lims:id="213799">Preamble</MarginalNote><Text>WHEREAS the safety and security of the individual, the protection of the values of the body politic and the preservation of the sovereignty, security and territorial integrity of the state are fundamental obligations of government;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="213800" lims:id="213800" format-ref="indent-0-0" language-align="no" list-item="no"><Text>AND WHEREAS the fulfilment of those obligations in Canada may be seriously threatened by a national emergency and, in order to ensure safety and security during such an emergency, the Governor in Council should be authorized, subject to the supervision of Parliament, to take special temporary measures that may not be appropriate in normal times;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="213801" lims:id="213801" format-ref="indent-0-0" language-align="no" list-item="no"><Text>AND WHEREAS the Governor in Council, in taking such special temporary measures, would be subject to the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal> and the <XRefExternal reference-type="act" link="C-12.3">Canadian Bill of Rights</XRefExternal> and must have regard to the <XRefExternal reference-type="other">International Covenant on Civil and Political Rights</XRefExternal>, particularly with respect to those fundamental rights that are not to be limited or abridged even in a national emergency;</Text></Provision></Preamble><Enacts list-item="no"><Text>NOW THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:fid="213807" lims:id="213807">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="E-4.5">Emergencies Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="213808" lims:id="213808" level="1"><TitleText>Application and Construction</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213809" lims:id="213809"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213810" lims:id="213810">Binding on Her Majesty</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213811" lims:id="213811"><Label>(1)</Label><Text>This Act is binding on Her Majesty in right of Canada or a province.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213812" lims:id="213812"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213813" lims:id="213813">Federal jurisdiction</MarginalNote><Label>(2)</Label><Text>For greater certainty, nothing in this Act derogates from the authority of the Government of Canada to deal with emergencies on any property, territory or area in respect of which the Parliament of Canada has jurisdiction.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213814" lims:id="213814"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213815" lims:id="213815">National emergency</MarginalNote><Label>3</Label><Text>For the purposes of this Act, a <DefinedTermEn>national emergency</DefinedTermEn> is an urgent and critical situation of a temporary nature that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213816" lims:id="213816"><Label>(a)</Label><Text>seriously endangers the lives, health or safety of Canadians and is of such proportions or nature as to exceed the capacity or authority of a province to deal with it, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213817" lims:id="213817"><Label>(b)</Label><Text>seriously threatens the ability of the Government of Canada to preserve the sovereignty, security and territorial integrity of Canada</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="213818" lims:id="213818"><Text>and that cannot be effectively dealt with under any other law of Canada.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213819" lims:id="213819"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213820" lims:id="213820">Construction</MarginalNote><Label>4</Label><Text>Nothing in this Act shall be construed or applied so as to confer on the Governor in Council the power to make orders or regulations</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213821" lims:id="213821"><Label>(a)</Label><Text>altering the provisions of this Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213822" lims:id="213822"><Label>(b)</Label><Text>providing for the detention, imprisonment or internment of Canadian citizens or permanent residents within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal> on the basis of race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="213825" lims:id="213825" level="1"><Label>PART I</Label><TitleText>Public Welfare Emergency</TitleText></Heading><Heading lims:inforce-start-date="2002-12-31" lims:fid="213826" lims:id="213826" level="2"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213827" lims:id="213827"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213828" lims:id="213828">Definitions</MarginalNote><Label>5</Label><Text>In this Part,</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="213829" lims:id="213829"><Text><DefinedTermEn>declaration of a public welfare emergency</DefinedTermEn> means a proclamation issued pursuant to subsection 6(1); (<DefinedTermFr>déclaration de sinistre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="213830" lims:id="213830"><Text><DefinedTermEn>public welfare emergency</DefinedTermEn> means an emergency that is caused by a real or imminent</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213831" lims:id="213831"><Label>(a)</Label><Text>fire, flood, drought, storm, earthquake or other natural phenomenon,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213832" lims:id="213832"><Label>(b)</Label><Text>disease in human beings, animals or plants, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213833" lims:id="213833"><Label>(c)</Label><Text>accident or pollution</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2002-12-31" lims:fid="213834" lims:id="213834"><Text>and that results or may result in a danger to life or property, social disruption or a breakdown in the flow of essential goods, services or resources, so serious as to be a national emergency. (<DefinedTermFr>sinistre</DefinedTermFr>)</Text></ContinuedDefinition></Definition></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="213835" lims:id="213835" level="2"><TitleText>Declaration of a Public Welfare Emergency</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213836" lims:id="213836"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213837" lims:id="213837">Declaration of a public welfare emergency</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213838" lims:id="213838"><Label>(1)</Label><Text>When the Governor in Council believes, on reasonable grounds, that a public welfare emergency exists and necessitates the taking of special temporary measures for dealing with the emergency, the Governor in Council, after such consultation as is required by section 14, may, by proclamation, so declare.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213839" lims:id="213839"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213840" lims:id="213840">Contents</MarginalNote><Label>(2)</Label><Text>A declaration of a public welfare emergency shall specify</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213841" lims:id="213841"><Label>(a)</Label><Text>concisely the state of affairs constituting the emergency;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213842" lims:id="213842"><Label>(b)</Label><Text>the special temporary measures that the Governor in Council anticipates may be necessary for dealing with the emergency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213843" lims:id="213843"><Label>(c)</Label><Text>if the direct effects of the emergency do not extend to the whole of Canada, the area of Canada to which the direct effects of the emergency extend.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213844" lims:id="213844"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213845" lims:id="213845">Effective date</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213846" lims:id="213846"><Label>(1)</Label><Text>A declaration of a public welfare emergency is effective on the day on which it is issued, but a motion for confirmation of the declaration shall be laid before each House of Parliament and be considered in accordance with section 58.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213847" lims:id="213847"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213848" lims:id="213848">Expiration of declaration</MarginalNote><Label>(2)</Label><Text>A declaration of a public welfare emergency expires at the end of ninety days unless the declaration is previously revoked or continued in accordance with this Act.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="213849" lims:id="213849" level="2"><TitleText>Orders and Regulations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213850" lims:id="213850"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213851" lims:id="213851">Orders and regulations</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213852" lims:id="213852"><Label>(1)</Label><Text>While a declaration of a public welfare emergency is in effect, the Governor in Council may make such orders or regulations with respect to the following matters as the Governor in Council believes, on reasonable grounds, are necessary for dealing with the emergency:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213853" lims:id="213853"><Label>(a)</Label><Text>the regulation or prohibition of travel to, from or within any specified area, where necessary for the protection of the health or safety of individuals;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213854" lims:id="213854"><Label>(b)</Label><Text>the evacuation of persons and the removal of personal property from any specified area and the making of arrangements for the adequate care and protection of the persons and property;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213855" lims:id="213855"><Label>(c)</Label><Text>the requisition, use or disposition of property;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213856" lims:id="213856"><Label>(d)</Label><Text>the authorization of or direction to any person, or any person of a class of persons, to render essential services of a type that that person, or a person of that class, is competent to provide and the provision of reasonable compensation in respect of services so rendered;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213857" lims:id="213857"><Label>(e)</Label><Text>the regulation of the distribution and availability of essential goods, services and resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213858" lims:id="213858"><Label>(f)</Label><Text>the authorization and making of emergency payments;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213859" lims:id="213859"><Label>(g)</Label><Text>the establishment of emergency shelters and hospitals;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213860" lims:id="213860"><Label>(h)</Label><Text>the assessment of damage to any works or undertakings and the repair, replacement or restoration thereof;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213861" lims:id="213861"><Label>(i)</Label><Text>the assessment of damage to the environment and the elimination or alleviation of the damage; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213862" lims:id="213862"><Label>(j)</Label><Text>the imposition</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213863" lims:id="213863"><Label>(i)</Label><Text>on summary conviction, of a fine not exceeding five hundred dollars or imprisonment not exceeding six months or both that fine and imprisonment, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213864" lims:id="213864"><Label>(ii)</Label><Text>on indictment, of a fine not exceeding five thousand dollars or imprisonment not exceeding five years or both that fine and imprisonment,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2002-12-31" lims:fid="213865" lims:id="213865"><Text>for contravention of any order or regulation made under this section.</Text></ContinuedParagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213866" lims:id="213866"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213867" lims:id="213867">Restriction</MarginalNote><Label>(2)</Label><Text>Where a declaration of a public welfare emergency specifies that the direct effects of the emergency extend only to a specified area of Canada, the power under subsection (1) to make orders and regulations, and any powers, duties or functions conferred or imposed by or pursuant to any such order or regulation, may be exercised or performed only with respect to that area.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213868" lims:id="213868"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213869" lims:id="213869">Idem</MarginalNote><Label>(3)</Label><Text>The power under subsection (1) to make orders and regulations, and any powers, duties or functions conferred or imposed by or pursuant to any such order or regulation,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213870" lims:id="213870"><Label>(a)</Label><Text>shall be exercised or performed</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213871" lims:id="213871"><Label>(i)</Label><Text>in a manner that will not unduly impair the ability of any province to take measures, under an Act of the legislature of the province, for dealing with an emergency in the province, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213872" lims:id="213872"><Label>(ii)</Label><Text>with the view of achieving, to the extent possible, concerted action with each province with respect to which the power, duty or function is exercised or performed; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213873" lims:id="213873"><Label>(b)</Label><Text>shall not be exercised or performed for the purpose of terminating a strike or lock-out or imposing a settlement in a labour dispute.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213874" lims:id="213874"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213875" lims:id="213875">Control or direction of police force</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213876" lims:id="213876"><Label>(1)</Label><Text>Nothing in a declaration of a public welfare emergency or in any order or regulation made pursuant thereto shall be construed or applied so as to derogate from, or to authorize the derogation from, the control or direction of the government of a province or a municipality over any police force over which it normally has control or direction.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213877" lims:id="213877"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213878" lims:id="213878">R.C.M.P.</MarginalNote><Label>(2)</Label><Text>Where the Royal Canadian Mounted Police is used or employed in a province or municipality pursuant to an arrangement under section 20 of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>, subsection (1) applies in respect of the Royal Canadian Mounted Police, subject to the terms and conditions of the arrangement.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="213879" lims:id="213879" level="2"><TitleText>Revocation, Continuation and Amendment of Declaration</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213880" lims:id="213880"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213881" lims:id="213881">Revocation by Parliament</MarginalNote><Label>10</Label><Text>Parliament may revoke a declaration of a public welfare emergency in accordance with section 58 or 59.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213882" lims:id="213882"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213883" lims:id="213883">Revocation by Governor in Council</MarginalNote><Label>11</Label><Text>The Governor in Council may, by proclamation, revoke a declaration of a public welfare emergency either generally or with respect to any area of Canada effective on such day as is specified in the proclamation.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213884" lims:id="213884"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213885" lims:id="213885">Continuation by Governor in Council</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213886" lims:id="213886"><Label>(1)</Label><Text>At any time before a declaration of a public welfare emergency would otherwise expire, the Governor in Council, after such consultation as is required by section 14, may, by proclamation, continue the declaration either generally or with respect to any area of Canada for such period, not exceeding ninety days, as is specified in the proclamation if the Governor in Council believes, on reasonable grounds, that the emergency will continue to exist or that the direct effects of the emergency will continue to extend to that area, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213887" lims:id="213887"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213888" lims:id="213888">Review of orders and regulations</MarginalNote><Label>(2)</Label><Text>Before issuing a proclamation continuing a declaration of a public welfare emergency, the Governor in Council shall review all current orders and regulations made under section 8 to determine if the Governor in Council believes, on reasonable grounds, that they continue to be necessary for dealing with the emergency and shall revoke or amend them to the extent that they do not so continue.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213889" lims:id="213889"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213890" lims:id="213890">Multiple continuations</MarginalNote><Label>(3)</Label><Text>A declaration of a public welfare emergency may be continued more than once pursuant to subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213891" lims:id="213891"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213892" lims:id="213892">Effective date</MarginalNote><Label>(4)</Label><Text>A proclamation continuing a declaration of a public welfare emergency is effective on the day on which it is issued, but a motion for confirmation of the proclamation shall be laid before each House of Parliament and be considered in accordance with section 60.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213893" lims:id="213893"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213894" lims:id="213894">Amendment by Governor in Council</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213895" lims:id="213895"><Label>(1)</Label><Text>Where the Governor in Council</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213896" lims:id="213896"><Label>(a)</Label><Text>has issued a declaration of a public welfare emergency specifying that the direct effects of the emergency extend only to a specified area of Canada, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213897" lims:id="213897"><Label>(b)</Label><Text>believes, on reasonable grounds, that the direct effects of the emergency have extended to any other area of Canada or to the rest of Canada,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="213898" lims:id="213898"><Text>the Governor in Council, after such consultation as is required by section 14, may, by proclamation, amend the declaration to specify that other area as an area of Canada to which the direct effects of the emergency extend or to remove the existing specification, as Emergency</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213928" lims:id="213928"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213929" lims:id="213929">Declaration of a public order emergency</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213930" lims:id="213930"><Label>(1)</Label><Text>When the Governor in Council believes, on reasonable grounds, that a public order emergency exists and necessitates the taking of special temporary measures for dealing with the emergency, the Governor in Council, after such consultation as is required by section 25, may, by proclamation, so declare.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213931" lims:id="213931"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213932" lims:id="213932">Contents</MarginalNote><Label>(2)</Label><Text>A declaration of a public order emergency shall specify</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213933" lims:id="213933"><Label>(a)</Label><Text>concisely the state of affairs constituting the emergency;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213934" lims:id="213934"><Label>(b)</Label><Text>the special temporary measures that the Governor in Council anticipates may be necessary for dealing with the emergency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213935" lims:id="213935"><Label>(c)</Label><Text>if the effects of the emergency do not extend to the whole of Canada, the area of Canada to which the effects of the emergency extend.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213936" lims:id="213936"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213937" lims:id="213937">Effective date</MarginalNote><Label>18</Label><Subsection lims:inforce-start-date="2002-12-31" emergency expires at the end of thirty days unless the declaration is previously revoked or continued in accordance with this Act.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="213941" lims:id="213941" level="2"><TitleText>Orders and Regulations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213942" lims:id="213942"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213943" lims:id="213943">Orders and regulations</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213944" lims:id="213944"><Label>(1)</Label><Text>While a declaration of a public order emergency is in effect, the Governor in Council may make such orders or regulations with respect to the following matters as the Governor in Council believes, on reasonable grounds, are necessary for dealing with the emergency:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213945" lims:id="213945"><Label>(a)</Label><Text>the regulation or prohibition of</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213946" lims:id="213946"><Label>(i)</Label><Text>any public assembly that may reasonably be expected to lead to a breach of the peace,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213947" lims:id="213947"><Label>(ii)</Label><Text>travel to, from or within any specified area, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213948" lims:id="213948"><Label>(iii)</Label><Text>the use of specified property;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213949" lims:id="213949"><Label>(b)</Label><Text>the designation and securing of protected places;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213950" lims:id="213950"><Label>(c)</Label><Text>the assumption of the control, and the restoration and maintenance, of public utilities and services;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213951" lims:id="213951"><Label>(d)</Label><Text>the authorization of or direction to any person, or any person of a class of persons, to render essential services of a type that that person, or a person of that class, is competent to provide and the provision of reasonable compensation in respect of services so rendered; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213952" lims:id="213952"><Label>(e)</Label><Text>the imposition</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213953" lims:id="213953"><Label>(i)</Label><Text>on summary conviction, of a fine not exceeding five hundred dollars or imprisonment not exceeding six months or both that fine and imprisonment, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="213954" lims:id="213954"><Label>(ii)</Label><Text>on indictment, of a fine not exceeding five thousand dollars or imprisonment not exceeding five years or both that fine and imprisonment,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2002-12-31" lims:fid="213955" lims:id="213955"><Text>for contravention of any order or regulation made under this section.</Text></ContinuedParagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213956" lims:id="213956"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213957" lims:id="213957">Restriction</MarginalNote><Label>(2)</Label><Text>Where a declaration of a public order emergency specifies that the effects of the emergency extend only to a specified area of Canada, the power under subsection (1) to make orders and regulations, and any powers, duties or functions conferred or imposed by or pursuant to any such order or regulation, may be exercised or performed only with respect to that area.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213958" lims:id="213958"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213959" lims:id="213959">Idem</MarginalNote><Label>(3)</Label><Text>The power under subsection (1) to make orders and regulations, and any powers, duties or functions conferred or imposed by manner that will not unduly impair the ability of any province to take measures, under an Act of the legislature of the province, for dealing with an emergency in the province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="213961" lims:id="213961"><Label>(b)</Label><Text>with the view of achieving, to the extent possible, concerted action with each province with respect to which the power, duty or function is exercised or performed.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213962" lims:id="213962"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213963" lims:id="213963">Control or direction of police force</MarginalNote><Label>20</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213964" lims:id="213964"><Label>(1)</Label><Text>Nothing in a declaration of a public order emergency or in any order or regulation made pursuant thereto shall be construed or applied so as to derogate from, or to authorize the derogation from, the control or direction of the government of a province or a municipality over any police force over which it normally has control or direction.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213965" lims:id="213965"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213966" lims:id="213966">R.C.M.P.</MarginalNote><Label>(2)</Label><Text>Where the Royal Canadian Mounted Police is used or employed in a province or municipality pursuant to an arrangement under section 20 of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>, subsection (1) applies in respect of the Royal Canadian Mounted Police, subject to the terms and conditions of the arrangement.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="213967" lims:id="213967" level="2"><TitleText>Revocation, Continuation and Amendment of Declaration</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213968" lims:id="213968"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213969" lims:id="213969">Revocation by Parliament</MarginalNote><Label>21</Label><Text>Parliament may revoke a declaration of a public order emergency in accordance with section 58 or 59.</Text></Section><Section lims:id="213971">Revocation by Governor in Council</MarginalNote><Label>22</Label><Text>The Governor in Council may, by proclamation, revoke a declaration of a public order emergency either generally or with respect to any area of Canada effective on such day as is specified in the proclamation.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="213972" lims:id="213972"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213973" lims:id="213973">Continuation by Governor in Council</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213974" lims:id="213974"><Label>(1)</Label><Text>At any time before a declaration of a public order emergency would otherwise expire, the Governor in Council, after such consultation as is required by section 25, may, by proclamation, continue the declaration either generally or with respect to any area of Canada for such period, not exceeding thirty days, as is specified in the proclamation if the Governor in Council believes, on reasonable grounds, that the emergency will continue to exist or that the effects of the emergency will continue to extend to that area, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213975" lims:id="213975"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213976" lims:id="213976">Review of orders and regulations</MarginalNote><Label>(2)</Label><Text>Before issuing a proclamation continuing a declaration of a public order emergency, the Governor in Council shall review all current orders and regulations made under section 19 to determine if the Governor in Council believes, on reasonable grounds, that they continue to be necessary for dealing with the emergency and shall revoke or amend them to the extent that they do not so continue.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213977" lims:id="213977"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213978" lims:id="213978">Multiple continuations</MarginalNote><Label>(3)</Label><Text>A declaration of a public order emergency may be continued more than once pursuant to subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="213979" lims:id="213979"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="213980" lims:id="213980">Effective reasonable grounds, that an international emergency exists and necessitates the taking of special temporary measures for dealing with the emergency, the Governor in Council, after such consultation as is required by section 35, may, by proclamation, so declare.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214020" lims:id="214020"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214021" lims:id="214021">Contents</MarginalNote><Label>(2)</Label><Text>A declaration of an international emergency shall specify</Text><Paragraph lims:id="214026"><Label>(1)</Label><Text>A declaration of an international emergency is effective on the day on which it is issued, but a motion for confirmation of the declaration shall be laid lims:id="214029" level="2"><TitleText>Orders and Regulations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2023-06-22" lims:fid="214030" lims:id="214030"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214031" lims:id="214031">Orders and regulations</MarginalNote><Label>30</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214032" lims:id="214032"><Label>(1)</Label><Text>While a declaration of an international emergency is in effect, the Governor in Council may make such orders or regulations with respect to the following matters as the Governor in Council believes, on reasonable grounds, are necessary for dealing with the emergency:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214033" lims:id="214033"><Label>(a)</Label><Text>the control or regulation of any specified industry or service, including the use of equipment, facilities and inventory;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214034" lims:id="214034"><Label>(b)</Label><Text>the appropriation, control, forfeiture, use and disposition of property or services;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214035" lims:id="214035"><Label>(c)</Label><Text>the authorization and conduct of inquiries in relation to defence contracts or defence supplies as defined in the <XRefExternal reference-type="act" link="D-1">Defence Production Act</XRefExternal> or to hoarding, overcharging, black marketing or fraudulent operations in respect of scarce commodities, including the conferment of powers under the <XRefExternal reference-type="act" link="I-11">Inquiries Act</XRefExternal> on any person authorized to conduct such an inquiry;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214036" lims:id="214036"><Label>(d)</Label><Text>the authorization of the entry and search of any dwelling-house, premises, conveyance or place, and the search of any person found therein, for any thing that may be evidence relevant to any matter that is the subject of an inquiry referred to in paragraph (c), and the seizure and detention of any such thing;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214037" lims:id="214037"><Label>(e)</Label><Text>the authorization of or direction to any person, or any person of a class of persons, to render essential services of a type that that person, or a person of that class, is competent to provide and the provision of reasonable compensation in respect of services so rendered;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214038" lims:id="214038"><Label>(f)</Label><Text>the designation and securing of protected places;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214039" lims:id="214039"><Label>(g)</Label><Text>the regulation or prohibition of travel outside Canada by Canadian citizens or permanent residents within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal> and of admission into Canada of other persons;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214040" lims:id="214040"><Label>(h)</Label><Text>the removal from Canada of persons, other than</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214041" lims:id="214041"><Label>(i)</Label><Text>Canadian citizens,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214042" lims:id="214042"><Label>(ii)</Label><Text>permanent residents within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214043" lims:id="214043"><Label>(iii)</Label><Text>protected persons within the meaning of subsection 95(2) of that Act who are not inadmissible under that Act on grounds of</Text><Clause lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="214044" lims:id="1413693"><Label>(A)</Label><Text>security, violating human or international rights, sanctions or serious criminality, or</Text></Clause><Clause lims:inforce-start-date="2002-12-31" lims:fid="214045" lims:id="214045"><Label>(B)</Label><Text>criminality and who have not been convicted of any offence under any Act of Parliament for which a term of imprisonment of more than six months has been imposed, or five years or more may be imposed;</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214046" lims:id="214046"><Label>(i)</Label><Text>the control or regulation of the international aspects of specified financial activities within Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214047" lims:id="214047"><Label>(j)</Label><Text>the authorization of expenditures for dealing with an international emergency in excess of any limit set by an Act of Parliament and the setting of a limit on such expenditures;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214048" lims:id="214048"><Label>(k)</Label><Text>the authorization of any minister of the Crown to discharge specified responsibilities respecting the international emergency or to take specified actions of a political, diplomatic or economic nature for dealing with the emergency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214049" lims:id="214049"><Label>(l)</Label><Text>the imposition</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214050" lims:id="214050"><Label>(i)</Label><Text>on summary conviction, of a fine not exceeding five hundred dollars or imprisonment not exceeding six months or both that fine and imprisonment, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214051" lims:id="214051"><Label>(ii)</Label><Text>on indictment, of a fine not exceeding five thousand dollars or imprisonment not exceeding five years or both that fine and imprisonment,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2002-12-31" lims:fid="214052" lims:id="214052"><Text>for contravention of any order or regulation made under this section.</Text></ContinuedParagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214053" lims:id="214053"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214054" lims:id="214054">Restriction</MarginalNote><Label>(2)</Label><Text>The power under subsection (1) to make orders and regulations, and any powers, duties or functions conferred or imposed by or pursuant to any such order or regulation,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214055" lims:id="214055"><Label>(a)</Label><Text>shall be exercised or performed</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214056" lims:id="214056"><Label>(i)</Label><Text>in a manner that will not unduly impair the ability of any province to take measures, under an Act of the legislature of the province, for dealing with an emergency in the province, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="214057" lims:id="214057"><Label>(ii)</Label><Text>with the view of achieving, to the extent possible, concerted action with each province with respect to which the power, duty or function is exercised or performed; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214058" lims:id="214058"><Label>(b)</Label><Text>shall not be exercised or performed for the purpose of censoring, suppressing or controlling the publication or communication of any information regardless of its form or lims:inforce-start-date="2002-12-31" lims:fid="214063" lims:id="214063"><Label>(1)</Label><Text>Nothing in a declaration of an international emergency or in any order or regulation made pursuant thereto shall be construed or applied so as to derogate from, or to authorize the derogation from, the control or direction of the government of a province or a municipality over any police force over which it normally has control or direction.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214064" lims:id="214064"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214065" lims:id="214065">R.C.M.P.</MarginalNote><Label>(2)</Label><Text>Where the Royal Canadian Mounted Police is used or employed in a province or municipality pursuant to an arrangement under section 20 of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>, subsection (1) applies in respect of the Royal Canadian Mounted Police, subject to the terms and conditions of the arrangement.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="214066" lims:id="214066" level="2"><TitleText>Revocation and Continuation of Declaration</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214067" lims:id="214067"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214068" lims:id="214068">Revocation by Parliament</MarginalNote><Label>32</Label><Text>Parliament may revoke a declaration of an international emergency in accordance with section 58 or 59.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214069" lims:id="214069"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214070" lims:id="214070">Revocation by Governor in Council</MarginalNote><Label>33</Label><Text>The Governor in Council may, by proclamation, revoke a lims:inforce-start-date="2002-12-31" lims:fid="214073" lims:id="214073"><Label>(1)</Label><Text>At any time before a declaration of an international emergency would otherwise expire, the Governor in Council, after such consultation as is required by section 35, may, by proclamation, continue the declaration for such period, not exceeding sixty days, as is specified in the proclamation if the Governor in Council believes, on reasonable grounds, that the emergency will continue to exist.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214074" lims:id="214074"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214075" lims:id="214075">Review of orders and regulations</MarginalNote><Label>(2)</Label><Text>Before issuing a proclamation continuing a declaration of an international emergency, the Governor in Council shall review all current orders and regulations made under section 30 to determine if the Governor in Council believes, on reasonable grounds, that they continue to be necessary for dealing with the emergency and shall revoke or amend them to the extent that they do not so continue.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214076" lims:id="214076"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214077" lims:id="214077">Multiple continuations</MarginalNote><Label>(3)</Label><Text>A declaration of an international emergency may be continued more than once pursuant to subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214078" lims:id="214078"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214079" lims:id="214079">Effective date</MarginalNote><Label>(4)</Label><Text>A proclamation continuing a declaration of an international emergency is effective on the day on which it is issued, but a motion for confirmation of the proclamation shall be laid before each House of Parliament and be considered in accordance with section 60.</Text></Subsection></Section><Heading lims:id="214082">Consultation</MarginalNote><Label>35</Label><Text>Before the Governor in Council issues or continues a declaration of an international emergency, the lieutenant governor in council of each province shall be consulted with respect to the proposed action to the extent that, in the opinion of the Governor in Council, it is appropriate and practicable to do so in the circumstances.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="214083" lims:id="214083" level="2"><TitleText>Effect of Expiration or Revocation</TitleText></Heading><Section lims:id="214100"><Label>(1)</Label><Text>When the Governor in Council believes, on reasonable grounds, that a war emergency exists and necessitates the taking of special temporary measures for dealing with the emergency, the Governor in Council, after such consultation as is required by section 44, may, by proclamation, so declare.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" after such consultation as is required by section 44, may, by proclamation, continue the declaration for such period, not exceeding one hundred and twenty days, as is specified in the proclamation if the Governor in Council believes, on reasonable grounds, that the emergency will continue to exist.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214129" lims:id="214129"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214130" lims:id="214130">Review of orders and regulations</MarginalNote><Label>(2)</Label><Text>Before issuing a proclamation continuing a declaration of a war emergency, the Governor in Council shall review all current orders and regulations made under section 40 to determine if the Governor in Council believes, on reasonable grounds, that they continue to be necessary or advisable for dealing with the emergency and shall revoke or amend them to the extent that they do not so continue.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214131" lims:id="214131"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214132" lims:id="214132">Multiple continuations</MarginalNote><Label>(3)</Label><Text>A declaration of a war emergency may be continued more than once pursuant to subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214133" lims:id="214133"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214134" lims:id="214134">Effective date</MarginalNote><Label>(4)</Label><Text>A proclamation continuing a declaration of a war emergency is effective on the day on which it is issued, but a motion for confirmation of the proclamation shall be laid before each House of Parliament and be considered in accordance with section 60.</Text></Subsection></Section><Heading lims:id="214137">Consultation</MarginalNote><Label>44</Label><Text>Before the Governor in Council issues or continues a declaration of a war emergency, the lieutenant governor in council of each province shall be consulted with respect to the proposed action to the extent that, in the opinion of the Governor in Council, it is appropriate and practicable to do so in the agent of the Crown, including any person providing services pursuant to an order or regulation made under subsection 8(1), 19(1), 30(1) or 40(1), for or in respect of any thing done or omitted to be done, or purported to be done or omitted to be done, in good faith under any of Parts I to IV or any proclamation, order or regulation issued or made thereunder.</Text></Subsection><Subsection reference-type="act">Crown Liability Act</XRefExternal> or any other law as if that subsection had not been enacted.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="214159" lims:id="214159" level="2"><TitleText>Compensation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214160" lims:id="214160"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214161" lims:id="214161">Compensation</MarginalNote><Label>48</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214162" lims:id="214162"><Label>(1)</Label><Text>Subject to subsection (2) and the regulations made under section 49, the Minister shall award reasonable compensation to any person who suffers loss, injury or damage as a result of any thing done, or purported to be done, under any of Parts I to IV or any proclamation, order or regulation issued or made thereunder.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214163" lims:id="214163"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214164" lims:id="214164">Release</MarginalNote><Label>(2)</Label><Text>No compensation shall be paid to a person unless that person, in consideration of the compensation, signs, in a form provided by the Minister, a release of any right of action that the person may have against the Crown as a result of any thing done, or purported to be done, under any of Parts I to IV or any proclamation, order or regulation issued or made thereunder.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214165" lims:id="214165"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214166" lims:id="214166">Subrogation</MarginalNote><Label>(3)</Label><Text>The Crown is subrogated to all rights of any person to whom compensation is paid to recover damages in respect of the loss, injury or damage for which the compensation is paid and may maintain an action in the name of that person or in the name of the Crown against any person against whom the action lies.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214167" lims:id="214167"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214168" lims:id="214168">Application of recovered sums</MarginalNote><Label>(4)</Label><Text>Any sum recovered by the Crown pursuant to an action under subsection (3) shall be applied</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214169" lims:id="214169"><Label>(a)</Label><Text>first, to payment of the costs actually incurred in the action and in levying execution, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214170" lims:id="214170"><Label>(b)</Label><Text>second, to reimbursement of the Crown for the compensation paid to the person whose rights were subrogated,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="214171" lims:id="214171"><Text>and the balance, if any, shall be paid to that person.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214172" lims:id="214172"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214173" lims:id="214173">Settlement</MarginalNote><Label>(5)</Label><Text>No settlement or release bars the rights of the Crown under subsection (3) unless the Minister has concurred therein.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214174" lims:id="214174"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214175" lims:id="214175">Regulations</MarginalNote><Label>49</Label><Text>The Governor in Council may make regulations</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214176" lims:id="214176"><Label>(a)</Label><Text>prescribing the form and manner of making applications for compensation, the information and evidence to be submitted in connection therewith and the procedure to be followed in the consideration of applications for compensation;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214177" lims:id="214177"><Label>(b)</Label><Text>prescribing the period within which applications for compensation must be made;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214178" lims:id="214178"><Label>(c)</Label><Text>prescribing the criteria to be used in determining the eligibility of any person for compensation;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214179" lims:id="214179"><Label>(d)</Label><Text>prescribing the methods and criteria to be used in assessing any loss, injury or damage for which compensation shall be paid;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214180" lims:id="214180"><Label>(e)</Label><Text>prescribing the maximum amount of compensation that may be paid to any person either generally or with respect to any particular loss, injury or damage;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214181" lims:id="214181"><Label>(f)</Label><Text>prescribing the terms and conditions for the payment of compensation;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214182" lims:id="214182"><Label>(g)</Label><Text>providing for the payment of compensation in a lump sum or in periodic payments;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214183" lims:id="214183"><Label>(h)</Label><Text>providing for <Language xml:lang="la">pro rata</Language> payments of compensation;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214184" lims:id="214184"><Label>(i)</Label><Text>establishing priorities among persons applying for compensation on the basis of classes of persons or classes of loss, injury or damage or otherwise;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214185" lims:id="214185"><Label>(j)</Label><Text>respecting the giving of notices to persons affected by applications for compensation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214186" lims:id="214186"><Label>(k)</Label><Text>generally, for carrying into effect the purposes and provisions of this Part.</Text></Paragraph></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="214187" lims:id="214187" level="2"><TitleText>Appeals</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214188" lims:id="214188"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214189" lims:id="214189">Assessor and Deputy Assessors</MarginalNote><Label>50</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214190" lims:id="214190"><Label>(1)</Label><Text>The Governor in Council shall, from among the judges of the Federal Court, appoint an Assessor and such number of Deputy Assessors as the Governor in Council considers necessary to hear and determine appeals under this Part and, subject to this Part, may prescribe their jurisdiction.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214191" lims:id="214191"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214192" lims:id="214192">Acting assessor</MarginalNote><Label>(2)</Label><Text>The Governor in Council shall, from among the judges of the Federal Court, appoint an acting assessor to act in the place of the Assessor in the event of the Assessor’s absence or incapacity.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214193" lims:id="214193"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214194" lims:id="214194">Deputy Assessor</MarginalNote><Label>(3)</Label><Text>The Assessor may designate a Deputy Assessor to hear and determine any appeal under this Part and, where the Assessor does so, the references in sections 52 and 53 to the “Assessor” shall be construed as including references to the “Deputy Assessor”.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214195" lims:id="214195"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214196" lims:id="214196">Appeal</MarginalNote><Label>51</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214197" lims:id="214197"><Label>(1)</Label><Text>Any person who has applied for compensation and is not satisfied with the decision of the Minister thereon may appeal the decision to the Assessor.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214198" lims:id="214198"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214199" lims:id="214199">Limitation period</MarginalNote><Label>(2)</Label><Text>No appeal may be made under this section more than three months after the day on which the person applying for compensation receives notice of the Minister’s decision thereon or such longer period as the Assessor may, either before or after the expiration of that period of three months, allow for special reasons.</Text></Subsection></Section><Section lims:inforce-start-date="2003-07-02" lims:lastAmendedDate="2003-07-02" lims:fid="214200" lims:id="214200"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="214201" lims:id="214201">Powers of Assessor</MarginalNote><Label>52</Label><Subsection lims:inforce-start-date="2003-07-02" lims:fid="214202" lims:id="214202"><Label>(1)</Label><Text>On the hearing of an appeal under this Part, the Assessor may</Text><Paragraph lims:inforce-start-date="2003-07-02" lims:fid="214203" lims:id="214203"><Label>(a)</Label><Text>confirm the decision of the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-07-02" lims:fid="214204" lims:id="214204"><Label>(b)</Label><Text>notwithstanding the maximum amount, if any, of compensation that may be paid to the person appealing, vary the decision of the Minister; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-07-02" lims:fid="214205" lims:id="214205"><Label>(c)</Label><Text>refer the matter back to the Minister for such further action as the Assessor may direct, including the calculation of compensation without regard to the maximum amount, if any, that may otherwise be paid.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="214206" lims:id="214206"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="214207" lims:id="214207">Costs</MarginalNote><Label>(2)</Label><Text>In any appeal under this Part, costs may be awarded to or against the Crown.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="214208" lims:id="214208"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="214209" lims:id="214209">Decision final</MarginalNote><Label>(3)</Label><Text>The decision of the Assessor on any appeal under this Part is final and conclusive and, except for judicial review under the <XRefExternal reference-type="act" link="F-7">Federal Courts Act</XRefExternal>, is not subject to appeal to or review by any court.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="214210" lims:id="214210"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="214211" lims:id="214211">Payment</MarginalNote><Label>(4)</Label><Text>Where the Assessor varies a decision of the Minister by awarding compensation or increasing the amount of compensation awarded by the Minister or, on a matter referred back for further action, the Minister increases the amount of compensation previously awarded, the Minister shall pay that compensation or increased compensation, as the case may be.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="214216"><Label>(1)</Label><Text>The Assessor may sit and hear appeals at any place or places, and shall arrange for such sittings and hearings as may be lims:id="214218">Expenses</MarginalNote><Label>(2)</Label><Text>The Assessor is entitled to be paid such travel allowances as are paid for attendances as a judge of the Federal Court under the <XRefExternal reference-type="act" link="J-1">Judges Act</XRefExternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214219" lims:id="214219"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214220" lims:id="214220">Procedure</MarginalNote><Label>54</Label><Text>The Assessor may, with the approval of the Governor in Council, make such rules respecting the conduct of appeals and the procedure for the bringing of appeals as the Assessor deems necessary to enable the discharge of the Assessor’s duties under this Act.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214221" lims:id="214221"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214234" lims:id="214234"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214235" lims:id="214235">Tabling in Parliament when sitting</MarginalNote><Label>58</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214236" lims:id="214236"><Label>(1)</Label><Text>Subject to subsection (4), a motion for confirmation of a declaration of emergency, signed by a minister of the Crown, together with an explanation of the reasons for issuing the declaration and a report on any consultation with the lieutenant governors in council of the provinces with respect to the declaration, shall be laid before each House of Parliament within seven sitting days after the declaration is issued.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" declaration of emergency is issued during a prorogation of Parliament or when either House of Parliament stands adjourned, Parliament or that House, as the case may be, shall be summoned forthwith to sit within seven days after the declaration is issued.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214239" lims:id="214239"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214240" lims:id="214240">Summoning Parliament</MarginalNote><Label>(3)</Label><Text>If a declaration of emergency is issued at a time when the House of Commons is dissolved, Parliament shall be summoned to sit at the earliest opportunity after the declaration is issued.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214241" lims:id="214241"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214242" lims:id="214242">Tabling in Parliament after summoned</MarginalNote><Label>(4)</Label><Text>Where Parliament or a House of Parliament is summoned to sit in accordance with subsection (2) or (3), the motion, explanation and report described in subsection (1) shall be laid before each House of Parliament or that House of Parliament, as the case may be, on the first sitting day after Parliament or that House is summoned.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214243" lims:id="214243"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214244" Parliament, the declaration, to the extent that it has not previously expired or been revoked, is revoked effective on the day of the negative vote and no further action under this section need be lims:inforce-start-date="2002-12-31" lims:fid="214263" lims:id="214263"><Label>(1)</Label><Text>A motion for confirmation of a proclamation continuing a declaration of emergency and of any orders and regulations named in the motion pursuant to subsection (3), signed by a minister of the Crown, together with an explanation of the reasons for issuing the proclamation, a report on any consultation with the lieutenant governors in council of the provinces with respect to the proclamation and a report on the review of orders and regulations conducted before the issuing of the proclamation, shall be laid before each House of Parliament within seven sitting days after the proclamation is issued.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214264" lims:id="214264"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214265" lims:id="214265">Motion for confirmation of proclamation amending a declaration</MarginalNote><Label>(2)</Label><Text>A motion for confirmation of a proclamation amending a declaration of emergency, signed by a minister of the Crown, together with an explanation of the reasons for issuing the proclamation and a report on any consultation with the lieutenant governors in council of the provinces with respect to the proclamation, shall be laid before each House of Parliament within seven sitting days after the proclamation is issued.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214266" lims:id="214266"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214267" lims:id="214267">Orders and regulations named</MarginalNote><Label>(3)</Label><Text>A motion for confirmation of a proclamation continuing a declaration of emergency shall name the orders and regulations in force on the issuing of the proclamation that the Governor in Council believed, on reasonable grounds, continued at that time to be necessary or, in the case of a proclamation issued pursuant to subsection 43(1), advisable, for dealing with the emergency.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214268" lims:id="214268"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214269" lims:id="214269">Consideration</MarginalNote><Label>(4)</Label><Text>Where a motion is laid before a House of Parliament as provided in subsection (1) or (2), that House shall, on the sitting day next following the sitting day on which the motion was so laid, take up and consider the motion.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214270" lims:id="214270"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214271" expired or been revoked, is revoked effective on the day of the negative vote and no further action under this section need be taken in the other House with respect to the House of Parliament by the deletion therefrom of an order or regulation named in the motion pursuant to subsection (3), the order or regulation is revoked effective on the day on which the motion, as amended, is adopted.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="214276" lims:id="214276" level="2"><TitleText>Orders and Regulations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="214277" lims:id="214277"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214278" lims:id="214278">Tabling in Parliament</MarginalNote><Label>61</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214279" lims:id="214279"><Label>(1)</Label><Text>Subject to subsection (2), every order or regulation made by the Governor in Council pursuant to this Act shall be laid before each House of Parliament within two sitting days after it is made.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214280" lims:id="214280"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214281" lims:id="214281">Reference to Committee</MarginalNote><Label>(2)</Label><Text>Where an order or regulation made pursuant to this Act is exempted from publication in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> by regulations made under the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal>, the order or regulation, in lieu of being laid before each House of Parliament as required by subsection (1), shall be referred to the Parliamentary Review Committee within two days after it is made or, if the Committee is not then designated or established, within the first two days after it is designated or established.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214282" lims:id="214282"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214283" lims:id="214283">Motion for revocation or amendment</MarginalNote><Label>(3)</Label><Text>Where a motion, for the concurrence</MarginalNote><Label>(5)</Label><Text>If a motion debated in accordance with subsection (4) is adopted by the House, a message shall forthwith be sent from that House informing the other House that the motion has been so adopted and requesting that the motion be concurred in by that other House.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214288" lims:id="214288"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214289" lims:id="214289">Consideration</MarginalNote><Label>(6)</Label><Text>Where a request for concurrence in a motion is made pursuant to subsection (5), the House to which the request is made shall take up and consider the motion within three sitting days after the request is made.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214294" lims:id="214294" level="2"><TitleText>Parliamentary Review Committee</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2022-07-26" lims:fid="214295" lims:id="214295"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214296" lims:id="214296">Review by Parliamentary Review Committee</MarginalNote><Label>62</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214297" lims:id="214297"><Label>(1)</Label><Text>The exercise of powers and the performance of duties and functions pursuant to a declaration of emergency shall be reviewed by a committee of both Houses of Parliament designated or established for that purpose.</Text></Subsection><Subsection lims:inforce-start-date="2022-07-26" lims:enacted-date="2022-06-23" lims:fid="214298" lims:id="1373047"><MarginalNote lims:inforce-start-date="2022-07-26" lims:enacted-date="2022-06-23" lims:fid="1373048" lims:id="1373048">Membership</MarginalNote><Label>(2)</Label><Text>The Parliamentary Review Committee shall include at least one member of the House of Commons from each party that has a recognized membership of 12 or more persons in that House and at least the Leader of the Government in the Senate or Government Representative in the Senate, or his or her nominee, the Leader of the Opposition in the Senate, or his or her nominee, and the Leader or Facilitator who is referred to in any of paragraphs 62.4(1)(c) to (e) of the <XRefExternal reference-type="act" link="P-1">Parliament of Canada Act</XRefExternal>, or his or her nominee.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214300" lims:id="214300"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214301" lims:id="214301">Oath of secrecy</MarginalNote><Label>(3)</Label><Text>Every member of the Parliamentary Review Committee and every person employed in the work of the Committee shall take the oath of secrecy set out in the schedule.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214302" lims:id="214302"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214303" lims:id="214303">Meetings in private</MarginalNote><Label>(4)</Label><Text>Every meeting of the Parliamentary Review Committee held to consider an order or regulation referred to it pursuant to subsection 61(2) shall be held in private.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214304" lims:id="214304"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214305" lims:id="214305">Revocation or amendment of order or regulation</MarginalNote><Label>(5)</Label><Text>If, within thirty days after an order or regulation is referred to the Parliamentary Review Committee pursuant to subsection 61(2), the Committee adopts a motion to the effect that the order or regulation be revoked or amended, the order or regulation is revoked or amended in accordance with the motion, effective on the day specified in the motion, which day may not be earlier than the day on which the motion is adopted.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="214306" lims:id="214306"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="214307" lims:id="214307">Report to Parliament</MarginalNote><Label>(6)</Label><Text>The Parliamentary Review Committee shall report or cause to be reported the results of its review under subsection (1) to each House of Parliament at least once every sixty days while the declaration of emergency is in effect and, in any case,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214308" lims:id="214308"><Label>(a)</Label><Text>within three sitting days after a motion for revocation of the declaration is filed under subsection 59(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214309" lims:id="214309"><Label>(b)</Label><Text>within seven sitting days after a proclamation continuing the declaration is issued; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="214310" lims:id="214310"><Label>(c)</Label><Text>within seven sitting days after the expiration
