lims:id="333156">Agreement ratified and confirmed</MarginalNote><Label>1</Label><Text>The Agreement between the Government of Canada and the Government of the Province of Nova Scotia, set out in the Schedule, is ratified and confirmed, and it shall take effect according to its terms.</Text></Section></Body><Schedule lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="333157" lims:id="333157" spanlanguages="no" bilingual="no"><ScheduleFormHeading lims:inforce-start-date="2003-01-01" lims:fid="333158" lims:id="333158"><Label>SCHEDULE</Label><TitleText /><TitleText>Memorandum of Agreement made this 14th Day of April, 1959</TitleText></ScheduleFormHeading><Provision lims:inforce-start-date="2003-01-01" lims:fid="333159" lims:id="333159" format-ref="indent-0-0" language-align="yes" list-item="no"><Text><Emphasis style="smallcaps">between</Emphasis></Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333160" lims:id="333160" format-ref="indent-1-1" language-align="yes" list-item="no"><Text>THE GOVERNMENT OF CANADA, hereinafter referred to as “Canada”,</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333161" lims:id="333161" format-ref="right-align" language-align="yes" list-item="no"><Text>of the first part,</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333162" lims:id="333162" format-ref="indent-0-0" language-align="yes" list-item="no"><Text><Emphasis style="smallcaps">and</Emphasis></Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333163" lims:id="333163" format-ref="indent-1-1" language-align="yes" list-item="no"><Text>THE GOVERNMENT OF THE PROVINCE OF NOVA SCOTIA, hereinafter referred to as “Nova Scotia”,</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333164" lims:id="333164" format-ref="right-align" language-align="yes" list-item="no"><Text>of the second part.</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333165" lims:id="333165" format-ref="indent-0-0" language-align="yes" list-item="no"><Text><Emphasis style="smallcaps">Whereas</Emphasis> since the enactment of the British North America Act, 1867, certain lands in the Province of Nova Scotia set aside for Indians have been surrendered to the Crown by the Indians entitled thereto;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333166" lims:id="333166" format-ref="indent-0-0" language-align="yes" list-item="no"><Text><Emphasis style="smallcaps">And Whereas</Emphasis> from time to time Letters Patent have been issued under the Great Seal of Canada purporting to convey said lands to various persons;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333167" lims:id="333167" format-ref="indent-0-0" language-align="yes" list-item="no"><Text><Emphasis style="smallcaps">And Whereas</Emphasis> two decisions of the Judicial Committee of the Privy Council relating to Indian lands in the Provinces of Ontario and Quebec lead to the conclusion that said lands could only have been lawfully conveyed by authority of Nova Scotia with the result that the grantees of said lands hold defective titles and are thereby occasioned hardship and inconvenience;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333168" lims:id="333168" format-ref="indent-0-0" language-align="yes" list-item="no"><Text><Emphasis style="smallcaps">Now this Agreement witnesseth</Emphasis> that the parties hereto, in order to settle all outstanding problems relating to Indian reserves in the Province of Nova Scotia and to enable Canada to deal effectively in future with lands forming part of said reserves, have mutually agreed subject to the approval of the Parliament of Canada and the Legislature of the Province of Nova Scotia as follows:</Text><Provision lims:inforce-start-date="2003-01-01" lims:fid="333169" lims:id="333169" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>1</Label><Text>In this agreement, unless the context otherwise requires,</Text><Provision lims:inforce-start-date="2003-01-01" lims:fid="333170" lims:id="333170" format-ref="indent-2-2" list-item="no" language-align="no"><Label>(a)</Label><Text><DefinedTermEn>Province</DefinedTermEn> means the Province of Nova Scotia;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333171" lims:id="333171" format-ref="indent-2-2" list-item="no" language-align="no"><Label>(b)</Label><Text><DefinedTermEn>reserve lands</DefinedTermEn> means those reserves in the Province referred to in the appendix to this agreement;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333172" lims:id="333172" format-ref="indent-2-2" list-item="no" language-align="no"><Label>(c)</Label><Text><DefinedTermEn>patented lands</DefinedTermEn> means those tracts of land in the Province in respect of which Canada accepted surrenders of their rights and interests therein from the Indians entitled to the use and occupation thereof and in respect of which grants were made by Letters Patent issued under the Gread Seal of Canada;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333173" lims:id="333173" format-ref="indent-2-2" list-item="no" language-align="no"><Label>(d)</Label><Text><DefinedTermEn>minerals</DefinedTermEn> includes salt, oil, natural gas, infusorial earth, ochres or paints, the base of which is found in the soil, fire clays, carbonate of lime, sulphate of lime, gypsum, coal, bituminous shale, albertite and uranium, but not sand, gravel and marl;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333174" lims:id="333174" format-ref="indent-2-2" list-item="no" language-align="no"><Label>(e)</Label><Text><DefinedTermEn><XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal></DefinedTermEn> means the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, Revised Statutes of Canada 1952, cap. 149, as amended from time to time and includes any re-enactment, revision or consolidation thereof;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333175" lims:id="333175" format-ref="indent-2-2" list-item="no" language-align="no"><Label>(f)</Label><Text><DefinedTermEn>surrender</DefinedTermEn> means the surrender for sale of reserve lands or a portion thereof pursuant to the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal> but does not include a surrender of rights and interests in reserve lands for purposes other than sale; and</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333176" lims:id="333176" format-ref="indent-2-2" list-item="no" language-align="no"><Label>(g)</Label><Text><DefinedTermEn>public highways</DefinedTermEn> means every road and bridge in reserve lands, constructed for public use by and at the expense of the Province or any municipality in the Province and in existence at the coming into force of this agreement.</Text></Provision></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333177" lims:id="333177" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>2</Label><Text>All grants of patented lands are hereby confirmed except insofar as such grants purport to transfer to the grantees any minerals and said minerals are hereby acknowledged to be the property of the Province.</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333178" lims:id="333178" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>3</Label><Text>Nova Scotia hereby transfers to Canada all rights and interests of the Province in reserve lands except lands lying under public highways and minerals.</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333179" lims:id="333179" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>4 (1)</Label><Text>In the event that a band of Indians in the Province becomes extinct, Canada shall revest in the Province all the rights and interests transferred to it under this agreement in the reserve lands occupied by such band prior to its becoming extinct.</Text><Provision lims:inforce-start-date="2003-01-01" lims:fid="333180" lims:id="333180" format-ref="indent-0-0" list-item="no" language-align="no"><Label>(2)</Label><Text>For the purpose of subparagraph (1) a band does not become extinct by enfranchisement.</Text></Provision></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333181" lims:id="333181" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>5</Label><Text>The mining regulations made from time to time under the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal> apply to the prospecting for, mining of or other dealing in all minerals in unsurrendered reserve lands and all minerals reserved in the grants referred to in paragraph 2, and any payment made pursuant to such regulations whether by way of rent, royalty, or otherwise, shall be paid to the Receiver General of Canada for the use and benefit of the Indian band or Indians from whose reserve lands such monies are so derived.</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333182" lims:id="333182" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>6 (1)</Label><Text>Canada shall forthwith notify Nova Scotia of any surrender and Nova Scotia may within thirty days of receiving such notification elect to purchase the surrendered lands at a price to be agreed upon.</Text><Provision lims:inforce-start-date="2003-01-01" lims:fid="333183" lims:id="333183" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>(2)</Label><Text>If Nova Scotia fails to elect within such thirty-day period, Canada may dispose of the surrendered lands without further reference to Nova Scotia.</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333184" lims:id="333184" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>(3)</Label><Text>Where a surrender is made under the condition that the surrendered lands be sold to a named or designated person at a certain price or for a certain consideration, Nova Scotia shall exercise its election subject to that price or consideration.</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333185" lims:id="333185" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>(4)</Label><Text>Subject to subparagraph (3) of this paragraph, should Canada and Nova Scotia be unable, within thirty days of the date of an election to purchase being made, to reach agreement on the price to be paid by Nova Scotia for any surrendered lands, the matter shall be referred to arbitrators as follows:</Text><Provision lims:inforce-start-date="2003-01-01" lims:fid="333186" lims:id="333186" format-ref="indent-1-1" list-item="no" language-align="no"><Label>(a)</Label><Text>Canada and Nova Scotia shall each appoint one arbitrator, and the two arbitrators so appointed shall appoint a third arbitrator;</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333187" lims:id="333187" format-ref="indent-1-1" list-item="no" language-align="no"><Label>(b)</Label><Text>the decision of the arbitrators as to the price to be paid by Nova Scotia for the surrendered lands shall be final and conclusive; and</Text></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333188" lims:id="333188" format-ref="indent-1-1" list-item="no" language-align="no"><Label>(c)</Label><Text>the costs of arbitration shall be borne equally by Canada and Nova Scotia.</Text></Provision></Provision></Provision></Provision><Provision lims:inforce-start-date="2003-01-01" lims:fid="333189" lims:id="333189" format-ref="indent-0-0" language-align="yes" list-item="no"><Text><Emphasis style="smallcaps">In Witness Whereof</Emphasis> the
