:id="401123"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401124" lims:id="401124">Minister to preside</MarginalNote><Label>4</Label><Text>The Minister presides over the Agency and has the management and direction of it.</Text></Section><Section lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="401125" lims:id="401125"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401126" lims:id="401126">Delegation to Agency</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401127" lims:id="401127"><Label>(1)</Label><Text>The Minister may, subject to any terms and conditions that the Minister specifies, delegate to an officer or employee of the Agency any of the powers, duties and functions that the Minister is authorized to exercise or perform under any Act of Parliament or any order made by the Governor in Council in respect of public health.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401128" lims:id="401128"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401129" lims:id="401129">Restriction</MarginalNote><Label>(2)</Label><Text>Subsection (1) does not authorize the Minister to delegate a power to make regulations nor a power to delegate under that subsection.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-02-05" lims:fid="401130" lims:id="401130" level="1"><TitleText>President</TitleText></Heading><Section Council shall appoint a Chief Public Health Officer, who is an officer of the Agency.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-05" lims:fid="401147" lims:id="401147"><MarginalNote lims:inforce-start-date="2015-02-05" lims:fid="401148" lims:id="401148">Qualifications required</MarginalNote><Label>(2)</Label><Text>The Chief Public Health Officer shall be a health professional who has qualifications in the field of public health.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-05" lims:fid="401150" lims:fid="401151" lims:id="401151"><MarginalNote lims:inforce-start-date="2015-02-05" lims:fid="401152" lims:id="401152">Lead health professional</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2015-02-05" lims:fid="401153" lims:id="401153"><Label>(1)</Label><Text>The Chief Public Health Officer is the lead health professional of the Government of Canada in relation to public health.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-05" lims:fid="401154" lims:id="401154"><MarginalNote lims:inforce-start-date="2015-02-05" lims:fid="401155" lims:id="401155">Advice</MarginalNote><Label>(1.1)</Label><Text>The Chief Public Health Officer shall provide the Minister and the President with public health advice that is developed on a scientific basis.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-05" lims:fid="401156" lims:id="401156"><MarginalNote lims:inforce-start-date="2015-02-05" lims:fid="401157" lims:id="401157">Communication with governments, public health authorities and organizations</MarginalNote><Label>(2)</Label><Text>The Chief Public Health Officer may, with respect to public health issues, communicate with governments, public health authorities or organizations in the public health field, within Canada or internationally.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-05" lims:fid="401158" lims:id="401158"><MarginalNote lims:inforce-start-date="2015-02-05" lims:fid="401159" lims:id="401159">Communication with the public, voluntary organizations and the private sector</MarginalNote><Label>(3)</Label><Text>The Chief Public Health Officer may communicate with the public, voluntary organizations in the public health field or the private sector for the purpose of providing information, or seeking their views, about public health issues.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="401162" lims:id="401162"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401163" lims:id="401163">Tenure of office and removal</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401164" lims:id="401164"><Label>(1)</Label><Text>The Chief Public Health Officer holds office during pleasure for a term not exceeding five years.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401165" lims:id="401165"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401166" lims:id="401166">Reappointment</MarginalNote><Label>(2)</Label><Text>The Chief Public Health Officer may be reappointed for one or more lims:inforce-start-date="2015-02-05" lims:fid="401170" lims:id="401170"><Label>(1)</Label><Text>The Chief Public Health Officer shall be paid, for the performance of his or her duties and functions, lims:inforce-start-date="2006-12-15" lims:fid="401175" lims:id="401175">Delegation</MarginalNote><Label>11</Label><Text>The Chief Public Health Officer may delegate any of the powers, duties and functions that the Chief Public Health Officer is authorized to exercise or perform, except the power to delegate under this section, to any officer or employee of the Agency.</Text></Section><Section lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="401176" lims:id="401176"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401177" lims:id="401177">Annual report on public health</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401178" lims:id="401178"><Label>(1)</Label><Text>The Chief Public Health Officer shall, within six months after the end of each fiscal year, submit a report to the Minister on the state of public health in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401179" lims:id="401179"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401180" lims:id="401180">Tabling in Parliament</MarginalNote><Label>(2)</Label><Text>The Minister shall cause the report to be laid before each House of Parliament on any of the first 15 days on which that House is sitting after the Minister receives the report.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401181" lims:id="401181"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401182" lims:id="401182">Other report on public health</MarginalNote><Label>(3)</Label><Text>The Chief Public Health Officer may prepare and publish a report on any issue relating to public health.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401183" lims:id="401183"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401184" lims:id="401184">Data and methodology</MarginalNote><Label>(4)</Label><Text>The Chief Public Health Officer shall, to the extent possible, in any report submitted or published under this section, set out the source of the data and information used in the preparation of the report and the methodology employed to arrive at the report’s findings, conclusions or recommendations.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401185" lims:id="401185"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401186" lims:id="401186">Contents of a report</MarginalNote><Label>(5)</Label><Text>The Chief Public Health Officer may, in any report submitted or published under this section, refer to public health problems and their causes, as well as any measures that may, in his or her opinion, be effective in preventing or resolving those problems.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-02-05" lims:fid="401187" lims:id="401187" level="1"><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="401188" lims:id="401188"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401189" lims:id="401189">Officers and employees</MarginalNote><Label>13</Label><Text>The officers and employees necessary for the proper conduct of the work of the Agency shall be appointed in accordance with the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="401190" lims:id="401190"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401191" lims:id="401191">Committees</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401192" lims:id="401192"><Label>(1)</Label><Text>The Minister may establish advisory and other committees in relation to public health and provide for their membership, duties, functions and operation.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401193" lims:id="401193"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401194" lims:id="401194">Remuneration</MarginalNote><Label>(2)</Label><Text>Members of a committee shall be paid, for the performance of their duties and functions, any remuneration that may be fixed by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401195" lims:id="401195"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401196" lims:id="401196">Travel, living and other expenses</MarginalNote><Label>(3)</Label><Text>Members of a committee are entitled to be paid, in accordance with Treasury Board directives, for reasonable travel, living and other expenses incurred in the performance of their duties and functions while absent from their ordinary place of work, in the case of full-time members, or from their ordinary place of residence, in the case of part-time members.</Text></Subsection></Section><Section lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="401197" lims:id="401197"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401198" lims:id="401198">Regulations</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401199" lims:id="401199"><Label>(1)</Label><Text>The Governor in Council may, on the recommendation of the Minister, make regulations respecting</Text><Paragraph lims:inforce-start-date="2006-12-15" lims:fid="401200" lims:id="401200"><Label>(a)</Label><Text>the collection, analysis, interpretation, publication and distribution of information relating to public health, for the purpose of paragraph 4(2)(h) of the <XRefExternal reference-type="act" link="H-3.2">Department of Health Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-12-15" lims:fid="401201" lims:id="401201"><Label>(b)</Label><Text>the protection of that information if it is confidential information, including if it is personal information as defined in section 3 of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="401202" lims:id="401202"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401203" lims:id="401203">Offence</MarginalNote><Label>(2)</Label><Text>Every person who knowingly possesses, uses or discloses information in contravention of a regulation made under subsection (1) is guilty of an offence and is liable, on summary conviction, to a fine not exceeding $50,000 or to imprisonment for a term not exceeding six months, or to both.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-02-05" lims:fid="401204" lims:id="401204" level="1"><TitleText>Transitional Provisions</TitleText></Heading><Section lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="401205" lims:id="401205" type="transitional"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="401206" lims:id="401206">Definitions</MarginalNote><Label>16</Label><Text>The following definitions apply in sections 17 to 19.</Text><Definition lims:inforce-start-date="2006-12-15" lims:fid="401207" lims:id="401207" type="transitional"><Text><DefinedTermEn>former agency</DefinedTermEn> means the portion of the federal public administration known as the Public Health Agency of Canada. (<DefinedTermFr>ancienne agence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-12-15" lims:fid="401208" lims:id="401208" type="transitional"><Text><DefinedTermEn>new agency</DefinedTermEn> means the Public Health Agency of Canada established under section 3. (<DefinedTermFr>nouvelle lims:inforce-start-date="2006-12-15" lims:fid="401211" lims:id="401211" type="transitional"><Label>(1)</Label><Text>The person occupying the office of Chief Public Health Officer on the day on which for that year for defraying the charges and expenses of the federal public administration for the former agency and that is unexpended on the day on which this section comes into force is deemed, on that day, to be an amount appropriated for defraying the charges and expenses of the federal public administration for the new agency.</Text></Subsection><Subsection duties and functions</MarginalNote><Label>(2)</Label><Text>If a power, duty or function is, under any Act, order, rule or regulation, or under any contract, lease, licence or other document, vested in or exercisable by an officer or employee of the former agency, the power, duty or function is vested in and shall be exercised by the appropriate officer or employee of the new agency, unless the Governor in Council, by order, designates a deputy minister or an officer of the federal public administration to exercise or perform that power, duty or
