level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396785" lims:id="396785"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396786" lims:id="396786">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396787" lims:id="396787"><Label>(1)</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="396788" lims:id="396788"><Text><DefinedTermEn>arbitrator</DefinedTermEn> means the arbitrator appointed pursuant to subsection 7(1); (<DefinedTermFr>arbitre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="396789" lims:id="396789"><Text><DefinedTermEn>collective agreement</DefinedTermEn> means the collective agreement between the employer and the union that expired on December 31, 1983; (<DefinedTermFr>convention collective</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="396790" lims:id="396790"><Text><DefinedTermEn>employee</DefinedTermEn> means a person employed by the employer who is bound by the collective agreement; (<DefinedTermFr>employé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="396791" lims:id="396791"><Text><DefinedTermEn>employer</DefinedTermEn> means the Prince Rupert Grain Ltd.; (<DefinedTermFr>employeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="396792" lims:id="396792"><Text><DefinedTermEn>union</DefinedTermEn> means the Grain Workers’ Union, Local 333. (<DefinedTermFr>syndicat</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396793" lims:id="396793"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396794" lims:id="396794">Words and expressions</MarginalNote><Label>(2)</Label><Text>Unless otherwise provided, words and expressions used in this Act have the same meaning as in Part V of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="396795" lims:id="396795" level="1"><TitleText>Grain Handling Operations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396796" lims:id="396796"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396797" lims:id="396797">Resumption of grain handling operations</MarginalNote><Label><FootnoteRef idref="P-19.6_en_1">*</FootnoteRef>3</Label><Text>On the coming into force of this Act,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396798" lims:id="396798"><Label>(a)</Label><Text>the employer shall forthwith resume grain handling operations at the grain terminal located on Ridley Island in the port of Prince Rupert, British Columbia; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396799" lims:id="396799"><Label>(b)</Label><Text>every employee shall, when so required, forthwith resume the duties of that employee’s employment.</Text></Paragraph><Footnote id="P-19.6_en_1" placement="section" status="editorial" xml:space="default"><Label>*</Label><Text>[Note: Act in force on the day immediately lims:inforce-start-date="2002-12-31" lims:fid="396801" lims:id="396801">Obligations of union</MarginalNote><Label><FootnoteRef idref="P-19.6_en_2">*</FootnoteRef>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396802" lims:id="396802"><Label>(1)</Label><Text>The union and each officer and representative of the union shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396803" lims:id="396803"><Label>(a)</Label><Text>forthwith on the coming into force of this Act, give notice to the employees that, by reason of that coming into force, grain handling operations are forthwith to be resumed at the grain terminal located on Ridley Island in the port of Prince Rupert, British Columbia and the employees, when so required, are forthwith to resume the duties of their employment;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396804" lims:id="396804"><Label>(b)</Label><Text>take all reasonable steps to ensure that employees comply with paragraph 3(b); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396805" lims:id="396805"><Label>(c)</Label><Text>refrain from any conduct that may encourage employees not to comply with paragraph 3(b).</Text></Paragraph><Footnote id="P-19.6_en_2" placement="section" employer</MarginalNote><Label><FootnoteRef idref="P-19.6_en_3">*</FootnoteRef>(2)</Label><Text>Neither the employer nor any officer or representative of the employer shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396808" lims:id="396808"><Label>(a)</Label><Text>in any manner impede any employee from complying with paragraph 3(b); or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396809" lims:id="396809"><Label>(b)</Label><Text>discharge or in any other manner discipline, or authorize or direct the discharge or discipline of, any employee by reason of that employee’s having been on strike before the coming into force of this Act.</Text></Paragraph><Footnote id="P-19.6_en_3" placement="section" status="editorial" lims:lastAmendedDate="2002-12-31" lims:fid="396810" lims:id="396810"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396811" lims:id="396811">Extension of collective agreement</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396812" lims:id="396812"><Label>(1)</Label><Text>The term of the collective agreement is extended to include the period beginning on January 1, 1984 and ending on December 31, 1989.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396813" lims:id="396813"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396814" lims:id="396814">Collective agreement amended</MarginalNote><Label><FootnoteRef idref="P-19.6_en_4">*</FootnoteRef>(2)</Label><Text>On the coming into force of this Act, the collective agreement shall be deemed to be amended by the incorporation therein of the terms and conditions of the collective agreement between the B.C. Terminal Elevator Operators’ Association and the union and in effect for the period beginning on January 1, 1987 and ending on December 31, 1989, other than any terms and conditions relating to the matters referred to the arbitrator pursuant to subsection 7(1).</Text><Footnote id="P-19.6_en_4" placement="section" status="editorial" xml:space="default"><Label>*</Label><Text>[Note: Act in force on the day immediately after the day on which this Act is assented to (assent date being January 20, 1988), but not before the twelfth hour after the time at which this Act is assented to, <Emphasis style="italic">see</Emphasis> section 12.]</Text></Footnote></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396815" lims:id="396815"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396816" lims:id="396816">Collective agreement binding for extended term</MarginalNote><Label>(3)</Label><Text>The collective agreement, as amended by or pursuant to this Act, is effective and binding on the parties thereto for the period for which the agreement is extended by subsection (1) notwithstanding anything in Part V of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> or in the agreement, and</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396817" lims:id="396817"><Label>(a)</Label><Text>Part V of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> applies in respect of the agreement, as so amended, as if that period were the term of the agreement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396818" lims:id="396818"><Label>(b)</Label><Text>the agreement, as so amended, shall, for the purposes of any Act of Parliament, be deemed to be an agreement between the employer and each of its employees on all matters relating to their employment.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396819" lims:id="396819"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396820" lims:id="396820">Strikes and lockouts prohibited</MarginalNote><Label>6</Label><Text>During the term of the collective agreement, as extended by subsection 5(1),</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396821" lims:id="396821"><Label>(a)</Label><Text>the employer shall not declare or cause a lockout against the union;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396822" lims:id="396822"><Label>(b)</Label><Text>no officer or representative of the union shall declare or authorize a strike against the employer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396823" lims:id="396823"><Label>(c)</Label><Text>no employee shall participate in a strike against the employer.</Text></Paragraph></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="396824" lims:id="396824" level="1"><TitleText>Arbitration</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396825" lims:id="396825"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396826" lims:id="396826">Arbitration</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396827" lims:id="396827"><Label>(1)</Label><Text>The Minister shall appoint an arbitrator and refer to the arbitrator all matters relating to staffing at the Grain Centre, job classification and security personnel that, at the time of the appointment, are in dispute between the employer and the union.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396828" lims:id="396828"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396829" lims:id="396829">Powers of arbitrator</MarginalNote><Label>(2)</Label><Text>The arbitrator has, with such modifications as the circumstances require, all the powers and duties of an arbitrator under section 157 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396830" lims:id="396830"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396831" lims:id="396831">Duties of arbitrator</MarginalNote><Label>(3)</Label><Text>The arbitrator shall decide all matters referred to the arbitrator pursuant to subsection (1) within forty-five days after the arbitrator’s appointment or such longer period as the employer and union may agree upon.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396832" lims:id="396832"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396833" lims:id="396833">Form of decision</MarginalNote><Label>(4)</Label><Text>The arbitrator shall set out the decision on the matters referred to the arbitrator in such form as will enable the decision to be incorporated into the collective agreement in accordance with section 8.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396834" lims:id="396834"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396835" lims:id="396835">Collective agreement amended</MarginalNote><Label>8</Label><Text>When the arbitrator has decided all matters referred to the arbitrator pursuant to subsection 7(1), the collective agreement shall be deemed to be amended by the incorporation therein of the decision of the arbitrator and of such other amendments as may have been agreed upon by the parties thereto prior to that decision.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="396836" lims:id="396836" level="1"><TitleText>Amendment of Collective Agreement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396837" lims:id="396837"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396838" lims:id="396838">Parties may amend collective agreement</MarginalNote><Label>9</Label><Text>Nothing in this Act shall be construed so as to limit the rights of the parties to the collective agreement to agree to amend any provision of the agreement as amended by or pursuant to this Act, other than a provision relating to the term of the agreement, and to give effect thereto.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="396839" lims:id="396839" level="1"><TitleText>Enforcement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396840" lims:id="396840"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396841" lims:id="396841">Offence by individuals</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396842" lims:id="396842"><Label>(1)</Label><Text>An individual who contravenes any provision of this Act is guilty of an offence punishable on summary conviction and is liable, for each day or part of a day during which the offence continues, to a fine</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396843" lims:id="396843"><Label>(a)</Label><Text>of not less than $10,000 or more than $50,000, where the individual was acting in the capacity of an officer or representative of the employer or the union when the offence was committed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="396844" lims:id="396844"><Label>(b)</Label><Text>of not less than $500 or more than $1,000, in any other case.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="396845" lims:id="396845"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396846" lims:id="396846">Offence by employer or union</MarginalNote><Label>(2)</Label><Text>Where the employer or the union contravenes any provision of this Act, it is guilty of an offence punishable on summary conviction and is liable, for each day or part of a day during which the offence continues, to a fine of not less than $20,000 or more than $100,000.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396847" lims:id="396847"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396848" lims:id="396848">Presumption</MarginalNote><Label>11</Label><Text>For the purposes of enforcement proceedings under this Act, the union is deemed to be a person.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="396849" lims:id="396849" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="396850" lims:id="396850"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="396851" lims:id="396851">Coming into force</MarginalNote><Label><FootnoteRef idref="P-19.6_en_5">*</FootnoteRef>12</Label><Text>This Act shall come into force on the day immediately after the day on which it is assented to, but not before the twelfth hour after the time at which it is assented to.</Text><Footnote id="P-19.6_en_5" placement="section" status="editorial" xml:space="default"><Label>*</Label><Text>[Note: Act assented to January 20, 1988.]</Text></Footnote></Section></Body></Statute>
