lims:fid="214477" lims:id="214477">Rendering seal ineffective is breaking it</MarginalNote><Label>(2)</Label><Text>The rendering ineffective of a seal pertaining to any meter shall, for the purposes of this Act, be deemed to constitute breaking the seal.</Text></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214478" lims:id="214478"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214479" lims:id="214479">Construction</MarginalNote><Label>(3)</Label><Text>Any reference in this Act, except in subsection 23(2), to the owner of a meter shall, in the case of a meter used by a contractor for any purpose mentioned in subsection 9(1), be construed as a reference to the lims:inforce-start-date="2002-12-31" lims:fid="214484" lims:id="214484">Units of electricity and gas</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214485" lims:id="214485"><Label>(1)</Label><Text>Subject to subsection (2) and the regulations,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214486" lims:id="214486"><Label>(a)</Label><Text>the unit of measurement for the sale of electricity shall be</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214487" lims:id="214487"><Label>(i)</Label><Text>the watt hour,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214488" lims:id="214488"><Label>(ii)</Label><Text>the volt-ampere hour,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214489" lims:id="214489"><Label>(iii)</Label><Text>the var hour, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214490" lims:id="214490"><Label>(iv)</Label><Text>the joule; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214491" lims:id="214491"><Label>(b)</Label><Text>the unit of measurement for the sale of gas shall be</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214492" lims:id="214492"><Label>(i)</Label><Text>in the case of sale by volume, the cubic metre or the cubic foot,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214493" lims:id="214493"><Label>(ii)</Label><Text>in the case of sale by energy units, the joule or the British Thermal Unit, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214494" lims:id="214494"><Label>(iii)</Label><Text>in the case of sale by mass, the kilogram.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214495" lims:id="214495"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214496" lims:id="214496">Multiples and submultiples of units</MarginalNote><Label>(2)</Label><Text>Any requirement of this section that a unit of measurement be a unit specified in subsection (1) is sufficiently complied with if the unit of measurement</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214497" lims:id="214497"><Label>(a)</Label><Text>is any multiple or submultiple of the unit so specified, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214498" lims:id="214498"><Label>(b)</Label><Text>is capable of being expressed by way of a prefix specified in Part V of Schedule I to the <XRefExternal reference-type="act" link="W-6">Weights and Measures Act</XRefExternal>,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="214499" lims:id="214499"><Text>but nothing in this subsection applies to a cubic foot specified in subparagraph (1)(b)(i) or a British Thermal Unit necessary to establish the units of measurement for sales referred to in section 3 shall remain in the custody of the Minister and form part of the system of reference standards referred to in the other than a standard designated under section 13 of the <XRefExternal reference-type="act" link="W-6">Weights and Measures Act</XRefExternal>, that is required for measurement or examination of electricity, gas or meters shall be used by an accredited meter verifier unless</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214508" lims:id="214508"><Label>(a)</Label><Text>the apparatus is calibrated, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214509" lims:id="214509"><Label>(b)</Label><Text>such calibration is certified,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="214510" lims:id="214510"><Text>in prescribed manner.</Text></ContinuedSectionSubsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="214512" lims:id="214512">1980-81-82-83, c. 87, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-08-01" lims:fid="214513" lims:id="214513" level="1"><TitleText>Registration</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214514" lims:id="214514"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214515" lims:id="214515">Register of contractors</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214516" lims:id="214516"><Label>(1)</Label><Text>The director shall maintain, in accordance with the regulations, a register for the registration of contractors.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214517" lims:id="214517"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214518" lims:id="214518">Certificate of registration</MarginalNote><Label>(2)</Label><Text>No contractor shall sell electricity or gas on the basis of measurement unless he holds a certificate of registration issued under the authority of this subsection in respect of the supply of electricity or gas, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214519" lims:id="214519"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214520" lims:id="214520">Contractor ceasing to be seller</MarginalNote><Label>(3)</Label><Text>Where a contractor ceases to sell electricity or gas on the basis of measurement, the contractor shall forthwith give notice, in prescribed manner, to the director to that effect and return to the director the certificate of registration referred to in subsection (2).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="214522" lims:id="214522">1980-81-82-83, c. 87, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-08-01" lims:fid="214523" lims:id="214523" level="1"><TitleText>Contractor’s Access and Reports</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214524" lims:id="214524"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214525" lims:id="214525">Right of access by contractor</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214526" lims:id="214526"><Label>(1)</Label><Text>A contractor may, at all reasonable times, for the purpose of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214527" lims:id="214527"><Label>(a)</Label><Text>inspecting, testing, installing, repairing, removing or changing, when it is lawful for him to do so, any meters, wiring, piping, fittings or other apparatus of the contractor for the measurement or conveyance of electricity or gas supplied by him, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214528" lims:id="214528"><Label>(b)</Label><Text>ascertaining the quantity or making other measurements of the electricity or gas consumed or supplied,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="214529" lims:id="214529"><Text>enter any premises belonging to or occupied by the purchaser to whom the contractor has undertaken to supply the electricity or gas.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214530" lims:id="214530"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214531" lims:id="214531">Liability of contractor</MarginalNote><Label>(2)</Label><Text>A contractor that has exercised any right of entry pursuant to subsection (1) is responsible for, and shall forthwith repair and make good, all damage caused by the entry or by any inspection, testing, installation, repair, removal or change for the purpose of prescribed intervals to the director, in respect of any gas supplied by the contractor, such particulars of the service pressures as are prescribed.</Text><HistoricalNote><HistoricalNoteSubItem lims:fid="214538" lims:id="214538" level="1"><TitleText>Meters</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214539" lims:id="214539"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214540" lims:id="214540">Verification</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214541" lims:id="214541"><Label>(1)</Label><Text>Subject to subsections (2) and (3), where a contractor or purchaser intends to use or cause to be used a meter for the purpose of obtaining the basis of a charge for electricity or gas supplied by or to him, the meter shall not, until it has been verified and sealed in accordance with this Act and the regulations, be put into service.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214542" lims:id="214542"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214543" lims:id="214543">Temporary dispensation</MarginalNote><Label>(2)</Label><Text>The director may grant permission for the putting into service, without verification and sealing or without sealing, of any meter or any class, type or design of meter on a temporary basis under such terms and conditions and for such period as the director stipulates.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214544" lims:id="214544"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214545" lims:id="214545">Permanent dispensation</MarginalNote><Label>(3)</Label><Text>The director may grant approval for the putting into service, without verification and sealing or without sealing, of any meter or any class, type or design of meter.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214546" lims:id="214546"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214547" lims:id="214547">Director’s approval required for verification</MarginalNote><Label>(4)</Label><Text>No meter shall be verified pursuant to this Act until it or the class, type or design of meter to which it belongs has received the approval of the director.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="214549" lims:id="214549">1980-81-82-83, c. 87, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2011-11-29" lims:lastAmendedDate="2011-11-29" lims:fid="214550" lims:id="214550"><MarginalNote lims:inforce-start-date="2011-11-29" lims:fid="214551" lims:id="214551">Accredited meter verifiers</MarginalNote><Label>10</Label><Text>Subject to the regulations, any person</Text><Paragraph lims:inforce-start-date="2011-11-29" lims:fid="214552" lims:id="214552"><Label>(a)</Label><Text>may, on making application in prescribed manner, be accredited by the director for purposes of the verification, sealing, reverification and resealing of any meter or any class, type or design of meter and the execution of prescribed incidental functions by that person or their employee, agent or mandatary; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-11-29" lims:fid="214553" lims:id="214553"><Label>(b)</Label><Text>shall, in the event of the granting of the application under paragraph (a), be issued with a certificate of accreditation in prescribed form by the director.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:id="214556"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214557" lims:id="214557">Revocation of permission</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214558" lims:id="214558"><Label>(1)</Label><Text>A permission granted under subsection 9(2) may, by notice given in prescribed manner, be revoked by the director for failure to comply with any of the terms or conditions on which the permission was granted.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214559" lims:id="214559"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214560" lims:id="214560">Revocation of approval or accreditation</MarginalNote><Label>(2)</Label><Text>Any approval granted under subsection 9(3) or (4) or accreditation granted under section 10 may, by notice given in prescribed manner, be revoked by the Minister for failure to comply with any conditions to which that approval or accreditation has been made subject in accordance with the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214561" lims:id="214561"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214562" lims:id="214562">Requirement on revocation</MarginalNote><Label>(3)</Label><Text>Where a permission under subsection 9(2) or an approval under subsection 9(3) is revoked, any meter that is in service pursuant to the permission or approval at the time of the revocation shall thereupon be taken out of service unless, in the case of revocation of an approval, the notice of revocation otherwise provides.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214563" lims:id="214563"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214564" lims:id="214564">Right to make representations</MarginalNote><Label>(4)</Label><Text>No permission under subsection 9(2), approval under subsection 9(3) or (4) or accreditation under section 10 shall be revoked unless</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214565" lims:id="214565"><Label>(a)</Label><Text>notice of the proposal to revoke it has been given in prescribed manner;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214566" lims:id="214566"><Label>(b)</Label><Text>any interested person objecting to the proposal has been afforded reasonable opportunity to make representations with respect to his objection; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214567" lims:id="214567"><Label>(c)</Label><Text>the representations, if any, so made have been taken into account in lims:id="214640"><Label>(1)</Label><Text>At the request of a contractor or purchaser who is dissatisfied with the condition or registration of any meter used in respect of electricity or gas supplied by or to him, an inspector shall proceed in prescribed manner and shall collect such payments, from such persons, at or within such times and for the provision of such services and facilities incidental to proceeding in that manner as are prescribed.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214641" lims:id="214641"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214642" lims:id="214642">Duties of inspector</MarginalNote><Label>(2)</Label><Text>Where an inspector proceeds in the matter of any request pursuant to subsection (1), he shall issue to each person directly concerned with the matter, including the owner of any meter tested by the inspector in the course of so proceeding, a certificate setting forth the inspector’s findings with respect to that matter and findings so set forth shall include the result of the test, if any.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214643" lims:id="214643"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214644" lims:id="214644">Reference to director for reconsideration</MarginalNote><Label>(3)</Label><Text>Where a person who is provided with a certificate of findings by an inspector pursuant to subsection (2) gives notice to the inspector within a prescribed time that he is dissatisfied with the findings, the inspector shall refer the matter to the director for reconsideration in prescribed manner.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214653" lims:id="214653">Idem</MarginalNote><Label>(2)</Label><Text>Subject to subsections (3) and (4), where, on a proceeding in the matter of any request pursuant to section 23, a meter is found to register with an error not permitted by the regulations and the meter was, at the date of the receipt of the request, more than three months past due for reverification, the error shall be deemed to have existed from the date on which the meter was last required to be reverified.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214654" lims:id="214654"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214655" lims:id="214655">Incorrect connection, etc.</MarginalNote><Label>(3)</Label><Text>Subject to subsection (4), where, on a proceeding in the matter of any request pursuant to section 23, it is found that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214656" lims:id="214656"><Label>(a)</Label><Text>a meter has been incorrectly connected,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214657" lims:id="214657"><Label>(b)</Label><Text>there has been an incorrect use of any prescribed apparatus respecting the registration of a meter, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214658" lims:id="214658"><Label>(c)</Label><Text>an incorrect multiplier has been used,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="214659" lims:id="214659"><Text>any error resulting therefrom and not permitted by the regulations shall be deemed to have existed from the time of installation of the meter so connected or for the period that the apparatus or multiplier has been in use, as the case may be.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214660" lims:id="214660"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214661" lims:id="214661">Where error’s duration determined</MarginalNote><Label>(4)</Label><Text>Where the duration of the existence of an error referred to in subsection (1), (2) or (3) is, on a proceeding mentioned therein, determined from past readings of a meter or other information, nothing in subsection (1), (2) or (3) applies to that error.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214662" lims:id="214662"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214663" lims:id="214663">Liability</MarginalNote><Label>(5)</Label><Text>A contractor or purchaser, as the case may be, is liable for the amount of the charge for electricity or gas determined on the basis of the full error and the time for which the error is, as provided in subsection (1), (2) or (3) or contemplated in subsection (4), deemed or determined to have existed.</Text></Subsection><Subsection lims:fid="214677" lims:id="214677"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="214678" lims:id="214678">Director’s functions</MarginalNote><Label>(2)</Label><Text>The director has, under the Minister, the direction and general supervision of the administration and enforcement of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="214679" lims:id="214679"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="214680" lims:id="214680">Designation to perform inspector’s functions</MarginalNote><Label>(3)</Label><Text>Despite anything in this Act, except as provided in subsections (5) and (5.1), any functions that pertain to an inspector’s office may be performed by any person who is designated as an inspector by the Minister for the purpose of the performance of those functions.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="214681" lims:id="214681"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="214682" lims:id="214682">Privileges, etc., of designated inspector</MarginalNote><Label>(4)</Label><Text>A person who has been designated under subsection (3) has, in relation to the execution of any functions pursuant thereto, the privileges and immunities of a holder of the office of inspector in so far as they may relate to the execution lims:id="214684">Restrictions</MarginalNote><Label>(5)</Label><Text>No person who is an accredited meter verifier or a seller of electricity, gas or meters or who is employed by or is the agent or mandatary of an accredited meter verifier or a seller of electricity, gas or meters may be appointed or designated under this section or act as a person so appointed or designated.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="214685" lims:id="214685"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="214686" lims:id="214686">Other restrictions</MarginalNote><Label>(5.1)</Label><Text>A person designated as an inspector under subsection (3) is not authorized to exercise the powers set out in subsection 29.12(1).</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="214687" lims:id="214687"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="214688" lims:id="214688">Inspector’s right of access to premises</MarginalNote><Label>(6)</Label><Text>Subject to subsection (7), an inspector may, at all reasonable times, for the purpose of performing any function pursuant to this Act, enter any premises where electricity or gas is being generated, produced, stored, distributed or used.</Text></Subsection><Subsection meter;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214713" lims:id="214713"><Label>(b)</Label><Text>prescribing, notwithstanding anything in the <XRefExternal reference-type="act" link="W-6">Weights and Measures Act</XRefExternal>, any units of measurement in lieu of, or as alternatives or in addition to, units specified, whether as alternatives or otherwise, in section 3;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214714" lims:id="214714"><Label>(c)</Label><Text>specifying or providing for specification of the manner in which meters of any class, type or design, or in any circumstances, are to be tested, verified, sealed, reverified or resealed and the manner and circumstances in which those meters are to be stamped, restamped, labelled, relabelled, tagged, retagged or otherwise marked;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214715" lims:id="214715"><Label>(d)</Label><Text>authorizing the director to establish plans for the verification and reverification of meters of any class, type or design, or in any circumstances, by statistical means on the basis of sampling;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214716" lims:id="214716"><Label>(e)</Label><Text>prescribing the fees payable by any person for any certificate, inspection or service provided by an inspector pursuant to this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214717" lims:id="214717"><Label>(f)</Label><Text>determining the nature of any charges that a person may be required to pay in relation to any inspection or service provided by an inspector pursuant to this Act and the manner in which those charges shall be determined;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214718" lims:id="214718"><Label>(g)</Label><Text>prescribing the time when, or period of time within which, and the manner in which any of the fees and charges referred to in paragraphs (e) and (f) shall be paid;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214719" lims:id="214719"><Label>(h)</Label><Text>specifying the variations in the conditions of supply within which the readings of any verified meter or of verified meters of any class, type or design shall be lawful;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214720" lims:id="214725"><Label>(ii)</Label><Text>the procedure for making application for the grant of any permission, approval or accreditation or for registration under section of inspectors and governing the execution of their functions;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214728" lims:id="214728"><Label>(l)</Label><Text>prescribing the conditions and manner of determination of units of measurement referred to in this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214729" lims:id="214729"><Label>(m)</Label><Text>governing the pressure under which gas is to be supplied;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214730" lims:id="214730"><Label>(n)</Label><Text>providing for determination of the quantity, energy density or energy concentration of gas and establishing standards therefor;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214731" lims:id="214731"><Label>(o)</Label><Text>specifying or providing for specification of the manner of making such tests, other than those in regard to meters, as are required under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214732" lims:id="214732"><Label>(p)</Label><Text>authorizing the director to delegate his functions under any provision of this Act, other than subsection 11(1) or section 22;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214733" lims:id="214733"><Label>(q)</Label><Text>exempting, conditionally or unconditionally, any meter or any class, type or design of meter or any class or type of transaction from any or all of the provisions of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214734" lims:id="214734"><Label>(r)</Label><Text>prohibiting, absolutely or to any extent, the presence of anything in gas supplied to a purchaser; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214735" lims:id="214735"><Label>(s)</Label><Text>prescribing any matter required or authorized by this Act to be prescribed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214736" lims:id="214736"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214737" lims:id="214737">Publication of proposed regulations</MarginalNote><Label>(2)</Label><Text>Subject to subsection (3), a copy of each regulation that the Governor in Council proposes to make pursuant to this Act shall be published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> and a reasonable opportunity shall be afforded to interested persons to make representations with respect thereto.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214738" lims:id="214805"><Label>(1)</Label><Text>After considering a request made under paragraph <XRefInternal>29.13</XRefInternal>(2)(a), the Minister may enter into a compliance agreement, as described in that paragraph, with the person making the request on any conditions that are satisfactory to the Minister, which conditions may</Text><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214806" lims:id="214806"><Label>(a)</Label><Text>include a provision for the giving of reasonable security, in a form and in an amount that are satisfactory to the Minister, as a guarantee that the person will comply with the compliance agreement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214807" lims:id="214807"><Label>(b)</Label><Text>provide for the reduction, in whole or in part, of the amount of the penalty for the violation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214808" lims:id="214808"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214809" lims:id="214809">Deeming</MarginalNote><Label>(2)</Label><Text>A person who enters into a compliance agreement with the Minister is, on doing so, deemed to have committed the violation to which the compliance agreement relates, and the proceedings commenced in respect of the violation under section <XRefInternal>29.12</XRefInternal> are ended.</Text></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214810" lims:id="214810"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214811" lims:id="214811">If compliance agreement complied with</MarginalNote><Label>(3)</Label><Text>If the Minister is of the opinion that a person who has entered into a compliance agreement has complied with it, the Minister shall cause the person to be provided with a notice to that effect, at which time any security given by the person under that agreement shall be returned to the person.</Text></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214812" lims:id="214812"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214813" lims:id="214813">If compliance agreement not complied with</MarginalNote><Label>(4)</Label><Text>If the Minister is of the opinion that a person who has entered into a compliance agreement has not complied with it, the Minister shall cause the person to be provided with a notice of default to the effect that</Text><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214814" lims:id="214814"><Label>(a)</Label><Text>instead of the penalty set out in the compliance agreement, the person is liable to pay, within the prescribed time and in the prescribed manner that are set out in the notice of default, twice the amount of the penalty set out in the notice of violation and, for greater certainty, subsection <XRefInternal>29.11</XRefInternal>(3) does not apply in respect of that amount; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214815" lims:id="214815"><Label>(b)</Label><Text>the security, if any, given by the person under the compliance agreement is forfeited to Her Majesty in right of Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214816" lims:id="214816"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214817" lims:id="214817">Effect of notice of default</MarginalNote><Label>(5)</Label><Text>Once they have been provided with the notice of default, the person shall pay the amount set out in it or, if the notice provides for the forfeiture of the security given under the compliance agreement, that security is forfeited to Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214818" lims:id="214818"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214819" lims:id="214819">Effect of payment</MarginalNote><Label>(6)</Label><Text>If the person pays the amount set out in a notice of default under paragraph (4)(a) within the prescribed time and in the prescribed manner that are set out in the notice,</Text><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214820" lims:id="214820"><Label>(a)</Label><Text>the Minister shall accept the amount as complete satisfaction of the lims:fid="214838" lims:id="214838">Review — violation</MarginalNote><Label>29.16</Label><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214839" lims:id="214839"><Label>(1)</Label><Text>After completing a review requested under paragraph <XRefInternal>29.13</XRefInternal>(2)(b) with respect to the acts or omissions that constitute the alleged violation identified in the notice of violation, the Minister shall determine whether the person who is named in the notice committed the violation and, if the Minister determines that the person did so but considers that the amount of the penalty for the violation was not established in accordance with the regulations, the Minister shall correct that amount and cause the person to be provided with a notice of the Minister’s decision.</Text></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214840" lims:id="214840"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214841" lims:id="214841">Review — penalty</MarginalNote><Label>(2)</Label><Text>After completing a review requested under paragraph <XRefInternal>29.13</XRefInternal>(2)(b) with respect to the amount of the penalty set out in the notice of violation, the Minister shall determine whether the amount of the penalty was established in accordance with the regulations and, if the Minister determines that it was not, the Minister shall correct that amount and cause the person to be provided with a notice of the Minister’s decision.</Text></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214842" lims:id="214842"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214843" lims:id="214843">Payment</MarginalNote><Label>(3)</Label><Text>The person who is provided with a notice of the Minister’s decision is liable to pay the amount of the penalty that is set out in it within the prescribed time and in the prescribed manner that are set out in the notice.</Text></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214844" lims:id="214844"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214845" lims:id="214845">Effect of payment</MarginalNote><Label>(4)</Label><Text>If the person pays the amount of the penalty that is set out in the notice of the Minister’s decision within the prescribed time and in the prescribed manner that are set out in the notice,</Text><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214846" lims:id="214846"><Label>(a)</Label><Text>the Minister shall accept the amount as complete satisfaction of the penalty; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214847" lims:id="214847"><Label>(b)</Label><Text>the proceedings commenced in respect of the violation under section <XRefInternal>29.12</XRefInternal> are ended.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214848" lims:id="214848"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214849" lims:id="214849">Submissions in writing</MarginalNote><Label>(5)</Label><Text>The Minister is to consider only written evidence and written submissions in determining whether a person committed a violation or whether the amount of a penalty was established in accordance with the 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-08-01" lims:fid="214852" lims:id="214852" level="2"><TitleText>Recovery of Debts</TitleText></Heading><Section lims:inforce-start-date="2014-08-01" lims:lastAmendedDate="2014-08-01" lims:fid="214853" lims:id="214853"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214854" lims:id="214854">Debts to Her Majesty</MarginalNote><Label>29.17</Label><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214855" lims:id="214855"><Label>(1)</Label><Text>The following amounts are debts due to Her Majesty in right of Canada that may be recovered in the Federal Court:</Text><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214856" lims:id="214856"><Label>(a)</Label><Text>the amount of a penalty set out in a notice of violation, beginning on the day on which it is required to be paid in accordance with the notice, unless a request is made to enter into a compliance agreement with the Minister or to have the Minister review the acts or omissions that constitute the violation or the amount of the penalty;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214857" lims:id="214857"><Label>(b)</Label><Text>every amount set out in a compliance agreement entered into with the Minister under subsection <XRefInternal>29.14</XRefInternal>(1), beginning on the day specified in that agreement or, if no day is specified, beginning on the day on which the agreement is entered into;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214858" lims:id="214858"><Label>(c)</Label><Text>the amount set out in a notice of default referred to in subsection <XRefInternal>29.14</XRefInternal>(4), beginning on the day specified in the notice;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214859" lims:id="214859"><Label>(d)</Label><Text>the amount of a penalty set out in the Minister’s notice under subsection <XRefInternal>29.15</XRefInternal>(1) or in the notice of the Minister’s decision made under subsection <XRefInternal>29.16</XRefInternal>(1) or (2), beginning on the day specified in the notice; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214860" lims:id="214860"><Label>(e)</Label><Text>the amount of any reasonable expenses incurred in attempting to recover an amount referred to in any of assists in making any certificate required under this Act or purporting to be a certificate so required or any stamp, seal, label, tag or mark prescribed for the purposes of this Act or purporting to be a stamp, seal, label, tag or mark so prescribed,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214929" lims:id="214929"><Label>(b)</Label><Text>knowingly sells, utters or disposes of, lets, uses, lends or exposes for sale any meter with any stamp, seal, label, tag or mark thereon made or obtained by means of the commission of an offence under paragraph (a) or section 32 or made or affixed by way of the use of anything so obtained,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214930" lims:id="214930"><Label>(c)</Label><Text>in relation to the administration of this Act, knowingly</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214931" lims:id="214931"><Label>(i)</Label><Text>makes any false representation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214932" lims:id="214932"><Label>(ii)</Label><Text>makes or causes to be made any false entry in any register or record,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214933" lims:id="214933"><Label>(iii)</Label><Text>makes or causes to be made any false document or makes any alteration, false in a material respect, to the form of a copy of any document, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214934" lims:id="214934"><Label>(iv)</Label><Text>produces or tenders any document containing false information,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214935" lims:id="214935"><Label>(d)</Label><Text>for a fraudulent purpose,</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214936" lims:id="214936"><Label>(i)</Label><Text>repairs or alters, or causes to be repaired or altered, or tampers with or does any other act in relation to a meter, or any wires or pipes leading to a meter, so as to cause the meter to register with an error, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214937" lims:id="214937"><Label>(ii)</Label><Text>replaces any meter with a meter calculated to mislead, or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214938" lims:id="214938"><Label>(e)</Label><Text>with intent to defraud, obtains, consumes, uses, supplies or sells electricity or gas in relation to which any meter</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214939" lims:id="214939"><Label>(i)</Label><Text>registers with an error caused by an offence under paragraph (d), or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214940" lims:id="214940"><Label>(ii)</Label><Text>in the case of commission therewith of an offence under subparagraph (d)(ii), is calculated to mislead,</Text></Subparagraph></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="214941" lims:id="214941"><Text>is guilty of an indictable offence and liable to lims:id="214944"><MarginalNote lims:inforce-start-date="2011-11-29" lims:fid="214945" lims:id="214945">Forfeiture</MarginalNote><Label>31</Label><Subsection lims:inforce-start-date="2011-11-29" lims:fid="214946" lims:id="214946"><Label>(1)</Label><Text>Subject to subsections (2) to (5), where any person is convicted of an offence under paragraph 30(b), any meter to which the offence relates is, in addition to any punishment imposed for the offence, forfeited to Her Majesty if that forfeiture is ordered by the court, in which event the meter shall be destroyed or otherwise disposed of as the Minister may direct.</Text></Subsection><Subsection lims:inforce-start-date="2011-11-29" lims:fid="214947" lims:id="214947"><MarginalNote lims:inforce-start-date="2011-11-29" lims:fid="214948" lims:id="214948">Application by person claiming interest or right</MarginalNote><Label>(2)</Label><Text>When any meter is ordered to be forfeited under subsection (1), any person, other than a party to the proceedings that resulted in the order, who claims an interest or right in the meter as owner, mortgagee or hypothecary creditor, as lien holder or holder of a prior claim or of any like interest or right may, within 30 days after the making of the order of forfeiture, apply to any superior court of competent jurisdiction for an order under subsection (5) after which the court shall fix a day for the hearing of the application.</Text></Subsection><Subsection lims:inforce-start-date="2011-11-29" lims:fid="214949" lims:id="214949"><MarginalNote lims:inforce-start-date="2011-11-29" lims:fid="214950" lims:id="214950">Notice</MarginalNote><Label>(3)</Label><Text>An applicant for an order under subsection (5) shall, at least 30 days prior to the day fixed for the hearing of the application, serve a notice of the application and of the hearing on the Minister and on all other persons who have claimed an interest or right in the meter that is the subject matter of the application as owner, mortgagee or hypothecary creditor, as lien holder or holder of a prior claim or of any like interest or right of whom the applicant has knowledge.</Text></Subsection><Subsection lims:inforce-start-date="2011-11-29" lims:fid="214951" lims:id="214951"><MarginalNote lims:inforce-start-date="2011-11-29" lims:fid="214952" lims:id="214952">Notice of intervention</MarginalNote><Label>(4)</Label><Text>Each person, other than the Minister, who is served with a notice under subsection (3) and who intends to appear at the hearing of the application to which the notice relates shall, at least ten days prior to the day fixed for the hearing, file an appropriate notice of intervention in the record of the court and serve a copy thereof on the Minister and on the applicant.</Text></Subsection><Subsection lims:inforce-start-date="2011-11-29" lims:fid="214953" lims:id="214953"><MarginalNote lims:inforce-start-date="2011-11-29" lims:fid="214954" lims:id="214954">Order declaring nature and extent of interests or rights</MarginalNote><Label>(5)</Label><Text>If, on the hearing of an application under this section, the court is satisfied that the applicant or any intervenor</Text><Paragraph lims:inforce-start-date="2011-11-29" lims:fid="214955" lims:id="214955"><Label>(a)</Label><Text>is innocent of any complicity in any conduct that caused the meter to be subject to forfeiture and of any collusion in relation to any such conduct, and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-11-29" lims:fid="214956" lims:id="214956"><Label>(b)</Label><Text>exercised all reasonable care in respect of the persons permitted to obtain possession and use of the meter to satisfy himself or herself that it was not likely to be used in the commission of an offence under paragraph 30(b) or, in the case of a mortgagee or hypothecary creditor or a lien holder or a holder of a prior claim, that they exercised such care with respect to the mortgagor or hypothecary debtor or the giver of a lien or prior claim,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2011-11-29" lims:fid="214957" lims:id="214957"><Text>the applicant, intervenor or both are entitled to an order declaring that their interests or rights are not affected by the forfeiture and declaring the nature and extent of each of their interests or rights and the rankings among them, and the court may, in addition, order that the meter to which the interests or rights relate be delivered to one or more of the persons found to have an interest or right in the meter or that an amount equal to the value of each of the interests or rights so declared be paid to the persons found to have those interests or E-4, s. 32; 2011, c. 3, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-08-01" lims:lastAmendedDate="2014-08-01" lims:fid="214973" lims:id="214973"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214974" lims:id="214974">Other offences</MarginalNote><Label>33</Label><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214975" lims:id="214975"><Label>(1)</Label><Text>Every person is guilty of an offence who</Text><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214976" lims:id="214976"><Label>(a)</Label><Text>prevents or refuses lawful access to any meter in his possession or control,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214977" lims:id="214977"><Label>(b)</Label><Text>obstructs or hinders any examination or testing authorized by or under this Act,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214978" lims:id="214978"><Label>(c)</Label><Text>puts into service or causes to be put into service any meter contrary to subsection 9(1),</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214979" lims:id="214979"><Label>(d)</Label><Text>refuses or neglects to cause any meter, being in a purchaser’s service, to be dealt with in any manner required under subsection 11(3) or section 12,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214980" lims:id="214980"><Label>(e)</Label><Text>being a contractor, contravenes subsection 6(2) or (3) or permits any meter, in default of compliance with section 12, to continue in service beyond the period within which it is required by that section to be dealt with in the manner provided thereby,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214981" lims:id="214981"><Label>(f)</Label><Text>contrary to subsection 15(1) verifies, seals, reverifies or reseals any meter or breaks or causes to be broken the seal of any meter,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214982" lims:id="214982"><Label>(g)</Label><Text>being an owner, contravenes subsection 16(2) or 22(2),</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214983" lims:id="214983"><Label>(h)</Label><Text>being an accredited meter verifier, contravenes section 17,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214984" lims:id="214984"><Label>(i)</Label><Text>obstructs or hinders an inspector in executing his functions under this Act,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214985" lims:id="214985"><Label>(j)</Label><Text>not being an inspector or an accredited meter verifier, marks pursuant to regulations made under paragraph 28(1)(c), or issues a certificate as to the accuracy or condition of, any meter after it has been installed for use, or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214986" lims:id="214986"><Label>(k)</Label><Text>for the purposes of any sale by him of electricity or gas by unit of measurement, supplies electricity or gas that is, subject to prescribed limits of error, less in quantity or otherwise than the electricity or gas that he</Text><Subparagraph lims:inforce-start-date="2014-08-01" lims:fid="214987" lims:id="214987"><Label>(i)</Label><Text>purports to supply, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-08-01" lims:fid="214988" lims:id="214988"><Label>(ii)</Label><Text>should supply on the basis of the total price charged therefor and the stated price per unit of measurement used to determine the total price.</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214989" lims:id="214989"><Label>(l)</Label><Text><Repealed>[Repealed, 2011, c. 3, s. 8]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214990" lims:id="214990"><Label>(m)</Label><Text><Repealed>[Repealed, 2011, c. 3, s. 8]</Repealed></Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-08-01" lims:fid="214991" lims:id="214991"><MarginalNote lims:inforce-start-date="2014-08-01" lims:fid="214992" lims:id="214992">Punishment — first offence</MarginalNote><Label>(2)</Label><Text>Every person who is guilty of an offence under subsection (1) is liable, for a first offence,</Text><Paragraph lims:inforce-start-date="2014-08-01" lims:fid="214993" lims:id="214993"><Label>(a)</Label><Text>on summary conviction, to a fine not exceeding $10,000; jurisdiction of Parliament extends, a certificate purporting to have been given by an inspector pursuant to this Act and to have been signed by the inspector who made the examination, investigation or test is evidence of the matters stated therein relating to the examination, investigation or test without proof of the signature or the official character or the capacity of the person appearing to have signed the certificate.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215033" lims:id="215033"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215034" lims:id="215034">Attendance of inspector</MarginalNote><Label>(2)</Label><Text>The party against whom a certificate of an inspector is produced pursuant to subsection (1) may, with leave of the court, lims:id="215051"><Label>(i)</Label><Text>a meter registers, a reading therefrom is obtained or the basis of a charge for electricity or gas is established from that reading,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="215052" lims:id="215052"><Label>(ii)</Label><Text>measurements respecting the extraction of natural gas are made to obtain the basis of any royalty or charge therefor, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="215053" lims:id="215053"><Label>(iii)</Label><Text>a supply of electricity or gas is metered in any case not referred to in subsection 9(1); or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215054" lims:id="215054"><Label>(b)</Label><Text>any supply or class or type of supply of any energy whatever or source thereof in such a form that the use of a meter in respect thereof was not contemplated by approval granted under subsection 9(4) before the making of the order.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215055" lims:id="215055"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215056" lims:id="215056">Provincial government’s request needed</MarginalNote><Label>(2)</Label><Text>An order made under subsection (1) with respect to apparatus used to obtain the basis of any royalty or charge referred to in subparagraph (1)(a)(ii) that is due to Her Majesty in right of any province, or to any other person, shall not have effect with respect to any such apparatus in a province unless, at the request of the government thereof, the order is, by its terms, expressed to have that been laid before Parliament pursuant to that subsection unless before the twentieth sitting day of Parliament after the order has been laid before Parliament a motion for the consideration of either House, to the effect that the order be revoked, signed by not less than fifty members of the House of Commons in the case of a motion for the consideration of that House and by not less than twenty members of the Senate in the case of a motion for the consideration of the Senate, is filed with the Speaker of the appropriate House.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215066" lims:id="215066"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215067" lims:id="215067">Consideration of motion</MarginalNote><Label>(3)</Label><Text>Where a motion for the consideration of the House of Commons or Senate is filed as provided in subsection (2) with respect to a particular order referred to in subsection (1), that House shall, not later than the sixth sitting day of that House following the filing of the motion, take up and consider the motion unless a motion to the like effect has earlier been taken up and considered in the other House.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215068" lims:id="215068"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215069" lims:id="215069">Definition of “sitting day of Parliament”</MarginalNote><Label>(4)</Label><Text>For the purposes of subsections (1) and (2), <DefinedTermEn>sitting day of Parliament</DefinedTermEn> means a day on which either House of Parliament sits.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem motion</MarginalNote><Label>41</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215074" lims:id="215074"><Label>(1)</Label><Text>A motion taken up and considered in accordance with subsection 40(3) shall be debated without interruption for not more than five hours and, on the conclusion of the debate or at the expiration of the fifth hour, the Speaker of the House of Commons or the Senate, as the case may be, shall forthwith, without further debate or amendment, put every question necessary for the disposition of the motion.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215075" lims:id="215075"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215076" lims:id="215076">Procedure on adoption of motion</MarginalNote><Label>(2)</Label><Text>If a motion taken up and considered in accordance with subsection 40(3) is adopted, with or without amendments, a message shall be sent from the House of Parliament adopting the motion informing the other House that the motion has been so adopted and requesting that the motion be concurred in by that other House.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215077" lims:id="215077"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215078" lims:id="215078">Procedure in other House</MarginalNote><Label>(3)</Label><Text>Within the first fifteen days next after receipt by it of a request pursuant to subsection (2) that the House of Parliament receiving the request is sitting, that House shall take up and consider the motion that is the subject of the request and all questions in connection therewith shall be debated without interruption for not more than five hours and, on the conclusion of the debate or at the expiration of the fifth hour, the Speaker of that House shall forthwith, without further debate or amendment, put every question necessary to determine whether or not the motion in question is concurred in.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="215080"
