in this Act.</Text><Definition lims:inforce-start-date="2025-10-10" lims:enacted-date="2024-10-10" lims:fid="277510" lims:id="1542594"><Text><DefinedTermEn>child sexual abuse and exploitation material</DefinedTermEn> has the same meaning as in subsection 163.1(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>. (<DefinedTermFr>matériel d’abus et lims:id="1542596"><Label>(a)</Label><Text>subsection 163.1(2) (making child sexual abuse and exploitation material);</Text></Paragraph><Paragraph lims:inforce-start-date="2025-10-10" lims:enacted-date="2024-10-10" lims:fid="1542597" lims:id="1542597"><Label>(b)</Label><Text>subsection 163.1(3) (distribution, etc., of child sexual abuse and exploitation material);</Text></Paragraph><Paragraph lims:inforce-start-date="2025-10-10" lims:enacted-date="2024-10-10" lims:fid="1542598" lims:id="1542598"><Label>(c)</Label><Text>subsection 163.1(4) (possession of child sexual abuse and exploitation material); or</Text></Paragraph><Paragraph lims:inforce-start-date="2025-10-10" lims:enacted-date="2024-10-10" lims:fid="1542599" lims:id="1542599"><Label>(d)</Label><Text>subsection 163.1(4.1) (accessing child sexual abuse and exploitation material). (<DefinedTermFr>infraction relative au matériel d’abus et d’exploitation service providing Internet access, Internet content hosting or electronic mail. (<DefinedTermFr>services Internet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-12-08" lims:fid="277518" lims:id="277518"><Text><DefinedTermEn>person</DefinedTermEn> means an individual, a corporation, a partnership or an unincorporated association or address</MarginalNote><Label>2</Label><Text>If a person is advised, in the course of providing an Internet service to the public, of an Internet Protocol address or a Uniform Resource Locator where child sexual abuse and exploitation material may be available to the public, the person must report that address or Uniform Resource Locator to the organization designated by the regulations, as soon lims:fid="1542608" lims:id="1542608">Duty to notify police officer</MarginalNote><Label>3</Label><Text>If a person who provides an Internet service to the public has reasonable grounds to believe that their Internet service is being or has been used to commit a child sexual abuse and exploitation material offence, the person must notify an officer, constable or other person employed for the preservation and maintenance of the public peace of that fact, as soon as feasible and in accordance with the regulations.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-12-08" lims:fid="277527" lims:id="277527">Preservation of computer data</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2011-12-08" lims:fid="277528" lims:id="277528"><Label>(1)</Label><Text>A person who makes a notification under section 3 must preserve all computer data related to the notification that is in their possession or control for 21 days after the day on which the notification is made.</Text></Subsection><Subsection lims:inforce-start-date="2011-12-08" lims:fid="277529" lims:id="277529"><MarginalNote lims:inforce-start-date="2011-12-08" lims:fid="277530" lims:id="277530">Destruction of preserved computer data</MarginalNote><Label>(2)</Label><Text>The person must destroy the computer data that would not be retained in the ordinary course of business and any document that is prepared for the purpose of preserving computer data under subsection (1) as soon as feasible after the expiry of the 21-day period, unless the person is required to preserve the computer data by a judicial order made under any other Act of Parliament or the legislature of a province.</Text></Subsection></Section><Section lims:inforce-start-date="2011-12-08" lims:lastAmendedDate="2011-12-08" lims:fid="277531" lims:id="277531"><MarginalNote lims:inforce-start-date="2011-12-08" lims:fid="277532" lims:id="277532">No disclosure</MarginalNote><Label>5</Label><Text>A person must not disclose that they have made a report under section 2 or a notification under section 3, or disclose the contents of a report or notification, if the disclosure could prejudice a criminal investigation, whether or not a criminal investigation has begun.</Text></Section><Section lims:inforce-start-date="2025-10-10" lims:enacted-date="2024-10-10" lims:lastAmendedDate="2025-10-10" lims:fid="277533" lims:id="1542612"><MarginalNote lims:inforce-start-date="2025-10-10" lims:enacted-date="2024-10-10" lims:fid="1542613" lims:id="1542613">No seeking out of child sexual abuse and exploitation material</MarginalNote><Label>6</Label><Text>Nothing in this Act requires or authorizes a person to seek out child sexual abuse and exploitation material.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-12-08" lims:fid="277536" lims:id="277536">Immunity</MarginalNote><Label>7</Label><Text>A civil proceeding cannot be commenced against a person for making a report in good faith under section 2 or for making a notification in good faith under section 3.</Text></Section><Section lims:inforce-start-date="2011-12-08" lims:lastAmendedDate="2011-12-08" lims:fid="277537" lims:id="277537"><MarginalNote lims:inforce-start-date="2011-12-08" lims:fid="277538" lims:id="277538">Self-incrimination</MarginalNote><Label>8</Label><Text>For greater certainty, nothing in this Act affects any right of a person to be protected against self-incrimination.</Text></Section><Section lims:inforce-start-date="2025-10-10" lims:enacted-date="2024-10-10" lims:lastAmendedDate="2025-10-10" lims:fid="277539" lims:id="1542617"><MarginalNote lims:inforce-start-date="2025-10-10" lims:enacted-date="2024-10-10" lims:fid="1542618" lims:id="1542618">Provincial or foreign jurisdiction</MarginalNote><Label>9</Label><Text>A person who has reported information in compliance with an obligation to report child sexual abuse and exploitation material under the laws of a province or a foreign jurisdiction is deemed to have complied with section 2 of this Act in relation to that information.</Text><HistoricalNote><HistoricalNoteSubItem 12</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2011-12-08" lims:fid="277541" lims:id="277541" level="1"><TitleText>Offences and Punishment</TitleText></Heading><Section lims:inforce-start-date="2011-12-08" lims:lastAmendedDate="2011-12-08" lims:fid="277542" lims:id="277542"><MarginalNote lims:inforce-start-date="2011-12-08" lims:fid="277543" lims:id="277543">Offence</MarginalNote><Label>10</Label><Text>Every person who knowingly contravenes any of sections 2 to 5 is guilty of an offence and liable on summary conviction,</Text><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="277544" lims:id="277544"><Label>(a)</Label><Text>in the case of an individual,</Text><Subparagraph lims:inforce-start-date="2011-12-08" lims:fid="277545" lims:id="277545"><Label>(i)</Label><Text>for a first offence, to a fine of not more than $1,000,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-12-08" lims:fid="277546" lims:id="277546"><Label>(ii)</Label><Text>for a second offence, to a fine of not more than $5,000, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-12-08" lims:fid="277547" lims:id="277547"><Label>(iii)</Label><Text>for each subsequent offence, to a fine of not more than $10,000 or to imprisonment for a term of not more than six months, or to both; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="277548" lims:id="277548"><Label>(b)</Label><Text>in all other cases,</Text><Subparagraph lims:inforce-start-date="2011-12-08" lims:fid="277549" lims:id="277549"><Label>(i)</Label><Text>for a first offence, to a fine of not more than $10,000,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-12-08" lims:fid="277550" lims:id="277550"><Label>(ii)</Label><Text>for a second offence, to a fine of not more than $50,000, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-12-08" lims:fid="277551" lims:id="277551"><Label>(iii)</Label><Text>for each subsequent offence, to a fine of not more than $100,000.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2011-12-08" lims:lastAmendedDate="2011-12-08" lims:fid="277552" lims:id="277552"><MarginalNote lims:inforce-start-date="2011-12-08" lims:fid="277553" lims:id="277553">Limitation period</MarginalNote><Label>11</Label><Text>A prosecution for an offence under this Act cannot be commenced more than two years after the time when the act or omission giving rise to the prosecution occurred.</Text></Section><Heading lims:inforce-start-date="2011-12-08" lims:fid="277554" lims:id="277554" level="1"><TitleText>Regulations</TitleText></Heading><Section lims:inforce-start-date="2011-12-08" lims:lastAmendedDate="2011-12-08" lims:fid="277555" lims:id="277555"><MarginalNote lims:inforce-start-date="2011-12-08" lims:fid="277556" lims:id="277556">Regulations</MarginalNote><Label>12</Label><Text>The Governor in Council may make regulations</Text><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="277557" lims:id="277557"><Label>(a)</Label><Text>designating an organization for the purpose of section 2;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="277558" lims:id="277558"><Label>(b)</Label><Text>respecting the role, functions and activities of the designated organization in relation to information received under this Act, including any security measures to be taken;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="277559" lims:id="277559"><Label>(c)</Label><Text>respecting the making of a report under section 2;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="277560" lims:id="277560"><Label>(d)</Label><Text>respecting a notification under section 3;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="277561" lims:id="277561"><Label>(e)</Label><Text>respecting security measures to be taken in relation to computer data preserved under section 4; and</Text></Paragraph><Paragraph           — 2026, c. 19, s. 180</TitleText></Heading><Section type="amending"><Label>180</Label><Text>Sections 3 and 4 of the Act are replaced by the following:</Text><AmendedText include-in-TableOfProvisions="no"><Section><MarginalNote>Duty to notify</MarginalNote><Label>3</Label><Subsection><Label>(1)</Label><Text>A person who provides an Internet service to the public and who has reasonable grounds to believe that their Internet service is being or has been used to commit a child sexual abuse and exploitation material offence must notify the law enforcement body designated by the regulations of that fact as soon as feasible and in accordance with the regulations, if</Text><Paragraph><Label>(a)</Label><Text>the offence has been committed by means of a <DefinitionRef>computer system</DefinitionRef>, as defined in subsection 342.1(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, that is located in Canada;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>the person has possession or control of the computer system; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>the child sexual abuse and exploitation material related to the offence is stored on the computer system.</Text></Paragraph></Subsection><Subsection><MarginalNote>Transmission data</MarginalNote><Label>(2)</Label><Text>If the material related to the offence is manifestly child sexual abuse and exploitation material, the person must include with the notification a document containing any <DefinitionRef>transmission data</DefinitionRef>, as defined in section 487.011 of the <XRefExternal reference-level="federal" reference-type="act" link="C-46">Criminal Code</XRefExternal>, related to the material that could assist in the investigation of the offence.</Text></Subsection></Section><Section><MarginalNote>Preservation of computer data</MarginalNote><Label>4</Label><Subsection><Label>(1)</Label><Text>A person who makes a notification under section 3 must preserve all computer data related to the notification that is in their possession or control for one year after the day on which the notification is made.</Text></Subsection><Subsection><MarginalNote>Destruction of preserved computer data</MarginalNote><Label>(2)</Label><Text>The person must destroy the computer data that would not be retained in the ordinary course of business and any document that is prepared for the purpose of preserving computer data under subsection (1) as soon as feasible after the end of the one-year period, unless the person is required to preserve the computer data by a judicial order made under any other Act of Parliament or any Act of the legislature of a province.</Text></Subsection></Section></AmendedText></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
