Regulations Respecting Zoning at Hamilton Airport

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 6Footnote * of the Aeronautics Act, is pleased hereby to approve the revocation by the Minister of Transport of the Hamilton Airport Zoning Regulations, C.R.C., c. 86, and to approve the annexed Regulations Respecting Zoning at Hamilton Airport, made by the Minister of Transport, in accordance with the schedule hereto.

Short Title

 These Regulations may be cited as the Hamilton Airport Zoning Regulations.

Interpretation

 In these Regulations,

airport

airport means Hamilton Airport at Mount Hope, in the Regional Municipality of Hamilton-Wentworth, in the Province of Ontario; (aéroport)

airport reference point

airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

approach surface

approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part III of the schedule; (surface d’approche)

Minister

Minister means the Minister of Transport; (ministre)

outer surface

outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (surface extérieure)

strip

strip means the rectangular portion of the landing area of the airport including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (bande)

transitional surface

transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (surface de transition)

 For the purposes of these Regulations, the assigned elevation of the airport reference point is deemed to be 230 m above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part II of the schedule.

General

 No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point

  • (a) any approach surface;

  • (b) the outer surface; or

  • (c) any transitional surface.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 5 (a) to (c), the Minister may direct the owner or occupier of the land on which that object is growing to remove the excessive growth.

Disposal of Waste

 No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste, edible by or attractive to birds.

SCHEDULE

PART IDescription of the Airport Reference Point

The airport reference point is a point distant 182.9 m measured southeasterly at right angles to the centre line of runway 07-25, from a point distant 914.4 m measured southwesterly along the said centre line from the northeasterly end of the said runway.

PART IIDescription of the Outer Limits of Land

The boundary of the outer limits of lands, shown on Hamilton Airport Zoning Plan No. 25-009-81-120, Sheets 1 to 13, dated June 21, 1983 are described as follows:

COMMENCING at the northwesterly corner of Lot 1, in Concession 1, of the geographic Township of Glanford, now the Municipality of the Township of Glanbrook;

THENCE easterly along the northern boundary of Lots 1, 2, 3, 4, and 5, in Concession 1, to the northeastern corner of the said Lot 5;

THENCE easterly in a straight line across the allowance for road between Lots 5 and 6, in the said Concession 1, to the northwestern corner of the said Lot 6;

THENCE easterly along the northern boundary of Lots 6 and 7, in the said Concession 1, to the northeastern corner of the said Lot 7;

THENCE southerly along the eastern boundary of the said Lot 7 to the southeastern corner of the said Lot;

THENCE easterly along the northern boundary of Lots 7 and 8, in Concession 2, to the northeastern corner of the said Lot 8;

THENCE southerly along the eastern boundary of Lot 8, in the said Concession 2, to the southeastern corner of the said Lot;

THENCE southwesterly in a straight line across the allowance for roads between Concessions 2 and 3 to the northwestern corner of Lot 9, in the said Concession 3;

THENCE easterly along the northern boundary of Lots 9 and 10, in the said Concession 3, to the northeastern corner of the said Lot 10;

THENCE southerly along the eastern boundary of Lot 10, in Concession 3, to its intersection with the northerly limit of the approach surface of strip 12L-30R;

THENCE along the limit of said approach surface on an azimuth of 98°45′09″ to a point being the northeasterly corner of said approach surface, the coordinates of which are 4,778,376.463 N., 603,002.2112 E;

THENCE along the easterly limit of said approach surface on an azimuth of 197°17′ a distance of 4 800 m to a point being the southeasterly corner of said approach surface the coordinates of which are 4,773,775.573 N., 601,640.8212 E;

THENCE along the southwesterly limit of said approach surface on an azimuth of 295°48′51″ to its intersection with the eastern boundary of Lot 10, in Concession 4, of the geographic Township of Glanford;

THENCE southerly along the eastern boundary of Lot 10, in the said Concession 4, to the southeastern corner of the said Lot;

THENCE southwesterly in a straight line across the allowance for road to the northeastern corner of Lot 10, in Concession 5;

THENCE southerly along the eastern boundary of Lot 10, in the said Concession 5, to the southeastern corner of the said Lot;

THENCE westerly along the southern boundary of the said Lot 10, to the northeastern corner of Lot 9, in Concession 6;

THENCE southerly along the eastern boundary of Lot 9, in the said Concession 6, to the southeastern corner of the said Lot;

THENCE westerly along the southern boundary of Lots 9, 8, 7 and 6, to the southwestern corner of Lot 6, in the said Concession 6;

THENCE westerly in a straight line across the allowance for road between Lots 6 and 5, in the said Concession 6, to the southeastern corner of the said Lot 5;

THENCE westerly along the southerly boundary of Lots 5, 4, 3, 2 and 1 and the production westerly of the said Lot 1, to the intersection of the said production with the eastern boundary of Lot 43, in Concession 7, in the geographic Township of Ancaster, now in the Municipality of the Town of Ancaster;

THENCE westerly in a straight line across Lot 43, in the said Concession 7, to a point in the western boundary of Lot 43 distant 914.4 m measured southerly along the said western boundary from the northwestern corner of the said Lot;

THENCE northerly along the western boundary of the said Lot 43, 914.4 m to the northwestern corner of the said Lot;

THENCE northwesterly in a straight line across the allowance for road between Concession 7 and 6 to the southeastern corner of Lot 42, in the said Concession 6;

THENCE westerly along the southerly boundary of Lot 42, in the said Concession 6, to the southwestern corner of the said Lot;

THENCE northerly along the western boundary of the said Lot 42, to the northwestern corner of the said Lot;

THENCE northerly across the allowance for road between Concessions 5 and 6, to the southeastern corner of Lot 41;

THENCE westerly along the southern boundary of Lots 41 and 40, in Concession 5, to the southwestern corner of Lot 40, in the said Concession 5;

THENCE northerly along the western boundary of Lot 40, in the said Concession 5, to the northwestern corner of the said Lot;

THENCE northwesterly in a straight line across the allowance for road between Concessions 5 and 4, to the southwestern corner of Lot 40, in the said Concession 4;

THENCE northerly along the western boundary of Lot 40, in Concession 4, to its intersection with the southerly limit of the approach surface of strip 12L-30R;

THENCE along the southerly limit of said approach surface on an azimuth of 278°45′09″ to a point being the southwesterly corner of said approach surface, the coordinates of which are 4,783,010.377 N., 570,431.3088 E;

THENCE along the westerly limit of said approach surface on an azimuth of 17°17′ a distance of 4 800 m to a point being the northwesterly corner of said approach surface, the coordinates of which are 4,787,611.267 N., 571,792.6988 E;

THENCE along the northeasterly limit of said approach surface on an azimuth of 115°48′51″ to its intersection with the western boundary of Lot 40, in Concession 4, of the geographic Township of Ancaster;

THENCE northerly along the western boundary of Lot 40, in the said Concession 4 to the northwestern corner of the said Lot;

THENCE easterly along the northern boundary of Lots 40, 41 and 42, in the said Concession 4, to the northeastern corner of the said Lot 42;

THENCE easterly in a straight line across the allowance for road to the northwestern corner of Lot 43, in the said Concession 4;

THENCE easterly along the northern boundary of Lots 43, 44, 45, 46, 47 and 48 in the said Concession 4, to the northeastern corner of the said Lot 48;

THENCE easterly in a straight line across the allowance for road to the northwestern corner of Lot 49 in the said Concession 4;

THENCE easterly along the northern boundary of Lots 49, 50, 51, 52 and 53, in the said Concession 4, to the northeastern corner of the said Lot 53;

THENCE southeasterly in a straight line across the allowance for road between the geographic Township of Ancaster and the geographic Township of Glanford to the point of commencement.

PART IIIDescription of the Approach Surfaces

The approach surfaces, shown on Hamilton Airport Zoning Plan No. 25-009-81-120, Sheets 2,3,4,5,6,8,10,11,12 and 13, dated June 21, 1983, are surfaces abutting each end of the strips associated with the runways designated 12L-30R, 12R-30L and 07-25 and are described as follows;

  • (a) a surface abutting the end of the strip associated with runway approach 12L consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 600 m from the projected centre line; said imaginary horizontal line being 50 m above the elevation at the end of the strip; thence the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 290 m above the elevation at the end of the strip;

  • (b) a surface abutting the end of the strip associated with runway approach 30R consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 600 m from the projected centre line; said imaginary horizontal line being 50 m above the elevation at the end of the strip; thence the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 290 m above the elevation at the end of the strip;

  • (c) a surface abutting the end of the strip associated with runway approach 12R consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 600 m from the projected centre line; the said imaginary horizontal line being 60 m measured vertically above the elevation at the end of the strip;

  • (d) a surface abutting the end of the strip associated with runway approach 30L consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 600 m from the projected centre line; the said imaginary horizontal line being 60 m measured vertically above the elevation at the end of the strip;

  • (e) a surface abutting the end of the strip associated with runway approach 07 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 630 m from the projected centre line; said imaginary horizontal line being 60 m above the elevation at the end of the strip; and

  • (f) a surface abutting the end of the strip associated with runway approach 25 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 630 m from the projected centre line; said imaginary horizontal line being 60 m above the elevation at the end of the strip.

PART IVDescription of the Outer Surface

The outer surface, shown on Hamilton Airport Zoning Plan No. 25-009-81-120, sheets 1,2,3,4,5,6,7,8,9,11 and 12, dated June 21, 1983 is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, an imaginary surface is located at 9 m above the surface of the ground.

PART VDescription of the Strip

The strips, shown on Hamilton Airport Zoning Plan No. 25-009-81-120, sheets 5 and 6, dated June 21, 1983, are described as follows:

  • (a) the strip associated with runway 12L-30R being 300 m in width, 150 m being on each side of the centre line of the runway, and 2 558.4 m in length;

  • (b) the strip associated with runway 12R-30L being 300 m in width, 150 m being on each side of the centre line of the runway, and 1 750 m in length; and

  • (c) the strip associated with runway 07-25 being 360 m in width, 180 m being on each side of the centre line of the runway, and 2 010 m in length.

PART VIDescription of Each Transitional Surface

Each transitional surface, shown on Hamilton Airport Zoning Plan No. 25-009-81-120, sheets 2,3,4,5,6,7,8,11 and 12, dated June 21, 1983, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of each strip extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.
