level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333651" lims:id="333651"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333652" lims:id="333652">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2003-06-19" lims:fid="333653" lims:id="333653"><Text><DefinedTermEn>Class “A” Reserve Service</DefinedTermEn> has the same meaning as in article 9.06 of the <XRefExternal reference-type="regulation">Queen’s Regulations and Orders for the Canadian Forces</XRefExternal>. (<DefinedTermFr>service de réserve de classe « A »</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-06-19" lims:fid="333654" lims:id="333654"><Text><DefinedTermEn>Class “B” Reserve Service</DefinedTermEn> has the same meaning as in article 9.07 of the <XRefExternal reference-type="regulation">Queen’s Regulations and Orders for the Canadian Forces</XRefExternal>. (<DefinedTermFr>service de réserve de classe « B »</DefinedTermFr>)</Text></Definition><Definition Defence. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-06-19" lims:fid="333657" lims:id="333657"><Text><DefinedTermEn>personal information</DefinedTermEn> has the same meaning as in section 3 of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal>. (<DefinedTermFr>renseignements personnels</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2003-06-19" lims:fid="333658" lims:id="333658" level="1"><TitleText>Designation</TitleText></Heading><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333659" lims:id="333659"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333660" lims:id="333660">Designation by Minister</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333661" lims:id="333661"><Label>(1)</Label><Text>Subject to subsection (2), the Minister may designate any person to exercise any power or perform any duty or function that may be exercised or performed by the Minister under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333662" lims:id="333662"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333663" lims:id="333663">Limitation</MarginalNote><Label>(2)</Label><Text>If the Minister has designated a person to make a decision under this Act, the Minister may not designate that same person to review the decision under subsection 11(1).</Text></Subsection></Section><Heading lims:inforce-start-date="2003-06-19" lims:fid="333664" lims:id="333664" level="1"><TitleText>Compensation</TitleText></Heading><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333665" lims:id="333665"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333666" lims:id="333666">Right of compensation</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333667" lims:id="333667"><Label>(1)</Label><Text>A person who, while serving as a member of the regular force, or a member of the reserve force performing Class “B” Reserve Service for more than 180 days or Class “C” Reserve Service, suffered an injury that resulted in a loss set out in column 1 of the schedule during the corresponding period set out in column 2 is entitled, on application, to the corresponding benefit set out in column 3 if the Minister is satisfied that</Text><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333668" lims:id="333668"><Label>(a)</Label><Text>the injury is attributable to the person’s service with the Canadian Forces;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333669" lims:id="333669"><Label>(b)</Label><Text>the loss resulted directly from the injury;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333670" lims:id="333670"><Label>(c)</Label><Text>the loss was not caused directly or indirectly by a self-inflicted injury, even if caused by insanity, or by the person’s improper conduct, including their wilful disobedience of an order and vicious or criminal conduct;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333671" lims:id="333671"><Label>(d)</Label><Text>the person survived for a period of at least 30 days after the injury;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333672" lims:id="333672"><Label>(e)</Label><Text>the loss occurred within 90 days after the injury; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333673" lims:id="333673"><Label>(f)</Label><Text>the person was not entitled to a lump-sum payment in respect of the injury under an insurance plan provided by the Government of Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333674" lims:id="333674"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333675" lims:id="333675">Right of compensation</MarginalNote><Label>(2)</Label><Text>A person who, while serving as a member of the reserve force performing Class “B” Reserve Service for 180 days or less or Class “A” Reserve Service, suffered an injury that resulted in a loss set out in column 1 of the schedule during the corresponding period set out in column 2 is entitled, on application, to the corresponding benefit set out in column 4 if the Minister is satisfied that the conditions in paragraphs (1)(a) to (f) are met.</Text></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333676" lims:id="333676"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333677" lims:id="333677">Interpretation</MarginalNote><Label>(3)</Label><Text>For the purposes of subsections (1) and (2) and the schedule, the loss of a hand or foot, or thumb and index finger, includes the loss of their use, and the loss of hearing or speech or of sight in one eye or both eyes means total and irrecoverable loss.</Text></Subsection></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333678" lims:id="333678"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333679" lims:id="333679">Limitation</MarginalNote><Label>5</Label><Text>The total benefits payable to a person in respect of an injury that may result in one or more losses shall not exceed $250,000 for a person referred to in subsection 4(1) or $100,000 for a person referred to in subsection 4(2).</Text></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333680" lims:id="333680"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333681" lims:id="333681">No benefit payable</MarginalNote><Label>6</Label><Text>No benefit is payable for any loss caused wholly or partly, or directly or indirectly, by</Text><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333682" lims:id="333682"><Label>(a)</Label><Text>disease, bodily or mental infirmity or the medical treatment of the disease or infirmity; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333683" lims:id="333683"><Label>(b)</Label><Text>ptomaines or bacterial infections, except an infection that is caused by the injury.</Text></Paragraph></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333684" lims:id="333684"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333685" lims:id="333685">Application made to Minister</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333686" lims:id="333686"><Label>(1)</Label><Text>Any person referred to in section 4 may make an application to the Minister for a benefit in the manner required by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333687" lims:id="333687"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333688" lims:id="333688">Deceased member</MarginalNote><Label>(2)</Label><Text>If the person died before the coming into force of this Act, or dies after the coming into force of this Act without making an application, the person’s estate or succession may apply for the benefit and has the same rights and obligations that the person would have had under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333689" lims:id="333689"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333690" lims:id="333690">Requirements</MarginalNote><Label>(3)</Label><Text>The Minister may require the applicant to provide</Text><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333691" lims:id="333691"><Label>(a)</Label><Text>any documentation necessary to substantiate their claim;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333692" lims:id="333692"><Label>(b)</Label><Text>any relevant information; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333693" lims:id="333693"><Label>(c)</Label><Text>an affidavit or statutory declaration attesting to the truth of the information provided.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333694" lims:id="333694"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333695" lims:id="333695">Consideration of application</MarginalNote><Label>(4)</Label><Text>The Minister shall consider an application without delay after its receipt and, in considering the application, may</Text><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333696" lims:id="333696"><Label>(a)</Label><Text>investigate the facts stated in the application and any other matter related to the application; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333697" lims:id="333697"><Label>(b)</Label><Text>collect relevant material and information from the records of departments and agencies of the Government of Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333698" lims:id="333698"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333699" lims:id="333699">Decision</MarginalNote><Label>(5)</Label><Text>After considering the application, the Minister shall approve the payment of the benefit if the Minister is satisfied that the applicant is entitled to a benefit, or refuse to approve the payment of the benefit in any other case.</Text></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333700" lims:id="333700"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333701" lims:id="333701">Notice of decision and reasons</MarginalNote><Label>(6)</Label><Text>The Minister shall notify the applicant of any decision made under subsection (5) and of the reasons for any refusal to approve the payment of a benefit.</Text></Subsection></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333702" lims:id="333702"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333703" lims:id="333703">Benefit of doubt</MarginalNote><Label>8</Label><Text>In making a decision under this Act, the Minister shall</Text><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333704" lims:id="333704"><Label>(a)</Label><Text>draw from the circumstances of the case, and the evidence presented to the Minister, every reasonable inference in favour of the applicant;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333705" lims:id="333705"><Label>(b)</Label><Text>accept any uncontradicted evidence presented to the Minister by the applicant that the Minister considers to be credible in the circumstances; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333706" lims:id="333706"><Label>(c)</Label><Text>resolve in favour of the applicant any doubt, in the weighing of evidence, as to whether the applicant has established a case.</Text></Paragraph></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333707" lims:id="333707"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333708" lims:id="333708">Decisions shall be made expeditiously</MarginalNote><Label>9</Label><Text>Decisions of the Minister shall be made as informally and expeditiously as the circumstances and considerations of fairness permit.</Text></Section><Section lims:inforce-start-date="2005-04-01" lims:lastAmendedDate="2005-04-01" lims:fid="333709" lims:id="333709"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="333710" lims:id="333710"><XRefExternal reference-type="act" link="I-11">Inquiries Act</XRefExternal></MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2005-04-01" lims:fid="333711" lims:id="333711"><Label>(1)</Label><Text>The Minister has all the powers of a commissioner appointed under Part II of the <XRefExternal reference-type="act" link="I-11">Inquiries Act</XRefExternal> for the purpose of carrying out the functions of the Minister under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="333712" lims:id="333712"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="333713" lims:id="333713">Taking oaths, etc.</MarginalNote><Label>(2)</Label><Text>Any officer or employee of the Department of National Defence or officer of the Canadian Forces, if designated by the Minister for the purpose, may, in the course of their employment or service, administer oaths and take and receive affidavits, declarations and solemn affirmations for the purpose of or incidental to the administration of this Act, and every person so designated has, with respect to any such oath, affidavit, declaration or affirmation, all the powers of a commissioner for administering oaths or taking affidavits.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="333714" lims:id="333714"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="333715" lims:id="333715">Acceptance of oaths, etc.</MarginalNote><Label>(3)</Label><Text>The Minister may accept, for the purpose of the administration of this Act, any oath administered or any affidavit, declaration or solemn affirmation taken or received by any person who has the powers of a commissioner for taking affidavits and who is an officer or employee of</Text><Paragraph lims:inforce-start-date="2005-04-01" lims:fid="333716" lims:id="333716"><Label>(a)</Label><Text>a department in, or other portion of, the federal public administration specified in Schedule I, IV or V to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, or</Text></Paragraph><Paragraph lims:inforce-start-date="2005-04-01" lims:fid="333717" lims:id="333717"><Label>(b)</Label><Text>a department of the government of a province.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2005-04-01" lims:fid="333719" lims:id="333719">2003, c. 14, ss. 10, 22</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2003-07-02" lims:lastAmendedDate="2003-07-02" lims:fid="333720" lims:id="333720"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="333721" lims:id="333721">Request for review</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2003-07-02" lims:fid="333722" lims:id="333722"><Label>(1)</Label><Text>An applicant who is dissatisfied with a decision made by the Minister under this Act may request a review of the decision by the Minister. After receiving the request, the Minister shall review the decision.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="333723" lims:id="333723"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="333724" lims:id="333724">Review on Minister’s motion</MarginalNote><Label>(2)</Label><Text>The Minister may, on the Minister’s own motion, review a decision made under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="333725" lims:id="333725"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="333726" lims:id="333726">Confirmation, amendment or rescinding</MarginalNote><Label>(3)</Label><Text>After reviewing the decision, the Minister may either confirm the decision or amend or rescind the decision if the Minister determines that there was an error with respect to any finding of fact or the interpretation of any law, or if new evidence is presented to the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="333727" lims:id="333727"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="333728" lims:id="333728">Decision is final</MarginalNote><Label>(4)</Label><Text>A decision of the Minister respecting a review is final and binding and, except for judicial review under the <XRefExternal reference-type="act" link="F-7">Federal Courts Act</XRefExternal>, is not subject to appeal or to review by any court. The decision shall not be the subject of a grievance under section 29 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-07-02" lims:fid="333730" lims:id="333730">2003, c. 14, ss. 11, 21</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333731" lims:id="333731"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333732" lims:id="333732">Representation of applicant</MarginalNote><Label>12</Label><Text>In all matters under this Act, an applicant may, at their own expense, be represented by a representative of their choice.</Text></Section><Heading lims:inforce-start-date="2003-06-19" lims:fid="333733" lims:id="333733" level="1"><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="333734" lims:id="333734"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="333735" lims:id="333735">Information that shall be made available to Minister</MarginalNote><Label>13</Label><Text>The following personal information relating to the person who sustained the injury shall, if requested by the Minister, be made available to the Minister to determine the applicant’s eligibility for a benefit:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="333736" lims:id="333736"><Label>(a)</Label><Text>personal information collected or obtained by the Department of Veterans Affairs in the administration of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> or Part 3 of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="333737" lims:id="333737"><Label>(b)</Label><Text>personal information collected or obtained by the Department of Transport in the administration of the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal>, the <XRefExternal reference-type="act" link="S-9">Canada Shipping Act</XRefExternal> or the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal> or any predecessor enactment relating to the same subject-matter; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="333738" lims:id="333738"><Label>(c)</Label><Text>personal information collected or obtained by the Library and Archives of Canada in the administration of the <XRefExternal reference-type="act" link="L-7.7">Library and Archives of Canada Act</XRefExternal>, or any predecessor enactment relating to the same that has been collected or obtained by the Minister in the administration of this Act may be disclosed by the Minister</Text><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333743" lims:id="333743"><Label>(a)</Label><Text>to any person or body, to the extent that the disclosure is necessary in order for the Minister to obtain information required for the administration of this or any member of the Canadian Forces, to the extent that the disclosure is required for the administration of this Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333745" lims:id="333745"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333746" lims:id="333746">Social Insurance Numbers</MarginalNote><Label>15</Label><Text>If a Social Insurance Number has been used to identify the service or medical records of a member of the Canadian Forces, the Minister or other authority having custody of those records may use the Social Insurance Number for the purpose of making those records available.</Text></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333747" lims:id="333747"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333748" lims:id="333748">Definition of <DefinedTermEn>overpayment</DefinedTermEn></MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333749" lims:id="333749"><Label>(1)</Label><Text>In this section, <DefinedTermEn>overpayment</DefinedTermEn> means a benefit, or part of a benefit, that was paid to a person and to which the person had no entitlement.</Text></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333750" lims:id="333750"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333751" lims:id="333751">Recovery of overpayment</MarginalNote><Label>(2)</Label><Text>If, through any cause, an overpayment is paid to a person, the overpayment is a debt due to Her Majesty by that person, and the Minister may recover the debt</Text><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333752" lims:id="333752"><Label>(a)</Label><Text>in accordance with section 155 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333753" lims:id="333753"><Label>(b)</Label><Text>by proceedings in any court of competent jurisdiction.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-06-19" lims:fid="333754" lims:id="333754"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333755" lims:id="333755">Remission of overpayment</MarginalNote><Label>(3)</Label><Text>If a person has received or obtained an overpayment, the Minister may, unless that person has been convicted of an offence under the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> in connection with the receiving or obtaining of the overpayment, remit all or any portion of the overpayment if the Minister is satisfied that</Text><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333756" lims:id="333756"><Label>(a)</Label><Text>the overpayment cannot be recovered within the reasonably foreseeable future;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333757" lims:id="333757"><Label>(b)</Label><Text>the administrative costs of recovering the overpayment are likely to equal or exceed the amount to be recovered;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333758" lims:id="333758"><Label>(c)</Label><Text>repayment of the overpayment would cause undue hardship to the person; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-06-19" lims:fid="333759" lims:id="333759"><Label>(d)</Label><Text>the overpayment is the result of an administrative error, delay or oversight on the part of a public servant or a member of the Canadian Forces.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333760" lims:id="333760"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333761" lims:id="333761">Immunity</MarginalNote><Label>17</Label><Text>No action or other proceeding lies against any person for anything done or said in good faith in the administration of this Act.</Text></Section><Section lims:inforce-start-date="2003-06-19" lims:lastAmendedDate="2003-06-19" lims:fid="333762" lims:id="333762"><MarginalNote lims:inforce-start-date="2003-06-19" lims:fid="333763" lims:id="333763">Deeming</MarginalNote><Label>18</Label><Text>For the purposes of section 25 of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, the payment of benefits under this Act is deemed not to be a compensation plan established by any other legislation of a similar
