Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211752" lims:id="211752" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211753" lims:id="211753"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211754" lims:id="211754">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2018-06-21" lims:fid="211755" lims:id="211755"><Text><DefinedTermEn>Board</DefinedTermEn> means the Parole Board of Canada. (<DefinedTermFr>Commission</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-06-21" lims:fid="211756" lims:id="211756"><Text><DefinedTermEn>Chairperson</DefinedTermEn> means the Chairperson of the Board designated under section 104 of the <XRefExternal reference-type="act" link="C-44.6">Corrections and Conditional Release Act</XRefExternal>. (<DefinedTermFr>président</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211757" lims:id="211757" level="1"><TitleText>Powers, Duties and Functions</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211758" lims:id="211758"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211759" lims:id="211759">Powers of Board</MarginalNote><Label>3</Label><Text>The Board may, in accordance with this Act, order or refuse to order expungement of a conviction in respect of the offences listed in the schedule.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211760" lims:id="211760"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211761" lims:id="211761">Delegation</MarginalNote><Label>4</Label><Text>The Board, subject to the approval of the Chairperson, may confer on any of its employees or class of its employees any of its powers, duties or functions under this Act.</Text></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211762" lims:id="211762" level="1"><TitleText>Expungement</TitleText></Heading><Heading lims:inforce-start-date="2018-06-21" lims:fid="211763" lims:id="211763" level="2"><TitleText>Effects</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211764" lims:id="211764"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211765" lims:id="211765">Effect of expungement</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211766" lims:id="211766"><Label>(1)</Label><Text>If the Board orders expungement of a conviction in respect of an offence listed in the schedule, the person convicted of the offence is deemed never to have been convicted of that offence.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211767" lims:id="211767"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211768" lims:id="211768">Lawful act</MarginalNote><Label>(2)</Label><Text>Nothing in this Act has the effect of making unlawful a lawful act or omission related to the expunged conviction that was committed prior to the expungement order.</Text></Subsection></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211769" lims:id="211769"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211770" lims:id="211770">Royal prerogative</MarginalNote><Label>6</Label><Text>Nothing in this Act in any manner limits or affects Her Majesty’s royal prerogative of mercy.</Text></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211771" lims:id="211771" level="2"><TitleText>Procedure</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211772" lims:id="211772"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211773" lims:id="211773">Application</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211774" lims:id="211774"><Label>(1)</Label><Text>A person who has been convicted of an offence listed in the schedule or a person referred to in subsection (2) may apply to the Board for an expungement order.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211775" lims:id="211775"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211776" lims:id="211776">Application on person’s behalf</MarginalNote><Label>(2)</Label><Text>If a person who has been convicted of an offence listed in the schedule is deceased, any of the following may apply for an expungement order on the person’s behalf:</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211777" lims:id="211777"><Label>(a)</Label><Text>the person’s spouse or the individual who, at the time of the person’s death, was cohabiting with the person in a conjugal relationship, having so cohabited for a period of at least one year;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211778" lims:id="211778"><Label>(b)</Label><Text>the person’s child;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211779" lims:id="211779"><Label>(c)</Label><Text>the person’s parent;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211780" lims:id="211780"><Label>(d)</Label><Text>the person’s brother or sister;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211781" lims:id="211781"><Label>(e)</Label><Text>the person’s agent or mandatary, attorney, guardian, trustee, committee, tutor or curator, or any other person who was appointed to act in a similar capacity before his or her death;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211782" lims:id="211782"><Label>(f)</Label><Text>the person’s executor or the administrator or liquidator of the person’s estate;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211783" lims:id="211783"><Label>(g)</Label><Text>any other individual who, in the opinion of the Board, is an appropriate representative of the person.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211784" lims:id="211784"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211785" lims:id="211785">Form and manner of application</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211786" lims:id="211786"><Label>(1)</Label><Text>An application for an expungement order must be in the form and manner determined by the Board and in accordance with subsections (2) and (3).</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211787" lims:id="211787"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211788" lims:id="211788">Contents of application</MarginalNote><Label>(2)</Label><Text>Subject to subsection (3), if an application is in respect of an offence for which criteria are set out in section <XRefInternal>25</XRefInternal> or in an order, the application must include documents that provide evidence that those criteria are satisfied.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211789" lims:id="211789"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211790" lims:id="211790">Sworn statement or solemn declaration</MarginalNote><Label>(3)</Label><Text>If it is not possible to obtain the documents referred to in subsection (2), the applicant must submit a sworn statement or solemn declaration</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211791" lims:id="211791"><Label>(a)</Label><Text>that explains the reasonable efforts made by the applicant to obtain the documents, and the reasons why they could not be obtained, including because they were lost or destroyed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211792" lims:id="211792"><Label>(b)</Label><Text>that affirms the evidence referred to in section <XRefInternal>25</XRefInternal> or in an order that could not otherwise be provided.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211793" lims:id="211793"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211794" lims:id="211794">Eligibility</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211795" lims:id="211795"><Label>(1)</Label><Text>The Board must reject an application that does not relate to an offence listed in the schedule or for which the applicant is not authorized by section <XRefInternal>7</XRefInternal>.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211796" lims:id="211796"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211797" lims:id="211797">Notice</MarginalNote><Label>(2)</Label><Text>The applicant must be advised in writing of the rejection of their application.</Text></Subsection></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211798" lims:id="211798"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211799" lims:id="211799">Incomplete application</MarginalNote><Label>10</Label><Text>If the Board determines that an application is incomplete, the Board may return it to the applicant at any time.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211800" lims:id="211800"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211801" lims:id="211801">Inquiries</MarginalNote><Label>11</Label><Text>On receipt of an application, the Board may cause inquiries to be made</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211802" lims:id="211802"><Label>(a)</Label><Text>for the purpose of determining whether the applicant is authorized to apply for an expungement order under section <XRefInternal>7</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211803" lims:id="211803"><Label>(b)</Label><Text>for the purposes of the review under section <XRefInternal>12</XRefInternal>.</Text></Paragraph></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211804" lims:id="211804"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211805" lims:id="211805">Review</MarginalNote><Label>12</Label><Text>Subject to sections <XRefInternal>9</XRefInternal> and <XRefInternal>10</XRefInternal>, the Board must review the application and the evidence gathered through any inquiries and determine whether there is evidence</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211806" lims:id="211806"><Label>(a)</Label><Text>if the application is in respect of an offence for which criteria are set out in section <XRefInternal>25</XRefInternal> or in an order, that any of those criteria are not satisfied; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211807" lims:id="211807"><Label>(b)</Label><Text>that the activity in respect of which the application is made is prohibited under the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> at the time the application is reviewed.</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211808" lims:id="211808" level="2"><TitleText>Order</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211809" lims:id="211809"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211810" lims:id="211810">Order to expunge</MarginalNote><Label>13</Label><Text>Subject to sections <XRefInternal>9</XRefInternal> and <XRefInternal>10</XRefInternal>, if the Board’s review reveals no evidence referred to in paragraph 12(a) or (b), the Board must order expungement of the conviction in respect of the offence for which the application was made.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211811" lims:id="211811"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211812" lims:id="211812">Refusal</MarginalNote><Label>14</Label><Text>Subject to sections <XRefInternal>9</XRefInternal> and <XRefInternal>10</XRefInternal>, if the Board’s review reveals evidence referred to in paragraph <XRefInternal>12</XRefInternal>(a) or (b), the Board must refuse to order expungement of the conviction in respect of the offence for which the application was made.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211813" lims:id="211813"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211814" lims:id="211814">Notice to applicant</MarginalNote><Label>15</Label><Text>The Board must notify the applicant in writing of the expungement order or of its refusal to order expungement.</Text></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211815" lims:id="211815" level="2"><TitleText>Destruction and Removal</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211816" lims:id="211816"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211817" lims:id="211817">Notification to RCMP</MarginalNote><Label>16</Label><Text>The Board must notify the Royal Canadian Mounted Police of any expungement order. The Board must also notify any superior, provincial or municipal court that, to its knowledge, has custody of any judicial record of the conviction to which the expungement order relates.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211818" lims:id="211818"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211819" lims:id="211819">Destruction or removal by RCMP</MarginalNote><Label>17</Label><Text>As soon as feasible after receipt of the notification from the Board, the Royal Canadian Mounted Police must destroy or remove any judicial record of the conviction to which the expungement order relates that is in its repositories or systems.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211820" lims:id="211820"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211821" lims:id="211821">Notification by RCMP</MarginalNote><Label>18</Label><Text>As soon as feasible after receipt of the notification from the Board, the Royal Canadian Mounted Police must provide notification of the expungement order to any federal department or agency, and to any provincial or municipal police force, that, to its knowledge, has custody of any judicial record of the conviction to which the expungement order relates.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211822" lims:id="211822"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211823" lims:id="211823">Destruction or removal by departments and agencies</MarginalNote><Label>19</Label><Text>As soon as feasible after receipt of a notification from the Royal Canadian Mounted Police, a federal department or agency must destroy or remove any judicial record of the conviction to which the expungement order relates that is in its repositories or systems.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211824" lims:id="211824"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211825" lims:id="211825">Non-application</MarginalNote><Label>20</Label><Text>Sections <XRefInternal>17</XRefInternal> and <XRefInternal>19</XRefInternal> apply despite sections 12 and 13 of the <XRefExternal reference-type="act" link="L-7.7">Library and Archives of Canada Act</XRefExternal>, subsections 6(1) and (3) of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal> and any other provision of an Act of Parliament.</Text></Section><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211826" lims:id="211826"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211827" lims:id="211827">For greater certainty</MarginalNote><Label>21</Label><Text>For greater certainty, sections <XRefInternal>17</XRefInternal> to <XRefInternal>20</XRefInternal> do not apply to documents submitted or produced in respect of an application under this Act.</Text></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211828" lims:id="211828" level="2"><TitleText>Disclosure of Information</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211829" lims:id="211829"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211830" lims:id="211830">Perjury investigation</MarginalNote><Label>22</Label><Text>The Board may, for the purpose of the investigation or prosecution of any offence under section 131 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> (perjury), disclose any information submitted or produced in respect of an application under this Act.</Text></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211831" lims:id="211831" level="1"><TitleText>Amendment of Schedule</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211832" lims:id="211832"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211833" lims:id="211833">Schedule</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211834" lims:id="211834"><Label>(1)</Label><Text>Subject to the conditions referred to in subsection (2), the Governor in Council may, by order, add to the schedule any item or portion of an item.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="211835" lims:id="211835"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211836" lims:id="211836">Conditions</MarginalNote><Label>(2)</Label><Text>In order to provide for expungement of convictions arising from an activity, the Governor in Council may add any item or portion of an item to the schedule if the activity no longer constitutes an offence under an Act of Parliament and the Governor in Council is of the opinion that the criminalization of the activity constitutes a historical injustice.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211837" lims:id="211837" level="1"><TitleText>Criteria</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211838" lims:id="211838"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211839" lims:id="211839">Order</MarginalNote><Label>24</Label><Text>The Governor in Council may, by order, establish the criteria related to an offence listed in the schedule that must be satisfied for expungement of a conviction to be ordered.</Text></Section><Heading lims:inforce-start-date="2018-06-21" lims:fid="211840" lims:id="211840" level="1"><TitleText>Same-Sex Sexual Offences</TitleText></Heading><Section lims:inforce-start-date="2018-06-21" lims:lastAmendedDate="2018-06-21" lims:fid="211841" lims:id="211841"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="211842" lims:id="211842">Offences listed in items 1 to 6 of schedule</MarginalNote><Label>25</Label><Text>An application for an expungement order for a conviction in respect of the offences listed in items 1 to 6 of the schedule must include evidence that the following criteria are satisfied:</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211843" lims:id="211843"><Label>(a)</Label><Text>the activity for which the person was convicted was between persons of the same sex;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="211844" lims:id="211844"><Label>(b)</Label><Text>the persons other than the person who was convicted had given their
