lims:inforce-start-date="2002-12-31" lims:fid="33849" lims:id="33849">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="B-8.5">British Columbia Treaty Commission Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33850" lims:id="33850" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33851" lims:id="33851"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33852" lims:id="33852">Definitions</MarginalNote><Label>2</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="33853" lims:id="33853"><Text><DefinedTermEn>Agreement</DefinedTermEn> means the British Columbia Treaty Commission Agreement executed among the Summit, Her Majesty in right of Canada and Her Majesty in right of British Columbia on September 21, 1992 and includes any amendments to it that may be made from time to time; (<DefinedTermFr>Accord</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="33854" lims:id="33854"><Text><DefinedTermEn>Commission</DefinedTermEn> means the British Columbia Treaty Commission established as set out in section 4; (<DefinedTermFr>Commission</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="33855" lims:id="33855"><Text><DefinedTermEn>first nation</DefinedTermEn> means an aboriginal governing body, however organized and established by aboriginal people within their traditional territory in British Columbia, that has been mandated by its constituents to enter into treaty negotiations on their behalf with Her Majesty in right of Canada and Her Majesty in right of British Columbia; (<DefinedTermFr>première nation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="33856" lims:id="33856"><Text><DefinedTermEn>Lieutenant Governor in Council</DefinedTermEn> means the Lieutenant Governor in Council of British Columbia; (<DefinedTermFr>lieutenant-gouverneur en conseil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="33857" lims:id="33857"><Text><DefinedTermEn>Minister</DefinedTermEn> means such member of the Queen’s Privy Council for Canada as may be designated by the Governor in Council as the Minister for the purposes of this Act; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="33858" lims:id="33858"><Text><DefinedTermEn>principals</DefinedTermEn> means Her Majesty in right of Canada, Her Majesty in right of British Columbia and the Summit; (<DefinedTermFr>signataires</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="33859" lims:id="33859"><Text><DefinedTermEn>Summit</DefinedTermEn> means the body that is established to represent the first nations in British Columbia that agree to participate in the process provided for in the Agreement to facilitate the negotiation of treaties among first nations, Her Majesty in right of Canada and Her Majesty in right of British Columbia. (<DefinedTermFr>Sommet</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33860" lims:id="33860" level="1"><TitleText>Purpose of Act</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33861" lims:id="33861"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33862" lims:id="33862">Purpose of Act</MarginalNote><Label>3</Label><Text>The purpose of this Act is to establish the British Columbia Treaty Commission as undertaken in the Agreement.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33863" lims:id="33863" level="1"><TitleText>Establishment of Commission</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33864" lims:id="33864"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33865" lims:id="33865">Commission jointly established</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33866" lims:id="33866"><Label>(1)</Label><Text>There is established, by the joint operation of this Act, an Act of the Legislature of British Columbia and a resolution of the Summit, the British Columbia Treaty Commission consisting of the Chief Commissioner and not more than four other commissioners.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33867" lims:id="33867"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33868" lims:id="33868">Commission is provincial entity</MarginalNote><Label>(2)</Label><Text>Subject to section 14, the Commission shall for all purposes be treated as having been established by or under an Act of the Legislature of British Columbia.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33869" lims:id="33869"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33870" lims:id="33870">Not agent</MarginalNote><Label>(3)</Label><Text>The Commission is not an agent of any of the principals.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33871" lims:id="33871" level="1"><TitleText>Purpose and Powers of Commission</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33872" lims:id="33872"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33873" lims:id="33873">Purpose of Commission</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33874" lims:id="33874"><Label>(1)</Label><Text>The purpose of the Commission is to facilitate, in British Columbia, the negotiation of treaties among one or more first nations, Her Majesty in right of Canada and Her Majesty in right of British Columbia.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33875" lims:id="33875"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33876" lims:id="33876">Powers of the Commission</MarginalNote><Label>(2)</Label><Text>The Commission has the capacity and powers of a natural person, including the power to sue and be sued, to enter into contracts and to acquire, hold and dispose of property for its purpose.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33877" lims:id="33877"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33878" lims:id="33878">Duties</MarginalNote><Label>(3)</Label><Text>In furthering its purpose, the Commission shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="33879" lims:id="33879"><Label>(a)</Label><Text>assess the readiness, in accordance with the Agreement, of Her Majesty in right of Canada, Her Majesty in right of British Columbia and one or more first nations to begin negotiations;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="33880" lims:id="33880"><Label>(b)</Label><Text>allocate funds that have been provided to enable first nations to participate in negotiations, in accordance with criteria agreed to by the principals;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="33881" lims:id="33881"><Label>(c)</Label><Text>encourage timely negotiations;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="33882" lims:id="33882"><Label>(d)</Label><Text>where the parties to a negotiation all agree, assist them in obtaining dispute resolution services;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="33883" lims:id="33883"><Label>(e)</Label><Text>prepare and maintain a public record of the status of negotiations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="33884" lims:id="33884"><Label>(f)</Label><Text>perform any other duties that are consistent with the Agreement and this Act.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33885" lims:id="33885" level="1"><TitleText>Commissioners</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33886" lims:id="33886"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33887" lims:id="33887">Meaning of <DefinitionRef>prior commissioner</DefinitionRef></MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33888" lims:id="33888"><Label>(1)</Label><Text>In this section, <DefinedTermEn>prior commissioner</DefinedTermEn> means any person who, at any time before the coming into force of this Act, was a commissioner pursuant to an appointment made by resolution of the Summit, an order of the Governor in Council or an order of the Lieutenant Governor in Council or jointly by the Governor in Council, the Lieutenant Governor in Council and the Summit.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33889" lims:id="33889"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33890" lims:id="33890">Prior commissioners continue</MarginalNote><Label>(2)</Label><Text>The prior commissioners in office on the coming into force of this Act are confirmed and continue as commissioners on and after the date of the establishment of the Commission as though they had been appointed pursuant to subsection 7(1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33891" lims:id="33891"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33892" lims:id="33892">Rights and obligations</MarginalNote><Label>(3)</Label><Text>The Commission has all the rights, property and interests in existence on the coming into force of this Act that were acquired by, and is, instead of any prior commissioner, responsible for all the debts, liabilities and obligations in existence on the coming into force of this Act that were incurred by, a prior commissioner in the performance of that person’s duties as a commissioner.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33893" lims:id="33893"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33894" lims:id="33894">Appointment of commissioners</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33895" lims:id="33895"><Label>(1)</Label><Text>One commissioner is to be appointed by order of the Governor in Council, one commissioner is to be appointed by order of the Lieutenant Governor in Council, two commissioners are to be appointed by resolution of the Summit and the Chief Commissioner is to be appointed jointly by the Governor in Council, the Lieutenant Governor in Council and the Summit.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33896" lims:id="33896"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33897" lims:id="33897">Term of office</MarginalNote><Label>(2)</Label><Text>The Chief Commissioner may be appointed for a term not exceeding three years and each of the other commissioners may be appointed for a term not exceeding two years.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33898" lims:id="33898"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33899" lims:id="33899">Removal of Chief Commissioner</MarginalNote><Label>(3)</Label><Text>The Chief Commissioner holds office during pleasure and may be removed by the Governor in Council, the Lieutenant Governor in Council and the Summit jointly.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33900" lims:id="33900"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33901" lims:id="33901">Removal of other commissioners</MarginalNote><Label>(4)</Label><Text>A commissioner other than the Chief Commissioner holds office during pleasure and may be removed by the person or body that appointed the commissioner.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33902" lims:id="33902"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33903" lims:id="33903">Re-appointment</MarginalNote><Label>(5)</Label><Text>A commissioner or former commissioner may be re-appointed.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33904" lims:id="33904"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33905" lims:id="33905">Chief executive officer</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33906" lims:id="33906"><Label>(1)</Label><Text>The Chief Commissioner is the chief executive officer of the Commission and has supervision over and direction of the day to day operations of the Commission.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33907" lims:id="33907"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33908" lims:id="33908">Absence or incapacity</MarginalNote><Label>(2)</Label><Text>In the event of the absence or incapacity of the Chief Commissioner or if that office is vacant, the other commissioners may designate, by unanimous agreement, one of them to act as Chief Commissioner during the absence, incapacity or vacancy, and the commissioner so designated has and may exercise all of the powers and perform all of the duties and functions of the Chief Commissioner.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33909" lims:id="33909"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33910" lims:id="33910">Terms and conditions of appointment</MarginalNote><Label>9</Label><Text>After the principals have reached agreement, the remuneration and other terms and conditions of the appointment of the commissioners are to be fixed by order of the Governor in Council, order of the Lieutenant Governor in Council and resolution of the Summit.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33911" lims:id="33911" level="1"><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33912" lims:id="33912"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33913" lims:id="33913">Office</MarginalNote><Label>10</Label><Text>The office of the Commission shall be in British Columbia.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33914" lims:id="33914"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33915" lims:id="33915">Quorum</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33916" lims:id="33916"><Label>(1)</Label><Text>The Chief Commissioner, one commissioner appointed by the Governor in Council, one commissioner appointed by the Lieutenant Governor in Council and one commissioner appointed by the Summit constitute a quorum of the Commission.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33917" lims:id="33917"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33918" lims:id="33918">Where acting Chief Commissioner</MarginalNote><Label>(2)</Label><Text>For the purpose of determining a quorum, an acting Chief Commissioner shall be counted both as Chief Commissioner and as a commissioner appointed by the person or body that appointed the commissioner.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33919" lims:id="33919"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33920" lims:id="33920">Chief Commissioner to preside at meetings</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33921" lims:id="33921"><Label>(1)</Label><Text>The Chief Commissioner shall preside at meetings of the Commission.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33922" lims:id="33922"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33923" lims:id="33923">Decisions of the Commission</MarginalNote><Label>(2)</Label><Text>Decisions of the Commission shall be made by agreement of at least one commissioner appointed by each of the Governor in Council, the Lieutenant Governor in Council and the Summit.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33924" lims:id="33924"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33925" lims:id="33925">Decisions of the Summit</MarginalNote><Label>13</Label><Text>Her Majesty in right of Canada is entitled to rely on resolutions of the Summit that are certified in the manner specified by the Summit as proof of the decisions of the Summit that are set out in the resolutions as certified.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33926" lims:id="33926"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33927" lims:id="33927">Access to information</MarginalNote><Label>14</Label><Text>The Commission is deemed to be a government institution as that term is defined in section 3 of the <XRefExternal reference-type="act" link="A-1">Access to Information Act</XRefExternal> and section 3 of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal> for the purposes of those Acts.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33928" lims:id="33928"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33929" lims:id="33929">Protection of Commission and employees</MarginalNote><Label>15</Label><Text>Her Majesty in right of Canada shall not make any civil claim against the Commission, any commissioner or any employee of or person retained by the Commission for anything done, omitted, reported or said in the course of the exercise or performance or purported exercise or performance of any power, duty or function under this Act, unless the claim arises from the wilful misconduct or gross negligence of the commissioner, employee or person retained.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33930" lims:id="33930"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33931" lims:id="33931">Commissioners to be indemnified</MarginalNote><Label>16</Label><Text>Her Majesty in right of Canada shall indemnify, in proportion to Her funding obligations as set out in the Agreement, the commissioners against all claims, damages and penalties that are made against or incurred by the commissioners in the exercise of their powers or performance of their duties and functions under this Act, except where the claims, damages or penalties arise from the commissioners’ wilful misconduct or gross negligence.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33932" lims:id="33932" level="1"><TitleText>Personnel</TitleText></Heading><Section lims:inforce-start-date="2005-04-01" lims:lastAmendedDate="2005-04-01" lims:fid="33933" lims:id="33933"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="33934" lims:id="33934">Personnel of Commission</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2005-04-01" lims:fid="33935" lims:id="33935"><Label>(1)</Label><Text>The Commission may employ or retain persons who are necessary to perform the duties and functions of the Commission.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="33936" lims:id="33936"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="33937" lims:id="33937">Presumption</MarginalNote><Label>(2)</Label><Text>No person employed or retained pursuant to subsection (1) shall, by virtue of being so employed or retained, be considered to be employed in the federal public administration.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2005-04-01" lims:fid="33939" lims:id="33939">1995, c. 45, s. 17; 2003, c. 22, s. 224(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33940" lims:id="33940" level="1"><TitleText>By-laws</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33941" lims:id="33941"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33942" lims:id="33942">By-laws</MarginalNote><Label>18</Label><Text>The Commission may make by-laws consistent with this Act and the Agreement respecting the carrying out of the work of the Commission, the management of its internal affairs and the duties of its officers and employees and of the persons retained by it.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33943" lims:id="33943" level="1"><TitleText>Financial Provisions</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="33944" lims:id="33944"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33945" lims:id="33945">Annual budget</MarginalNote><Label>19</Label><Text>The Commission shall submit its budget for each financial year to the principals for review and approval before the deadline set by the principals.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="33946" lims:id="33946" level="1"><TitleText>Audit</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" accounts and financial transactions of the Commission shall be audited annually by a qualified independent auditor designated by the Commission, and a report of the audit shall be made to the case within six months after the end of each financial year, submit to the principals a report of all activities under this Act for that financial year, including the financial statements and the auditor’s report.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33953" lims:id="33953"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="33954" lims:id="33954">Contents</MarginalNote><Label>(2)</Label><Text>The report submitted pursuant to subsection (1) must contain information with respect to the progress of negotiations facilitated by the Commission, the other operations of the Commission and any other matter that the Commission deems appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="33955"
