Regulations Respecting Zoning at Wiarton Airport

Whereas, pursuant to section 4.5Footnote * of the Aeronautics Act, a copy of the proposed Zoning Regulations respecting Wiarton Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette, Part I, on December 26th, 1987, and on January 2nd, 1988, and in two successive issues of the Wiarton Echo on January 27th and February 3rd, 1988, and in two successive issues of the Owen Sound Sun Times on January 28th and 29th, 1988, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto.

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 4.4Footnote * of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at Wiarton Airport.

Short Title

 These Regulations may be cited as the Wiarton Airport Zoning Regulations.

Interpretation

  •  (1) In these Regulations,

    airport

    airport means the Wiarton Airport, in the Township of Keppel, County of Grey, in the Province of Ontario; (aéroport)

    airport reference point

    airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

    approach surface

    approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)

    Minister

    Minister means the Minister of Transport: (ministre)

    outer surface

    outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)

    strip

    strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)

    transitional surface

    transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)

  • (2) For the purposes of these Regulations, the elevation of the airport reference point is 219 m above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule.

General

 No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point

  • (a) the approach surfaces;

  • (b) the outer surface; or

  • (c) the transitional surfaces.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth.

Disposal of Waste

 No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste edible by or attractive to birds.

SCHEDULE(ss. 2 and 3)

PART IDescription of Airport Reference Point

The airport reference point shown on Wiarton Airport Zoning Plan No. 42-062 84-87, Sheet 5, dated April 2, 1986, is a point distant 247.5 m measured southeasterly at right angles from the centre line of runway 05-23, from a point distant 495.4 m measured southwesterly along the said centre line from the northeastern end of the said runway 05-23.

PART IIDescription of the Approach Surfaces

The approach surfaces, shown on Wiarton Airport Zoning Plan No. 42-062 84-87, Sheets 2 to 8 inclusive and 10 to 13 inclusive, dated April 2, 1986 are surfaces abutting each end of the strips associated with runways designated 05-23 and 11-29 and are described as follows:

  • (a) a surface abutting the end of the strip associated with runway approach 05 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m above the elevation at the end of the strip;

  • (b) a surface abutting the end of the strip associated with runway approach 23 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m above the elevation at the end of the strip;

  • (c) a surface abutting the end of the strip associated with runway approach 11 consisting of an inclined plane having a ratio of 1 m measured vertically to 25 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 1 075 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 137.5 m from the projected centre line; the said imaginary horizontal line being 43 m above the elevation at the end of the strip; and

  • (d) a surface abutting the end of the strip associated with runway approach 29 consisting of an inclined plane having a ratio of 1 m measured vertically to 25 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 1 100 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 140 m from the projected centre line; said imaginary horizontal line being 44 m above the elevation at the end of the strip.

PART IIIDescription of the Outer Surface

The outer surface, shown on Wiarton Airport Zoning Plan No. 42-062 84-87, Sheets 1 to 9 inclusive and 11 and 12, dated April 2, 1986, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground.

PART IVDescription of the Strips

The strips shown on Wiarton Airport Zoning Plan No. 42-062 84-87, Sheet 5 dated April 2, 1986 are described as follows:

  • (a) the strip associated with runway 05-23 is 300 m in width, 150 m being on each side of the centre line of the runway, and 1 621.36 m in length; and

  • (b) the strip associated with runway 11-29 is 60 m in width, 30 m being on each side of the centre line of the runway, and 1 173.32 m in length.

PART VDescription of Each Transitional Surface

Each transitional surface, shown on Wiarton Airport Zoning Plan No. 42-062 84-87, Sheets 2 to 8 inclusive and 11 and 12, dated April 2, 1986, is described as follows:

  • (a) the transitional surface associated with runway 05-23, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip;

  • (b) the transitional surface associated with runway 11-29, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 5 m measured horizontally at right angles to the centre line and projected centre line extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.

PART VIDescription of the Lands to Which These Regulations Apply

The boundary of the outer limits of lands, shown on Wiarton Airport Zoning Plan No. 42-062 84-87, Sheets 1 to 4 and 6 to 13, dated April 2, 1986, is described as follows:

COMMENCING at the northwesterly corner of Lot 3, Concession 24 in the Township of Amabel;

THENCE easterly along the line between Concessions 24 and 25 to the southwesterly corner of Lot 2, Concession 25;

THENCE northerly along the western boundary of the said Lot 2, Concession 25 to the northwesterly corner thereof;

THENCE easterly along the northern boundaries of Lot 2 and Lot 1, Concession 25 to the northeasterly corner of the said Lot 1;

THENCE easterly in a straight line across the road allowance between Lot 1 and Lot A, Concession 25 to the northwest corner of the said Lot A;

THENCE easterly along the northern boundary of the said Lot A and continuing easterly along the easterly production thereof to the intersection with the High Water Mark on the westerly shore of Colpoy’s Bay;

THENCE easterly in a straight line across Colpoy’s Bay to the intersection of the High Water Mark on the easterly shore of Colpoy’s Bay with the westerly production of the southern boundary of Lot 12, Colpoy’s Range in the Township of Keppel;

THENCE easterly along the said westerly production, across Lot 11, Jones Range in the said Township of Keppel and across the road allowance between said Lot 11, Jones Range and Lot 12, Colpoy’s Range to the southwesterly corner of the said Lot 12;

THENCE easterly along the southern boundaries of Lot 12 and Lot 13 in Colpoy’s Range aforesaid to the intersection thereof with the northwestern boundary of Approach Surface 23;

THENCE northeasterly along the said northwestern boundary of Approach Surface 23, on an azimuth of thirty-six degrees twelve minutes thirty-six seconds (36°12′36″), to the most northerly corner thereof, the coordinates of which said corner are 4 967 203.08 North, 500 641.62 East;

THENCE southeasterly along the northeastern boundary of the said Approach Surface 23, on an azimuth of one hundred and thirty-four degrees forty-four minutes twenty-six seconds (134°44′26″), to the most easterly corner thereof, the coordinates of which said corner are 4 963 825.83 North, 504 049.59 East;

THENCE southwesterly along the southeastern boundary of the said Approach Surface 23, on an azimuth of two hundred and thirty-three degrees sixteen minutes seventeen seconds (233°16′17″), to the intersection thereof with the northern boundary of Lot 15, Concession 24 in the said Township of Keppel;

THENCE easterly along the said northern boundary of Lot 15, Concession 24 to the northeasterly corner thereof;

THENCE southerly along the eastern boundary of the said Lot 15, Concession 24 to the southeasterly corner thereof;

THENCE easterly in a straight line across the road allowance between Lots 15 and 16 to the southwesterly corner Lot 16, Concession 24;

THENCE easterly along the southern boundary of said Lot 16, Concession 24 to the southeasterly corner thereof;

THENCE southerly in a straight line across the road allowance between Concessions 23 and 24 to the northeasterly corner of Lot 16, Concession 23;

THENCE southerly along the eastern boundary of said Lot 16, Concession 23 to the southeasterly corner thereof;

THENCE along the line between Concessions 22 and 23 to the northeasterly corner of Lot 16, Concession 22;

THENCE southerly along the eastern boundary of said Lot 16, Concession 22 to the southeasterly corner thereof;

THENCE westerly along the southern boundary of the said Lot 16, Concession 21 to the southwesterly corner thereof;

THENCE westerly in a straight line across the road allowance between Lots 15 and 16 to the northeasterly corner of Lot 15, Concession 20;

THENCE southerly along the eastern boundary of the said Lot 15, Concession 20 to the southeasterly corner thereof;

THENCE westerly along the southern boundaries of Lots 15 and 14, Concession 20 to the southwesterly corner of the said Lot 14, Concession 20;

THENCE southerly in a straight line across the road allowance between Concessions 19 and 20 to the northeasterly corner of Lot 13, Concession 19;

THENCE southerly along the eastern boundary of the said Lot 13, Concession 19 to the southeasterly corner thereof;

THENCE westerly along the southern boundaries of Lots 13, 12 and 11, Concession 19 to the southwesterly corner of the said Lot 11, Concession 19;

THENCE westerly in a straight line across the road allowance between Lots 10 and 11 to the southeasterly corner of Lot 10, Concession 19;

THENCE westerly along the southern boundaries of Lots 10, 9, 8, 7 and 6, Concession 19 to the southwesterly corner of the said Lot 6, Concession 19;

THENCE westerly in a straight line across the road allowance between Lots 5 and 6 to the southeasterly corner of Lot 5, Concession 19;

THENCE westerly along the southern boundaries of Lots 5, 4, 3, 2 and 1, Concession 19 to the southwesterly corner of the said Lot 1, Concession 19;

THENCE westerly in a straight line across the road allowance between the Township of Keppel and the Township of Amabel to the southeasterly corner of Lot 1, Concession 19 in the said Township of Amabel;

THENCE westerly along the southern boundary of the said Lot 1, Concession 19 in the Township of Amabel to the southwesterly corner thereof;

THENCE northerly along the western boundary of the said Lot 1, Concession 19 to the intersection thereof with the southeastern boundary of Approach Surface 05;

THENCE southwesterly along the said southeastern boundary of Approach Surface 05, on an azimuth of two hundred and sixteen degrees twelve minutes thirty-six seconds (216°12′36″), to the most southerly corner thereof, the coordinates of which said corner are 4 941 374.43 North, 481 800.53 East;

THENCE northwesterly along the southwestern boundary of the said Approach Surface 05, on an azimuth of three hundred and fourteen degrees forty-four minutes twenty-six seconds (314°44′26″), to the most westerly corner thereof, the coordinates of which said corner are 4 944 751.68 North, 478 392.56 East;

THENCE northeasterly along the northwestern boundary of the said Approach Surface 05, on an azimuth of fifty-three degrees sixteen minutes seventeen seconds (53°16′17″), to the intersection with the western boundary of Lot 2, Concession 20 in the said Township of Amabel;

THENCE northerly along the said western boundary of Lot 2, Concession 20 to the northwesterly corner thereof;

THENCE westerly along the line between Concessions 20 and 21 to the southwesterly corner of Lot 3, Concession 21;

THENCE northerly along the western boundary of the said Lot 3, Concession 21 to the northwesterly corner thereof;

THENCE northerly in a straight line across the road allowance between Concessions 21 and 22 to the southeasterly corner of Lot 4, Concession 22;

THENCE westerly along the southern boundary of the said Lot 4, Concession 22 to the southwesterly corner thereof;

THENCE northerly along the western boundary of the said Lot 4, Concession 22 to the Northwesterly corner thereof;

THENCE along the line between Concessions 22 and 23 to the southwesterly corner of Lot 4, Concession 23;

THENCE northerly along the western boundary of the said Lot 4, Concession 23 to the intersection thereof with the southern limit of Former Bruce County Road No. 13 (Division Street);

THENCE easterly along the said southern limit of Former Bruce County Road No. 13 (Division Street) to the intersection thereof with the eastern boundary of the said Lot 4, Concession 23;

THENCE northerly along the said eastern boundary of Lot 4, Concession 23 to the northeasterly corner thereof;

THENCE northerly in a straight line across the road allowance between Concessions 23 and 24 to the southwesterly corner of Lot 3, Concession 24;

THENCE northerly along the western boundary of the said Lot 3, Concession 24 to the northwesterly corner thereof, the said northwesterly corner also being the Point of Commencement.
