commission under the Great Seal to hold office during pleasure and to assist the Minister in carrying out his or her responsibilities relating to international trade.</Text></Section><Section departmental services and facilities</MarginalNote><Label>5</Label><Text>A minister appointed under section 3 or 4 is to act with the concurrence of the Minister in carrying out his or her responsibilities and is to make use of the services and facilities of the Department.</Text></Section><Heading lims:inforce-start-date="2013-06-26" lims:fid="233909" lims:id="233909" level="1"><TitleText>Committees</TitleText></Heading><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="233910" lims:id="233910"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233911" lims:id="233911">Committees to advise and assist</MarginalNote><Label>6</Label><Text>The Governor in Council may establish advisory and other committees to advise or assist the Minister or to exercise and perform any powers, duties and functions that the Governor in Council specifies and may fix the remuneration and expenses to be paid to the members of the committees so established.</Text></Section><Heading lims:inforce-start-date="2013-06-26" lims:fid="233912" lims:id="233912" level="1"><TitleText>Officers of the Department</TitleText></Heading><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="233913" lims:id="233913"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233914" lims:id="233914">Deputy head</MarginalNote><Label>7</Label><Text>The Governor in Council may appoint an officer called the Deputy Minister of Foreign Affairs to hold office during pleasure and to be the deputy head of the Department.</Text></Section><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="233915" lims:id="233915"><MarginalNote lims:id="233917"><Label>(1)</Label><Text>The Governor in Council may appoint three Associate Deputy Ministers of Foreign Affairs, each of whom is to have the rank and status of a deputy head of a department and is, under the Deputy Minister of Foreign Affairs, to exercise and perform any powers, duties and functions, as a deputy of the Minister and otherwise, that the Minister specifies.</Text></Subsection><Subsection lims:inforce-start-date="2013-06-26" lims:fid="233918" lims:id="233918"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233919" lims:id="233919">Deputy Ministers for International Trade and for International Development</MarginalNote><Label>(2)</Label><Text>The Governor in Council may designate one of the Associate Deputy Ministers appointed under subsection (1) to be Deputy Minister for International Trade and one to be Deputy Minister for International Development.</Text></Subsection></Section><Section lims:id="233922" level="1"><TitleText>Powers, Duties and Functions of the Minister</TitleText></Heading><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2025-06-26" Minister</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2013-06-26" lims:fid="233925" lims:id="233925"><Label>(1)</Label><Text>The powers, duties and functions of the Minister extend to and include all matters over which Parliament has jurisdiction, not by law assigned to any other department, board or agency of the Government of Canada, relating to the conduct of the external affairs of Canada, including international trade and commerce and international development.</Text></Subsection><Subsection lims:inforce-start-date="2013-06-26" lims:fid="233926" lims:id="233926"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233927" lims:id="233927">Powers, duties and functions of Minister</MarginalNote><Label>(2)</Label><Text>In exercising and performing his or her powers, duties and functions under this Act, the Minister is to</Text><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233928" lims:id="233928"><Label>(a)</Label><Text>conduct all diplomatic and consular relations on behalf of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233929" lims:id="233929"><Label>(b)</Label><Text>conduct all official communication between the Government of Canada and the government of any other country and between the Government of Canada and any international organization;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233930" lims:id="233930"><Label>(c)</Label><Text>conduct and manage international negotiations as they relate to Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233931" lims:id="233931"><Label>(d)</Label><Text>coordinate Canada’s international economic relations;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233932" lims:id="233932"><Label>(e)</Label><Text>foster the expansion of Canada’s international trade and commerce;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233933" lims:id="233933"><Label>(f)</Label><Text>foster sustainable international development and poverty reduction in developing countries and provide humanitarian assistance during crises;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233934" lims:id="233934"><Label>(g)</Label><Text>coordinate the direction given by the Government of Canada to the heads of Canada’s diplomatic and consular missions;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233935" lims:id="233935"><Label>(h)</Label><Text>have the management of Canada’s diplomatic and consular missions;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233936" lims:id="233936"><Label>(i)</Label><Text>administer the foreign service of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233937" lims:id="233937"><Label>(j)</Label><Text>foster the development of international law and its application in Canada’s external relations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233938" lims:id="233938"><Label>(k)</Label><Text>carry out any other duties and functions that are by law assigned to him or her.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2025-06-26" lims:enacted-date="2025-06-26" lims:fid="1533608" lims:id="1533608"><MarginalNote lims:inforce-start-date="2025-06-26" lims:enacted-date="2025-06-26" lims:fid="1533609" lims:id="1533609">Supply management</MarginalNote><Label>(2.1)</Label><Text>In exercising and performing the powers, duties and functions set out in subsection (2), the Minister must not make any commitment on behalf of the Government of Canada, by international trade treaty or agreement, that would have the effect of</Text><Paragraph lims:inforce-start-date="2025-06-26" lims:enacted-date="2025-06-26" lims:fid="1533610" lims:id="1533610"><Label>(a)</Label><Text>increasing the <DefinitionRef>tariff rate quota</DefinitionRef>, within the meaning of subsection 2(1) of the <XRefExternal reference-level="federal" reference-type="act" link="C-54.011">Customs Tariff</XRefExternal>, applicable to dairy products, poultry or eggs; or</Text></Paragraph><Paragraph lims:inforce-start-date="2025-06-26" lims:enacted-date="2025-06-26" lims:fid="1533611" lims:id="1533611"><Label>(b)</Label><Text>reducing the tariff applicable to those goods when they are imported in excess of the applicable tariff rate quota.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-06-26" lims:fid="233939" lims:id="233939"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233940" lims:id="233940">Programs</MarginalNote><Label>(3)</Label><Text>The Minister may develop and carry out programs related to the Minister’s powers, duties and functions for the promotion of Canada’s interests abroad, including</Text><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233941" lims:id="233941"><Label>(a)</Label><Text>the fostering of the expansion of Canada’s international trade and commerce; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233942" lims:id="233942"><Label>(b)</Label><Text>the fostering of sustainable international development and of poverty reduction in developing countries and the provision of humanitarian lims:id="233950">Cost recovery</MarginalNote><Label>(2)</Label><Text>The fees are to be prescribed with a view to the recovery of the costs incurred by Her Majesty in right of Canada in providing Governor in Council, enter into agreements with the government of any province or any agency of a province respecting the carrying out of programs related to the Minister’s powers, duties and for International Trade</MarginalNote><Label>13</Label><Text>Subject to section 5, the Minister for International Trade is to promote the expansion of Canada’s international trade and commerce by</Text><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233961" lims:id="233961"><Label>(a)</Label><Text>assisting Canadian exporters in their international marketing initiatives and promoting Canadian export sales;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233962" lims:id="233962"><Label>(b)</Label><Text>improving the access of Canadian produce, products and services to external markets through trade negotiations;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233963" lims:id="233963"><Label>(c)</Label><Text>fostering trade relations with other countries; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233964" lims:id="233964"><Label>(d)</Label><Text>contributing to the improvement of world trading conditions.</Text></Paragraph></Section><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="233965" lims:id="233965"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233966" lims:id="233966">Minister for International Development</MarginalNote><Label>14</Label><Text>Subject to section 5, the Minister for International Development is to foster sustainable international development and poverty reduction in developing countries and provide humanitarian assistance during crises by</Text><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233967" lims:id="233967"><Label>(a)</Label><Text>undertaking activities related to international development and humanitarian assistance;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233968" lims:id="233968"><Label>(b)</Label><Text>ensuring the effectiveness of Canada’s international development and humanitarian assistance activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233969" lims:id="233969"><Label>(c)</Label><Text>fostering relations with other countries and organizations engaged in international development or humanitarian assistance activities; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233970" lims:id="233970"><Label>(d)</Label><Text>ensuring Canada’s contributions to international development and humanitarian assistance are in line with Canadian values and priorities.</Text></Paragraph></Section><Heading lims:inforce-start-date="2013-06-26" lims:fid="233971" lims:id="233971" level="1"><TitleText>Heads of Missions</TitleText></Heading><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="233972" lims:id="233972"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233973" lims:id="233973">Definition of <DefinedTermEn>head of mission</DefinedTermEn></MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2013-06-26" lims:fid="233974" lims:id="233974"><Label>(1)</Label><Text>In this section, <DefinedTermEn>head of mission</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233975" lims:id="233975"><Label>(a)</Label><Text>an ambassador, high commissioner or consul-general of Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-26" lims:fid="233976" lims:id="233976"><Label>(b)</Label><Text>any other person that is appointed to represent Canada in another country or a portion of another country or at an international organization or diplomatic conference and that is designated head of mission by the Governor in Council.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-06-26" lims:fid="233977" lims:id="233977"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233978" lims:id="233978">Duties of head of mission</MarginalNote><Label>(2)</Label><Text>Except as otherwise instructed by the Governor in Council, a head of mission is to have the management and direction of their mission and its activities and the supervision of the official activities of the various departments and agencies of the Government of Canada in the country or portion of the country or at the international organization to which they are appointed.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-06-26" lims:fid="233979" lims:id="233979" level="1"><TitleText>Transitional Provisions</TitleText></Heading><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="233980" lims:id="233980"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233981" lims:id="233981">Minister for International Cooperation and President of CIDA</MarginalNote><Label>16</Label><Text>Any person who holds the office of Minister for International Cooperation or of President of the Canadian International Development Agency on the day on which this section comes into force is deemed to hold the office of Minister for International Development or Deputy Minister for International Development, respectively, on and after that day.</Text></Section><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="233982" lims:id="233982"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233983" lims:id="233983">Positions</MarginalNote><Label>17</Label><Text>Nothing in this Act is to be construed as affecting the status of an employee who, immediately before the coming into force of this Act, occupied a position in the Canadian International Development Agency except that the employee, on the coming into force of this section, occupies their position in the Department of Foreign Affairs, Trade and Development under the authority of the Deputy Minister of Foreign Affairs.</Text></Section><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="233984" lims:id="233984"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="233985" lims:id="233985">Transfer of appropriations</MarginalNote><Label>18</Label><Text>Any amount appropriated by an Act of Parliament for the fiscal year in which this section comes into force to defray the charges and expenses of the Canadian International Development Agency that is unexpended is deemed to have been appropriated to defray the charges and expenses of the Department of made under an Act of Parliament or any order, contract, lease, licence or other document, any power, duty or function is vested in or may be exercised or performed by the Minister for International Cooperation or Minister of International Cooperation, the President of the Canadian International Development Agency or any other employee of that Agency, that power, duty or function is vested in or may be exercised or performed by the Minister for International Development, the Deputy Minister for International Development or the appropriate officer of the Department of Foreign Affairs, Trade
