address those matters;</Text></Provision><Provision lims:inforce-start-date="2013-06-19" lims:fid="220931" lims:id="220931" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas measures are required to provide spouses or common-law patners with rights and remedies during a conjugal relationship, when that relationship breaks down or on the death of a spouse or common-law partner in respect of</Text><Provision lims:inforce-start-date="2013-06-19" lims:fid="220932" lims:id="220932" format-ref="indent-0-0" list-item="no" language-align="no"><Text>the use, occupation and possession of family homes on reserves, including exclusive occupation of those homes in cases of family violence, and</Text></Provision><Provision lims:inforce-start-date="2013-06-19" lims:fid="220933" lims:id="220933" format-ref="indent-0-0" list-item="no" language-align="no"><Text>the division of the value of any interests or rights that they hold in or to structures and lands on those reserves;</Text></Provision></Provision><Provision lims:inforce-start-date="2013-06-19" lims:fid="220934" lims:id="220934" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas it is important that, when spouses or common-law partners exercise those rights and seek those remedies, the decision-maker</Text><Provision lims:inforce-start-date="2013-06-19" lims:fid="220935" lims:id="220935" format-ref="indent-0-0" list-item="no" language-align="no"><Text>take into account the best interests of the children, including the interest of any child who is a First Nation member to maintain a connection with that First Nation, and</Text></Provision><Provision lims:inforce-start-date="2013-06-19" lims:fid="220936" lims:id="220936" format-ref="indent-0-0" list-item="no" language-align="no"><Text>be informed by the First Nation with respect to the cultural, social and legal context in the circumstances;</Text></Provision></Provision><Provision lims:inforce-start-date="2013-06-19" lims:fid="220937" lims:id="220937" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas the Government of Canada has recognized the inherent right of self-government as an aboriginal right and is of the view that implementation of that right is best achieved through negotiations;</Text></Provision><Provision lims:inforce-start-date="2013-06-19" lims:fid="220938" lims:id="220938" format-ref="indent-0-0" list-item="no" language-align="no"><Text>Whereas this Act is not intended to define the nature and scope of any right of self-government or to prejudge the outcome of any self-government negotiation;</Text></Provision><Provision lims:inforce-start-date="2013-06-19" lims:fid="220939" lims:id="220939" format-ref="indent-0-0" list-item="no" language-align="no"><Text>And whereas the Parliament of Canada wishes to advance the exercise, in a manner consistent with the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>, of First Nations law-making power over family homes on reserves and matrimonial interests or rights in or to structures and lands on reserves;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2013-06-19" lims:fid="220940" lims:id="220940"><Provision lims:inforce-start-date="2013-06-19" lims:fid="220941" lims:id="220941" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2013-06-19" lims:fid="220942" lims:id="220942"><Heading lims:inforce-start-date="2013-06-19" lims:fid="220943" lims:id="220943" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2013-12-16" title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="F-1.2">Family Homes on Reserves and Matrimonial Interests or Rights Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2013-06-19" lims:fid="220946" lims:id="220946" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2013-12-16" lims:lastAmendedDate="2022-12-15" lims:fid="220947" lims:id="220947"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220948" lims:id="220948">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2013-12-16" lims:fid="220949" lims:id="220949"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2013-12-16" lims:fid="220950" lims:id="220950"><Text><DefinedTermEn>council</DefinedTermEn>, in relation to a First Nation, has the same meaning as the expression <DefinedTermEn>council of the band</DefinedTermEn> in subsection 2(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>. (<DefinedTermFr>conseil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220951" lims:id="220951"><Text><DefinedTermEn>court</DefinedTermEn>, unless otherwise indicated, means, in respect of a province, the court referred to in any of paragraphs (a) to (e) of the definition <DefinedTermEn>court</DefinedTermEn> in subsection 2(1) of the <XRefExternal reference-type="act" link="D-3.4">Divorce Act</XRefExternal>. (<DefinedTermFr>tribunal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220952" lims:id="220952"><Text><DefinedTermEn>designated judge</DefinedTermEn>, in respect of a province, means any of the following persons who are authorized by the lieutenant governor in council of the province to act as a designated judge for the purposes of this Act:</Text><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220953" lims:id="220953"><Label>(a)</Label><Text>a justice of the peace appointed by the lieutenant governor in council of the province;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220954" lims:id="220954"><Label>(b)</Label><Text>a judge of the court in the province; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220955" lims:id="220955"><Label>(c)</Label><Text>a judge of a court established under the laws of the province. (<DefinedTermFr>juge désigné</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220956" lims:id="220956"><Text><DefinedTermEn>family home</DefinedTermEn> means a structure — that need not be affixed but that must be situated on reserve land — where the spouses or common-law partners habitually reside or, if they have ceased to cohabit or one of them has died, where they habitually resided on the day on which they ceased to cohabit or the death occurred. If the structure is normally used for a purpose in addition to a residential purpose, this definition includes only the portion of the structure that may reasonably be regarded as necessary for the residential purpose. (<DefinedTermFr>foyer familial</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220957" lims:id="220957"><Text><DefinedTermEn>First Nation</DefinedTermEn> means a band as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>. (<DefinedTermFr>première nation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220958" lims:id="220958"><Text><DefinedTermEn>First Nation member</DefinedTermEn> means a person whose name appears on the band list of a First Nation or who is entitled to have their name appear on that list. (<DefinedTermFr>membre de la première nation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220959" lims:id="220959"><Text><DefinedTermEn>interest or right</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220960" lims:id="220960"><Label>(a)</Label><Text>the following interests or rights referred to in the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>:</Text><Subparagraph lims:inforce-start-date="2013-12-16" lims:fid="220961" lims:id="220961"><Label>(i)</Label><Text>a right to possession, with or without a Certificate of Possession or a Certificate of Occupation, allotted in accordance with section 20 of that Act,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-16" lims:fid="220962" lims:id="220962"><Label>(ii)</Label><Text>a permit referred to in subsection 28(2) of that Act, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-16" lims:fid="220963" lims:id="220963"><Label>(iii)</Label><Text>a lease under section 53 or 58 of that Act;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="220964" lims:id="1385888"><Label>(b)</Label><Text>an interest or right in or to reserve land that is subject to any <DefinitionRef>First Nation law</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="F-31.46">Framework Agreement on First Nation Land Management Act</XRefExternal> or to any <DefinitionRef>land code</DefinitionRef> within the meaning of subsection 2(2) of that Act, to any First Nation law enacted under a self-government agreement to which Her Majesty in right of Canada is a party, or to any land governance code adopted, or any Kanesatake Mohawk law enacted, under the <XRefExternal reference-type="act" link="K-0.5">Kanesatake Interim Land Base Governance Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220965" lims:id="220965"><Label>(c)</Label><Text>an interest or right in or to a structure — that need not be affixed but that must be situated on reserve land that is not the object of an interest or right referred to in paragraph (a) — which interest or right is recognized by the First Nation on whose reserve the structure is situated or by a court order made under section <XRefInternal>48</XRefInternal>. (<DefinedTermFr>droit ou intérêt</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220966" lims:id="220966"><Text><DefinedTermEn>matrimonial interests or rights</DefinedTermEn> means interests or rights, other than interests or rights in or to the family home, held by at least one of the spouses or common-law partners</Text><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220967" lims:id="220967"><Label>(a)</Label><Text>that were acquired during the conjugal relationship;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220968" lims:id="220968"><Label>(b)</Label><Text>that were acquired before the conjugal relationship but in specific contemplation of the relationship; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220969" lims:id="220969"><Label>(c)</Label><Text>that were acquired before the conjugal relationship but not in specific contemplation of the relationship and that appreciated during the relationship.</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2013-12-16" lims:fid="220970" lims:id="220970"><Text>It excludes interests or rights that were received from a person as a gift or legacy or on devise or descent, and interests or rights that can be traced to those interests or rights. (<DefinedTermFr>droits ou intérêts matrimoniaux</DefinedTermFr>)</Text></ContinuedDefinition></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="220971" lims:id="1191956"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Indigenous Services. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220972" lims:id="220972"><Text><DefinedTermEn>peace officer</DefinedTermEn> means a person referred to in paragraph (c) of the definition <DefinedTermEn>peace officer</DefinedTermEn> in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>.  (<DefinedTermFr>agent de la paix</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-16" lims:fid="220973" lims:id="220973"><Text><DefinedTermEn>spouse</DefinedTermEn> includes either of two persons who have entered in good faith into a marriage that is voidable or void. (<DefinedTermFr>époux</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="220974" lims:id="220974"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220975" lims:id="220975">Words and expressions</MarginalNote><Label>(2)</Label><Text>Unless the context otherwise requires, words and expressions used in this Act have the same meaning as in the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="220976" lims:id="220976"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220977" lims:id="220977">Agreement between spouses or common-law partners</MarginalNote><Label>(3)</Label><Text>For greater certainty, for the purposes of this Act, an agreement between spouses or common-law partners includes an agreement reached through the use of traditional dispute resolution.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="220978" lims:id="220978"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220979" lims:id="220979">Former spouse or common-law partner</MarginalNote><Label>(4)</Label><Text>For the purposes of the definition <DefinedTermEn>matrimonial interests or rights</DefinedTermEn> in subsection (1), subsection (3), section 6, subsections <XRefInternal>15</XRefInternal>(2), (4) and (5) and sections <XRefInternal>16</XRefInternal>, <XRefInternal>20</XRefInternal>, <XRefInternal>26</XRefInternal>, <XRefInternal>28</XRefInternal> to <XRefInternal>33</XRefInternal>, <XRefInternal>43</XRefInternal>, <XRefInternal>45</XRefInternal>, <XRefInternal>48</XRefInternal>, <XRefInternal>49</XRefInternal> and <XRefInternal>54</XRefInternal>, a spouse or common-law partner includes a former spouse or common-law partner.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="220980" lims:id="220980"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220981" lims:id="220981">Term not restrictive</MarginalNote><Label>(5)</Label><Text>The use of the term <DefinedTermEn>application</DefinedTermEn> to describe a proceeding in a court under this Act must not be construed as limiting the name under which and the form and manner in which that proceeding may be taken in that court, and the name, manner and form of the proceeding in that court are those that are provided for by the rules regulating the practice and procedure in that court.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="220982" lims:id="220982"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220983" lims:id="220983">Kanesatake</MarginalNote><Label>(6)</Label><Text>For the purposes of this Act, a reference to a reserve is also a reference to the Kanesatake Mohawk interim land base as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="K-0.5">Kanesatake Interim Land Base Governance province.</Text></Section><Heading lims:inforce-start-date="2013-06-19" lims:fid="220987" lims:id="220987" level="1"><TitleText>Purpose and Application</TitleText></Heading><Section lims:inforce-start-date="2013-12-16" lims:lastAmendedDate="2013-12-16" lims:fid="220988" lims:id="220988"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220989" lims:id="220989">Purpose</MarginalNote><Label>4</Label><Text>The purpose of this Act is to provide for the enactment of First Nation laws and the establishment of provisional rules and procedures that apply during a conjugal relationship, when that relationship breaks down or on the death of a spouse or common-law partner, respecting the use, occupation and possession of family homes on First Nation reserves and the division of the value of any interests or rights held by spouses or common-law partners in or to structures and lands on those reserves.</Text></Section><Section lims:inforce-start-date="2013-12-16" lims:lastAmendedDate="2013-12-16" lims:fid="220990" lims:id="220990"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220991" lims:id="220991">Title to First Nation land</MarginalNote><Label>5</Label><Text>For greater certainty,</Text><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220992" lims:id="220992"><Label>(a)</Label><Text>title to reserve lands is not affected by this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220993" lims:id="220993"><Label>(b)</Label><Text>reserve lands continue to be set apart for the use and benefit of the First Nation for which they were set apart; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="220994" lims:id="220994"><Label>(c)</Label><Text>reserve lands continue to be lands reserved for the Indians within the meaning of Class 24 of section 91 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1867</XRefExternal>.</Text></Paragraph></Section><Section lims:inforce-start-date="2013-12-16" lims:lastAmendedDate="2013-12-16" lims:fid="220995" lims:id="220995"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="220996" lims:id="220996">Spouses or common-law partners</MarginalNote><Label>6</Label><Text>This Act applies to spouses or common-law partners only if at least one of them is a First Nation member or an Indian.</Text></Section><Heading lims:inforce-start-date="2013-06-19" lims:fid="220997" lims:id="220997" level="1"><TitleText>Enactment of First Nation Laws</TitleText></Heading><Heading lims:inforce-start-date="2013-06-19" lims:fid="220998" lims:id="220998" level="2"><TitleText>Power of First Nations</TitleText></Heading><Section lims:inforce-start-date="2013-12-16" lims:lastAmendedDate="2013-12-16" lims:fid="220999" lims:id="220999"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221000" lims:id="221000">Power to enact First Nation laws</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221001" lims:id="221001"><Label>(1)</Label><Text>A First Nation has the power to enact First Nation laws that apply during a conjugal relationship, when that relationship breaks down or on the death of a spouse or common-law partner, respecting the use, occupation and possession of family homes on its reserves and the division of the value of any interests or rights held by spouses or common-law partners in or to structures and lands on its reserves.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221002" lims:id="221002"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221003" lims:id="221003">Contents</MarginalNote><Label>(2)</Label><Text>The laws must include procedures for amending and repealing them and may include</Text><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="221004" lims:id="221004"><Label>(a)</Label><Text>provisions for administering them; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-16" lims:fid="221005" lims:id="221005"><Label>(b)</Label><Text>despite subsection 89(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, provisions for enforcing, on a reserve of the First Nation, an order of a court that includes one or more provisions made under the laws or a decision made or an agreement reached under the laws.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221006" lims:id="221006"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221007" lims:id="221007">Notice to provincial Attorney General</MarginalNote><Label>(3)</Label><Text>When a First Nation intends to enact laws, the council must so notify the Attorney General of any province in which a reserve of the First Nation is situated.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221008" lims:id="221008"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221009" lims:id="221009">Non-application of <XRefExternal reference-type="act" link="S-22">Statutory Instruments intends to enact First Nation laws under section <XRefInternal>7</XRefInternal>, the council of the First Nation must submit the proposed First Nation laws to the First Nation members for their approval.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221014" lims:id="221014"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221015" lims:id="221015">Eligibility to vote</MarginalNote><Label>(2)</Label><Text>Every person who is 18 years of age or over and a member of the First Nation, whether or not resident on a reserve of the First Nation, is eligible to vote in the community approval process.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221016" lims:id="221016"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221017" lims:id="221017">Information to be provided</MarginalNote><Label>(3)</Label><Text>The council must, before proceeding to obtain community approval, take reasonable measures that are in accordance with the First Nation’s practices to locate voters and inform them of their right to vote, the means of exercising that right and the content of the proposed laws.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221018" lims:id="221018"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221019" lims:id="221019">Publication of notice</MarginalNote><Label>(4)</Label><Text>The council must publish a notice of the date, time and place of a vote.</Text></Subsection></Section><Section force of law on the day on which they are approved or on any later day that may be specified in or under them and judicial notice must from then on be taken of the laws in any lims:id="221034">Evidence of laws</MarginalNote><Label>(2)</Label><Text>In the absence of evidence to the contrary, a copy of the First Nation laws appearing to be certified as a true copy by an officer of the First Nation is proof of the original without proof of the officer’s signature or official character.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" First Nation laws, as amended from time to time, must be maintained by the council for public inspection at locations designated by the council.</Text></Subsection><Subsection may occupy that home for a period of 180 days after the day on which the death occurs, whether or not the survivor is a First Nation member or an Indian.</Text></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221070" lims:id="221070"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221071" lims:id="221071">Consent of spouse or common-law partner</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221072" lims:id="221072"><Label>(1)</Label><Text>Subject to the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, a spouse or common-law partner who holds an interest or right in or to the family home must not dispose of or encumber that interest or right during the conjugal relationship without the free and informed consent in writing of the other spouse or common-law partner, whether or not that person is a First Nation member or an Indian.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221073" lims:id="221073"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221074" lims:id="221074">Setting aside</MarginalNote><Label>(2)</Label><Text>If a spouse or common-law partner disposes of or encumbers their interest or right in or to the family home without the required consent of the other spouse or common-law partner, a court may, on application by the other spouse or common-law partner, by order, set aside the transaction and impose conditions on any future disposition or encumbrance of that interest or right by the spouse or common-law partner to whom the interest or right reverts.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221075" lims:id="221075"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221076" lims:id="221076">Exception</MarginalNote><Label>(3)</Label><Text>However, the disposition or encumbrance may not be set aside if the other contracting party acquired it for value and acted in good faith.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221077" lims:id="221077"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221078" lims:id="221078">Damages</MarginalNote><Label>(4)</Label><Text>A spouse or common-law partner who has not given consent to a transaction for which it was required may, without prejudice to any other right, claim damages from the other spouse or common-law partner.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221079" lims:id="221079"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221080" lims:id="221080">Proof of consent</MarginalNote><Label>(5)</Label><Text>The spouse or common-law partner who disposed of or encumbered the interest or right in or to the family home has the burden of proving that the other spouse or common-law partner consented to the disposition or encumbrance.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221081" lims:id="221081"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221082" lims:id="221082">Authorization</MarginalNote><Label>(6)</Label><Text>Subject to the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, a court may, on application by the spouse or common-law partner who holds an interest or right in or to the family home, by order, authorize that person, subject to any conditions that the court considers appropriate, to dispose of or encumber that interest or right without the required consent of the other spouse or common-law partner if the court is satisfied that the other spouse or common-law partner cannot be found, is not capable of consenting or is unreasonably withholding consent.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-06-19" lims:fid="221083" lims:id="221083" level="3"><TitleText>Emergency Protection Order</TitleText></Heading><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221084" lims:id="221084"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221085" lims:id="221085">Order of designated judge</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221086" lims:id="221086"><Label>(1)</Label><Text>On <Language xml:lang="la">ex parte</Language> application by a spouse or common-law partner, a designated judge of the province in which the family home is situated may make an order for a period of up to 90 days that contains one or more of the provisions referred to in subsection (5) and that is subject to any conditions that the judge specifies, if the judge is satisfied that</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221087" lims:id="221087"><Label>(a)</Label><Text>family violence has occurred; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221088" lims:id="221088"><Label>(b)</Label><Text>the order should be made without delay, because of the seriousness or urgency of the situation, to ensure the immediate protection of the person who is at risk of harm or property that is at risk of damage.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221089" lims:id="221089"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221090" lims:id="221090">Applicant</MarginalNote><Label>(2)</Label><Text>The spouse or common-law partner may make the application even if that person has been forced to vacate the family home as a result of family violence.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221091" lims:id="221091"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221092" lims:id="221092">Acting on behalf of applicant</MarginalNote><Label>(3)</Label><Text>A peace officer or other person may also make the application on behalf of the spouse or common-law partner with that person’s consent, or if that person does not consent, with leave of the designated judge granted in accordance with the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221093" lims:id="221093"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221094" lims:id="221094">Considerations</MarginalNote><Label>(4)</Label><Text>In making the order, the designated judge must consider, among other things,</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221095" lims:id="221095"><Label>(a)</Label><Text>the history and nature of the family violence;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221096" lims:id="221096"><Label>(b)</Label><Text>the existence of immediate danger to the person who is at risk of harm or property that is at risk of damage;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221097" lims:id="221097"><Label>(c)</Label><Text>the best interests of any child in the charge of either spouse or common-law partner, including the interest of any child who is a First Nation member to maintain a connection with that First Nation;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221098" lims:id="221098"><Label>(d)</Label><Text>the interests of any elderly person or person with a disability who habitually resides in the family home and for whom either spouse or common-law partner is the caregiver;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221099" lims:id="221099"><Label>(e)</Label><Text>the fact that a person, other than the spouses or common-law partners, holds an interest or right in or to the family home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221100" lims:id="221100"><Label>(f)</Label><Text>the period during which the applicant has habitually resided on the reserve; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221101" lims:id="221101"><Label>(g)</Label><Text>the existence of exceptional circumstances that necessitate the removal of a person other than the applicant’s spouse or common-law partner from the family home in order to give effect to the granting to the applicant of exclusive occupation of that home, including the fact that the person has committed acts or omissions referred to in subsection (9) against the applicant, any child in the charge of either spouse or common-law partner, or any other person who habitually resides in the family home.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221102" lims:id="221102"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221103" lims:id="221103">Content of order</MarginalNote><Label>(5)</Label><Text>The order may contain</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221104" lims:id="221104"><Label>(a)</Label><Text>a provision granting the applicant exclusive occupation of the family home and reasonable access to that home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221105" lims:id="221105"><Label>(b)</Label><Text>a provision requiring the applicant’s spouse or common-law partner and any specified person who habitually resides in the family home — whether or not they are First Nation members or Indians — to vacate the family home, immediately or within a specified period, and prohibiting them from re-entering the home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221106" lims:id="221106"><Label>(c)</Label><Text>a provision directing a peace officer, immediately or within a specified period, to remove the applicant’s spouse or common-law partner and any specified person who habitually resides in the family home — whether or not they are First Nation members or Indians — from the family home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221107" lims:id="221107"><Label>(d)</Label><Text>a provision prohibiting any person who is required to vacate the family home under a provision referred to in paragraph (b) from attending near the family home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221108" lims:id="221108"><Label>(e)</Label><Text>a provision directing a peace officer, within a specified period, to accompany the applicant’s spouse or common-law partner or any specified person to the family home or other location in order to supervise the removal of personal belongings; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221109" lims:id="221109"><Label>(f)</Label><Text>any other provision that the designated judge considers necessary for the immediate protection of the person who is at risk of harm or property that is at risk of damage.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221110" lims:id="221110"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221111" lims:id="221111">Notice of order</MarginalNote><Label>(6)</Label><Text>Any person against whom the order is made and any person specified in the order are bound by the order on receiving notice of it.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221112" lims:id="221112"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221113" lims:id="221113">Service by peace officer</MarginalNote><Label>(7)</Label><Text>A peace officer must serve a copy of the order on the persons referred to in subsection (6) either directly or, if authorized by the court in the province in which the designated judge has jurisdiction, by substituted service in the manner, under the circumstances and on the conditions prescribed by regulation. The peace officer must inform the applicant as soon as each service is effected.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221114" lims:id="221114"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221115" lims:id="221115">No personal liability</MarginalNote><Label>(8)</Label><Text>An action or other proceeding must not be instituted against a peace officer for any act or omission done in good faith in the execution or intended execution of the peace officer’s duties under this section.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221116" lims:id="221116"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221117" lims:id="221117">Definition of <DefinedTermEn>family violence</DefinedTermEn></MarginalNote><Label>(9)</Label><Text>For the purposes of this section, <DefinedTermEn>family violence</DefinedTermEn> means any of the following acts or omissions committed by a spouse or common-law partner against the other spouse or common-law partner, any child in the charge of either spouse or common-law partner, or any other person who habitually resides in the family home:</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221118" lims:id="221118"><Label>(a)</Label><Text>an intentional application of force without lawful authority or consent, excluding any act committed in self-defence;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221119" lims:id="221119"><Label>(b)</Label><Text>an intentional or reckless act or omission that causes bodily harm or damage to property;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221120" lims:id="221120"><Label>(c)</Label><Text>an intentional, reckless or threatened act or omission that causes a reasonable fear of bodily harm or damage to property;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221121" lims:id="221121"><Label>(d)</Label><Text>sexual assault, sexual abuse or the threat of either;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221122" lims:id="221122"><Label>(e)</Label><Text>forcible confinement without lawful authority; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221123" lims:id="221123"><Label>(f)</Label><Text>criminal harassment.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221124" lims:id="221124"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221125" lims:id="221125">Order sent to court for review</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221126" lims:id="221126"><Label>(1)</Label><Text>Immediately after making an order under section <XRefInternal>16</XRefInternal>, a designated judge referred to in paragraph (a) or (c) of the definition <DefinedTermEn>designated judge</DefinedTermEn> in subsection <XRefInternal>2</XRefInternal>(1) must forward a copy of the order and all supporting materials to the court in the province in which the designated judge has jurisdiction.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221127" lims:id="221127"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221128" lims:id="221128">Review by court</MarginalNote><Label>(2)</Label><Text>The court must review the order within three working days after the day on which it is received or, if a judge is not available within that period, as soon as one becomes available.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221129" lims:id="221129"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221130" lims:id="221130">Decision</MarginalNote><Label>(3)</Label><Text>The court, on reviewing the order and the materials, must, by order,</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221131" lims:id="221131"><Label>(a)</Label><Text>confirm the order if the court is satisfied that there was sufficient evidence before the designated judge to support the making of the order; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221132" lims:id="221132"><Label>(b)</Label><Text>direct a rehearing of the matter by the court if the court is not satisfied that the evidence before the designated judge was sufficient to support the making of all or part of the order.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221133" lims:id="221133"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221134" lims:id="221134">Notice</MarginalNote><Label>(4)</Label><Text>The court must give notice to the parties and any person specified in the order made by the designated judge of its decision and of any consequent procedures.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221135" lims:id="221135"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221136" lims:id="221136">Confirmed order</MarginalNote><Label>(5)</Label><Text>An order that is confirmed is deemed to be an order of the court.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221137" lims:id="221137"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221138" lims:id="221138">Rehearing — order continues</MarginalNote><Label>(6)</Label><Text>If the court directs that a matter be reheard, the order continues in effect and is not stayed unless the court orders otherwise.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221139" lims:id="221139"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221140" lims:id="221140">Evidence at rehearing</MarginalNote><Label>(7)</Label><Text>The materials referred to in subsection (1) must be considered as evidence at the rehearing, in addition to any evidence presented at the rehearing, including evidence on the collective interests of the First Nation members, on whose reserve the family home is situated, in their reserve lands.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221141" lims:id="221141"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221142" lims:id="221142">Order on rehearing</MarginalNote><Label>(8)</Label><Text>On a rehearing, the court may, by order, confirm, vary or revoke the order made under section 16, and may extend the duration of the order beyond the period of 90 days referred to in subsection <XRefInternal>16</XRefInternal>(1).</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221143" lims:id="221143"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221144" lims:id="221144">Section <XRefInternal>18</XRefInternal> application</MarginalNote><Label>(9)</Label><Text>If an application is made under section <XRefInternal>18</XRefInternal> and a rehearing has been ordered but has not begun, that application must be heard at the hearing, in addition to any evidence presented at the hearing, including evidence on the collective interests of the First Nation members, on whose reserve the family home is situated, in their reserve lands.</Text></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221154" lims:id="221154"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221155" lims:id="221155">Confidentiality</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221156" lims:id="221156"><Label>(1)</Label><Text>Subject to subsection (2), on application by the parties or on its own motion, the court in the province in which the designated judge has jurisdiction may make an order that contains one or more of the following provisions and that is subject to any conditions that the court specifies:</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221157" lims:id="221157"><Label>(a)</Label><Text>a provision excluding members of the public, other than the parties, from all or part of a rehearing referred to in section <XRefInternal>17</XRefInternal> or a hearing referred to in section <XRefInternal>18</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221158" lims:id="221158"><Label>(b)</Label><Text>a provision prohibiting the publication or broadcasting of any information from the rehearing or hearing, including the name of a party, witness or child in the charge of either party or any information likely to identify any of those persons; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221159" lims:id="221159"><Label>(c)</Label><Text>a provision prohibiting disclosure to the public of any information in a court document or record related to a proceeding under section <XRefInternal>17</XRefInternal> or <XRefInternal>18</XRefInternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221160" lims:id="221160"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221161" lims:id="221161">Conditions</MarginalNote><Label>(2)</Label><Text>The court may only make the order if it is satisfied that</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221162" lims:id="221162"><Label>(a)</Label><Text>the order is necessary for the safety of a party or witness or the safety or physical or emotional well-being of a child; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221163" lims:id="221163"><Label>(b)</Label><Text>protecting a party, witness or child from an undue hardship or adverse effect that could be caused by making the information public outweighs the public’s right to the information.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2013-06-19" lims:fid="221164" lims:id="221164" level="3"><TitleText>Exclusive Occupation Order</TitleText></Heading><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221165" lims:id="221165"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221166" lims:id="221166">Court order</MarginalNote><Label>20</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221167" lims:id="221167"><Label>(1)</Label><Text>A court may, on application by a spouse or common-law partner whether or not that person is a First Nation member or an Indian, order that the applicant be granted exclusive occupation of the family home and reasonable access to that home, subject to any conditions and for the period that the court specifies.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221168" lims:id="221168"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221169" lims:id="221169">Interim order</MarginalNote><Label>(2)</Label><Text>The court may make, on application by either spouse or common-law partner, an interim order to the same effect, pending the determination of the application under subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221170" lims:id="221170"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221171" lims:id="221171">Considerations</MarginalNote><Label>(3)</Label><Text>In making an order under this section, the court must consider, among other things,</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221172" lims:id="221172"><Label>(a)</Label><Text>the best interests of any children who habitually reside in the family home, including the interest of any child who is a First Nation member to maintain a connection with that First Nation;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221173" lims:id="221173"><Label>(b)</Label><Text>the terms of any agreement between the spouses or common-law partners;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221174" lims:id="221174"><Label>(c)</Label><Text>the collective interests of First Nation members in their reserve lands and the representations made by the council of the First Nation on whose reserve the family home is situated with respect to the cultural, social and legal context that pertains to the application;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221175" lims:id="221175"><Label>(d)</Label><Text>the period during which the applicant has habitually resided on the reserve;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221176" lims:id="221176"><Label>(e)</Label><Text>the financial situation and the medical condition of the spouses or common-law partners;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221177" lims:id="221177"><Label>(f)</Label><Text>the availability of other suitable accommodation that is situated on the reserve;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221178" lims:id="221178"><Label>(g)</Label><Text>any existing order made on a matter related to the consequences of the breakdown of the conjugal relationship;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221179" lims:id="221179"><Label>(h)</Label><Text>any family violence;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221180" lims:id="221180"><Label>(i)</Label><Text>any acts or omissions by one of the spouses or common-law partners that reasonably constitute psychological abuse against the other spouse or common-law partner, any child in the charge of either spouse or common-law partner, or any other family member who habitually resides in the family home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221181" lims:id="221181"><Label>(j)</Label><Text>the existence of exceptional circumstances that necessitate the removal of a person other than the applicant’s spouse or common-law partner from the family home in order to give effect to the granting to the applicant of exclusive occupation of that home, including the fact that the person has committed acts or omissions that constitute family violence, or reasonably constitute psychological abuse, against the applicant, any child in the charge of either spouse or common-law partner, or any other family member who habitually resides in the family home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221182" lims:id="221182"><Label>(k)</Label><Text>the interests of any elderly person or person with a disability who habitually resides in the family home and for whom either spouse or common-law partner is the caregiver;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221183" lims:id="221183"><Label>(l)</Label><Text>the fact that a person, other than the spouses or common-law partners, holds an interest or right in or to the family home; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221184" lims:id="221184"><Label>(m)</Label><Text>the views of any person who received a copy of the application, presented to the court in any form that the court allows.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221185" lims:id="221185"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221186" lims:id="221186">Content of order</MarginalNote><Label>(4)</Label><Text>An order made under this section may contain provisions such as</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221187" lims:id="221187"><Label>(a)</Label><Text>a provision requiring the applicant’s spouse or common-law partner and any specified person — whether or not they are First Nation members or Indians — to vacate the family home, immediately or within a specified period, and prohibiting them from re-entering the home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221188" lims:id="221188"><Label>(b)</Label><Text>a provision requiring the applicant’s spouse or common-law partner to preserve the condition of the family home until that person vacates it;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221189" lims:id="221189"><Label>(c)</Label><Text>a provision directing the applicant to make payments to the other spouse or common-law partner toward the cost of other accommodation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221190" lims:id="221190"><Label>(d)</Label><Text>a provision requiring either spouse or common-law partner to pay for all or part of the repair and maintenance of the family home and of other liabilities arising in respect of the family home, or to make payments to the other spouse or common-law partner for those purposes.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221191" lims:id="221191"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221192" lims:id="221192">Emergency protection order revoked</MarginalNote><Label>(5)</Label><Text>An existing order made under any of sections <XRefInternal>16</XRefInternal> to <XRefInternal>18</XRefInternal> in favour of or against one of the spouses or common-law partners is revoked when the court makes an order under this section, except to the extent specified in that order.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221193" lims:id="221193"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221194" lims:id="221194">Application to vary or revoke order</MarginalNote><Label>(6)</Label><Text>Any person in whose favour or against whom an order is made under subsection (1), any person specified in the order, or the holder of an interest or right in or to the family home may apply to the court to have the order varied or revoked if there has been a material change in circumstances. The court may, by order, confirm, vary or revoke the order.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221195" lims:id="221195"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221196" lims:id="221196">Notice to affected persons</MarginalNote><Label>(7)</Label><Text>An applicant for an order under this section must, without delay, send a copy of the application to any person who is of the age of majority or over, whom the applicant is seeking to have the court order to vacate the family home, to any person who holds an interest or right in or to the family home and to any other person specified in the rules regulating the practice and procedure in the court.</Text></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221197" lims:id="221197"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221198" lims:id="221198">Order after death</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221199" lims:id="221199"><Label>(1)</Label><Text>A court may, on application by a survivor whether or not that person is a First Nation member or an Indian, order that the survivor be granted exclusive occupation of the family home and reasonable access to that home, subject to any conditions and for the period that the court specifies.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221200" lims:id="221200"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221201" lims:id="221201">Interim order</MarginalNote><Label>(2)</Label><Text>The court may make, on application by the survivor, an interim order to the same effect, pending the determination of the application under subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221202" lims:id="221202"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221203" lims:id="221203">Considerations</MarginalNote><Label>(3)</Label><Text>In making an order under this section, the court must consider, among other things,</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221204" lims:id="221204"><Label>(a)</Label><Text>the best interests of any children who habitually reside in the family home, including the interest of any child who is a First Nation member to maintain a connection with that First Nation;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221205" lims:id="221205"><Label>(b)</Label><Text>the terms of the will;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221206" lims:id="221206"><Label>(c)</Label><Text>the terms of any agreement between the spouses or common-law partners;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221207" lims:id="221207"><Label>(d)</Label><Text>the collective interests of First Nation members in their reserve lands and the representations made by the council of the First Nation on whose reserve the family home is situated with respect to the cultural, social and legal context that pertains to the application;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221208" lims:id="221208"><Label>(e)</Label><Text>the medical condition of the survivor;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221209" lims:id="221209"><Label>(f)</Label><Text>the period during which the survivor has habitually resided on the reserve;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221210" lims:id="221210"><Label>(g)</Label><Text>the fact that the family home is the only property of significant value in the estate;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221211" lims:id="221211"><Label>(h)</Label><Text>the interests of any person who holds or will hold an interest or right in or to the family home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221212" lims:id="221212"><Label>(i)</Label><Text>the interests of any elderly person or person with a disability who habitually resides in the family home and for whom the survivor is the caregiver;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221213" lims:id="221213"><Label>(j)</Label><Text>the existence of exceptional circumstances that necessitate the removal of a person from the family home in order to give effect to the granting to the survivor of exclusive occupation of that home, including the fact that the person has committed acts or omissions that constitute family violence, or reasonably constitute psychological abuse, against the survivor, any child in the charge of the survivor, or any other family member who habitually resides in the family home; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221214" lims:id="221214"><Label>(k)</Label><Text>the views of any person who received a copy of the application, presented to the court in any form that the court allows.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221215" lims:id="221215"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221216" lims:id="221216">Content of order</MarginalNote><Label>(4)</Label><Text>An order made under this section may contain provisions such as</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221217" lims:id="221217"><Label>(a)</Label><Text>a provision requiring the survivor to preserve the condition of the family home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221218" lims:id="221218"><Label>(b)</Label><Text>a provision requiring any specified person, whether or not that person holds an interest or right in or to the family home, to vacate it immediately or within a specified period, and prohibiting them from re-entering the home; However, a peace officer must serve a copy of the order on those persons if the court so directs.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221222" lims:id="221222"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221223" lims:id="221223">Application to vary or revoke order</MarginalNote><Label>(6)</Label><Text>The survivor, the executor of the will or the administrator of the estate, any person specified in an order made under subsection (1) or the holder of an interest or right in or to the family home may apply to the court to have that order varied or revoked if there has been a material change in circumstances. The court may, by order, confirm, vary or revoke the order.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221224" lims:id="221224"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221225" lims:id="221225">Notice to affected persons</MarginalNote><Label>(7)</Label><Text>An applicant for an order under this section must, without delay, send a copy of the application to the executor of the will or the administrator of the estate, if the applicant knows who those persons are, to the Minister, to any person who is of the age of majority or over, whom the applicant is seeking to have the court order to vacate the family home, to any person who holds an interest or right in or to the family home and to any other person specified in the rules regulating the practice and procedure in the court.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-06-19" lims:fid="221226" lims:id="221226" level="3"><TitleText>Other Provisions</TitleText></Heading><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221227" lims:id="221227"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221228" lims:id="221228">Family violence</MarginalNote><Label>22</Label><Text>For greater certainty, a designated judge or a court may find that family violence has occurred for the purposes of this Act whether or not, in respect of the act or omission in question, a charge has been laid, dismissed or withdrawn or a conviction has been or could be obtained.</Text></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221229" lims:id="221229"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221230" lims:id="221230">Interest or right not affected</MarginalNote><Label>23</Label><Text>For greater certainty, an order made under any of sections <XRefInternal>16</XRefInternal> to <XRefInternal>18</XRefInternal>, <XRefInternal>20</XRefInternal> or <XRefInternal>21</XRefInternal> does not change who holds an interest or right in or to the family home nor does it prevent an executor of a will or an administrator of an estate from transferring such an interest or right to a named beneficiary under the will or to a beneficiary on intestacy, or a court from ordering the transfer of such an interest or right under section <XRefInternal>31</XRefInternal> or <XRefInternal>36</XRefInternal>.</Text></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221231" lims:id="221231"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221232" lims:id="221232">Notice</MarginalNote><Label>24</Label><Text>The person in whose favour an order is made under section <XRefInternal>17</XRefInternal>, <XRefInternal>18</XRefInternal> or <XRefInternal>20</XRefInternal> must, without delay, give notice of the order to any person against whom the order is made and any person specified in the order. However, a peace officer must serve a copy of the order on those persons if the court so directs.</Text></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221233" lims:id="221233"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221234" lims:id="221234">Contiguous property</MarginalNote><Label>25</Label><Text>For the purposes of sections <XRefInternal>16</XRefInternal>, <XRefInternal>20</XRefInternal> and <XRefInternal>21</XRefInternal>, if the reserve land on which the family home is situated is the object of an interest or right referred to in subparagraph (a)(i) of the definition <DefinedTermEn>interest or right</DefinedTermEn> in subsection <XRefInternal>2</XRefInternal>(1), exclusive occupation of the family home includes exclusive occupation of the portion of that land that is contiguous to the family home and that is strictly necessary for the use and enjoyment of the family home.</Text></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221235" lims:id="221235"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221236" lims:id="221236">Leases</MarginalNote><Label>26</Label><Text>When an order made under any of sections <XRefInternal>16</XRefInternal> to <XRefInternal>18</XRefInternal>, <XRefInternal>20</XRefInternal> or <XRefInternal>21</XRefInternal> grants exclusive occupation of the family home to a spouse, common-law partner or survivor who is not a lessee under the lease for the family home, the spouse, common-law partner or survivor is bound by the lease during the period of the order.</Text></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221237" lims:id="221237"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221238" lims:id="221238">Offence</MarginalNote><Label>27</Label><Text>Any person who contravenes an order made under any of sections <XRefInternal>16</XRefInternal> to <XRefInternal>19</XRefInternal>, a provision referred to in paragraph <XRefInternal>20</XRefInternal>(4)(a) contained in an order made under section <XRefInternal>20</XRefInternal> or a provision referred to in paragraph <XRefInternal>21</XRefInternal>(4)(b) contained in an order made under section <XRefInternal>21</XRefInternal> is guilty of an offence punishable on summary conviction and liable</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221239" lims:id="221239"><Label>(a)</Label><Text>in the case of a first offence, to a fine not exceeding $2,000 or to imprisonment for a term not exceeding three months, or to both; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221240" lims:id="221240"><Label>(b)</Label><Text>in the case of a subsequent offence, level="3"><TitleText>Breakdown of a Conjugal Relationship</TitleText></Heading><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221243" lims:id="221243"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221244" lims:id="221244">Division of value</MarginalNote><Label>28</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221245" lims:id="221245"><Label>(1)</Label><Text>When a conjugal relationship breaks down, each spouse or common-law partner is entitled, on application made under section <XRefInternal>30</XRefInternal>, to an amount equal to one half of the value, on the valuation date, of the interest or right that is held by at least one of them in or to the family home and to the amounts referred to in subsections (2) and (3).</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221246" lims:id="221246"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221247" lims:id="221247">First Nation members</MarginalNote><Label>(2)</Label><Text>A spouse or common-law partner who is a member of the First Nation on whose reserve are situated any structures and lands that are the object of interests or rights that are held by the other spouse or common-law partner is also entitled to an amount equal to the total of</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221248" lims:id="221248"><Label>(a)</Label><Text>one half of the value, on the valuation date, of matrimonial interests or rights referred to in paragraphs (a) and (b) of the definition <DefinedTermEn>matrimonial interests or rights</DefinedTermEn> in subsection <XRefInternal>2</XRefInternal>(1) that are held by the other spouse or common-law partner in or to structures and lands situated on a reserve of that First Nation,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221249" lims:id="221249"><Label>(b)</Label><Text>the greater of</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221250" lims:id="221250"><Label>(i)</Label><Text>one half of the appreciation in value, between the day on which the conjugal relationship began and the valuation date inclusive, of matrimonial interests or rights referred to in paragraph (c) of that definition that are held by the other spouse or common-law partner in or to structures and lands situated on a reserve of that First Nation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221251" lims:id="221251"><Label>(ii)</Label><Text>the difference between the payments that the spouse or common-law partner made towards improvements made, between the day on which the conjugal relationship began and the valuation date inclusive, to structures and lands situated on a reserve of that First Nation that are the object of matrimonial interests or rights referred to in that paragraph (c) that are held by the other spouse or common-law partner, and the amount of debts or other liabilities outstanding on the valuation date that were assumed to make the payments, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221252" lims:id="221252"><Label>(c)</Label><Text>the difference between the payments that the spouse or common-law partner made towards improvements made, between the day on which the conjugal relationship began and the valuation date inclusive, to structures and lands situated on a reserve of that First Nation that are the object of interests or rights that are held by the other spouse or common-law partner that would have been matrimonial interests or rights referred to in that paragraph (c) if they had appreciated during the conjugal relationship, and the amount of debts or other liabilities outstanding on the valuation date that were assumed to make the payments.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221253" lims:id="221253"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221254" lims:id="221254">Non-members</MarginalNote><Label>(3)</Label><Text>A spouse or common-law partner who is not a member of the First Nation on whose reserve are situated any structures and lands that are the object of interests or rights that are held by the other spouse or common-law partner is also entitled to an amount equal to the total of</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221255" lims:id="221255"><Label>(a)</Label><Text>one half of the value, on the valuation date, of matrimonial interests or rights referred to in paragraphs (a) and (b) of the definition <DefinedTermEn>matrimonial interests or rights</DefinedTermEn> in subsection <XRefInternal>2</XRefInternal>(1) that are held by the other spouse or common-law partner in or to structures situated on a reserve of that First Nation,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221256" lims:id="221256"><Label>(b)</Label><Text>the greater of</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221257" lims:id="221257"><Label>(i)</Label><Text>one half of the appreciation in value, between the day on which the conjugal relationship began and the valuation date inclusive, of matrimonial interests or rights referred to in paragraph (c) of that definition that are held by the other spouse or common-law partner in or to structures situated on a reserve of that First Nation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221258" lims:id="221258"><Label>(ii)</Label><Text>the difference between the payments that the spouse or common-law partner made towards improvements made, between the day on which the conjugal relationship began and the valuation date inclusive, to structures situated on a reserve of that First Nation that are the object of matrimonial interests or rights referred to in that paragraph (c) that are held by the other spouse or common-law partner, and the amount of debts or other liabilities outstanding on the valuation date that were assumed to make the payments, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221259" lims:id="221259"><Label>(c)</Label><Text>the difference between the payments that the spouse or common-law partner made towards improvements made, between the day on which the conjugal relationship began and the valuation date inclusive, to the following lands and structures situated on a reserve of that First Nation, and the amount of debts or other liabilities outstanding on the valuation date that were assumed to make the payments:</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221260" lims:id="221260"><Label>(i)</Label><Text>lands that are the object of matrimonial interests or rights that are held by the other spouse or common-law partner, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221261" lims:id="221261"><Label>(ii)</Label><Text>structures that are the object of interests or rights that are held by the other spouse or common-law partner that would have been matrimonial interests or rights referred to in that paragraph (c) if they had appreciated during the conjugal relationship.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221262" lims:id="221262"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221263" lims:id="221263">Determination of value</MarginalNote><Label>(4)</Label><Text>For the purposes of subsections (1) to (3), the value of the interests or rights is the difference between</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221264" lims:id="221264"><Label>(a)</Label><Text>the amount that a buyer would reasonably be expected to pay for interests or rights that are comparable to the interests or rights in question, and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221265" lims:id="221265"><Label>(b)</Label><Text>the amount of any outstanding debts or other liabilities assumed for acquiring the interests or rights or for improving or maintaining the structures and lands that are the object of the interests or rights.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221266" lims:id="221266"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221267" lims:id="221267">Agreement by parties</MarginalNote><Label>(5)</Label><Text>Despite subsection (4), on agreement by the spouses or common-law partners, the value of the interests or rights may be determined on any other basis.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221268" lims:id="221268"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221269" lims:id="221269">Definition of <DefinedTermEn>valuation date</DefinedTermEn></MarginalNote><Label>(6)</Label><Text>For the purposes of this section, <DefinedTermEn>valuation date</DefinedTermEn> means</Text><Definition lims:inforce-start-date="2014-12-16" lims:fid="221270" lims:id="221270"><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221271" lims:id="221271"><Label>(a)</Label><Text>in the case of spouses, the earliest of the following days:</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221272" lims:id="221272"><Label>(i)</Label><Text>the day on which the spouses separated with no reasonable prospect of reconciliation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221273" lims:id="221273"><Label>(ii)</Label><Text>the day on which the judgment granting their divorce was rendered,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221274" lims:id="221274"><Label>(iii)</Label><Text>the day on which the marriage was declared a nullity,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221275" lims:id="221275"><Label>(iv)</Label><Text>the day on which one of the spouses made an application related to the consequences of the breakdown of the marriage, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221276" lims:id="221276"><Label>(v)</Label><Text>the day on which one of the spouses made an application to restrain improvident depletion of the interest or right in or to the family home and of the matrimonial interests or rights that is subsequently granted; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221277" lims:id="221277"><Label>(b)</Label><Text>in the case of common-law partners, the earliest of the following days:</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221278" lims:id="221278"><Label>(i)</Label><Text>the day on which one of the common-law partners manifested the intention not to continue the conjugal relationship,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221279" lims:id="221279"><Label>(ii)</Label><Text>the day on which one of the common-law partners made an application related to the consequences of the breakdown of the conjugal relationship, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221280" lims:id="221280"><Label>(iii)</Label><Text>the day on which one of the common-law partners made an application to restrain improvident depletion of the interest or right in or to the family home and of the matrimonial interests or rights that is subsequently granted.</Text></Subparagraph></Paragraph></Definition></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221281" lims:id="221281"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221282" lims:id="221282">Variation of amount</MarginalNote><Label>29</Label><Text>On application by a spouse or common-law partner, a court may, by order, vary the amount owed to or by the applicant under section <XRefInternal>28</XRefInternal> if that amount would be unconscionable, having regard to, among other things,</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221283" lims:id="221283"><Label>(a)</Label><Text>the applicant’s financial responsibility related to the care and upbringing of the children in the applicant’s charge;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221284" lims:id="221284"><Label>(b)</Label><Text>the amount of debts or other liabilities referred to in that section incurred by each spouse or common-law partner;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221285" lims:id="221285"><Label>(c)</Label><Text>any significant change in the value of the interests or rights in question between the valuation date as defined in subsection <XRefInternal>28</XRefInternal>(6) and the day on which the order is made, inclusive;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221286" lims:id="221286"><Label>(d)</Label><Text>the fact that one of the spouses or common-law partners may obtain exclusive occupation of the family home on agreement or under an order referred to in section <XRefInternal>20</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221287" lims:id="221287"><Label>(e)</Label><Text>the availability of accommodation that is comparable to the family home and that is situated on the same reserve as the family home;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221288" lims:id="221288"><Label>(f)</Label><Text>the duration of the conjugal relationship;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221289" lims:id="221289"><Label>(g)</Label><Text>the terms of any agreement between the spouses or common-law partners;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221290" lims:id="221290"><Label>(h)</Label><Text>the reduction of the value of the interests or rights in question as a result of acts or omissions by the applicant’s spouse or common-law partner including the disposition of any such interest or right for less than its fair value, the improvident depletion of any such interest or right, the disposition or encumbrance of the interest or right in or to the family home without the applicant’s required consent, and the encumbrance of that interest or right after the valuation date as defined in subsection <XRefInternal>28</XRefInternal>(6); or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221291" lims:id="221291"><Label>(i)</Label><Text>other determinations that the court may make on any matters related to the consequences of the breakdown of the conjugal relationship.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221292" lims:id="221292"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221293" lims:id="221293">Amount payable</MarginalNote><Label>30</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221294" lims:id="221294"><Label>(1)</Label><Text>On application by one of the spouses or common-law partners made within three years after the day on which they ceased to cohabit, a court may, by order, determine any matter in respect of each spouse’s or common-law partner’s entitlement under sections <XRefInternal>28</XRefInternal> and <XRefInternal>29</XRefInternal> including</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221295" lims:id="221295"><Label>(a)</Label><Text>determining the amount payable by one spouse or common-law partner to the other; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221296" lims:id="221296"><Label>(b)</Label><Text>providing that the amount payable be settled by</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221297" lims:id="221297"><Label>(i)</Label><Text>payment of the amount in a lump sum,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221298" lims:id="221298"><Label>(ii)</Label><Text>payment of the amount by installments,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221299" lims:id="221299"><Label>(iii)</Label><Text>the transfer of an interest or right under an order referred to in section <XRefInternal>31</XRefInternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221300" lims:id="221300"><Label>(iv)</Label><Text>the set-off or compensation of any amounts owed by one spouse or common-law partner to the other, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221301" lims:id="221301"><Label>(v)</Label><Text>any combination of the methods referred to in subparagraphs (i) to (iv).</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221302" lims:id="221302"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221303" lims:id="221303">Extension of time</MarginalNote><Label>(2)</Label><Text>On application by a spouse or common-law partner, a court may, by order, extend the period of three years by any amount of time that it considers appropriate, if the court is satisfied that the applicant failed to make an application within that period for either of the following reasons:</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221304" lims:id="221304"><Label>(a)</Label><Text>circumstances existed that were beyond the control of the applicant; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221305" lims:id="221305"><Label>(b)</Label><Text>only after the period expired did the applicant become aware of any interests or rights referred to in subsections <XRefInternal>28</XRefInternal>(1) to (3).</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2022-12-15" lims:fid="221306" lims:id="221306"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221307" lims:id="221307">Order to transfer interests or rights</MarginalNote><Label>31</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221308" lims:id="221308"><Label>(1)</Label><Text>When a conjugal relationship breaks down, a court may, on application by a spouse or common-law partner who is a First Nation member, order that an interest or right, referred to in subparagraph (a)(i) or paragraph (b) or (c) of the definition <DefinedTermEn>interest or right</DefinedTermEn> in subsection <XRefInternal>2</XRefInternal>(1), in or to any structure or land situated on a reserve of that First Nation be transferred to the applicant if the court is satisfied that</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221309" lims:id="221309"><Label>(a)</Label><Text>the spouses or common-law partners agreed in writing to the transfer of the interest or right, the consent of both parties was free and informed and the agreement is not unconscionable, having regard to, among other things, the factors listed in section <XRefInternal>29</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221310" lims:id="221310"><Label>(b)</Label><Text>the applicant had previously held the interest or right before the cessation of cohabitation; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221311" lims:inforce-start-date="2014-12-16" lims:fid="221313" lims:id="221313">Clarification</MarginalNote><Label>(2)</Label><Text>A transfer may be ordered under subsection (1)</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221314" lims:id="221314"><Label>(a)</Label><Text>in the case of a First Nation that is not referred to in any of paragraphs (b) to (d), despite section <DefinitionRef>First Nation law</DefinitionRef> as defined in subsection 2(1) of that Act, to which the First Nation is subject;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221316" lims:id="221316"><Label>(c)</Label><Text>in the case of a First Nation that has entered into a self-government agreement to which Her Majesty in right of Canada is a party, subject to any First Nation law enacted under the agreement; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221317" lims:id="221317"><Label>(d)</Label><Text>in the case of the depletion</MarginalNote><Label>32</Label><Text>On application by a spouse or common-law partner, a court may make any order that it considers necessary to restrain the improvident depletion of the interest or right in or to the family home and of the matrimonial interests or rights for the purpose of protecting</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221320" lims:id="221320"><Label>(a)</Label><Text>the right that might be granted to the applicant in an order made under section <XRefInternal>20</XRefInternal> or any interest or right that might be transferred to the applicant in an order made under section <XRefInternal>31</XRefInternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221321" lims:id="221321"><Label>(b)</Label><Text>the value of the interests or rights that will be used to determine the amount that might be payable to the applicant in an order made under section <XRefInternal>30</XRefInternal>.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221322" lims:id="221322"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221323" lims:id="221323">Enforcement of agreements</MarginalNote><Label>33</Label><Text>If spouses or common-law partners enter into a written agreement, after they cease to cohabit, that sets out the amount to which each is entitled and how to settle the amount payable by one of the methods referred to in subparagraph <XRefInternal>30</XRefInternal>(1)(b)(i), (ii) or (iv) or any combination of those methods, a court may, on application by one of them, make an order to enforce that agreement if the court is satisfied that the consent of both parties to the agreement was free and informed, and that the agreement is not unconscionable, having regard to, among other things, the factors listed in section <XRefInternal>29</XRefInternal>.</Text></Section><Heading lims:inforce-start-date="2013-06-19" lims:fid="221324" lims:id="221324" level="3"><TitleText>Death of a Spouse or Common-Law Partner</TitleText></Heading><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221325" lims:id="221325"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221326" lims:id="221326">Entitlement of survivor</MarginalNote><Label>34</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221327" lims:id="221327"><Label>(1)</Label><Text>On the death of a spouse or common-law partner, the survivor is entitled, on application made under section <XRefInternal>36</XRefInternal>, to an amount equal to one half of the value, on the valuation date, of the interest or right that was held by the deceased individual in or to the family home and to the amounts referred to in subsections (2) and (3).</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221328" lims:id="221328"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221329" lims:id="221329">First Nation members</MarginalNote><Label>(2)</Label><Text>A survivor who is a member of the First Nation on whose reserve are situated any structures and lands that are the object of interests or rights that were held by the deceased individual is also entitled to an amount equal to the total of</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221330" lims:id="221330"><Label>(a)</Label><Text>one half of the value, on the valuation date, of matrimonial interests or rights referred to in paragraphs (a) and (b) of the definition <DefinedTermEn>matrimonial interests or rights</DefinedTermEn> in subsection <XRefInternal>2</XRefInternal>(1) that were held by the deceased individual in or to structures and lands situated on a reserve of that First Nation,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221331" lims:id="221331"><Label>(b)</Label><Text>the greater of</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221332" lims:id="221332"><Label>(i)</Label><Text>one half of the appreciation in value, between the day on which the conjugal relationship began and the valuation date inclusive, of matrimonial interests or rights referred to in paragraph (c) of that definition that were held by the deceased individual in or to structures and lands situated on a reserve of that First Nation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221333" lims:id="221333"><Label>(ii)</Label><Text>the difference between the payments that the survivor made towards improvements made, between the day on which the conjugal relationship began and the valuation date inclusive, to structures and lands situated on a reserve of that First Nation that are the object of matrimonial interests or rights referred to in that paragraph (c) that were held by the deceased individual, and the amount of debts or other liabilities outstanding on the valuation date that were assumed to make the payments, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221334" lims:id="221334"><Label>(c)</Label><Text>the difference between the payments that the survivor made towards improvements made, between the day on which the conjugal relationship began and the valuation date inclusive, to structures and lands situated on a reserve of that First Nation that are the object of interests or rights that were held by the deceased individual that would have been matrimonial interests or rights referred to in that paragraph (c) if they had appreciated during the conjugal relationship, and the amount of debts or other liabilities outstanding on the valuation date that were assumed to make the payments.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221335" lims:id="221335"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221336" lims:id="221336">Non-members</MarginalNote><Label>(3)</Label><Text>A survivor who is not a member of the First Nation on whose reserve are situated any structures and lands that are the object of interests or rights that were held by the deceased individual is also entitled to an amount equal to the total of</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221337" lims:id="221337"><Label>(a)</Label><Text>one half of the value, on the valuation date, of matrimonial interests or rights referred to in paragraphs (a) and (b) of the definition <DefinedTermEn>matrimonial interests or rights</DefinedTermEn> in subsection <XRefInternal>2</XRefInternal>(1) that were held by the deceased individual in or to structures situated on a reserve of that First Nation,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221338" lims:id="221338"><Label>(b)</Label><Text>the greater of</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221339" lims:id="221339"><Label>(i)</Label><Text>one half of the appreciation in value, between the day on which the conjugal relationship began and the valuation date inclusive, of matrimonial interests or rights referred to in paragraph (c) of that definition that were held by the deceased individual in or to structures situated on a reserve of that First Nation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221340" lims:id="221340"><Label>(ii)</Label><Text>the difference between the payments that the survivor made towards improvements made, between the day on which the conjugal relationship began and the valuation date inclusive, to structures situated on a reserve of that First Nation that are the object of matrimonial interests or rights referred to in that paragraph (c) that were held by the deceased individual, and the amount of debts or other liabilities outstanding on the valuation date that were assumed to make the payments, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221341" lims:id="221341"><Label>(c)</Label><Text>the difference between the payments that the survivor made towards improvements made, between the day on which the conjugal relationship began and the valuation date inclusive, to the following lands and structures situated on a reserve of that First Nation, and the amount of debts or other liabilities outstanding on the valuation date that were assumed to make the payments:</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221342" lims:id="221342"><Label>(i)</Label><Text>lands that are the object of matrimonial interests or rights that were held by the deceased individual, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221343" lims:id="221343"><Label>(ii)</Label><Text>structures that are the object of interests or rights that were held by the deceased individual that would have been matrimonial interests or rights referred to in that paragraph (c) if they had appreciated during the conjugal relationship.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221344" lims:id="221344"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221345" lims:id="221345">Determination of value</MarginalNote><Label>(4)</Label><Text>For the purposes of subsections (1) to (3), the value of the interests or rights is the difference between</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221346" lims:id="221346"><Label>(a)</Label><Text>the amount that a buyer would reasonably be expected to pay for interests or rights that are comparable to the interests or rights in question, and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221347" lims:id="221347"><Label>(b)</Label><Text>the amount of any outstanding debts or other liabilities assumed for acquiring the interests or rights or for improving or maintaining the structures and lands that are the object of the interests or rights.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221348" lims:id="221348"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221349" lims:id="221349">Agreement by parties</MarginalNote><Label>(5)</Label><Text>Despite subsection (4), on agreement by the survivor and the executor of the will or the administrator of the estate, the value of the interests or rights may be determined on any other basis.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221350" lims:id="221350"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221351" lims:id="221351">Definition of <DefinedTermEn>valuation date</DefinedTermEn></MarginalNote><Label>(6)</Label><Text>For the purposes of this section, <DefinedTermEn>valuation date</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221352" lims:id="221352"><Label>(a)</Label><Text>in the case of spouses, the earliest of the following days:</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221353" lims:id="221353"><Label>(i)</Label><Text>the day before the day on which the death occurred,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221354" lims:id="221354"><Label>(ii)</Label><Text>the day on which the spouses ceased to cohabit as a result of the breakdown of the marriage, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221355" lims:id="221355"><Label>(iii)</Label><Text>the day on which the spouse who is now the survivor made an application to restrain improvident depletion of the interest or right in or to the family home and of the matrimonial interests or rights that is subsequently granted; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221356" lims:id="221356"><Label>(b)</Label><Text>in the case of common-law partners, the earlier of the following days:</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221357" lims:id="221357"><Label>(i)</Label><Text>the day before the day on which the death occurred, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221358" lims:id="221358"><Label>(ii)</Label><Text>the day on which the common-law partner who is now the survivor made an application to restrain improvident depletion of the interest or right in or to the family home and of the matrimonial interests or rights that is subsequently granted.</Text></Subparagraph></Paragraph></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221359" lims:id="221359"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221360" lims:id="221360">Variation of amount</MarginalNote><Label>35</Label><Text>On application by an executor of a will or an administrator of an estate, a court may, by order, vary the amount owed to the survivor under section <XRefInternal>34</XRefInternal> if the spouses or common-law partners had previously resolved the consequences of the breakdown of the conjugal relationship by agreement or judicial decision, or if that amount would be unconscionable, having regard to, among other things, the fact that any children of the deceased individual would not be adequately provided for.</Text></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2022-12-15" lims:fid="221361" lims:id="221361"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221362" lims:id="221362">Determination by court</MarginalNote><Label>36</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221363" lims:id="221363"><Label>(1)</Label><Text>On application by a survivor made within 10 months after the day on which the death of their spouse or common-law partner occurs, a court may, by order, determine any matter in respect of the survivor’s entitlement under sections <XRefInternal>34</XRefInternal> and <XRefInternal>35</XRefInternal> including</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221364" lims:id="221364"><Label>(a)</Label><Text>determining the amount payable to the survivor; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221365" lims:id="221365"><Label>(b)</Label><Text>providing that the amount payable to the survivor be settled by</Text><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221366" lims:id="221366"><Label>(i)</Label><Text>payment of the amount in a lump sum,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221367" lims:id="221367"><Label>(ii)</Label><Text>payment of the amount by installments,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221368" lims:id="221368"><Label>(iii)</Label><Text>if the survivor is a First Nation member, by the transfer of an interest or right, referred to in subparagraph (a)(i) or paragraph (b) or (c) of the definition <DefinedTermEn>interest or right</DefinedTermEn> in subsection <XRefInternal>2</XRefInternal>(1), in or to any structure or land situated on a reserve of that First Nation, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-12-16" lims:fid="221369" lims:id="221369"><Label>(iv)</Label><Text>any combination of the methods referred to in subparagraphs (i) to (iii).</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221370" lims:id="221370"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221371" lims:id="221371">Extension of time</MarginalNote><Label>(2)</Label><Text>On application by the survivor, a court may, by order, extend the period of 10 months by any amount of time that it considers appropriate, if the court is satisfied that the survivor failed to make an application within that period for any of the following reasons:</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221372" lims:id="221372"><Label>(a)</Label><Text>the survivor did not know of the death of their spouse or common-law partner until after the period expired;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221373" lims:id="221373"><Label>(b)</Label><Text>circumstances existed that were beyond the control of the survivor; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221374" lims:id="221374"><Label>(c)</Label><Text>only after the period expired did the applicant become aware of any interests or rights referred to in subsections <XRefInternal>34</XRefInternal>(1) to (3).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221375" lims:id="221375"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221376" lims:id="221376">Clarification</MarginalNote><Label>(3)</Label><Text>A transfer may be ordered lims:id="221381"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221382" lims:id="221382">Variation of trust</MarginalNote><Label>(4)</Label><Text>On application by a survivor, an executor of a will or an administrator of an estate, the court may, by order, vary the terms of a trust that is established under the terms of the deceased individual’s will so that the amount that is payable to the survivor may be paid.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221383" lims:id="221383"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221384" lims:id="221384">Notice to affected persons</MarginalNote><Label>(5)</Label><Text>An applicant for an order under this section must, without delay, send a copy of the application to the following persons, to the Minister and to any other person specified in the rules regulating the practice and procedure in the court:</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221385" lims:id="221385"><Label>(a)</Label><Text>in the case where the applicant is the survivor, to the executor of the will or the administrator of the estate, if the applicant knows who those persons are; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221386" lims:id="221386"><Label>(b)</Label><Text>in the case where the applicant is the executor of a will or an administrator of an estate, to the survivor.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221387" lims:id="221387"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221388" lims:id="221388">Notice to beneficiaries</MarginalNote><Label>(6)</Label><Text>On receipt of the copy of the application, the executor of the will or the administrator of the estate or, if neither has been appointed, the Minister must, without delay, send a copy of the application to the named beneficiaries under the will and the beneficiaries on intestacy.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385896" lims:id="1385896" lims:fid="221389" lims:id="221389"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221390" lims:id="221390">Survivor’s choice</MarginalNote><Label>37</Label><Text>If a court decides, after the death of a spouse or common-law partner, that an amount is payable to the survivor under section <XRefInternal>30</XRefInternal> or <XRefInternal>36</XRefInternal>, the survivor may not, in respect of the interest or right in or to the family home and of the matrimonial interests or rights, benefit from the deceased individual’s will or sections 48 to 50.1 of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221391" lims:id="221391"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221392" lims:id="221392">Distribution of estate</MarginalNote><Label>38</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221393" lims:id="221393"><Label>(1)</Label><Text>Subject to subsection (2), an executor of a will or an administrator of an estate must not proceed with the distribution of the estate until one of the following occurs:</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221394" lims:id="221394"><Label>(a)</Label><Text>the survivor consents in writing to the proposed distribution;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221395" lims:id="221395"><Label>(b)</Label><Text>the period of 10 months referred to in subsection <XRefInternal>36</XRefInternal>(1) and any extended period the court may have granted under subsection <XRefInternal>36</XRefInternal>(2) have expired and no application has been made under subsection <XRefInternal>36</XRefInternal>(1) within those periods; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221396" dependants</MarginalNote><Label>(2)</Label><Text>Subsection (1) does not prohibit reasonable advances to survivors or other dependants of the deceased spouse or common-law partner for their lims:id="221400">Two survivors</MarginalNote><Label>(3)</Label><Text>When there are two survivors — a common-law partner and a spouse with whom the deceased individual was no longer cohabiting — and an amount is payable to both under an order referred to in section <XRefInternal>36</XRefInternal>, the executor of the will or the administrator of the estate must pay the survivor who was the common-law partner before paying the survivor who was the spouse.</Text></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221401" lims:id="221401"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221402" lims:id="221402">Improvident depletion</MarginalNote><Label>39</Label><Text>On application by a survivor, a court may make any order that it considers necessary to restrain the improvident depletion of the interest or right in or to the family home and of the matrimonial interests or rights for the purpose of protecting</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221403" lims:id="221403"><Label>(a)</Label><Text>the right that might be granted to the survivor in an order made under section <XRefInternal>21</XRefInternal> or any interest or right that might be transferred to the applicant in an order made under section <XRefInternal>36</XRefInternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221404" lims:id="221404"><Label>(b)</Label><Text>the value of the interests or rights that will be used to determine the amount that might be payable to the survivor in an order made under section <XRefInternal>36</XRefInternal>.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-12-16" agreements</MarginalNote><Label>40</Label><Text>If a survivor and the executor of the will or the administrator of the estate enter into a written agreement that sets out the amount to which the survivor is entitled and how to settle the amount payable by one or both of the methods referred to in subparagraph <XRefInternal>36</XRefInternal>(1)(b)(i) or (ii), a court may, on application by one of them, make an order to enforce that agreement if the court is satisfied that the consent of the survivor to the agreement was free and informed and that the agreement is not lims:fid="221409" lims:id="221409">Notice of application</MarginalNote><Label>41</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221410" lims:id="221410"><Label>(1)</Label><Text>An applicant for an order under this Act, except under sections <XRefInternal>16</XRefInternal> and <XRefInternal>19</XRefInternal>, must, without delay, send a copy of the application to the council of any First Nation on whose reserve the structures and lands in question are situated.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221411" lims:fid="221420" lims:id="221420">Divorce proceeding pending</MarginalNote><Label>(2)</Label><Text>When a divorce proceeding — as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="D-3.4">Divorce Act</XRefExternal> — between spouses is pending, the court that has jurisdiction to hear and determine the matter has jurisdiction to hear and determine an application by one of the spouses.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221421" lims:id="221421"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221422" lims:id="221422">Other proceedings pending</MarginalNote><Label>(3)</Label><Text>When a proceeding, other than a divorce proceeding, related to the consequences of the breakdown of a spouse’s or common-law partner’s conjugal relationship is pending, the court that is seized of the matter has jurisdiction to hear and determine an application by the spouse or common-law pending proceedings</MarginalNote><Label>(4)</Label><Text>If no divorce proceeding is pending and no court is seized of a matter referred to in subsection (3), the court that has jurisdiction to hear and determine an application by a spouse or common-law partner is the court in the province in which the structures and lands in question are situated or, if that property is situated in more than one province, the court in one of those provinces whose jurisdiction is accepted by both spouses or common-law partners or, in the absence of agreement, either the court in the province in which they habitually reside or, if they have ceased to cohabit, in which they habitually resided on the day on which they ceased to cohabit.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221425" lims:id="221425"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221426" lims:id="221426">Exception</MarginalNote><Label>(5)</Label><Text>Despite subsection (4), if the court in a province that is seized of the matter referred to in subsection (3) is not a court as defined in subsection <XRefInternal>2</XRefInternal>(1), the court that has jurisdiction to hear and determine an application by the spouse or common-law partner is the court, as defined in subsection <XRefInternal>2</XRefInternal>(1), in that province.</Text></Subsection></Section><Section of a matter related to the distribution of property on the death of a spouse or common-law partner has jurisdiction to hear and determine an application made under section <XRefInternal>21</XRefInternal>, <XRefInternal>35</XRefInternal>, <XRefInternal>36</XRefInternal>, <XRefInternal>39</XRefInternal> or <XRefInternal>40</XRefInternal> by the survivor, the executor of the will or the administrator of the estate.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221430" lims:id="221430"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221431" lims:id="221431">No pending proceedings</MarginalNote><Label>(2)</Label><Text>If no court is seized of a matter referred to in subsection (1), the court that has jurisdiction to hear and determine the application is the court in the province in which the structures and lands in question are situated or, if that property is situated in more than one province, the court in the province in which both spouses or common-law partners habitually resided on the day on which the death occurred or, if they ceased to cohabit before the death, in which they habitually resided on the day on which they ceased to cohabit.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221432" lims:id="221432"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221433" lims:id="221433">Exception</MarginalNote><Label>(3)</Label><Text>Despite subsection (2), if the court in a province that is seized of the matter referred to in subsection (1) is not a court as defined in subsection <XRefInternal>2</XRefInternal>(1) and the Minister has not consented to the exercise of jurisdiction by the court or directed the matter to the court under section 44 of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>, the court that has jurisdiction to hear and determine the application is the court, as defined in subsection <XRefInternal>2</XRefInternal>(1), in that province.</Text></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221434" reference-type="act" link="D-3.4">Divorce Act</XRefExternal> is deemed, for the purposes of section 21 of that Act, to be an order made under that Act.</Text></Subsection><Subsection level="2"><TitleText>Rules of Practice and Procedure</TitleText></Heading><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2014-12-16" lims:fid="221442" lims:id="221442"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221443" lims:id="221443">Definitions</MarginalNote><Label>47</Label><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221444" lims:id="221444"><Label>(1)</Label><Text>The following definitions apply in this section.</Text><Definition lims:inforce-start-date="2014-12-16" lims:fid="221445" lims:id="221445"><Text><DefinedTermEn>appellate court</DefinedTermEn>, in respect of an appeal from a court, means the court exercising appellate jurisdiction with respect to that appeal. (<DefinedTermFr>cour d’appel</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-12-16" lims:fid="221446" lims:id="221446"><Text><DefinedTermEn>competent authority</DefinedTermEn>, in respect of a court in a province, a court established under the laws of a province or an appellate court in a province, means the body, person or group of persons ordinarily competent under the laws of that province to make rules regulating the practice and procedure in that court. (<DefinedTermFr>autorité compétente</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221447" lims:id="221447"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221448" lims:id="221448">Rules</MarginalNote><Label>(2)</Label><Text>Subject to subsection (3), the competent authority may make rules applicable to any proceedings under this Act in a court, or appellate court, in a province, and to any proceedings under section <XRefInternal>16</XRefInternal> in a court established under the laws of a province, including, without limiting the generality of the foregoing, rules</Text><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221449" lims:id="221449"><Label>(a)</Label><Text>regulating the practice and procedure in the court, including the addition of persons as parties to the proceedings;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221450" lims:id="221450"><Label>(b)</Label><Text>respecting the conduct and disposition of any proceedings under this Act without an oral hearing;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221451" lims:id="221451"><Label>(c)</Label><Text>regulating the sittings of the court;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221452" lims:id="221452"><Label>(d)</Label><Text>respecting the fixing and awarding of costs;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221453" lims:id="221453"><Label>(e)</Label><Text>prescribing and regulating the duties of officers of the court;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221454" lims:id="221454"><Label>(f)</Label><Text>respecting the transfer of proceedings under this Act to or from the court; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-12-16" lims:fid="221455" lims:id="221455"><Label>(g)</Label><Text>prescribing and regulating any other matter considered expedient to attain the ends of justice and carry into effect the purposes and provisions of this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221456" lims:id="221456"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221457" lims:id="221457">Exercise of power</MarginalNote><Label>(3)</Label><Text>The power to make rules conferred by subsection (2) on a competent authority must be exercised in the like manner and subject to the like terms and conditions, if any, as the power to make rules conferred on that authority by the laws of the province.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221458" lims:id="221458"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221459" lims:id="221459">Not statutory instruments</MarginalNote><Label>(4)</Label><Text>Rules made under this section by a competent authority that is not a judicial or quasi-judicial body are deemed not to be statutory instruments within the meaning and for the purposes of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal>.</Text></Subsection></Section><Heading right</MarginalNote><Label>48</Label><Text>For the purposes of this Act, a court may, by order, determine whether a spouse, a common-law partner, a survivor or an estate of a deceased spouse or common-law partner holds an interest or right in or to a structure or land situated on a reserve, on application by one of the spouses or common-law partners, the survivor, the executor of the will, the administrator of the estate or the council of the First Nation on whose reserve the structure or land is situated.</Text></Section><Section lims:inforce-start-date="2014-12-16" application under any of sections <XRefInternal>29</XRefInternal> to <XRefInternal>33</XRefInternal> and both spouses or common-law partners or one of them dies before the application is disposed of, the application may be continued by or against the executor of the will or the administrator of the estate of the spouse or common-law partner who dies.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221466" lims:id="221466"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221467" lims:id="221467">Application by survivor</MarginalNote><Label>(2)</Label><Text>When a survivor makes an application under section <XRefInternal>36</XRefInternal>, <XRefInternal>39</XRefInternal> or <XRefInternal>40</XRefInternal> and the survivor dies before the application is disposed of, the application may be continued by the executor of the will or the administrator of the estate of the survivor.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221468" lims:id="221468"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221469" lims:id="221469">Application by executor or administrator</MarginalNote><Label>(3)</Label><Text>When an executor of a will or an administrator of an estate makes an application under section <XRefInternal>35</XRefInternal> or <XRefInternal>40</XRefInternal> and the survivor dies before the application is disposed of, the application may be continued against the executor of the will or the administrator of the estate of the survivor.</Text></Subsection></Section><Section lims:inforce-start-date="2014-12-16" lims:lastAmendedDate="2022-12-15" lims:fid="221470" under this Act, except under section <XRefInternal>19</XRefInternal>, the applicant must, without delay, send a copy of the order to the Minister or, if the order is in respect of any structure or Nation member nor an Indian and in whose favour an order is made under subsection <XRefInternal>30</XRefInternal>(1), section <XRefInternal>33</XRefInternal>, subsection <XRefInternal>36</XRefInternal>(1) or section <XRefInternal>40</XRefInternal>, a council may, on behalf of the person, enforce the order on a reserve of the council’s First Nation as if the order had been made in favour of the First Nation.</Text></Subsection><Subsection lims:inforce-start-date="2014-12-16" lims:fid="221480" lims:id="221480"><MarginalNote lims:inforce-start-date="2014-12-16" lims:fid="221481" lims:id="221481">Payment into court</MarginalNote><Label>(2)</Label><Text>If the council notifies the person that it will not enforce the order or does not enforce it within a reasonable period after the application is made, a court may, on application by the person, vary the order to require the person against whom the order was made to pay into court the amount payable that was specified in the order, if the court is satisfied that it is necessary for the enforcement of the order.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-06-19" lims:fid="221482" lims:id="221482" level="1"><TitleText>Regulations</TitleText></Heading><Section lims:inforce-start-date="2013-12-16" lims:lastAmendedDate="2013-12-16" lims:fid="221483" lims:id="221483"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221484" lims:id="221484">Governor in Council</MarginalNote><Label>53</Label><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221485" lims:id="221485"><Label>(1)</Label><Text>The Governor in Council may make regulations that the Governor in Council considers necessary for carrying out the purposes and provisions of this Act, including regulations making rules that are applicable to any proceedings under this Act and prescribing anything that by this Act is to be prescribed.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-16" lims:fid="221486" lims:id="221486"><MarginalNote lims:inforce-start-date="2013-12-16" lims:fid="221487" lims:inforce-start-date="2013-06-19" lims:fid="221491" lims:id="221491" type="transitional"><Label>(1)</Label><Text>If, under section <XRefInternal>12</XRefInternal>, sections <XRefInternal>13</XRefInternal> to <XRefInternal>52</XRefInternal> begin to apply to a First Nation,</Text><Paragraph lims:inforce-start-date="2013-06-19" lims:fid="221492" lims:id="221492" type="transitional"><Label>(a)</Label><Text>sections <XRefInternal>28</XRefInternal> to <XRefInternal>33</XRefInternal> apply to spouses or common-law partners in respect of structures and lands situated on a reserve of that First Nation if they ceased to cohabit on or after the day on which those sections began to apply to that First Nation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-19" lims:fid="221493" lims:id="221493" type="transitional"><Label>(b)</Label><Text>sections <XRefInternal>14</XRefInternal>, <XRefInternal>21</XRefInternal> and <XRefInternal>34</XRefInternal> to <XRefInternal>40</XRefInternal> apply to survivors in respect of structures and lands situated on a reserve of that First Nation if the death occurred on or after the day on which those sections began to apply to that First Nation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-06-19" lims:fid="221494" lims:id="221494" type="transitional"><MarginalNote lims:inforce-start-date="2013-06-19" lims:fid="221495" lims:id="221495">Cessation of application</MarginalNote><Label>(2)</Label><Text>If, under section <XRefInternal>12</XRefInternal>, sections <XRefInternal>13</XRefInternal> to <XRefInternal>52</XRefInternal> cease to apply to a First Nation,</Text><Paragraph lims:inforce-start-date="2013-06-19" lims:fid="221496" lims:id="221496" type="transitional"><Label>(a)</Label><Text>proceedings commenced under those sections in respect of structures and lands situated on a reserve of that First Nation must be completed as if those sections had not ceased to apply;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-19" lims:fid="221497" lims:id="221497" type="transitional"><Label>(b)</Label><Text>section <XRefInternal>15</XRefInternal> continues to apply to spouses or common-law partners in respect of the family home situated on a reserve of that First Nation if the interest or right in or to the family home was disposed of or encumbered before the day on which that section ceased to apply to that First Nation, and sections <XRefInternal>41</XRefInternal> to <XRefInternal>51</XRefInternal> continue to apply in respect of proceedings taken by those spouses or common-law partners under section <XRefInternal>15</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-19" lims:fid="221498" lims:id="221498" type="transitional"><Label>(c)</Label><Text>sections <XRefInternal>28</XRefInternal> to <XRefInternal>33</XRefInternal> continue to apply to spouses or common-law partners in respect of structures and lands situated on a reserve of that First Nation if they had ceased to cohabit before the day on which those sections ceased to apply to that First Nation, and sections <XRefInternal>41</XRefInternal> to <XRefInternal>52</XRefInternal> continue to apply in respect of proceedings taken by those spouses or common-law partners under any of sections <XRefInternal>29</XRefInternal> to <XRefInternal>33</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-06-19" lims:fid="221499" lims:id="221499" type="transitional"><Label>(d)</Label><Text>sections <XRefInternal>14</XRefInternal>, <XRefInternal>21</XRefInternal> and <XRefInternal>34</XRefInternal> to <XRefInternal>40</XRefInternal> continue to apply to survivors in respect of structures and lands situated on a reserve of that First Nation if the death occurred before the day on which those sections ceased to apply to that First Nation, and sections <XRefInternal>23</XRefInternal>, <XRefInternal>25</XRefInternal> to <XRefInternal>27</XRefInternal> and <XRefInternal>41</XRefInternal> to <XRefInternal>52</XRefInternal> continue to apply in respect of proceedings involving those survivors taken under section <XRefInternal>21</XRefInternal>, <XRefInternal>35</XRefInternal>, <XRefInternal>36</XRefInternal>, <XRefInternal>39</XRefInternal> or <XRefInternal>40</XRefInternal>.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:lastAmendedDate="2022-12-15" lims:fid="221500" lims:id="1385902" type="transitional"><MarginalNote lims:inforce-start-date="2022-12-15" lims:enacted-date="2022-12-15" lims:fid="1385903" lims:id="1385903">Subsection 12(2)</MarginalNote><Label>55</Label><Text>Subsection 12(2) does not apply to a First Nation that, on the day on which this section comes into force, is a <DefinitionRef>First Nation</DefinitionRef> within the meaning of subsection 2(2) of the <XRefExternal reference-type="act"
