AERONAUTICS ACT

Regulations Respecting Zoning at Montreal International Airport

Short Title

 These Regulations may be cited as the Montreal International Airport Zoning Regulations.

Interpretation

 In these Regulations,

airport

airport means Montreal International Airport, Dorval, in the Province of Quebec; (aéroport)

airport reference point

airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

approach surface

approach surface means an imaginary inclined plane the lower end of which is a horizontal line at right angles to the centre of a strip and passing through a point at the strip end on the centre line of the strip; (surface d’approche)

horizontal surface

horizontal surface means an imaginary horizontal plane centering on and 150 feet above the assigned elevation of the airport reference point; (surface horizontale)

strip

strip means a rectangular portion of the landing area of the airport, 1,200 feet in width, including the runway, especially prepared for the take-off and landing of aircraft in a particular direction; (bande)

transitional surface

transitional surface means an imaginary inclined plane extending upward and outward from the outer lateral limits of a strip and its approach surface to an intersection with the horizontal surface or other transitional surfaces. (surface de transition)

 For the purposes of these Regulations, the airport reference point is deemed to be 104 feet above sea level.

Application

 These Regulations apply to all lands, including public road allowances, adjacent to or in the vicinity of the airport, as more particularly described in Part II of the schedule except any such lands that are described in Part III of the schedule.

General

 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of the highest point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,

  • (a) a horizontal surface, the limits of which may be described as follows:

    BEGINNING at the intersection of the lot line between lots 492 and 493 of the Official Plan and Book of Reference for the Parish of St. Laurent with the Northwesterly boundary of Côte de Liesse Road; THENCE, following the said lot line between lots 492 and 493 in a Northwesterly direction to a line parallel to the centre line of the Runway 06R-24L running N. 42°40′ E. and one thousand five hundred and fifty-nine feet (1,559) therefrom measured in a Southeasterly direction; THENCE, following the last described line N. 42°40′ E. to its intersection with a line running N. 47°20′ W. at six thousand eight hundred and fifty feet (6,850) measured in a Northeasterly direction from the end of the strip of the aforementioned runway; THENCE, following the last described line N. 47°20′ W. a distance of three thousand one hundred and eighteen feet (3,118) to a point; THENCE, N. 34°41′50″ E. to its intersection with the lot line between lots 490 and 491; THENCE, in a Northwesterly direction following the Northeasterly boundary of lot 491 and its Northwesterly production to its intersection with the Northwesterly boundary of Côte Vertu Road; THENCE, following the last mentioned boundary in a Southwesterly direction to its intersection with the lot line between lots 210-642 and 210-479; THENCE, in a Northwesterly direction following the last mentioned lot line and its Northwesterly production to the Northwesterly corner of lot 210-479; THENCE, in a Northeasterly direction to a point being the Southeasterly corner of lot 209; THENCE, following the lot line between lots 209 and 210 in a Northwesterly direction to a point on the Southerly boundary of the Horizontal Surface of the Cartierville Airport as described in the Cartierville Airport Zoning Regulations, registered at Montreal, P.Q., on May 31, 1963 as Instrument No. 1674804; THENCE, following the last mentioned boundary S. 87°54′26″ W. to its intersection with the Southeasterly boundary of Bois Franc Road; THENCE, following the said Southeasterly boundary of Bois Franc Road in a general Southwesterly direction to its intersection with the Southeasterly production of the lot line between lots 123 and 124; THENCE, following the said production and the said lot line between lots 123 and 124 in a Northwesterly direction to its intersection with the parish line between the parish of Ste. Geneviève and the parish of St. Laurent; THENCE, following the last mentioned parish line in a general Westerly direction to the Southerly corner of lot 32, parish of Ste. Geneviève; THENCE, following the Southwesterly boundary of lot 32 in a general Northwesterly direction to its intersection with the lot line between lots 302 and 303; THENCE in a general Southwesterly direction following the last mentioned lot line and its Southwesterly production to its intersection with the Southwesterly boundary of Montée St. Rémi Road; THENCE, following the last mentioned boundary in a general Southeasterly direction to the Southeasterly corner of lot 273; THENCE, following the Southeasterly boundary of lot 273 in a general Southwesterly direction to its intersection with the Northeasterly boundary of lot 267; THENCE, following the Northeasterly boundary of lots 267 and 268 in a general Southeasterly direction to its intersection with the parish line between the parishes of Ste. Geneviève and Pointe Claire; THENCE, following the last mentioned parish line in a general Southwesterly direction to its intersection with the Northeasterly boundary of St. Jean Road; THENCE, following the last mentioned boundary in a general Southeasterly direction to its intersection with the lot line between lots 109-144 and 109-145 (street), parish of Pointe Claire; THENCE, following the Northwesterly boundary of lot 109-145 (street) in a Northeasterly direction to its intersection with the production of the Northeasterly boundary of lot 109-39; THENCE, in a Southeasterly direction following the said production and the Northeasterly boundary of lots 109-39 and 108-852 (street) to its intersection with the Northwesterly boundary of lot 108-813 (street); THENCE, in a Northeasterly direction following the said Northwesterly boundary of lot 108-813 to its intersection with the Northwesterly production of the Easterly boundary of lot 108-798; THENCE, in a Southerly direction following the said production and the said Easterly boundary of lot 108-798 to the Southeasterly corner of lot 108-798; THENCE, following the Southeasterly boundary of lot 108-799 to its intersection with the lot line between lots 54-3-43 and 55-146; THENCE, following the last mentioned lot line in a Southerly direction to the Southwesterly corner of lot 55-146; THENCE, in a Northeasterly direction following the Southeasterly boundary of lots 55-146, 55-145, 55-144, 55-143, 55-142 and the Southwesterly boundary of lots 55-141, 55-140 and 55-139 to the Northeasterly corner of lot 55-103; THENCE, in a Southeasterly direction following the Northeasterly boundary of lot 55-103 to its intersection with the lot line between lots 55-125 and 55-126; THENCE, in a Southeasterly direction following the last mentioned lot line to the Southwesterly corner of lot 55-82; THENCE, in a Southeasterly direction to a point being the Westerly corner of lot 55-64; THENCE, in a Northeasterly direction following the Northwesterly boundary of lots 55-64 and 55-34 to the Northeasterly corner of lot 55-34; THENCE, in a Southeasterly direction, following the Easterly boundary of lot 55-34 to its intersection with the Northerly boundary of lot 55-1; THENCE, in an Easterly direction to a point being the Northeasterly corner of lot 55-1; THENCE, in a Southeasterly direction to a point being the Northwesterly corner of lot 56-9; THENCE, in an Easterly direction to a point being the Northeasterly corner of lot 56-1; THENCE, in a Southeasterly direction to a point being the Southwesterly corner of lot 56-83 being on the Northerly shore of Lake St. Louis; THENCE, following the said Northerly shore of Lake St. Louis in a general Southeasterly direction to a point being the Southeasterly corner of lot 880, parish of Lachine; THENCE, following the Easterly boundary of lot 880 and its Northerly production in a general Northerly direction to a point on the Northwesterly production of the Northerly boundary of lot 882-130; THENCE, following the said production, the Northerly boundary of lot 882-130 and its Southeasterly production in a general Southeasterly direction to its intersection with the lot line between lots 887-294 and 894-239; THENCE, in a general Northeasterly direction to a point at the intersection of the Northerly boundary of lot 1029 with the lot line between lots 898 and 899; THENCE, following the Northerly boundary of lot 1029 in a general Easterly direction to its intersection with the lot line between lots 904 and 905; THENCE, in a Northerly direction following the lot line between lots 904 and 905 to its intersection with the parish line between the parish of St. Laurent and the parish of Lachine; THENCE, following the last mentioned parish line in a general Easterly direction to a point where there is an angle in the parish line; THENCE, continuing along the said parish line in a general Northerly direction to its intersection with the lot line between lots 550 and 551, parish of St. Laurent; THENCE, following the last mentioned lot line in a general Northwesterly direction to its intersection with a line parallel to the strip end at end of Runway 28 and ten thousand feet (10,000′) therefrom; THENCE, following the last mentioned line and its Northerly production N. 02°24′ W. to its intersection with the Southwesterly boundary of lot 560; THENCE, in a general Northwesterly direction following the last mentioned boundary and its Northwesterly production to its intersection with the Northwesterly boundary of Côte de Liesse Road; THENCE, following the last mentioned boundary in a general Northeasterly direction to the Point of Beginning,

  • (b) the approach surfaces abutting each end of the strip designated as 06L-24R, the strip designated as 10-28 and the strip designated as 06R-24L and extending outward therefrom, the dimensions of which approach surfaces are 600 feet on each side of the centre line of the strip at the strip ends and 2,000 feet on each side of the projected centre line of the strip at the outer ends, the said outer ends being 200 feet above the elevations at the strip ends and measured horizontally, 10,000 feet from the strip ends, and

  • (c) the several transitional surfaces, each rising at an angle determined on the basis of a ratio of one (1) foot vertically for every seven (7) feet measured horizontally from the outer lateral limits of the strips and their abutting surfaces, excepting thereout and therefrom the transitional surfaces associated with the strip designated as 12-30,

as shown on Plan M-3015 A-B-C, dated June 2, 1965, of record in the Department of Transport.

PART IAirport Reference Point

Premising that the bearings hereinafter mentioned are astronomical and are referred to the centre line of strip 6L-24R Montreal International Airport, Dorval, Province of Quebec, as North forty-two degrees forty minutes East (N. 42°40′ E.):

BEGINNING at the intersection of the centre line of strip 6L-24R with the centre line of strip 10-26; THENCE, North forty-two degrees forty minutes East (N. 42°40′ E.,) along the centre line of strip 6L-24R a distance of three thousand, four hundred feet (3,400′) to a point; THENCE, South forty-seven degrees twenty minutes East (S. 47°20′ E.,) a distance of four hundred and fifty feet (450′) to a point henceforth designated as the airport reference point; said airport reference point being also at four thousand, five hundred and fifty-four feet and three tenths (4,554.3′) measured along a line having a bearing of South fifty degrees twenty-one minutes East (S. 50°21′ E.,) from a point being the most easterly corner of lot No. 78 Parish of Pointe Claire on the Parish line between lot 78 Parish of Pointe Claire and lot 144 Parish of St. Laurent; the said airport reference point having an assigned true elevation of one hundred and four feet (104′) above sea level.

ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being partly in the Parish of St. Laurent, partly in the Parish of Pointe Claire and partly in the Parish of Lachine, County of Jacques Cartier, Province of Quebec and being more particularly described as follows:

BEGINNING at a point on the lot line between lots 12 and 13 of the Official Plan and Book of Reference for the parish of Lachine, at a distance of one hundred and one feet and six tenths (101.6′) measured along the said lot line in a Northerly direction from its intersection with the Northerly boundary of lot 1029.
