AGRICULTURAL PRODUCTS MARKETING ACTPrince Edward Island Tobacco OrderOrder Granting Authority to Regulate the Marketing in Interprovincial and Export Trade of Tobacco Produced in Prince Edward IslandShort TitleThis Order may be cited as the Prince Edward Island Tobacco Order.InterpretationIn this Order,Act means the Prince Edward Island Natural Products Marketing Act; (Loi)Board means the Prince Edward Island Marketing Board; (Régie)Commodity Board means the Prince Edward Island Tobacco Commodity Marketing Board established pursuant to the Act; (Office de commercialisation)Plan means the Prince Edward Island Tobacco Commodity Marketing Plan established and amended from time to time pursuant to the Act and any regulations made pursuant to the Act to give effect to the Plan; (Plan)tobacco means unmanufactured flue-cured tobacco produced in the Province of Prince Edward Island. (tabac)Interprovincial and Export TradeThe Board and the Commodity Board are each authorized to regulate the marketing of tobacco in interprovincial and export trade and for such purposes may, with respect to persons and property situated within the Province of Prince Edward Island, exercise all or any powers like the powers exercisable by each of them in relation to the marketing of tobacco locally within that Province under the Act and the Plan.LeviesThe Commodity Board is authorized,[Revoked, SOR/80-90]in relation to the powers granted to it by section 3 with respect to the marketing of tobacco in interprovincial and export trade,to make orders fixing, imposing and collecting levies or charges from persons situated within the Province of Prince Edward Island engaged in the production or marketing of tobacco and for such purpose classifying such persons into groups and fixing the levies or charges payable by the members of the different groups in different amounts, and to use such levies or charges for its purposes, including the creation of reserves, and the payment of expenses and losses resulting from the sale or disposal of tobacco, and the equalization or adjustment among producers of tobacco of moneys realized from the sale thereof during such period or periods of time as the Commodity Board may determine.SOR/80-90
