(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-12-16" lims:enacted-date="2024-12-16" lims:fid="599540" lims:id="1503211"><Text><DefinedTermEn>Assistant Deputy Minister</DefinedTermEn> means the Assistant Deputy Minister, Lands and Economic Development; (<DefinedTermFr>sous-ministre adjoint</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="599541" lims:id="599541" generate-in-text="no"><Text><DefinedTermEn>deputy electoral officer</DefinedTermEn> means a person appointed by an electoral officer for the purposes of a referendum; (<DefinedTermFr>président du scrutin</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="599542" lims:id="599542" generate-in-text="no"><Text><DefinedTermEn>elector</DefinedTermEn>, in respect of a referendum, means an elector of the band in respect of which the referendum is being held; (<DefinedTermFr>réserve</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="599550" lims:id="599550" generate-in-text="no"><Text><DefinedTermEn>surrender</DefinedTermEn><Repealed>[Revoked, SOR/94-369, s. 4]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="599551" lims:id="599551" generate-in-text="no"><Text><DefinedTermEn>voter declaration form</DefinedTermEn> means a document that sets out, or provides for,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599552" lims:id="599552"><Label>(a)</Label><Text>the name of an elector,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599553" lims:id="599553"><Label>(b)</Label><Text>the band membership or registry number of the elector or, if the elector does not have a band membership or registry number, the date of birth of the elector,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599554" lims:id="599554"><Label>(c)</Label><Text>a statement that the elector has read and understood the information package regarding the proposed designation or surrender and has voted freely and without compulsion, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599555" lims:id="599555"><Label>(d)</Label><Text>the name, address and telephone number of a witness to the signature of the elector. level="1"><TitleText>Holding of Referendum</TitleText></Heading><Section lims:inforce-start-date="2013-03-01" lims:lastAmendedDate="2013-03-01" lims:fid="599559" lims:id="599559"><Label>3</Label><Subsection lims:inforce-start-date="2013-03-01" lims:fid="599560" lims:id="599560"><Label>(1)</Label><Text>The Minister may, at the request of the council of a band or whenever the Minister considers it advisable, order that a referendum be held under subparagraph 39(1)(b)(iii), subsection 39(2) or section 39.1 of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2013-03-01" lims:fid="599561" lims:id="599561"><Label>(2) and (3)</Label><Text><Repealed>[Repealed, SOR/2000-392, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="599564" lims:id="599564" level="1"><TitleText>Voters List</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599565" lims:id="599565"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599566" lims:id="599566"><Label>(1)</Label><Text>At least 49 days before the day on which a referendum is to be held</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599567" lims:id="599567"><Label>(a)</Label><Text>where the band holding the referendum has assumed control of its own membership under section 10 of the Act, the band shall provide the electoral officer with a list of the names of all electors; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599568" lims:id="599568"><Label>(b)</Label><Text>where the Band List of the band holding the referendum is maintained in the Department under section 11 of the Act, the Registrar shall provide the electoral officer with a list of the names of all electors.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599569" lims:id="599569"><Label>(2)</Label><Text>A voters list shall set out</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599570" lims:id="599570"><Label>(a)</Label><Text>the names of all electors, in alphabetical order; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599571" lims:id="599571"><Label>(b)</Label><Text>the band membership or registry number of each elector or, if the elector does not have a band membership or registry number, the date of birth of the elector.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599572" lims:id="599572"><Label>(3)</Label><Text>On request, the electoral officer or deputy electoral officer shall confirm whether the name of a person is on the voters list.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599573" lims:id="599573"><Label>(4)</Label><Text>The electoral officer shall revise the voters list where it is demonstrated that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599574" lims:id="599574"><Label>(a)</Label><Text>the name of an elector has been omitted from the list;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599575" lims:id="599575"><Label>(b)</Label><Text>the name of an elector is incorrectly set out in the list; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599576" lims:id="599576"><Label>(c)</Label><Text>the name of a person not qualified to vote is included in the list.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599577" lims:id="599577"><Label>(5)</Label><Text>For the purposes of subsection (4), a person may demonstrate</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599578" lims:id="599578"><Label>(a)</Label><Text>that the name of an elector has been omitted from, or incorrectly set out in, the voters list by presenting to the electoral officer evidence from the Registrar or from the band that the elector is on the Band List, is at least 18 years of age and is qualified to vote at band elections; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599579" lims:id="599579"><Label>(b)</Label><Text>that the name of a person not qualified to vote has been included in the voters list by presenting to the electoral officer evidence that that person is not on the Band List, is not at least 18 years of age or is not qualified to vote at band elections.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599581" lims:id="599581">SOR/2000-392, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="599582" lims:id="599582" level="1"><TitleText>Addresses of Electors</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599583" lims:id="599583"><Label>4.1</Label><Text>At least 49 days before the day on which a referendum is to be held, the band shall provide the electoral officer with the last known addresses, if any, of all electors who do not reside on the reserve.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599585" lims:id="599585">SOR/2000-392, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="599586" lims:id="599586" level="1"><TitleText>Notification of Referendum</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599587" lims:id="599587"><Label>4.2</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599588" lims:id="599588"><Label>(1)</Label><Text>At least 14 days before the day on which an information meeting for a referendum is to be held and at least 42 days before the day of the referendum, the electoral officer or deputy electoral officer shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599589" lims:id="599589"><Label>(a)</Label><Text>post a notice of the referendum and a list of the names of electors in at least one conspicuous place on the reserve; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599590" lims:id="599590"><Label>(b)</Label><Text>mail or deliver to every elector of the band who does not reside on the reserve and for whom an address has been provided</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599591" lims:id="599591"><Label>(i)</Label><Text>a notice of the referendum,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599592" lims:id="599592"><Label>(ii)</Label><Text>a mail-in ballot, initialled on the back by the electoral officer,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599593" lims:id="599593"><Label>(iii)</Label><Text>an outer, postage-paid return envelope, pre-addressed to the electoral officer,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599594" lims:id="599594"><Label>(iv)</Label><Text>a second, inner envelope marked “Ballot” for insertion of the completed ballot,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599595" lims:id="599595"><Label>(v)</Label><Text>a voter declaration form,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599596" lims:id="599596"><Label>(vi)</Label><Text>a letter of instruction regarding voting by mail-in ballot, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599597" lims:id="599597"><Label>(vii)</Label><Text>an information package regarding the designation or surrender that is the subject of the referendum.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599598" lims:id="599598"><Label>(2)</Label><Text>A notice of a referendum shall state</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599599" lims:id="599599"><Label>(a)</Label><Text>the question to be submitted to the electors;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599600" lims:id="599600"><Label>(b)</Label><Text>the date on which the referendum will be held;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599601" lims:id="599601"><Label>(c)</Label><Text>the location of each polling station and the hours that it will be open for voting;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599602" lims:id="599602"><Label>(d)</Label><Text>that electors may vote either in person at a polling station in accordance with subsection 9(3) or by mail-in ballot;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599603" lims:id="599603"><Label>(e)</Label><Text>the name and telephone number of the electoral officer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599604" lims:id="599604"><Label>(f)</Label><Text>the date, time and location of the information meeting.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599605" lims:id="599605"><Label>(3)</Label><Text>At the request of an elector who resides on the reserve, the electoral officer shall provide the elector with the material referred to in subsection (1)(b).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599606" lims:id="599606"><Label>(4)</Label><Text>The electoral officer shall indicate on the voters list that a ballot has been provided to each elector to whom a mail-in ballot was mailed, delivered or otherwise provided, and keep a record of the date on which, and the addresses to which, each mail-in ballot was mailed or delivered.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599607" lims:id="599607"><Label>(5)</Label><Text>An elector to whom a mail-in ballot was mailed, delivered or provided under subsection (1) or (3) is not entitled to vote in person at a polling station other than in accordance with subsection 9(3).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:fid="599610" lims:id="599610" level="1"><TitleText>Information Meetings</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599611" lims:id="599611"><Label>4.3</Label><Text>Before the day on which a referendum is to be held, the electoral officer shall ensure that at least one information meeting is held to provide electors with information regarding the designation or surrender that is the subject of the referendum.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599613" lims:id="599613">SOR/2000-392, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="599614" lims:id="599614" level="1"><TitleText>Preparation for Referendum</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599616" lims:id="599616">SOR/2000-392, s. 4</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599617" lims:id="599617"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599618" lims:id="599618"><Label>(1)</Label><Text>The electoral officer shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599619" lims:id="599619"><Label>(a)</Label><Text>prepare sufficient ballots, initialled on the back by the electoral officer, stating the question to be submitted to the electors;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599620" lims:id="599620"><Label>(b) and (c)</Label><Text><Repealed>[Repealed, SOR/2000-392, s. 5]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599621" lims:id="599621"><Label>(d)</Label><Text>procure a sufficient number of ballot boxes; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599622" lims:id="599622"><Label>(e)</Label><Text>before the poll is open cause to be delivered to the deputy electoral officer the ballot papers and a sufficient number of lead pencils for marking the ballot papers.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599623" lims:id="599623"><Label>(2) and (3)</Label><Text><Repealed>[Repealed, SOR/2000-392, s. 5]</Repealed></Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599625" lims:id="599625">SOR/2000-392, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="599626" lims:id="599626" level="1"><TitleText>Voting by Mail-in Ballot</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-12-16" lims:fid="599627" lims:id="599627"><Label>5.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599628" lims:id="599628"><Label>(1)</Label><Text>An elector may vote by mail-in ballot by</Text><Paragraph lims:inforce-start-date="2024-12-16" lims:enacted-date="2024-12-16" lims:fid="599629" lims:id="1503214"><Label>(a)</Label><Text>marking the ballot by placing a check mark or other mark, clearly indicating the elector’s response to the question stated on the ballot;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599630" lims:id="599630"><Label>(b)</Label><Text>folding the ballot in a manner that conceals the question and any marks, but exposes the initials on the back;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599631" lims:id="599631"><Label>(c)</Label><Text>placing the ballot in the inner envelope and sealing that envelope;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599632" lims:id="599632"><Label>(d)</Label><Text>completing and signing the voter declaration form in the presence of a witness who is at least 18 years of age;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599633" lims:id="599633"><Label>(e)</Label><Text>placing the inner envelope and the completed, signed and witnessed voter declaration form in the outer envelope; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599634" lims:id="599634"><Label>(f)</Label><Text>delivering or, subject to subsection (6), mailing the outer envelope to the electoral officer before the time at which the polls close on the day of the referendum.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599635" lims:id="599635"><Label>(2)</Label><Text>Where an elector is unable to vote in the manner set out in subsection (1), the elector may enlist the assistance of another person to mark the ballot and complete and sign the voter declaration form in accordance with subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599636" lims:id="599636"><Label>(3)</Label><Text>A witness referred to in paragraph (1)(d) shall attest to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599637" lims:id="599637"><Label>(a)</Label><Text>the fact that the person completing and signing the voter declaration form is the person whose name is set out in the form; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599638" lims:id="599638"><Label>(b)</Label><Text>where the elector enlisted the assistance of another person under subsection (2), the fact that the elector is the person whose name is set out in the form and that the ballot was marked according to the directions of the elector.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599639" lims:id="599639"><Label>(4)</Label><Text>An elector who inadvertently spoils a mail-in ballot may obtain another ballot by returning the spoiled ballot to the electoral officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599640" lims:id="599640"><Label>(5)</Label><Text>An elector who loses a mail-in ballot may obtain another ballot by delivering to the electoral officer a written affirmation that the elector has lost the mail-in ballot, signed by the elector in the presence of the electoral officer, a justice of the peace, a notary public or a commissioner for oaths.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599641" lims:id="599641"><Label>(6)</Label><Text>Mail-in ballots that are not received by the electoral officer before the time at which the polls close on the day of the referendum are void and shall not be Stations</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599645" lims:id="599645"><Label>5.2</Label><Text>The electoral officer shall establish at least one polling station on the reserve.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599647" lims:id="599647">SOR/2000-392, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599648" lims:id="599648"><Label>6</Label><Text>The electoral officer or the deputy electoral officer shall provide a compartment at each polling place where the elector can mark his ballot paper free from observation.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599649" lims:id="599649"><Label>7</Label><Text>The electoral officer or the deputy electoral officer shall, immediately before the opening of the poll, open the ballot box and call upon such persons who may be present to witness that it is empty and shall then lock and properly seal the box and place it in view for the reception of the ballots.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599650" lims:id="599650"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599651" lims:id="599651"><Label>(1)</Label><Text>Polling stations shall be kept open from 9:00 a.m., local time, until 8:00 p.m., local time, on the day of the referendum.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599652" lims:id="599652"><Label>(2)</Label><Text>An elector who is inside a polling station at the time that the polling station is to close is entitled to vote.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599654" lims:id="599654">SOR/2000-392, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599655" lims:id="599655"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599656" lims:id="599656"><Label>(1)</Label><Text>Subject to subsection 4.2(5), where a person attends at a polling station for the purpose of voting, the electoral officer or deputy electoral officer shall, if the person’s name is set out in the voters list, provide the person with a ballot.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599657" lims:id="599657"><Label>(2)</Label><Text>The electoral officer or the deputy electoral officer shall place on the list of electors a mark opposite the name of every elector receiving a ballot paper.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599658" lims:id="599658"><Label>(3)</Label><Text>An elector to whom a mail-in ballot was mailed, delivered or provided under subsection 4.2(1) or (3) may obtain a ballot and vote in person at a polling station if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599659" lims:id="599659"><Label>(a)</Label><Text>the elector returns the mail-in ballot to the electoral officer or deputy electoral officer; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599660" lims:id="599660"><Label>(b)</Label><Text>where the elector has lost the mail-in ballot, the elector provides the electoral officer or deputy electoral officer with a written affirmation that the elector has lost the mail-in ballot, signed by the elector in the presence of the electoral officer, deputy electoral officer, a justice of the peace, a notary public or a commissioner for oaths.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599662" lims:id="599662">SOR/2000-392, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599663" lims:id="599663"><Label>10</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599664" lims:id="599664"><Label>(1)</Label><Text>The electoral officer or the deputy electoral officer shall explain the mode of voting to an elector when requested to do so by such elector.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599665" lims:id="599665"><Label>(2)</Label><Text>On the application of an elector who is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599666" lims:id="599666"><Label>(a)</Label><Text>not able to read, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599667" lims:id="599667"><Label>(b)</Label><Text>incapacitated by blindness or other physical cause,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="599668" lims:id="599668"><Text>the electoral officer or the deputy electoral officer shall assist that elector by marking his ballot paper in the manner directed by the elector and shall place such ballot paper in the ballot box.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599669" lims:id="599669"><Label>(3)</Label><Text>The electoral officer or the deputy electoral officer shall make an entry in the list of electors opposite the name of the elector that the ballot paper was marked by him at the request of the elector and the reasons therefor.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-12-16" lims:fid="599670" lims:id="599670"><Label>11</Label><Text>Except as provided in subsection 10(2), every elector receiving a ballot paper shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599671" lims:id="599671"><Label>(a)</Label><Text>proceed immediately to the compartment provided for marking the ballot paper;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-16" lims:enacted-date="2024-12-16" lims:fid="599672" lims:id="1503216"><Label>(b)</Label><Text>mark the ballot by placing a check mark or other mark, clearly indicating the elector’s response to the question stated on the ballot;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599673" lims:id="599673"><Label>(c)</Label><Text>fold the ballot in a manner that conceals the question and any marks, but exposes the initials on the back;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599674" lims:id="599674"><Label>(d)</Label><Text>forthwith deliver it to the electoral officer or the deputy electoral officer for deposit in the ballot box.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599676" lims:id="599677"><Label>12</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599678" lims:id="599678"><Label>(1)</Label><Text>An elector who receives a soiled or improperly printed ballot paper, or inadvertently spoils his ballot paper in marking it shall, upon returning the ballot paper to the electoral officer or the deputy electoral officer, be entitled to another ballot paper.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599679" lims:id="599679"><Label>(2)</Label><Text>An elector who has received a ballot paper and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599680" lims:id="599680"><Label>(a)</Label><Text>leaves the compartment for marking ballot papers without delivering the same to the electoral officer or the deputy electoral officer in the manner provided, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599681" lims:id="599681"><Label>(b)</Label><Text>refuses to vote,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="599682" lims:id="599682"><Text>shall forfeit his right to vote on the referendum and the electoral officer or the deputy electoral officer shall make an entry on the list of electors opposite the name of the elector that the elector did not return the ballot paper or refused to vote as the case may be.</Text></ContinuedSectionSubsection></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599683" lims:id="599683"><Label>13</Label><Text>The electoral officer or the deputy electoral officer shall allow only one elector in the compartment for marking ballot papers at any one time.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599684" lims:id="599684"><Label>14</Label><Text><Repealed>[Repealed, SOR/2000-392, s. 10]</Repealed></Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599685" lims:id="599685"><Label>15</Label><Text>No person shall interfere or attempt to interfere with an elector when marking his ballot paper or obtain or attempt to obtain at the polling place information as to how an elector is about to vote or has voted.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599686" lims:id="599686"><Label>16</Label><Text>The electoral officer and deputy electoral officer shall maintain peace and good order during the voting.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599688" lims:id="599688">SOR/2000-392, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599689" lims:id="599689"><Label>17</Label><Text>Whenever the electoral officer or the deputy electoral officer does not understand the language spoken by an elector, he or she shall enlist the aid of an interpreter to communicate with respect to all matters required to enable that elector to vote.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599691" lims:id="599691">SOR/2000-392, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="599692" lims:id="599692" level="1"><TitleText>Counting of Votes</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599693" lims:id="599693"><Label>17.1</Label><Text>As soon as is practicable after the close of the polls, the electoral officer shall, in the presence of the deputy electoral officer and any members of the council of the band who are present, open each envelope containing a mail-in ballot that was received before the close of the polls and, without unfolding the ballot,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599694" lims:id="599694"><Label>(a)</Label><Text>set aside the ballot if</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599695" lims:id="599695"><Label>(i)</Label><Text>it was not accompanied by a voter declaration form, or the voter declaration form is not signed or witnessed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599696" lims:id="599696"><Label>(ii)</Label><Text>the name of the elector set out in the voter declaration form is not on the voters list, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599697" lims:id="599697"><Label>(iii)</Label><Text>the voters list shows that the elector has already voted; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599698" lims:id="599698"><Label>(b)</Label><Text>place a mark on the voters list opposite the name of the elector set out in the voter declaration form and deposit the ballot in a ballot box.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599700" been deposited under section 17.1, the electoral officer shall, in the presence of the deputy electoral officer and any members of the council of the band who are present, open all ballot boxes and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599703" lims:id="599703"><Label>(a)</Label><Text>examine the ballot papers;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599704" lims:id="599704"><Label>(a.1)</Label><Text>set aside any ballot that does not have the initials of the electoral officer or deputy electoral officer on the back;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599705" lims:id="599705"><Label>(b)</Label><Text>reject all ballot papers</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599706" lims:id="599706"><Label>(i)</Label><Text><Repealed>[Repealed, SOR/2000-392, s. 12]</Repealed></Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599707" lims:id="599707"><Label>(ii)</Label><Text>that have been marked incorrectly, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599708" lims:id="599708"><Label>(iii)</Label><Text>upon which anything appears by which an elector can be identified;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599709" lims:id="599709"><Label>(c)</Label><Text>count the votes given in favour of and against the question submitted in the referendum; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599710" lims:id="599710"><Label>(d)</Label><Text>prepare a statement in writing of the number of votes so given and of the number of ballot papers rejected.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599711" lims:id="599711"><Label>(2)</Label><Text>The statement referred to in paragraph (1)(d) shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599712" lims:id="599712"><Label>(a)</Label><Text>signed by the electoral officer and by the chief or a member of the council of the band; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-16" lims:enacted-date="2024-12-16" lims:fid="599713" lims:id="1503218"><Label>(b)</Label><Text>filed in the local office of the indicates</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599721" lims:id="599721"><Label>(i)</Label><Text>the number of electors who were entitled to vote,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599722" lims:id="599722"><Label>(ii)</Label><Text>the number of electors who voted,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599723" lims:id="599723"><Label>(iii)</Label><Text>the number of votes cast in favour of and against the question submitted in the referendum, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599724" lims:id="599724"><Label>(iv)</Label><Text>the number of rejected ballots; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599725" lims:id="599725"><Label>(b)</Label><Text>deliver a copy of the statement to</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599726" lims:id="599726"><Label>(i)</Label><Text>the Assistant Deputy Minister,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-16" lims:enacted-date="2024-12-16" lims:fid="599727" lims:id="1503220"><Label>(ii)</Label><Text>the person in charge of the regional office of the Department, them.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599733" lims:id="599733"><Label>(2)</Label><Text>If no review has been requested within 60 days after the referendum, the electoral officer shall destroy the ballots used in the voting.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="599735" Referenda</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="599737" lims:id="599737"><Label>21</Label><Text>Notwithstanding sections 4.2 and 4.3, in respect of a referendum held under subsection 39(2) of the Act,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599738" lims:id="599738"><Label>(a)</Label><Text>the notice of the referendum shall be posted, and the material referred to in paragraph 4.2(1)(b) shall be mailed or delivered, in the manner set out in subsection 4.2(1), at least 35 days before the day on which the referendum is to be held;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599739" lims:id="599739"><Label>(b)</Label><Text>the notice of the referendum is not required to set out the date, time or location of an information meeting;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599740" lims:id="599740"><Label>(c)</Label><Text>in lieu of an information package referred to in subparagraph 4.2(1)(b)(vii), any elector to whom an information package was sent in respect of the previous referendum shall be sent</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599741" lims:id="599741"><Label>(i)</Label><Text>a statement referring him or her to that information package, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="599742" lims:id="599742"><Label>(ii)</Label><Text>instructions on how to obtain an additional information package, if he or she requires one; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599743" lims:id="599743"><Label>(d)</Label><Text>an information lims:inforce-start-date="2006-03-22" lims:fid="599748" lims:id="599748"><Label>(1)</Label><Text>An elector may, in the manner set out in subsection (2), request a review of the referendum by the Minister where the elector believes that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599749" lims:id="599749"><Label>(a)</Label><Text>there was a contravention of these Regulations that may affect the results of the referendum; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="599750" lims:id="599750"><Label>(b)</Label><Text>there was corrupt practice in connection with the referendum.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599751" lims:id="599751"><Label>(2)</Label><Text>A request for a review of a referendum shall be made by forwarding the request to the Minister, by registered mail addressed to the Assistant Deputy Minister, within seven days after the day of the referendum, accompanied by a declaration, containing the grounds for requesting the review and any other relevant information, signed in the presence of a witness who is at least 18 years of age.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599752" lims:id="599752"><Label>(3)</Label><Text>Within 21 days after the receipt of a request for a review of a referendum, the Minister shall mail a copy of the request to the electoral officer who conducted the referendum.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="599753" lims:id="599753"><Label>(4)</Label><Text>Within 10 days after the receipt of a request under subsection (3), the electoral officer shall forward to the Minister, by registered mail addressed to the Assistant Deputy Minister, a declaration responding to the grounds stated in the request, signed in the presence of a witness who is at least 18 years of sufficient to call into question the validity of a referendum held under subparagraph 39(1)(b)(iii) or subsection 39(2) of the Act, the Minister shall advise the Governor in Council                     — SOR/2000-392, s. 16</TitleText></Heading><Section><Label>16</Label><Text>Notwithstanding the provisions of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._957">Indian Referendum Regulations</XRefExternal>, as enacted or amended by these Regulations, the <XRefExternal reference-type="regulation" link="C.R.C.,_c._957">Indian Referendum Regulations</XRefExternal>, as they read immediately before the coming into force of these Regulations, apply to all referenda held during the period beginning on October 20, 2000 and ending on November 19, 2000.</Text></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
                    — SOR/2000-392, s. 17</TitleText></Heading><Section><Label>17</Label><Text>For every referendum that is held during the period beginning on November 20, 2000 and ending on December 8, 2000,</Text><Paragraph><Label>(a)</Label><Text>notwithstanding subsection 4(1) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._957">Indian Referendum Regulations</XRefExternal>, as enacted by section 4, the list of the names of all electors shall be provided to the electoral officer at least 30 days before the day on which the referendum is to be held;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>notwithstanding section 4.1 of those Regulations, as enacted by section 4, the last known addresses of all electors who do not reside on the reserve shall be provided to the electoral officer at least 30 days before the day on which the referendum is to be held; and</Text></Paragraph><Paragraph><Label>(c)</Label><Text>notwithstanding subsection 4.2(1) of those Regulations, as enacted by section 4, at least 14 days before the day on which an information meeting is to be held and at least 28 days before the day on which the referendum is to be held, the electoral officer or deputy electoral officer shall</Text><Subparagraph><Label>(i)</Label><Text>post a notice of the referendum and a list of the names of electors in at least one conspicuous place on the reserve, and</Text></Subparagraph><Subparagraph><Label>(ii)</Label><Text>mail, by priority post, or deliver to every elector of the band who does not reside on the reserve and for whom an address has been provided,</Text><Clause><Label>(A)</Label><Text>the material referred to in subparagraphs 4.2(1)(b)(i), (ii), (iv), (v) and (vii) of those Regulations, as enacted by section 4,</Text></Clause><Clause><Label>(B)</Label><Text>an outer envelope, pre-addressed to the electoral officer, pre-paid for delivery by priority post, and</Text></Clause><Clause><Label>(C)</Label><Text>a letter of instruction regarding voting by mail-in ballot, reflecting the shorter time periods applicable.</Text></Clause></Subparagraph></Paragraph></Section></RelatedOrNotInForce></RegulationPiece></Schedule><RecentAmendments><Amendment><AmendmentCitation>SOR/2024-280</AmendmentCitation><AmendmentDate>2024-12-16</AmendmentDate></Amendment></RecentAmendments></Regulation>
