relation to the management by those First Nations of their lands, and other First Nations have signed the Framework Agreement after that date;</Text></Provision><Provision lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385586" lims:id="1385586" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the <XRefExternal reference-type="act" link="F-11.8">First Nations Land Management Act</XRefExternal>, the purpose of which was to ratify and bring into effect the Framework Agreement, received royal assent on June 17, 1999;</Text></Provision><Provision lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385587" lims:id="1385587" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And whereas it is appropriate to enact a new implementation Act to replace the <XRefExternal reference-type="act" link="F-11.8">First Nations Land Management Act</XRefExternal> and to reflect the primacy of the Framework Agreement, while also ensuring the continuity with the previous legal framework;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2022-12-15" lims:id="1385596">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385597" lims:id="1385597"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385598" lims:id="1385598"><Text><DefinedTermEn>First Nation land</DefinedTermEn> means reserve land or lands set aside to which a land code applies. It includes all the interests or land rights in, and resources of, the land that are within the legislative authority of Parliament. (<DefinedTermFr>terres de la première nation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385599" lims:id="1385599"><Text><DefinedTermEn>First Nation law</DefinedTermEn> means a law that is enacted by a First Nation in accordance with the Framework Agreement and the land code of that First Nation. (<DefinedTermFr>texte législatif de la première nation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385600" lims:id="1385600"><Text><DefinedTermEn>Framework Agreement</DefinedTermEn> means the Framework Agreement on First Nation Land Management, signed by Her Majesty in right of Canada and 13 First Nations on February 12, 1996 — and signed by other First Nations after that date — as amended from time to time in accordance with its provisions. (<DefinedTermFr>accord-cadre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385601" lims:id="1385601"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Crown-Indigenous Relations. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385602" lims:id="1385602"><Text><DefinedTermEn>reserve</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>. (<DefinedTermFr>réserve</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385603" lims:id="1385603"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385604" lims:id="1385604">Definitions in Framework Agreement</MarginalNote><Label>(2)</Label><Text>In this Act, <DefinedTermEn>First Nation</DefinedTermEn>, <DefinedTermEn>First Nation Lands Register</DefinedTermEn>, <DefinedTermEn>interest</DefinedTermEn>, <DefinedTermEn>land code</DefinedTermEn>, <DefinedTermEn>land right</DefinedTermEn>, <DefinedTermEn>Lands Advisory Board</DefinedTermEn> and <DefinedTermEn>licence</DefinedTermEn> have the same meaning as in subclause 1.1 of the Framework Agreement and <DefinedTermEn>lands set aside</DefinedTermEn> has the same meaning as <DefinitionRef>Lands Set Aside</DefinitionRef> in that subclause 1.1.</Text></Subsection></Section><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385605" lims:id="1385605"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385606" lims:id="1385606">Not a treaty</MarginalNote><Label>3</Label><Text>The Framework Agreement is not a treaty within the meaning of section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385607" lims:id="1385607"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385608" lims:id="1385608">Binding on His Majesty</MarginalNote><Label>4</Label><Text>This Act is binding on His Majesty in right of Canada.</Text></Section><Heading lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385609" lims:id="1385609" level="1"><TitleText>Framework Agreement</TitleText></Heading><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385610" lims:id="1385610"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385611" lims:id="1385611">Force of law</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385612" lims:id="1385612"><Label>(1)</Label><Text>The Framework Agreement continues to have effect and has the force of law.</Text></Subsection><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385613" lims:id="1385613"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385614" lims:id="1385614">Rights and obligations</MarginalNote><Label>(2)</Label><Text>For greater certainty, a person or body has the powers, rights, privileges, immunities and benefits conferred on the person or body by the Framework Agreement and must perform the duties, and is subject to the liabilities, imposed on the person or body by the Framework Agreement.</Text></Subsection><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385615" lims:id="1385615"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385616" lims:id="1385616">Framework Agreement binding</MarginalNote><Label>(3)</Label><Text>For greater certainty, the Framework Agreement is binding on, and may be relied on by, all persons and bodies.</Text></Subsection></Section><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385617" lims:id="1385617"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385618" lims:id="1385618">Framework Agreement prevails</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385619" lims:id="1385619"><Label>(1)</Label><Text>In the event of any inconsistency or conflict between the Framework Agreement and this Act, the Framework Agreement prevails to the extent of the inconsistency or conflict.</Text></Subsection><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385620" lims:id="1385620"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385621" lims:id="1385621">Act prevails</MarginalNote><Label>(2)</Label><Text>In the event of any inconsistency or conflict between this Act and any other federal law, this Act prevails to the extent of the inconsistency or conflict.</Text></Subsection></Section><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:id="1385623">Publication</MarginalNote><Label>7</Label><Text>The Minister must make available to the public</Text><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385624" lims:id="1385624"><Label>(a)</Label><Text>the Framework Agreement that was signed by Her Majesty in right of Canada and 13 First Nations on February 12, 1996 and any amendments made to it; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385625" lims:id="1385625"><Label>(b)</Label><Text>the most recent consolidated version of the Framework Agreement that has been approved by the Minister and the Lands Advisory Board.</Text></Paragraph></Section><Heading lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385626" lims:id="1385626" level="1"><TitleText>Rights and Obligations of His Majesty in Right of Canada</TitleText></Heading><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385627" lims:id="1385627"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385628" lims:id="1385628">Transfer</MarginalNote><Label>8</Label><Text>On the coming into force of the land code of a First Nation, the rights and obligations of His Majesty in right of Canada as grantor in respect of the interests or land rights and the licences described in the First Nation’s individual agreement referred to in clause 6 of the Framework Agreement are transferred to the First Nation in accordance with that individual agreement.</Text></Section><Heading lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385629" lims:id="1385629" level="1"><TitleText>First Nation Lands Register</TitleText></Heading><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385630" lims:id="1385630"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385631" lims:id="1385631">Register continued</MarginalNote><Label>9</Label><Text>The First Nation Land Register established by the Minister under section 25 of the <XRefExternal reference-type="act" link="F-11.8">First Nations Land Management Act</XRefExternal>, chapter 24 of the Statutes of Canada, 1999, is continued as the First Nation Lands Register.</Text></Section><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385632" lims:id="1385632"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385633" lims:id="1385633">Regulations</MarginalNote><Label>10</Label><Text>The Governor in Council may, on the recommendation of the Minister and in accordance with the Framework Agreement, make regulations respecting the administration of the First Nation Lands Register, the registration of interests or land rights in it and the recording of any other matter in it, including but not limited to regulations respecting</Text><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385634" lims:id="1385634"><Label>(a)</Label><Text>the effects of registering interests or land rights, including priorities;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385635" lims:id="1385635"><Label>(b)</Label><Text>the payment of fees for the registration of interests or land rights and for any other service in relation to the Register;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385636" lims:id="1385636"><Label>(c)</Label><Text>the appointment, remuneration, powers, duties and functions of the officers and employees who administer the Register;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385637" lims:id="1385637"><Label>(d)</Label><Text>the keeping, by officers and employees, of documents that are not registrable; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385638" lims:id="1385638"><Label>(e)</Label><Text>the transfer of the administration of the Register to any person or body and the disclosure of <DefinitionRef>personal information</DefinitionRef> as defined in section 3 of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal> for that purpose.</Text></Paragraph></Section><Heading lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385639" lims:id="1385639" level="1"><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385640" lims:id="1385640"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385641" lims:id="1385641">Judicial notice</MarginalNote><Label>11</Label><Text>Judicial notice must be taken of the Framework Agreement, a land code that is in force and any First Nation law.</Text></Section><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="1385642" lims:id="1385642"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385643" lims:id="1385643">Notice</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385644" lims:id="1385644"><Label>(1)</Label><Text>If an issue is raised by a party in any judicial or administrative proceeding in respect of the interpretation or validity of a provision of the Framework Agreement, this Act, a land code or a First Nation law, the issue must not be decided until the party has served notice</Text><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385645" lims:id="1385645"><Label>(a)</Label><Text>on the Attorney General of Canada and the Lands Advisory Board, in the case of a provision of the Framework Agreement or this Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385646" lims:id="1385646"><Label>(b)</Label><Text>on the First Nation, in the case of a provision of a land code or a First Nation law.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385647" lims:id="1385647"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385648" lims:id="1385648">Content and timing</MarginalNote><Label>(2)</Label><Text>The notice must</Text><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385649" lims:id="1385649"><Label>(a)</Label><Text>describe the proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385650" lims:id="1385650"><Label>(b)</Label><Text>state the subject matter of
