Critical Habitat of the Roseate Tern (Sterna dougallii) Order

Whereas the Roseate Tern (Sterna dougallii) is a wildlife species that is listed as an endangered species in Part 2 of Schedule 1 to the Species at Risk ActFootnote a;

Whereas the recovery strategy that identified the critical habitat of that species has been included in the Species at Risk Public Registry;

Whereas a portion of the critical habitat of that species is in a place referred to in subsection 58(2)Footnote b of that Act and, under subsection 58(5) of that Act, that portion must be excluded from the annexed Order;

Whereas, pursuant to subsection 58(5) of that Act, the competent minister must consult with every other competent minister and whereas the Minister of the Environment is also the Minister responsible for the Parks Canada Agency;

And whereas the Minister of the Environment is of the opinion that the annexed Order would affect land that is under the authority of the Minister of Fisheries and Oceans and, pursuant to subsection 58(9) of that Act, has consulted with that Minister with respect to the Order;

Therefore, the Minister of the Environment, pursuant to subsections 58(4) and (5) of the Species at Risk ActFootnote a, makes the annexed Critical Habitat of the Roseate Tern (Sterna dougallii) Order.

Application

 Subsection 58(1) of the Species at Risk Act applies to the portion of the critical habitat of the Roseate Tern (Sterna dougallii) — which critical habitat is identified in the recovery strategy for that species that is included in the Species at Risk Public Registry — that is located within the following areas:

  • (a) Country Island in Nova Scotia and an area extending 200 m seaward from the mean high tide line;

  • (b) an area extending 200 m seaward from the mean high tide line of each of North Brother Island and South Brother Island in Nova Scotia; and

  • (c) any area that is within a 200 m perimeter of each polygon encompassing each individual nesting colony of any species of tern on Sable Island in Nova Scotia, excluding any area that is within the Sable Island National Park Reserve of Canada, as described in Schedule 2 of the Canada National Parks Act.

Coming into Force

 This Order comes into force on the day on which it is registered.
