AGRICULTURAL PRODUCTS MARKETING ACTSaskatchewan Hog Service Charge (Interprovincial and Export) RegulationsRegulations Respecting the Service Charge Imposed on Certain Persons Engaged in the Marketing in Interprovincial and Export Trade of Hogs Produced in SaskatchewanShort Title

1These Regulations may be cited as the Saskatchewan Hog Service Charge (Interprovincial and Export) Regulations.

Interpretation

2In these Regulations,Act means The Natural Products Marketing Act, 1972 of Saskatchewan; (Loi)assembly yard means premises to which producers may deliver their hogs; (parc de groupage)assembly yard operator means the owner or the operator of an assembly yard; (exploitant d’un parc de groupage)Commission means the Saskatchewan Hog Marketing Commission established pursuant to the Act and the Plan; (Commission)hog means any member of the species Sus Scrofa L. (domestic pig) produced in Saskatchewan; (porc)Plan means the Saskatchewan Hog Marketing Plan established and amended from time to time pursuant to the Act; (Plan)processor means any person engaged in the business of processing hogs or using hogs in manufacturing; (transformateur)producer means(a)any person engaged in producing or feeding hogs and making them available for slaughter and includes the employer of any such person,(b)any person who, under any lease or agreement, is entitled to a share of the hogs produced or fed by a person referred to in paragraph (a), and(c)any person who takes possession of any hogs from any person under any form of security for a debt; (producteur)small processor means a processor who, in the previous calendar year, processed less than two per cent of all hogs slaughtered in Saskatchewan according to the reports published by the Department of Agriculture of Canada. Application

3These Regulations apply only to the marketing of hogs in interprovincial and export trade and to persons and property situated in the Province of Saskatchewan.

Rate

4Subject to section 6, a service charge of $0.50 per hog marketed for slaughter is payable to the Commission by every producer.

Payment

5(1)The service charge payable by a producer shall be deducted from the moneys payable to the producer by the Commission.(2)Every small processor who purchases hogs directly from a producer shall deduct the service charge payable in respect of those hogs from the moneys payable to the producer and remit it on a monthly basis to the Commission.(3)Every assembly yard operator who conducts an auction of sows shall deduct the service charge payable in respect of those sows from the proceeds payable to the producer and remit it on a monthly basis to the Commission.

Exemptions

6These Regulations do not apply to a producer who(a)holds a dispensation certificate issued pursuant to section 8 of the Saskatchewan Hog Marketing (Interprovincial and Export) Regulations;(b)has a hog slaughtered for his own consumption;(c)sells a hog to a consumer for consumption by the consumer;(d)sells a hog to a processor designated by the Commission to provide specific research data; or(e)markets any of the following classes of hogs:(i)breeding stock,(ii)weanling pigs,(iii)feeder pigs, or(iv)boars.
