Marginal note:Appeal by dangerous mentally disordered accused
  •  (1) Where a court finds an accused to be a dangerous mentally disordered accused and increases the cap applicable to the accused pursuant to section 672.65, the accused may appeal to the court of appeal against the increase in the cap on any ground of law or fact or mixed law and fact.

  • Marginal note:Disposition of appeal

    (2) On an appeal by an accused under subsection (1), the court of appeal may

    • (a) quash any increase in the cap and impose any other cap that might have been imposed in respect of the offence, or order a new hearing; or

    • (b) dismiss the appeal.
