Non-Canadian Ships Safety Order

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to subsection 420(1) of the Canada Shipping Act, hereby makes the annexed Non-Canadian Ships Safety Order.

Interpretation

 The definitions in this section apply in this Order.

Act

Act means the Canada Shipping Act. (Loi)

approved classification society

approved classification society has the meaning assigned in subsection 2(1) of the Marine Machinery Regulations. (société de classification agréée)

coasting trade

coasting trade has the meaning assigned in subsection 2(1) of the Coasting Trade Act. (cabotage)

Application

 This Order applies to every ship registered elsewhere than in Canada that

  • (a) is engaged in the coasting trade of Canada;

  • (b) operates within Canadian waters; or

  • (c) makes a voyage or operates in any fishing zone of Canada described in section 16 of the Oceans Act and prescribed in regulations made under paragraph 25(b) of that Act.

General

 Part V of the Act and any regulations made under that Part apply to every ship described in section 2.

Repeal

 The Non-Canadian Ships Safety OrderFootnote 1 is repealed.

Coming into Force

 This Order comes into force on July 30, 1997.
